Abstract

The transformation of mining law policy in Law No. 3 of 2020 concerning Minerals and Coal has broad implications for mining law, including illegal tin mining. The high dependence of the tin extractive economy in Bangka Belitung has changed the landscape of this archipelago province as an area with a high level of natural damage and social disasters. The ability of governments through regulatory instruments to tackle illegal mining is an important ideal goal. This research was conducted using socio-legal methods, to produce a comprehensive analysis related to the environmental and social impacts of illegal tin mining after the renewal of the mineral and coal law. This study found that the transition of mining authority from the central government to the regional government directly has an impact on the proliferation of illegal mining activities. Substantive changes in the mineral and coal law have not provided a strategic solution because the tug-of-war over authority ends with the continued delegation of authority to grant community mining permits to local governments. Meanwhile, the unpreparedness of local governments has resulted in the continued marginalization of mining communities and has an impact on widespread environmental damage. The lack of fair decision-making processes for people mining licences is indicative of an immature tin mining management in Bangka Belitung. The purpose of this study is to provide a comprehensive overview of the implications of the latest mineral and coal policies on illegal tin mining activities, as a reference and consideration in strategic policy making to create an ideal and sustainable tin mining ecosystem.

Abstract

Dinamika politik hukum pengaturan mengenai kewenangan perizinan mineral dan batu bara mengalami perubahan yang cukup signifikan. Semula kewenangan diberikan oleh undang-undang kepada pemerintah daerah, saat ini kewenangan tersebut diambil alih oleh pemerintah pusat. Tujuan dari penelitian ini ingin mengetahui arah dan dasar filosofis politik hukum yang melatarbelakangi perubahan Undang-Undang Minerba serta implikasinya terhadap kewenangan perizinan pertambangan. Manfaat yang diperoleh dari penelitian agar dapat diketahuinya beberapa perubahan yang signifikan kewenangan perizinan pertambangan berikut pula syarat dan tahapannya. Metode penelitian menggunakan penelitian hukum normatif. Hasil kajian penelitian menyajikan kesimpulan bahwa paradigma sentralistik pemberian izin secara terpadu menandai pula bergesernya kewenangan daerah yang semula secara atribusi menjadi kewenangan delegasi. Penegasan arah politik hukum pertambangan merupakan prioritas kewenangan pemerintah pusat ketika beberapa pasal-pasal strategis telah dilakukan perubahan bahkan dihapuskan. Perubahan formulasi dalam Pasal 4 (hak penguasaan mineral dan batu bara) dan Pasal 6 (kewenangan pengelolaan pertambangan) UU Minerba Tahun 2020 menunjukkan tidak adanya lagi keberpihakan terhadap pemerintah daerah untuk memberikan alokasi kewenangan perizinan pertambangan.The dynamics of the legal politics of regulating mineral and coal licensing authorities have undergone significant changes. Initially, the authority was given by law to local governments, now this authority is taken over by the central government. The purpose of this research is to find out the direction and philosophical basis of the legal politics behind the amendments to the Minerba Law and its implications for the mining licensing authority. The benefits obtained from research are so that some significant changes in mining licensing authority can be identified as well as the terms and stages. The research method uses normative legal research. The results of the research study present the conclusion that the centralistic paradigm of granting permits in an integrated manner also marks the shift of regional authority from attribution to delegation authority. Affirming the political direction of mining law is a priority for the authority of the central government when several strategic articles have been amended and even eliminated. Amendments to the formulation in Article 4 (mineral and coal control rights) and Article 6 (mining management authority) of the 2020 Minerba Law show that there is no longer any partiality for local governments to allocate mining licensing authority.

