Abstract

This article discusses Imām Al-Ghazālī’s thoughts regarding politics in Islam, the socio-political conditions behind it, and the values of Islamic education contained in it. This discourse is urgent because seeing the political phenomenon in Indonesia is very worrying after the collapse of the authoritarianism regime during the Old Order era. This paper uses a type of literature research using some of the works of Imām Al-Ghazālī as the primary source. The socio-political conditions underlying the beginning of Imām Al-Ghazālī’s writings related to Islamic politics were the weak understanding of society’s religion and disintegration in the political field of Muslims at that time. From some of his works, there are four themes studied by Imām Al-Ghazālī regarding politics in Islam, namely amar ma’rūf nahī munkar in politics, the origin of the emergence of a nation, theories about state leadership, sources of power and authority of the head of state. As for the values of Islamic education contained in Imām Al-Ghazālī’s thoughts regarding politics in Islam, namely amar ma’rūf nahī munkar, power comes from God, the authority of leaders in matters of the world and the hereafter, mutualism between the people and leaders, mature, intelligent, free, male, a descendant of Quraish, healthy hearing or vision, real power, guidance, knowledge, and being careful in doing things. The fourteen values of Islamic education above include the spiritual dimension, the cultural dimension, and the intelligence dimension.

Abstract

This article aims to analyze William R. Roff’s theoretical approach to Hajj and its contribution to Islamic studies in Indonesia. This contribution arose from his concern with the very few historians of religions who made functional, analytical categories for explaining religious phenomena. This paper is a literature study and uses William R. Roff’s writing, Theoretical Approaches to the Hajj, as the primary source and analyzes it using qualitative data analysis. The author found that William R. Roff explained the implementation of the pilgrimage and its meaning by elaborating on Arnold van Gennep’s theory and Victor Turner’s thesis. The pre-implementation stage of the pilgrimage means the separation contained in the ramalan ritual (extra-Islamic) to determine the best time for the pilgrims’ departure, apologies and prayers, preparation of supplies, repayment of debts, and their obligations before the pilgrimage. The stage of the hajj implementation means the transition that is contained in the peak performance of the hajj ritual. The post-implementation phase of the Hajj means togetherness in the change in attributes, understanding of the pilgrims, and their implementation in the community life where they live. William R. Roff’s theoretical contribution to the pilgrimage, the outcome of which was satisfactory to both parties, has been used as a model by scholars and researchers for studying other religious rituals in Islam. His interpretation of the hajj ritual falls into the third phase called new Islamic studies to approach.

Abstract

AbstractMarriage is a holly and sacred bond. Hence, before getting married, spouses should make good preparations and considerations by having pre-wedding counseling in order that the marriage will be harmonious and long lasting without divorce ending. This is based on a field research on pre-wedding counseling known as suscatin held by KUA, Kec. Pontianak Timur, and that by GKKB Jemaat Pontianak. Both pre-marriage counseling programs are differently applied but they have common purposes: providing marital guidance, description, and preparation in order that spouses can maintain their harmonious marriage: sakinah, mawadah, and rahmah.Keywords: Pre-wedding Counseling, KUA Kec. Pontianak Timur, GKKB Jemaat Pontianak.  Abstrak Pernikahan adalah sebuah ikatan yang suci dan sakral. Sebelum mengikat sebuah ikatan yang suci tersebut, para calon suami-isteri harus mempersiapkan sematang-matangnya. Banyak sekali pasangan suami-isteri menikah, akan tetapi kehidupan keluarganya tidak berlangsung dengan harmonis, bahkan terjadi perceraian. Oleh karena itu, diperlukan bimbingan, arahan, dan konseling sebelum melakukan sebuah pernikahan tersebut. Tujuannya adalah supaya para calon pasangan suami-isteri tersebut sudah siap untuk membina sebuah keluarga yang sakinah. Tulisan ini merupakan hasil dari penelitian lapangan (field research) dengan menggunakan pendekatan deskriptif-analitik. Kursus pra-nikah di KUA Kec. Pontianak Timur dikenal dengan istilah Suscatin, sedangkan di GKKB Jemaat Pontianak dikenal dengan istilah konseling pra-nikah. Pelaksanaan kursus pra-nikah diantara keduanya memiliki perbedaan dan persamaan masing-masing. Perbedaannya lebih kepada hal yang teknis, sedangkan persamaanya terletak dari tujuan diadakannya kursus pra-nikah tersebut, yaitu memberi arahan, gambaran persiapan, bimbingan, dan konseling kepada calon pasangan suami-isteri untuk dapat membina rumah tangga yang sakinah, mawaddah, dan rahmah.Kata Kunci: Kursus, Pra-Nikah, KUA Kec. Abstract

