Abstract

Fair dealing is an important element in industrial design legislation. Analysing the concept of fair dealing can help society achieve fairness in protecting industrial design works. Fair dealing means that other parties can use industrial design for education and research purposes as long as it does not prejudice the interests of industrial design rights holders. This study aims to analyse the value of fairness in the concept of fair dealing in industrial design law to be used as guidelines for the rights holders and the public so they do not violate industrial design law and advance the welfare of society. This study uses normative legal research through statutes, conceptual approaches, and primary and secondary legal materials. This study finds that fairness in fair dealing and the protection of industrial design can be achieved by balancing the rights of designers and society. Fairness for both can be achieved if the rights holders and society have opportunities to use and enjoy industrial designs. Industrial design rights holders have limited monopoly rights, and the public can use the results of industrial design in a limited manner for their welfare. This is in line with Aristotle’s observation that justice is given in accordance with values of propriety that are not the same.

Abstract

Perkembangan teori hukum tidak bisa dilepaskan dari lingkungan zamannya. Upaya memahami hukum harus dimulai dengan mamahami tatanan sosial lingkungannya. Tatanan sosial tersebut pada dasarnya mewakili cara berfikir manusia terhadap lingkungan sosialnya, yang selalu terikat dengan ruang dan waktu. Artikel ini ingin menjawab masalah utama yakni: apa saja pemikiran hukum Satjipto Rahardjo dalam kerangka ilmu hukum? Bagaimana kerangka pemikiran berbasis teori hukum dari Satjipto Rahardjo terkait dengan pembangunan hukum dalam konsep hukum progresif? Pemikiran hukum progresif dari Satjipto Rahardjo, lahir karena keadaan Indonesia pada masa lalu, berkaitan dengan usaha dari pemikir hukum untuk menawarkan gagasannya agar persoalan hukum di negeri ini tidak menemui ‘jalan buntu’. Namun demikian konsep pembangunan hukum, konsep hukum progresif berperan penting di dalamnya.

Abstract

Sejak berlakunya Undang-Undang No. 3 Tahun 2020 tentang Pertambangan Mineral dan Batubara eksistensi pertambangan rakyat dari aspek perizinan, pengawasan, pembinaan, hingga pengelolaan lingkungan hidup semakin menyulitkan masyarakat kecil. Tujuan penelitian ingin mengetahui sejauh mana keberpihakan negara terhadap eksistensi pertambangan rakyat pasca perubahan regulasi yang baru. Sisi manfaat dalam hal kebijakan hukum dalam rangka memperkuat posisi hukum pertambangan rakyat. Metode penelitian menggunakan penelitian hukum normatif. Hasil kajian dari penelitian ini antara lain; pertama, dengan diberlakukannya Undang-Undang Minerba Tahun 2020 membuat kewenangan perizinan pemerintah daerah telah dihapus. Pengorganisasian perizinan menjadi sentralistik oleh pemerintah pusat. Kedua, eksistensi pertambangan rakyat menjadi tidak jelas pihak mana yang berwenang menetapkan wilayah pertambangan rakyat. Ketiga, peran strategis pemerintah daerah telah dicabut dan saat ini pemerintah daerah hanya menjadi perpanjangan tangan pemerintah pusat sehingga akan muncul budaya birokratisasi dalam tata kelola pertambangan rakyat.

Abstract

The role of the community is very strong and cares about the cultural heritage in their area in the form of the Kotakapur site. Communities who are members of POKDARWIS Bekawan, Kotakapur vilage, trying to make a historical tourism village are not easy, it requires the participation of the Regency Government and related agencies in overcoming one by one the problems that become obstacles to the construction of the site. The problem in this writing is what is the scope of Pokdarwis as a community organization? and secondly how is the urgency of legal entities in community organizations in the form of associations?. Problems will be analyzed using normative research methods, by producing answers, namely first, Pokdarwis is a social organization in the form of associations, second, the urgency of legal entities in Pokdarwis is their legal position as legal subjects.

Abstract

Local wisdom becomes the full authority of the Regency/City Government as clearly stated in the Table of Division of Authority for the Sub-Division of Local Wisdom Based on Law no. 23 of 2014 concerning Regional Government. Therefore, it is very necessary to know the urgency of the integration of local wisdom related to environmental conservation in the Bangka Belitung Islands. This study uses a socio-legal approach, namely the object of research remains in the form of law, namely laws and regulations related to local wisdom and the environment with the use of methods and theories of social sciences to assist researchers in conducting analysis. Local Wisdom is very important to be integrated in regional policies related to environmental conservation because there is a reciprocal relationship between humans and nature, where people who pay attention to local wisdom related to the environment always place the balance of nature in environmental management and must be accepted or approved, which means that the regulation gets recognition. legitimacy) from the community because it comes from local wisdom that lives in the community.

Abstract

Law enforcement is a series of processes to describe values, ideas, ideals, and subsequently become legal objectives. The awareness and compliance of sailing administration to Matras fishermen in catching fish is very much determined by the legal culture of the community. The purpose of this discussion is to determine law enforcement in the context of legal culture in society. The results of the discussion conclude that the legal culture of Matras fishermen displays something unique, namely a spiritual presence and a contextual existence. Therefore, law enforcement in the cultural context is sharing space with the other side of the value that is believed to be sacred in religious substance and believing in the value of local wisdom. The pattern of law enforcement with a cultural dimension is a manifestation of synchronization of the various aspects of substance, structure and culture itself

