Abstract

This study examines the changes to the direct procurement mechanism under Presidential Regulation Number 46 of 2025 concerning the Second Amendment to Presidential Regulation Number 16 of 2018 on Government Goods and Services Procurement. This research employs a normative legal method with a descriptive-analytical approach, utilizing statutory, conceptual, and analytical frameworks. Three research questions are analyzed: the substantive changes to the direct procurement mechanism, the legal analysis from the perspectives of legal certainty and good governance principles, and the implications for effectiveness, transparency, and accountability in government procurement. The findings indicate that Presidential Regulation Number 46 of 2025 introduces significant normative changes through mandatory full digitalization, strengthened procurement officer competency requirements, expanded scope to village governments, and increased direct purchase thresholds for construction works. Reviewed from legal certainty theory, the regulation clarifies norms although transitional challenges require careful management. From a good governance perspective, the digitalization of direct procurement simultaneously reinforces transparency, accountability, and effectiveness. The study concludes that these changes signify a paradigmatic transformation in government procurement toward data-driven governance that is openly accountable to the public.

Abstract

This study aims to analyze the regulation of administrative appeals against State Administrative Decisions under Law Number 30 of 2014 on Government Administration, examine administrative appeals from the perspective of legal certainty, and identify the factors affecting their effectiveness. This research employs a normative legal research method using statutory, conceptual, and case approaches. The findings indicate that Law Number 30 of 2014 provides a legal basis for administrative appeals as a form of legal protection prior to litigation before the State Administrative Court. However, the existing regulation does not comprehensively govern the examination procedures, resulting in potential legal uncertainty. The effectiveness of administrative appeals is influenced by legal substance, institutional structure, legal culture, compliance with the General Principles of Good Governance, and the harmonization of legislation. Therefore, strengthening the regulatory framework and institutional capacity is essential to ensure legal certainty in the settlement of administrative disputes.

Abstract

This Community Service activity aims to enhance legal awareness and integrity of village government officials through anti-corruption socialization. Conducted in Desa Pintasan, Kecamatan Gaung, Kabupaten Indragiri Hilir, the activity employed a participatory approach using interactive lectures, discussions, and case studies. The results indicate an increased understanding among village officials regarding the limits of authority, accountability principles, and legal consequences of administrative actions that may violate regulations. Furthermore, the socialization successfully instilled values of integrity and transparency in village governance. The activity also provided a platform for dialogue between village officials and academics, fostering a more contextual understanding of law implementation in everyday governance practices. These findings highlight the importance of legal literacy as a preventive strategy in fostering clean, accountable, and sustainable village administration. Practically, the activity strengthened village officials’ capacity to prevent corrupt practices and improve public service quality. From an academic perspective, the results provide important empirical evidence on the effectiveness of participatory approaches in enhancing the integrity of village government officials.

Abstract

Kegiatan Pengabdian kepada Masyarakat ini bertujuan untuk meningkatkan pemahaman masyarakat mengenai kepemilikan tanah dan keabsahan administrasi pertanahan berdasarkan perspektif Hukum Administrasi Negara, Hukum Perdata, dan Hukum Pidana. Kegiatan dilaksanakan di Desa Danau Pulai Indah, Kecamatan Kempas, Kabupaten Indragiri Hilir melalui metode penyuluhan hukum, diskusi interaktif, observasi, dan dokumentasi. Materi yang disampaikan meliputi pentingnya pendaftaran tanah, prosedur administrasi pertanahan, perlindungan hukum terhadap hak atas tanah, serta konsekuensi hukum yang timbul akibat pelanggaran di bidang pertanahan. Hasil kegiatan menunjukkan bahwa sebelum penyuluhan sebagian masyarakat masih memiliki pemahaman yang terbatas mengenai legalitas kepemilikan tanah dan prosedur administrasi pertanahan. Setelah kegiatan berlangsung, peserta menunjukkan peningkatan pemahaman mengenai pentingnya kepastian hukum, tertib administrasi pertanahan, serta perlindungan hak atas tanah melalui mekanisme hukum yang berlaku. Kegiatan ini memberikan kontribusi dalam meningkatkan kesadaran hukum masyarakat sekaligus memperkuat sinergi antara perguruan tinggi, pemerintah desa, dan masyarakat dalam mewujudkan sistem administrasi pertanahan yang tertib, transparan, dan memberikan kepastian hukum.

Abstract

This normative legal study analyzes the synchronization between Minister of Social Affairs Regulation No. 9 of 2012 on the Empowerment of Remote Indigenous Communities (KAT) and the principle of regional authority decentralization under Law No. 23 of 2014 in Indragiri Hilir Regency, focusing on the Duanu Tribe community in coastal areas. Employing a descriptive-analytical juridical normative approach through library research and statutory interpretation, the study reveals that conceptually, harmonization space exists through the adoption of Permensos substance into local regulations, development planning documents (RPJMD-RPJMDes), and cross-sectoral coordination. However, implementation faces obstacles including the absence of specific local regulations, data and budget limitations, extreme geographical accessibility challenges, and cultural resistance. Strengthening efforts are recommended through special Perda/Perbup for KAT, integration of KAT indicators into RPJMD, digital SOPs integrated with SIKS, civil servant training, and multi-stakeholder participation to achieve sustainable, locally adaptive empowerment. Abstract

Cross-border human trafficking is a transnational crime that frequently occurs in border areas, including Rupat Island, which is directly adjacent to the Malacca Strait and serves as one of the vulnerable routes for human smuggling and trafficking, with geographical conditions characterized by numerous unofficial small ports and minimal surveillance along unregistered routes contributing significantly to the prevalence of this practice. This study aims to examine the implementation of handling cross-border human trafficking crimes within the legal jurisdiction of Rupat Island and to identify the obstacles faced by law enforcement officers in the handling process, with the problem formulations being how the implementation of handling cross-border human trafficking crimes is carried out within the jurisdiction of Rupat Island and what obstacles are encountered in its implementation. This study employs a sociological (empirical juridical) legal research method with a descriptive qualitative approach, where data were collected through field studies, including interviews with law enforcement officials (Police, Immigration, and related agencies), as well as literature studies on relevant laws and regulations, particularly Law Number 21 of 2007 concerning the Eradication of the Criminal Act of Trafficking in Persons. The findings indicate that the implementation of handling cross-border human trafficking crimes in the jurisdiction of Rupat Island has not been optimally carried out, attributed to limited human resources and surveillance facilities, the vast and difficult-to-monitor maritime area, lack of inter-agency coordination, and low legal awareness among the local community, so that strengthening inter-agency coordination, improving border surveillance infrastructure, and conducting legal awareness programs for the community are necessary to reduce the incidence of human trafficking crimes in the region.