Beberapa negara muslim dunia telah melakukan perubahan di bidang hukum keluarga, salah satunya adalah konsep hak ijbar wali dalam pernikahan. Hal ini disebabkan karena konsep hak ijbar wali yang didasarkan pada pendapat-pendapat para ulama di masa lalu sudah tidak relevan lagi pada masa sekarang ini. Teori perubahan hukum dan sosial yang dikemukakan oleh Ibnu Qayyim al-Jauziyyah bisa menjadi solusi bagi problematika yang berkembang di negara-negara muslim dunia saat ini. Teori ini menjawab mengapa konsep wali dengan hak ijbar -nya berbeda antara negara muslim satu dengan yang lainnya, yaitu bahwa setiap negara mempunyai latar belakang kultur, budaya, sosio-politik dan sosio-historis yang berbeda-beda. Inilah yang menyebabkan para ahli hukum di setiap daerah berbeda dalam menetapkan sebuah produk hukum. Tulisan ini bertujuan untuk melihat argumentasi yang menyetarakan hak memilih calon mempelai antara laki-laki dengan perempuan, tanpa ada hak ijbar dan intervensi wali di dalamnya. Hal ini sesuai dengan perkembangan hukum dan sosial yang terjadi pada masyarakat.

Abstract

Islamic syari'ah was revealed to give benefits to everyone and to avoid them from disadvantages of lives, therefore syari'ah is meant to be suitable and compatible with the development of human beings. This is the basic concept of maqasid al-syari'ah as introduced and explained by the medieval Islamic scholar Imam al-Syațibiin his book al-muwafaqat. However, the concept of maqasid al-syari'ah is experiencing development from time to time and it has become a new paradigm in the contemporary Islamic philosophy. new paradigm of maqasid al-syari'ah is introduced by popularized by Jasser Auda with a systems approach. The development of paradigm of maqasid, from the old to the new maqasid, can be seen from its emphasizing of meaning. The old concept ofmaqasid emphasizes protection of human beings and preservation of benefits, while. the new concept of maqasid emphazies development of human beings and their rights.

Abstract

The Indonesian Ulema Council (Majelis Ulama Indonesia, MUI) was stigmatised as an institution accommodating conservative Islamic groups’ interests post-New Order. However, the religious fatwas produced by the MUI during the Covid-19 pandemic in 2020 had prioritised independence so that it returned to its original role, namely as a translator of government policies. For this reason, this article aims to examine the MUI fatwas and its relationship to state policies in tackling the spread of Covid-19. It is a qualitative research study with a historical approach, examining the content of seven fatwas issued by the Fatwa Commission (Komisi Fatwa) between March and July 2020 as the primary data sources. This study found that MUI’s legal arguments and methods are more inclusive, flexible, and progressive towards socio-religious problems. These fatwas have become a reference for the government in taking policies to suppress the spread of Covid-19. It is reinforced by the fact that several fatwas issued by MUI were used as guidelines by the government in formulating policies to curb the spread of Covid-19. Therefore, the authors argue that the MUI’s fatwa politics not only serve the interests of the Muslim community but also align with the state’s interests in tackling the spread of Covid-19. Thus, the debate regarding the stigmatisation of the role of MUI can be dismissed through these findings, providing new insights into the dynamic interplay between religious and legal frameworks.

Abstract

The position of migrant workers is often seen as a weak party. To some extent, such migrant workers are regarded as similar to slaves. In Indonesia, the government has to protect all citizens, including those abroad who have the status of migrant workers. Migrant Workers’ Protection Law 18/2017 was issued to protect citizens as migrant workers. However, several migrant workers remained legally unprotected abroad. This study used the normative approach that aimed to discuss the protection of Indonesian migrant workers from two-fold, juridical and fiqh siyasah dusturiyah perspectives. While the government protected migrant workers by issuing Law 18/2017, it has more specifically provided directions and objectives to protect migrant workers. This Law ensures human rights for migrant workers despite legal, economic, and social protection for them and their families. Then, the protection of migrant workers from fiqh siyasah dusturiyah should be under the four principles of the workforce in Islam: human independence, human dignity, justice, and the clarity of the contract and wage transaction. Abstract