Abstract

Santet kerap kali menimbulkan keresahan masyarakat, belum ada hukum positif yang mengatur tentang santet. RUU KUHP Nasional yang akan datang, santet dirumuskan dalam Pasal 252. Politik hukum dalam memformulasikan santet hanya menjangkau dimensi perbuatan bukan akibat dari perbuatan tersebut. Penelitian ini bertujuan menganalisis konstruksi nilai dan pemaknaan kebijakan kriminal perbuatan santet. Hasil kajian menunjukkan, bahwa berdasarkan maksud dari Pasal 252 mencegah praktik main hakim sendiri, konstruksi nilai dibangun berbasis pada ide dasar pencegahan berorientasi pada kebijakan perlindungan masyarakat (social defence policy). Perspektif nilai yang ingin ditegaskan tercermin dalam teori relatif dicirikan bahwa tujuan pidana adalah mencegah kejahatan terjadi dan sebagai sarana memperbaiki pelaku kejahatan. Pemaknaan normatif, santet merupakan delik formil yang dilarang adalah perbuatannya bukan akibat yang ditimbulkan. Pemaknaan integrasi-sosial ialah upaya mendukung terwujudnya masyarakat yang patuh hukum maka kriminalisasi santet ditujukan pemeliharaan stabilitas masyarakat agar saling melindungi tidak membalas dengan perbuatan main hakim sendiri.

Abstract

Pemerintah berkewajiban untuk melindungi seluruh kepentingan perkembangan usaha mikro ketika akan menjalin kemitraan. Dalam perjalanannya, hubungan kemitraan tersebut akan ada pasang surutnya. Karena itu, untuk melindungi pelaku Usaha Mikro dari kerugian dan mencegah permbuatan melawan hukum, perlu adanya advokasi dan mekanisme penyelesaian sengketa yang efektif dan efesien. Penelitian ini menganalisis penyelesaian perselisihan atau sengketa pelaku usaha mikro dalam bermitra dan bagaimana penyelesaian perselisihan atau sengketa selain persaingan usaha dalam perjanjian kemitraan yang efektif dan efisien. Penelitian ini merupakan penelitian hukum dengan pendekatan perundang-undangan dan konseptual. Hasil dari penelitian ini adalah mendorong penyelesaian perselisihan atau sengketa melalui alternatif penyelesaian sengketa perjanjian kemitraan melalui Mediasi.

Abstract

The transformation of mining law policy in Law No. 3 of 2020 concerning Minerals and Coal has broad implications for mining law, including illegal tin mining. The high dependence of the tin extractive economy in Bangka Belitung has changed the landscape of this archipelago province as an area with a high level of natural damage and social disasters. The ability of governments through regulatory instruments to tackle illegal mining is an important ideal goal. This research was conducted using socio-legal methods, to produce a comprehensive analysis related to the environmental and social impacts of illegal tin mining after the renewal of the mineral and coal law. This study found that the transition of mining authority from the central government to the regional government directly has an impact on the proliferation of illegal mining activities. Substantive changes in the mineral and coal law have not provided a strategic solution because the tug-of-war over authority ends with the continued delegation of authority to grant community mining permits to local governments. Meanwhile, the unpreparedness of local governments has resulted in the continued marginalization of mining communities and has an impact on widespread environmental damage. The lack of fair decision-making processes for people mining licences is indicative of an immature tin mining management in Bangka Belitung. The purpose of this study is to provide a comprehensive overview of the implications of the latest mineral and coal policies on illegal tin mining activities, as a reference and consideration in strategic policy making to create an ideal and sustainable tin mining ecosystem.

Abstract

Dinamika politik hukum pengaturan mengenai kewenangan perizinan mineral dan batu bara mengalami perubahan yang cukup signifikan. Semula kewenangan diberikan oleh undang-undang kepada pemerintah daerah, saat ini kewenangan tersebut diambil alih oleh pemerintah pusat. Tujuan dari penelitian ini ingin mengetahui arah dan dasar filosofis politik hukum yang melatarbelakangi perubahan Undang-Undang Minerba serta implikasinya terhadap kewenangan perizinan pertambangan. Manfaat yang diperoleh dari penelitian agar dapat diketahuinya beberapa perubahan yang signifikan kewenangan perizinan pertambangan berikut pula syarat dan tahapannya. Metode penelitian menggunakan penelitian hukum normatif. Hasil kajian penelitian menyajikan kesimpulan bahwa paradigma sentralistik pemberian izin secara terpadu menandai pula bergesernya kewenangan daerah yang semula secara atribusi menjadi kewenangan delegasi. Penegasan arah politik hukum pertambangan merupakan prioritas kewenangan pemerintah pusat ketika beberapa pasal-pasal strategis telah dilakukan perubahan bahkan dihapuskan. Perubahan formulasi dalam Pasal 4 (hak penguasaan mineral dan batu bara) dan Pasal 6 (kewenangan pengelolaan pertambangan) UU Minerba Tahun 2020 menunjukkan tidak adanya lagi keberpihakan terhadap pemerintah daerah untuk memberikan alokasi kewenangan perizinan pertambangan.The dynamics of the legal politics of regulating mineral and coal licensing authorities have undergone significant changes. Initially, the authority was given by law to local governments, now this authority is taken over by the central government. The purpose of this research is to find out the direction and philosophical basis of the legal politics behind the amendments to the Minerba Law and its implications for the mining licensing authority. The benefits obtained from research are so that some significant changes in mining licensing authority can be identified as well as the terms and stages. The research method uses normative legal research. The results of the research study present the conclusion that the centralistic paradigm of granting permits in an integrated manner also marks the shift of regional authority from attribution to delegation authority. Affirming the political direction of mining law is a priority for the authority of the central government when several strategic articles have been amended and even eliminated. Amendments to the formulation in Article 4 (mineral and coal control rights) and Article 6 (mining management authority) of the 2020 Minerba Law show that there is no longer any partiality for local governments to allocate mining licensing authority.