Abstract

Abstract Perubahan Undang-Undang Nomor 22 Tahun 2022 Tentang Pemasyarakatan sebagai payung hukum pelaksanaan sistem pemasyarakatan dimana Undang-Undang tentang Pemasyarakatan tersebut telah mempertegas posisi pemasyarakatan dalam sistem peradilan pidana dan fungsi pemasyarakatan sebagai perlakuan terhadap pelanggar hukum. Adanya perubahan mendasar dalam Undang undang pemasyarakatan ini, akan berimplikasi terhadap perlakuan terhadap tahanan, anak dan warga binaan pemasyarakatan. Perubahan Undang-undang Nomor 22 Tahun 2022 Tentang Pemasyarakatan menitikberatkan terciptanya keadilan, keseimbangan, pemulihan hubungan, perlindungan hukum, dan jaminan terhadap hak tahanan, anak, narapidana, dan anak binaan sehingga menyiratkan adanya pengaturan fungsi Pemasyarakatan yang progresif sebagaimana hukum progresif merupakan gagasan atau pemikiran hokum yang diperkenalkan Prof. Satjipto Rahardjo yang bermula dari keprihatinan terhadap kehidupan berhukum teutama Undang Undang Nomor 12 tahun 1995 tentang pemasyarakatan sudah kurang pas terutama setelah berlakunya PP Nomor 99 tahun 2012 tentang syarat dan tata cara pelaksanaan hak wargabinaan pemasyarakatan yang dirubah dengan PP Nomor 32 tahun 1999. Permasalahan penelitian yaitu bagaimana kontribusi hukum progresif terhadap fungsi Pemasyarakatan dalam Undang-Undang Nomor 22 tahun 2022 tentang Pemasyarakatan. Metode penelitian yakni penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual hukum progresif. Hasil Penelitian pertama, mengetahui fungsi Pemasyarakatan dalam Undang-Undang Nomor 22 tahun 2022 tentang Pemasyarakatan apakah sudah progresif karena mengikuti pandangan hukum untuk manusia yakni Pemasyarakatan bukan hanya untuk Warga Binaan Pemasyarakatan tetapi juga Tahanan. Kedua, dalam Undang-undang Nomor 22 Tahun 2022 tentang  Pemasyarakatan tidak lagi mempertahankan status quo sebatas pembinaan saja tapi telah bergerak lebih maju dan lebih luas meliputi Pelayanan, Pembinaan, Pembimbingan Kemasyarakatan, Perawatan, Pengamanan, dan Pengamatan. Ketiga, Undang-undang Nomor 22 tahun 2022 tentang Pemasyarakatan apakah telah mengantisipasi hambatan hukum tertulis dalam kondisi praktek Pemasyarakatan di lapangan melalui dukungan intelijen Pemasyarakatan, sistem teknologi informasi Pemasyarakatan, sarana dan prasarana, pengawasan oleh intenal dan eksternal, serta kerja sama, bantuan dan peran serta berbagai pihak dalam rangka pelaksanaan tugas Pemasyarakatan. Keempat, menilai apakah Undang- undang Pemasyarakatan Nomor 22 Tahun 2022 tentang Pemasyarakatan memberi perhatian besar terhadap peranan perilaku manusia. Abstract

Discourses on the Pancasila legal state conception has been long time to be issues in several academic and scientific forums that is not finally discussed and debated. This article is exploring the problems: (1) why a legal culture is important in national legal system development? (2) How to understand the culture? (3) How the culture in the Public Mining Law? Based on the problems, it can be decribed that the crucial of legal culture in national development caused by public as a target of regulation and the imposition of punishment. In this case, it should understand the culture as a basis for the basis of national legal system by putting the Pancasila values to be united. Abstract

Ketentuan pidana Pasal 162 UU Minerba menetapkan perbuatan menghalang-halangi kegiatan usaha pertambangan sebagai perbuatan pidana (delik). Tujuan penelitian ingin mengetahui secara kritis tujuan pemidanaan delik Pasal 162 dalam perspektif kebijakan kriminalisasi. Asas manfaat yang diharapkan agar dapat melihat secara objektif dalil teori kriminalisasi, sehingga dapat memberikan masukan bagi pembentuk undang-undang dalam memformulasikan ketentuan pidana. Metode penelitian menggunakan penelitian hukum normatif. Hasil penelitian menyimpulkan kebijakan kriminalisasi pada delik Pasal 162 tidak dapat dibenarkan menurut teori moral dan teori liberal individualistik. Hakikat nilai moralitas masyarakat terdistorsi dengan keberlakuan delik tersebut. Negara telah membatasi ruang kebebasan warga negara untuk hidup merdeka menyampaikan dan memperjuangkan hak-hak dasarnya. Bahkan kebijakan kriminalisasi yang dilakukan oleh pembentuk undang-undang tidak mendapat legitimasi yang kuat dari esensi tujuan pemidanaan yang sejalan dengan prinsip nilai, prinsip kemanfaatan, dan prinsip kemanusiaan. Rekomendasi kedepan agar kebijakan legislasi haruslah dilakukan dengan pendekatan rasional dan pendekatan kebijakan.

