Abstract

Artikel ini membahas terkait dengan dasar hukum perjanjian dengan membandingkan konsep-konsep yang ada dalam perspektif Syariah dan konvensional. Tujuan utama dari penulisan artikel ini adalah untuk memberikan pemahaman yang lebih mendalam tentang perbedaan dan persamaan antara kedua sistem hukum tersebut dalam mengatur perjanjian, serta implikasinya terhadap praktik hukum di masyarakat. Metode yang digunakan dalam penelitian ini adalah kajian literatur dengan mengumpulkan data dari berbagai sumber hukum primer dan sekunder, termasuk teks-teks hukum, buku, artikel, dan jurnal yang relevan. Hasil penelitian menunjukkan Perjanjian syariah dan perjanjian konvensional memiliki perbedaan mendasar dari segi landasan hukum, prinsip, dan tujuan. Perjanjian konvensional didasarkan pada Kitab Undang-Undang Hukum Perdata (KUHPer) dan hukum positif lainnya yang berlaku di Indonesia. Sementara itu, perjanjian syariah berlandaskan pada Al-Qur’an, Hadis, Ijma’, dan Qiyas, serta juga merujuk pada prinsip-prinsip fiqh muamalah.

Abstract

Penelitian ini bertujuan untuk mengkaji dan mengetahui strategi yang diterapkan oleh PT. Putra Jaya Nanas dalam memberdayakan sumber daya manusia yang dimiliki dalam upaya meningkatkan potensi human capital yang ada. Variabel penelitian difokuskan pada strategi yang diterapkan oleh perusahaan dalam memberdayakan sumber daya manusia yang dimiliki. Penelitian ini menggunakan pendekatan kualitatif deskriptif, pengumpulan data diperoleh melalui pengamatan, wawancara, dan juga dokumentasi. Hasil analisis menunjukan bahwa dari beberapa strategi pemberdayaan yang sudah diimplementasikan oleh PT. Putra jaya nanas masih belum maksimal dalam mengoptimalkan potensi human capital karyawanya. Dari strategi yang sudah diimplementasikan keterbukaan komunikasi dan juga penciptaan ruang kompetisi dapat dikatakan sudah berjalan dengan baik, namun pada pelatihan karyawan masih memerlukan banyak perbaikan. Sedangkan dimensi yang sangat diperlukan namun belum dimiliki perusahaan adalah administrator sebagai fungsi HRD. Kata Kunci: Strategi, Pemberdayaan SDM, Human Capital

Abstract

This study aims to reinterpret the concept of iddah (waiting period) for career women using a maqashid sharia approach based on Najmuddin Thufi’s thought. Iddah is an Islamic ruling intended to protect family and societal welfare, yet it presents challenges for modern career women. The traditional rules of iddah, which restrict activities outside the home, can impact women’s social and economic well-being, particularly for those who work. This research employs Najmuddin Thufi’s approach, which emphasizes public interest (maslahah), to explore whether the rules of iddah require adjustment for career women without compromising the fundamental objectives of Islamic law. Using a qualitative methodology with a library research approach, this study gathers data from literature on Islamic law, maqashid sharia and Najmuddin Thufi’s theory. The study finds that reconstructing iddah for career women is feasible by applying maqashid sharia principles, particularly through Thufi’s emphasis on maslahah. In the context of working women, traditional iddah rules—which limit activities outside the home—present challenges, especially concerning economic and social well-being. Based on the principle of maslahah, the iddah rule can be adapted without disregarding the core objectives of sharia, allowing career women to continue working during the waiting period as long as they uphold personal dignity and adhere to Islamic legal regulations. This approach offers a contextual and adaptive interpretation of Islamic law that aligns with modern developments while preserving the objectives of Sharia. The study concludes that iddah for career women can be reconstructed to bridge the gap between religious obligations and contemporary socio-economic needs.

Abstract

This community service project was motivated by the increasing misuse of illegal online lending among youth in Kedungwaru, Tulungagung, driven by low literacy in sharia economic law and limited digital risk awareness. The program focused on strengthening sharia economic legal literacy related to illegal fintech for local youth organizations, which play a strategic role in preventing financial misconduct among young people. The primary objective was to enhance participants’ understanding of illegal online loan characteristics, sharia principles in financial transactions, and digital risk mitigation strategies. The project employed an educational-participatory approach through Focus Group Discussions (FGDs), interactive lectures, case demonstrations, and comprehension assessments. Data were collected through observation, questionnaires, and limited interviews. The results indicate a significant improvement in participants’ understanding of fintech legality, the concepts of riba and gharar within illegal lending practices, and their ability to identify fraudulent loan applications. Participants also demonstrated readiness to act as educational agents within their respective youth communities.
