Abstract

The use of force against other countries is strictly prohibited and has the character of jus cogens. However, this provision is not rigidly applied in the self-defence context codified in the United Nations Charter 1945 Article 51, also in the air defence context through the existence of the Air Defence Identification Zone (ADIZ). This research discusses whether ADIZ embodies the anticipatory efforts in the framework of customary international law. The research results indicate that the determination of ADIZ is not a form of self-defence principle in Article 51, which is the realm of jus ad bellum. Moreover, the conservative self-defence prerequisites in Article 51 are no longer relevant in line with the revolutionary development of aviation and its armament technology. Therefore, ADIZ as a state security practice constitutes a form of anticipatory efforts within the framework of long-standing state practice as customary international law.

Abstract

International Humanitarian Law and International Refugee Law are two branchs of law relevant to the protection of human rights in a specific context. This research aimed at evaluate the relationship of these two branchs of law. Legal materials that thoroughly considered and analized in this research were relevant international rules and facts embodied in international customs, general principles of law, international treaties, conventions, declarations and decisions of international organisation, recommendations, academic publications, proceedings and working papers. Based upon the analysis of the existing legal materials, eventually, it could be inferred that International Humanitarian Law has influenced International Refugee Law both in the standard setting and in the interpretation process. The rules embodied in these two branchs of law established a continuum protection for the victims of confilct with violence. Two international humanitarian agencies; International Committee of the Red Cross and the United Nations High Commissionner for Refugees has served as the guardians in the framework of promotion and implementation of these two branchs of law. Grave breaches of International Humanitarian Law and acts triggered international displacement were international wrongful acts and generate state responsibility.

Abstract

The discourse between International Human Rights Law (IHRL) and Islam has been a longstanding one. However, not all IHRL courses in Indonesia include Islamic human rights as one of the taught chapters. This normative research explores the urgency to include Islamic human rights in the IHRL curriculum, and finds that it is indeed urgent to do so. There are two reasons found to include Islamic human rights in IHRL. First, as a counter towards the Eurocentric discourse of IHRL. Second, there are paradigmatic differences between IHRL and Islam which, if not understood, will make it difficult to fairly consider the discourse and analyze the derivative issues. There are two paradigmatic differences between IHRL and Islamic human rights, which are the epistemology and rights-obligation construction (Diskursus antara Hukum Hak Asasi Manusia Internasional (HHAMI) dan Islam telah ada sejak lama dan hingga kini tidak habis-habis. Akan tetapi, ternyata tidak semua mata kuliah HHAMI yang diajarkan di fakultas-fakultas hukum Indonesia mencakupi HAM Islam sebagai salah satu pokok bahasan. Penelitian yang bersifat normatif ini akan mengkaji urgensi memasukkan konsep HAM Islam ke dalam kurikulum HHAMI, dan ditemukan bahwa hal tersebut memang memiliki urgensi. Ditemukan dua alasan utama untuk melakukan hal tersebut. Pertama, sebagai salah satu counter terhadap naratif Eurosentrisme dalam diskursus HHAMI. Kedua, ternyata ada beberapa perbedaan yang bersifat paradigmatic antara HHAMI dan Islam, yang apabila tidak dikenal maka akan sulit mendudukkan diskursus HHAMI dan Islam dengan akurat apalagi mengkaji isu-isu turunan dengan tepat. Perbedaan paradigmatic ini ada dua, yaitu pada tatanan epistemology serta konstruksi antara hak dan kewajiban)

Abstract

This paper examined the process and prospect of the institutionalization of humanitarian values in the international instrument adopted by the United Nations in 1998. As a matter of fact, since the adoption by the United Nations in 1998, this instrument has been disseminated widely and, has been used by various international organisations (both UN Agencies and non UN Agencies), regional organisations, state and non-state entities as guidance in dealing with the internal displacement crisis. Some states even incorporated the principles embodied in this instrument into their national legislation. It has to be noted that The Guiding Principles on Internal Displacement clarify any grey areas that might exist, and address the gaps identified in the existing international legal system. Accordingly, this instrument should be treated as common platform for international community in the efforth of protecting and assisting internally displaced persons throughout the world.

Abstract

AbstractIn the context of addressing challenges of globalization there are many issues deserve to be discussed and elaborated. This paper addressed the three fundamental issues which are inseparable and interconnected each other: Spreading Universalism; Reinterpretation of Sovereignty, and the Decline of Supranationalism. The role of international organizations in the contemporary international system remain significant, however, constituents in the member States would judge whether they could maintain their relevance to the constituents interests and keep mutual relatianship with the member States.IntisariAda beragam persoalan yang layak diperdebatkan dan dijelaskan dalam mencermati tantangan globalisasi. Tiga persoalan mendasar dan saling terkait menjadi fokus bahasan dalam tulisan ini yakni: Universalisme yang makin meluas; re-interpretasi kedaulatan dan melemahnya supranasionalisme. Dewasa ini peran institusi internasional masih memiliki peran yang signifikan, namun, Negara­negara akan mencermati apakah institusi-isntitusi internasional ini mampu menjaga relevansinya terhadap kepentingan konstituen dan hubungan yangsaling menguntungkan dengan negara anggotanya.

