Abstract

The development of the insurance business in Indonesia is also colored and overshadowed by various problems such as disputes between insurance companies and consumers or customers regarding complicated claims procedures, misunderstandings about the contents of policies, rejection of insurance claims, services provided by insurance companies that are not optimal, customer anger due to Insurance companies fail to pay Insurance Claims and Fraud, namely intentional fraud committed against or by insurance companies or agents, for the purpose of financial gain. Therefore, it is necessary to optimize supervision by OJK on the insurance business in Indonesia. The type of research used in this research is Normative Research with a Statute Approach and a Conceptual Approach. The results of this study are optimizing the OJK's supervision of the Insurance Business in Indonesia, which is a combination of supervisory models, namely direct supervision (active) and indirect supervision (passive) and preventive forms of legal protection, namely creating responsive and progressive regulations governing the insurance business. especially tightening licensing and reporting mechanisms in its supervision and repressive forms of legal protection, namely the OJK in collaboration with law enforcement officers to conduct investigations and investigations into cases of insurance company defaults including providing criminal sanctions (by the Police and the Prosecutor's Office assisted by the OJK). In addition, OJK provides administrative sanctions for insurance companies, namely revocation of insurance company licenses, closing companies and taking profits from insurance companies to pay compensation to their customers

Abstract

This study focuses on the application of legal sanctions against disclosure violations committed by issuers in the Indonesian capital market.The type of research used in this research is Normative Research with Statute Approach, Conceptual Approach. This study also uses legal materials which consist of primary legal materials, namely legal materials in the form of Law No. 8 of 1995 concerning Capital Markets and Law No. 21 of 2011 concerning the Financial Services Authority. Secondary Legal Materials, namely literature and scientific articles relating to the issues raised in this study and Tertiary Legal Materials consisting of legal dictionaries and encyclopedias. The technique for collecting legal materials used in this research is a Documentation Study with Analysis of Legal Materials, namely Qualitative Descriptive Analysis. The results of this study are that renewal in the form of reconstruction of legal sanctions in the form of increasing the length of imprisonment and increasing the amount of fines for violations of openness in the Capital Market is absolutely necessary in strengthening the existence of the Capital Market in Indonesia so as to create a healthy economic climate and attract investors to invest in the Indonesian Capital Market. The mechanism for imposing sanctions on issuers who violate transparency in the Capital Market has been regulated normatively in Article 101 of Law No. 8 of 1995 concerning Capital Markets and reaffirmed in Article 9 of Law No. 21 of 2011 concerning the Financial Services Authority and Circular Letters Financial Services Authority of the Republic of Indonesia Number: 7 /SEOJK.04/2022 Concerning Procedures for Examination in the Capital Markets Sector. This is done in order to create substantive justice in the field of the Indonesian Capital Market.

Abstract

Penelitian ini bertujuan untuk mengetahui peroses pelaksanaan tentang transaksi jual beli ternak melalui media elektronik dalam peresfektif hukum di Indonesia serta mengetahui bentuk penyelsaian sengketa dalam transaksi jual beli ternak melalui media elektronik. Penelitian ini merupakan jenis penelitian hukum normatif, dengan menggunakan pendekatan Perundang-Undangan dan konseptual (Conseptual Approach). Dalam jual beli ternak melalui media elektronik memiliki aturan khusus baik dari segi prosedur atupun mekanismenya. Guna menjamin pelindungan dan kepastian hukum baik dari segi pelaku usaha ataupun konsumen maka dalam hal perjanjian jual beli melalui media elektronik harus memenuhi syarat sahnya perjanjian sebagaimana diatur dalam Pasal 1320 KUH Perdata yang terdiri dari Adanya kesepakatan, kecakapan Suatu hal tertentu dan suatu sebab yang halal. Adapun pelaksanaan traknaksi jual beli melalui media elektronik meliputi tahapan pra kontrak, tahapan kontraktual dan post kontraktual. Terkait dengan sebelum pelaksanaan perjanjian dalam hal pengiriman ternak di Nusa Nusa Tenggara Barat yang harus diperhatikan oleh pelaku usaha adalah harus berpedoman pada Peraturan Daerah Nomor 4 tahun 2020 Tentang Tata Niaga Ternak. Adapun penyelseain sengketa meliputi litigasi dan non litigasi.

