Abstract

The retributive paradigm in criminal case resolution focuses on punishing the offender, often neglecting the victim's interests. This is evident in victims' limited role in court, where they primarily serve as witnesses and lack the authority to take meaningful action. Furthermore, the Indonesian legal system continues to prioritize imprisonment, resulting in incarceration for nearly all offenses, ranging from minor to severe, which contributes significantly to prison overcrowding. This study examined and analyzed the role of Restorative Justice Houses in Yogyakarta City in resolving criminal cases through a restorative justice approach. Such an approach is crucial, as it promotes social harmony and helps prevent larger societal conflicts. Therefore, it is essential to advocate for the broader implementation of restorative justice as a conflict resolution.

Abstract

In Simpang Rimba Village, Simpang Rimba District, South Bangka Regency, the majority of the population relies on the micro, small, and medium enterprises (MSEs), particularly in agriculture, crafts, and trade. Based on monitoring on the Simpang Rimba Village website, micro and small business owners who do not yet have a Business Identification Number (NIB) are at risk of facing legal and administrative obstacles in their business development. This community service program aims to introduce the NIB as a crucial tool for strengthening business existence and legality, and to provide direct assistance to MSEs in obtaining a NIB effectively and efficiently. The community service team will assist MSEs in applying for a Business Identification Number (NIB) through the OSS system. Facilitation: Assistance includes direct guidance in completing online forms and ensuring all required documents are complete. Duration: This assistance will be on going. During the assistance in making this NIB, 18 NIB Certificates were registered and printed, which shows an increase in legal understanding or the administrative impact of the NIB. Abtrak Desa Simpang Rimba, Kecamatan Simpang Rimba, Kabupaten Bangka Selatan, sebagian besar penduduknya bergantung pada sektor UMK, terutama di bidang pertanian, kerajinan, dan perdagangan. Berdasarkan hasil prmantauan pada laman Desa Simpang Rimba pelaku usaha mikro dan kecil yang belum memiliki Nomor Induk Berusaha, hal ini secarfa hukum, berisiko menghadapi kendala hukum dan administratif dalam perkembangan usahanya. Metode dalam program pengabdian ini, diharapkan dapat memperkenalkan NIB sebagai alat yang penting bagi penguatan eksistensi dan legalitas usaha, serta memberikan pendampingan langsung kepada pelaku UMK untuk memperoleh NIB secara efektif dan efisien. Tim pengabdian mendampingi pelaku UMK dalam proses pengajuan Nomor Induk Berusaha (NIB) melalui sistem OSS. Fasilitasi pendampingan mencakup pengarahan langsung dalam pengisian formulir secara online serta memastikan seluruh dokumen yang dibutuhkan telah lengkap. Pendampingan ini akan berlangsung. Selama dalam pendampingan pembuatan NIB ini sebanyak 18 Sertifikat NIB terdaftar dan tercetak yang menunjukkan peningkatan pemahaman hukum, atau dampak administrative dari NIB.

Abstract

The complexity of mining business governance affects rational actions to tackle mining crime using the criminal policies in a progressive legal dimension. This research focuses on dealing with mining crime using criminal policies and rational efforts in the progressive legal dimension. It was conducted using normative legal research method using secondary data obtained from primary and secondary legal materials. The urgency of this research is to provide guidance towards the application of appropriate rules of mining for the actors in the business. It was also directed to provide references in mining law enforcement through an integral policy. The results showed that criminal policy through penal means in the formulation stage has the ability to regulate licensing crimes, corporate crimes, crimes against reclamation, and criminal obstruction of mining businesses. Moreover, the application stage involves the legal construction of material and formal offenses while the execution stage requires integral law enforcement. It is also important to note that the non-penal means which focuses on prevention maps potential actors with the ability to create the victims while the secondary prevention maps the mining areas with potential conflicts. This means the progressiveness of mining criminal policies rationally in the progressive law dimension enforces certainty and basic ideas underlying the norms.