Abstract

In the contemporary digital age, corruption has evolved into a common enemy, transcending borders and becoming a transnational and extraordinary crime. Within the ASEAN framework, corruption is no longer perceived as the concern of a single nation but as a shared threat to all member states and the global community at large. Despite the pervasive and deeply entrenched nature of corruption, concerted efforts have been made to combat this scourge. Among these measures, asset recovery stands out as an extraordinary tool, addressing not only the prevention and enforcement aspects but also the crucial task of repatriating ill-gotten gains to their rightful country of origin. Indonesia and the ASEAN community have entered into various treaties aimed at facilitating asset recovery, with the ASEAN Mutual Legal Assistance Treaty (AMLAT) serving as a pivotal legal instrument in this endeavour. Recognizing the transnational nature of corruption, interstate relations and diplomatic cooperation have assumed a vital role in supporting the success of asset recovery processes. This study explores the evolving landscape of corruption in the digital age, its transformation into a transnational concern, and the collective efforts undertaken within ASEAN to combat it. By focusing on asset recovery as an extraordinary measure, it sheds light on the multifaceted dimensions of eradicating corruption and emphasizes the importance of international collaboration in returning misappropriated assets to their rightful owners.

Abstract

Humanitarian assistance is one of the actions that can be taken to limit and reduce the impact of armed conflict. Humanitarian assistance is aimed at civilians during armed conflicts. The purpose of this study is to analyze the position of humanitarian assistance in the 21st century. This research was conducted through conceptual and comparative approaches, as well as using normative legal research methods, also using prescription analysis techniques.  The results showed that the principle of distinction is the basic principle of humanitarian assistance, which means that this assistance is mandatory. State sovereignty must still be recognized and upheld in the context of providing humanitarian assistance. States have the primary responsibility to provide assistance to their peoples in the midst of armed conflict as one of the parties responsible for armed conflict, external humanitarian actors must respect the agreement and cooperation of States affected by armed conflict. Abstrak   Bantuan kemanusiaan merupakan salah satu Tindakan yang dapat dilakukan untuk membatasi dan mengurangi dampak dari adanya konflik bersenjata. Bantuan kemanusiaan ditujukan kepada masyarakat sipil selama konflik bersenjata. Tujuan dari penelitian ini untuk menganalisi kedudukan humanitarian assistance di abad 21. Penelitian ini dilakukan melalui pendekatan konseptual dan komparatif, serta  menggunakan metode penelitian hukum normatif, juga menggunakan teknik analisis preskripsi. Hasil penelitian menunjukan bahwa prinsip pembedaan adalah prinsip dasar bantuan kemanusiaan yang artinya bantuan ini merupakan hal yang wajib. Kedaulatan negara harus tetap diakui dan dijunjung tinggi dalam rangka pemberian bantuan kemanusiaan. Negara mempunyai tanggung jawab utama untuk memberikan bantuan kepada masyarakatnya yang sedang dilanda konflik bersenjata sebagai salah satu pihak yang bertanggung jawab pada konflik bersenjata, aktor kemanusiaan eksternal harus menghormati persetujuan dan kerja sama negara-negara yang terkena dampak dari konflik bersenjata

Abstract

This study aims to analyze the effect of Organizational Citizenship Behavior, Innovative Behavior, Individual Creativity, and Loyalty on Employee Performance at PT Tarindo. The benefit of this research is that this research can be used as input in developing and determining the right Human Resource Management strategy in order to get results that optimize employee performance in the company. The population of researchers is all employees of PT Tarindo with a total of 86 employees, with a total sample of 86 respondents of PT Tarindo using non probability sampling techniques; saturated sampling (census). The results of the analysis and discussion show that partially Organizational Citizenship Behavior has a positive and significant effect on Employee Performance, Innovative Behavior has a positive and significant effect on Employee Performance, Individual Creativity has a positive and significant effect on Employee Performance, and Loyalty has a positive and significant effect on Employee Performance at PT Tarindo

Abstract

In recent years, face recognition has grown significantly in importance and popularity. Google created FaceNet, a deep learning system, in 2015, and it performs very well in creating extremely precise and personalised numerical representations of faces, or embeddings. In order to swiftly and effectively identify people, this study evaluates FaceNet's effectiveness in producing face embeddings and applies it to a variety of classification techniques, including support vector machine (SVM), decision tree, random forest, and k-nearest neighbours (KNN). A dataset with a wide range of positions, facial expressions, and lighting settings is used for the assessment. The findings of the experiment demonstrated that SVM with an radial basis function (RBF) kernel outperformed the other assessed classification techniques, achieving the maximum accuracy of 95%. These findings demonstrate the wide range of applications that face recognition technology may be used for, including identity management and security in different settings.

Abstract

Shipwreck cargo or Benda Muatan Kapal Tenggelam (BMKT) in Indonesia, often referred to as underwater cultural heritage (UCH), holds significant economic potential for Indonesia, a nation prosperous in UCH sites. However, the preservation and management of these assets frequently encounter legal challenges at both national and international levels. This study examined the complex legal landscape surrounding shipwreck cargo in Indonesia, highlighting the divergent perspectives of national legislation and international norms. Indonesia's domestic laws allow for the auctioning of shipwreck cargo, which presents an opportunity for economic advancement. However, this approach clashes with the principles outlined in the Convention on Protection of the Underwater Cultural Heritage 2001, which underscore the collective heritage value of UCH objects and discourages their commercialization. This legal divergence underscores the need for Indonesia to balance its national interests with its international commitments in managing shipwreck cargo. By examining these legal intricacies, this study reveals the challenges of the coexistence of conflicting legal frameworks. It provides insights into potential strategies for harmonizing preservation efforts with commercial interests, thereby facilitating a balanced approach to the management of shipwreck cargo. By navigating these complexities, Indonesia can effectively leverage its underwater cultural heritage while fulfilling its obligations as a member of the international community.