Abstract

Berdasarkan hasil penelitian diketahui bahwa perlindungan hukum bagi penyedia jasa konstruksi diatur dalam Pasal 1244 dan 1245, dalam Pasal tersebut penyedia jasa konstruksi terbebaskan dari tanggung jawab atas kerusakan yang disebabkan oleh force majeure. Sehingga pengguna jasa konstruksi tidak dapat menuntut ganti kerugian terhadap penyedia jasa konstruksi tersebut dikarenakan hal ini terjadi karena adanya bencana alam dan di luar dari kelalaian pihak penyedia jasa konstruksi. Perjanjian kontrak menjadi kunci utama dalam mengatasi permasalahan ini. Para pihak lebih memperhatikan kontrak perjanjian mengenai force majeure. Ketika para pihak tidak detail dalam mengatur kontrak perjanjian tersebut maka para pihak mau tidak mau melakukan addendum perjanjian untuk mencari jalan keluar dalam melanjutkan atau memberhentikan proyek konstruksi tersebut. Selain itu Agar proyek konstruksi tersebut dapat berjalan hingga akhir kedua belah pihak terutama pihak pengguna yang mengalami kerugian yang disebabkan oleh keadaan kahar dapat melakukan klaim asuransi agar kerugian yang dialami dapat di klaim asuransi, tetapi dengan persyaratan yang telah ditentukan oleh asuransi tersebut.

Abstract

Penelitian ini bertujuan untuk menganalisis Kebijakan Pemerintah dalam Mengembangkan Usaha Mikro dan Kecil di Masa Pandemi Covid-19 dan bagaimana Perlindungan Hukum Bagi Pelaku Usaha Mikro dan Kecil di Masa Pandemi Covid-19. Penelitian ini menggunakan jenis penelitian Normatif - Empiris. Berdasarkan hasil penelitian kebijakan pemerintah dalam mengembangkan Usaha Mikro dan Kecil di masa pandemi Covid-19 yakni pemberian bantuan langsung tunai, subsidi listrik, dan insentif pajak sedangkan bentuk perlindungan hukum yang diberikan pemerintah untuk Usaha Mikro dan Kecil di masa pandemi Covid-19 ini adalah Regulasi yang tertuang dalam Penyaluran Bantuan Pemerintah Bagi Pelaku Usaha Mikro untuk Mendukung Pemulihan Ekonomi Nasional. Realisasi program (PEN) ini meliputi bantuan langsung dari Presiden (Banpres) senilai Rp. 1.2 Juta, program pembiayaan Investasi kepada koperasi melalui Lembaga Pengelola dana Bergilir atau Kredit Modal Kerja untuk pelaku usaha, dan program kebijakan kredit usaha rakyat (KUR).

Abstract

This paper focuses on increasing public awareness about the importance of obtaining a trading business license in Giri Madia Village, Lingsar District, West Lombok Regency. The formulation of the problem in this paper is what are the benefits of administering a trading business license and what is the mechanism for obtaining a trading business license. The type of research used in this study is Normative-Empirical Research with Statute Approach, Conceptual Approach and Sociological Approach. This paper uses legal materials consisting of primary legal materials, namely Law No. 20 of 2008 concerning Micro, Small and Medium Enterprises,Regulation of the Minister of Trade of the Republic of Indonesia No. 07/M-Dag/PER/2/ 2017 Regarding the Third Amendment to the Regulation of the Minister of Trade Number 36/M-Dag/PER/9/2007 concerning Issuance of Trading Business Permits and Regulation of the Minister of Trade of the Republic of Indonesia No. 50 of 2020 concerning Provisions for Business Licenses, Advertising, Guidance and Supervision of Business Actors in Trade Through Electronic Systems. Secondary Legal Materials, namely literature and scientific articles relating to the issues raised in this study and Tertiary Legal Materials consisting of legal dictionaries and encyclopedias. The technique of collecting legal material/data used in this study is Documentation Studies and Interviews with Analysis of Legal Materials, namely Qualitative Descriptive Analysis with deductive conclusions. The results of this study are that the people of Giri Madia Village have increased their understanding and enthusiasm for managing trade business permits in running a business either directly or through E-Commerce. Apart from that, the benefits of having a business license are opening up access for MSME actors to obtain credit at financial institutions.

Abstract

In the modern context, the Traditional Medicine Knowledge (TMK) of Sasak community is a valuable economic asset considering its usage as a basic knowledge (milestone) in the modern medicine discovery. As a form of human intellectual ability, TMK is regulated under the IPRs-TRIPs regime, whereas TMK have prominent opposite characters with IPRs. This fact raises particular issues in terms of: the form of Sasak community’s TMK, regulation of its protection under the IPRs regime and the ideal legal institution to realize the protection. The majority of Sasak’s TMK are transmitted verbally, a fraction of it was written in babon (book of) tetamba/oat and lontar Usada. The IPRs-TRIPs regime only provides indirect regulation toward TMK, as contained in Patent and Plant Variety Protection Law. Ideally, there should be a local Law that particularly regulates protection on Sasak’s TMK in order to prevent misappropriation. Thus, there is a void of Law since there is no Sui Generis Law on the protection of TMK.Keywords: legal protection, traditional medicine knowledge, legal void