Abstract

The WvS Criminal Code of the Dutch colonial legacy does not formulate the objectives and guidelines of punishment in it, there are only rules for retaliatory criminal provision. The National Criminal Code has formulated explicitly the purpose and guidelines of punishment in it as a reference for judges in sentencing crimes. The purpose of this study is to analyze the basic idea of the objectives and guidelines of punishment which then the objectives and guidelines of the punishment will be a progressive consideration of judges in deciding the criminal conviction of criminal offenders. The research method used is normative legal research. The focus of the research analysis is on the concept of norms Article 51 to Article 54 of the National Criminal Code concerning the objectives and guidelines for punishment. Using the Law approach and analytical approach in explaining problems with the study of literature literature. The results of the study concluded that the basic idea of the purpose and guidelines of punishment is how criminal punishment can be humanist and in accordance with the values of Pancasila. There are at least 3 points that are considered as the basic idea of the goals and guidelines for punishment, namely uphold goals, strengthen principles and review guidelines. Furthermore, the purpose and guidelines of sentencing will be the affirmation and progressive consideration of the judge in sentencing the crime. Judges in enforcing the law become less rigid so that the balance between intellectual and spiritual intelligence plays an important role. Imposing crimes with a sense of humanity and justice. Abstract

The Kepulauan Bangka Belitung Province, Indonesia, is renowned for its extensive history of tin mining, a pivotal component of the local economy. Notably, this mining encompasses operations conducted by both corporate entities and individual community members, shaping the region's socio-economic landscape. This research seeks to investigate the multifaceted implications of community-led tin mining activities in Bangka Belitung. Employing a qualitative and socio-legal approach, the study underscores its significance in the acquisition of high-quality data derived from site visits, comprehensive surveys, and interviews with the diverse local community, encompassing various subsistence groups and socio-economic backgrounds. Our findings indicate that individual community mining activities have indeed contributed positively to the economic growth of the Kepulauan Bangka Belitung Province, particularly in the Bangka Regency. However, they also manifest negative repercussions in terms of illegal mining, which adversely affects state revenue due to unregistered taxpayers. Furthermore, these activities hinder human resource development and highlight a deficiency in the supervision of reclamation efforts undertaken by artisanal mining operators. Therefore, the study emphasizes the imperative for government intervention, focusing on community mining permits to enforce reclamation regulations and ensure sustainable, responsible mining practices.

Abstract

AbstractPancasila is a major cornerstone in the making of law (law and Legislation) with a new or replacement of laws (political law), so that the values of the Deity, Humanity and Society (nationalistic; democratic; social justice) must be actualized into the substance of the law, the legal structure and legal culture to be built, is expected to strengthen national integration, democratization of law, achieve prosperity and social justice by putting Pancasila, ranging from values, goals until the actualization of the various fields of existing law, whether criminal, civil, administrative and the other, as well as the internalization of the structures of law and legal culture of Pancasila. AbstrakPancasila merupakan landasan utama dalam pembuatan hukum (Peraturan Perundang-Undangang) baru maupun dengan penggantian hukum lama (politik hukum), sehingga nilai-nilai Ketuhanan, Kemanusiaan dan Kemasyarakatan (nasionalistik; demokratik; berkeadilan sosial) harus teraktualisasi kedalam substansi hukum, struktur hukum maupun kultur hukum yang akan dibangun, diharapkan dapat menguatkan integrasi bangsa, demokratisasi hukum, tercapainya kesejahteraan dan keadilan sosial dengan menempatkan Pancasila, mulai dari nilai, tujuan sampai dengan aktualisasi kepada berbagai bidang hukum yang ada, baik hukum pidana, perdata, tata usaha negara dan lain-lain, serta internalisasi pada struktur hukum dan budaya hukum Pancasila.