This article analyses a manuscript on the Islamic law of inheritance, entitled Majmū‘ al-Mīrāth fī Ḥukm al-Farā’iḍ, written by Ismail Mundu. The manuscript resulted from Mundu’s anxiety about the difficulties encountered by his students in understanding the Islamic inheritance-sharing mechanism and the predicted extinction of the Islamic law of inheritance. Through content analysis and historical approaches, the author found that the inclination of thought in Mundu’s Islamic law of inheritance was based on the Shāfi‘ī school with a clearly different point that constitutes its specific and evident contribution. The manuscript included charts containing concise formulas that were not in any other works of Shāfi‘ī school and that could be used as a practical guide to facilitate beginners in learning the Islamic law of inheritance. This article, therefore, contributes to the study of the history of Islamic law by providing evidence of the establishment of local ideas and thought on the Islamic law of inheritance applied by Mundu when he served as Mufti of the Kubu Kingdom and Judge of the Kubu Court from 1907 to 1957.[Artikel ini menganalisis sebuah manuskrip tentang hukum waris Islam, berjudul Majmū‘ al-Mīrāth fī Ḥukm al-Farā’iḍ, karya Ismail Mundu. Manuskrip ini disusun atas keprihatinan terhadap kesulitan-kesulitan yang dialami murid-murid Mundu dalam memahami mekanisme pembagian waris Islam dan ramalan kepunahan ilmu waris karena masyarakat Muslim lebih mengutamakan hukum adat. Melalui studi analisis isi dan pendekatan sejarah, penulis menemukan bahwa kecenderungan pemikiran hukum waris Islam Mundu berdasarkan pada mazhab Shāfi‘ī dengan perbedaan jelas yang merupakan kontribusinya yang spesifik dan nyata. Karya tersebut menyediakan jadwal (tabel) yang berisi rumus-rumus ringkas yang tidak terdapat dalam karya-karya mazhab Shāfi‘ī lainnya dan dapat digunakan sebagai pedoman untuk memudahkan para pemula dalam mempelajari hukum waris Islam. Oleh karena itu, artikel ini berkontribusi bagi kajian sejarah hukum Islam dengan memberikan bukti adanya gagasan dan pemikiran local tentang hukum waris Islam yang diterapkan oleh Mundu ketika menjabat sebagai Mufti Kerajaan Kubu dan Hakim Pengadilan Kubu (1907-1957).]

Abstract

Apart from gender, differences in religious affiliation have often been perceived as negatively impacting the rights of non-Muslims in the practice of family law within Muslim jurisdictions. This article challenges that assumption by presenting recent evidence from the practice of religious courts in Indonesia, specifically in inheritance cases involving testators without heirs. It aims to analyze the legal arguments employed by religious judges in granting the testator’s estate to non-Muslim cognates through hibah (gift). By examining three court verdicts, from the first instance to the cassation level, the author finds that religious judges utilize both juridical and philosophical reasoning to accommodate the rights of non-Muslims via the institution of hibah wājibah (mandatory gift). While the juridical arguments at the first-instance level align with classical fiqh (Islamic jurisprudence), which prescribes allocating the testator’s estate to the bait al-māl (public treasury), higher-level judges deviate from this approach. They adopt an expansive interpretation of hibah provisions, prioritizing societal justice over rigid adherence to classical fiqh rules. Unlike waṣiat wājibah (mandatory will), hibah wājibah offers greater flexibility, as a maximum limit does not constrain it. The author argues that the state’s efforts to encourage religious judges to shift away from rigid classical fiqh references have been gradually successful. This finding carries significant implications for promoting justice and equality among citizens, regardless of their religious affiliation. [Perbedaan afiliasi agama, selain gender, berdampak negatif pada hak yang diterima oleh non-muslim dalam praktik hukum keluarga di yurisdiksi muslim. Artikel ini membantah asumsi ini dengan menyajikan bukti terbaru melalui praktik peradilan agama Indonesia pada kasus pewaris tidak memiliki ahli waris. Untuk itu, artikel ini bertujuan untuk menganalisis argumentasi hukum yang digunakan oleh para hakim agama dalam menyelesaikan kasus tersebut yang melibatkan kerabat non-muslim. Melalui analisis isi terhadap tiga putusan pengadilan agama dari tingkat pertama sampai kasasi, penulis menemukan bahwa para hakim menggunakan argumentasi yuridis dan filosofis untuk mengakomodasi hak-hak non-muslim melalui institusi hibah wajibah. Meskipun argumentasi yuridis para hakim agama pada tingkat pertama kompatibel dengan ketentuan fikih klasik yang memberikan harta peninggalan tersebut ke bait al-māl, namun argumentasi hukum para hakim pada dua tingkat terakhir cenderung mengabaikannya. Mereka menginterpretasikan secara ekspansif ketentuan tentang hibah dengan mempertimbangkan rasa keadilan yang hidup di masyarakat. Pemenuhan hak-hak non-muslim melalui hibah wajibah ini lebih fleksibel, karena tidak memiliki batas maksimal bagian sebagaimana dalam wasiat wajibah. Penulis berargumentasi bahwa upaya negara menjauhkan para hakim agama dari merujuk pada ketentuan fikih klasik berhasil secara bertahap. Abstract

This study examines the tradition of fidyah payments—compensation for missed prayers (ṣalāt) on behalf of the deceased—within the Sasak Muslim community in Central Lombok, Indonesia. Although this practice diverges from the mainstream Shāfiʿī school of law (madhhab), which the community primarily follows, it endures as a deeply ingrained tradition. Based on fieldwork and interviews with tuan gurus (local religious leaders) and deceased family members, the research finds that fidyah is commonly paid using rice, money, or gold from the deceased’s estate, distributed as alms to the poor. The community views fidyah as a means of atoning for missed prayers, offering peace to the family. Tuan gurus legitimize this practice by citing specific Islamic juristic opinions, particularly those of Imām al-Subkī and Imām Abū Ḥanīfah. Over generations, the Sasak community has internalized fidyah as a communal obligation, with non-compliance regarded as a family dishonor. This study demonstrates how tuan gurus’ teachings shape and institutionalize religious practices, transforming them into essential cultural traditions.
