Abstract

This paper aims to provide the understanding and knowledge of the takeover of an non performing loan collaterals by Rural Banks through auctions after the Constitutional Court Decision Number 102/PPU-XVIII/2020. This paper uses a normative legal research type and examines the arrangements for conducting auctions and taking over bad credit collateral by BPR after the Constitutional Court's decision Number 102/PUU-XVIII/2020 using the Statue Approach and the Conceptual Approach. The results of this study conclude that the submission of a judicial review of Article 12A paragraph (1) of the Banking Law by PT. BPR Lestari Bali is inseparable fromithe existence of the "Commercial Bank" clause in that article is considered to be in conflict with several provisions ofothe article in the Constitution of the Republic of Indonesia and is discriminatory towards the rights of Rural Banks to participate as auction buyers for non performing loan collaterals. The submission of a judicial review by PT. BPR Lestari Bali provides and then provides convenience in providing legal certainty for the takeover of bad credit collateral through auctions or outside auctions for BPR, in which this decision then states that the phrase "Commercial Banks" in Article 12A paragraph (1) of the Banking Law has no binding legal force as long as is not interpreted as "Commercial Banks and Rural Banks" so that BPR can then participate in buying part or all of the collateral for debtors who do not fulfill their obligations either through auction or outside the auction. Tulisan ini bertujuan untuk memberikan pemahaman serta pengetahuan terhadap pengambilalihan agunan kredit macet oleh Bank Perkreditan Rakyat melalui lelang pasca putusan Mahkamah Konstitusi Nomor 102/PPU-XVIII/2020. Tulisan ini menggunakan jenis penelitian hukum normative dan mengkaji pengaturan pelaksanaan lelang serta pengambilalihan agunan kredit macet oleh BPR pasca putusan MK Nomor 102/PUU-XVIII/2020 dengan menggunakan pendekatan Peraturan Perundang-Undangan (Statute Approach) dan Pendekatan Konseptual. Hasil dari penelitian ini menyimpulkan bahwa pengajuan judicial review terhadap pasal 12A ayat (1) Undang-Undang Perbankan oleh PT. BPR Lestari Bali ini tidaklah terlepas dari pandangan bahwa keberadaan klausula “Bank Umum” dalam pasal ini dianggap mengalami pertentangan dengan beberapa ketentuan pasal dalam Undang-Undang Dasar Negara Republik Indonesia dan bersifat diskriminatif terhadap hak Bank Perkreditan Rakyat untuk turut serta menjadi pembeli lelang terhadap kredit debitur yang mengalami macet. Pengajuan judicial review yang dilakukan oleh PT. BPR Lestari Bali kemudian memberikan kemudahan dalam pemberian kepastian hukum pengambialihan agunan kredit macet melalui lelang maupun diluar pelelangan bagi BPR, yang mana putusan ini kemudian menyatakan bahwa frasa “Bank Umum” dalam Pasal 12A ayat (1) UU Perbankan tidak mempunyai kekuatan hukum mengikat sepanjang tidak dimaknai sebagai “Bank Umum dan Bank Perkreditan Rakyat” sehingga BPR kemudian dapat turut serta membeli sebagian atau seluruh agunan debiturnya yang tidak melakukan kewajiban baik melalui lelang maupun diluar lelang.

Abstract

ABSTRAK Penelitian ini bertujuan untuk mengetahui bagaimana proses seleksi polri di wilayah Kepolisian Resort Gianyar. Dan apakah selama proses seleksi sudah selaras pada prinsip – prinsip good governance guna menghasilkan sumber daya manusia (SDM) kepolisian yang menjalankan fungsi manjerial. Metode penelitian yang digunakan dalam penelitian ini adalah metode deskriptif dengan pendekatan kualitatif yang berorientasi pada fenomena naturalistik atau alam, yang bertujuan untuk memahami masalah manusia dan sosial. Pelaksanaan penerimaan Polri Tahun 2022 di Polres Gianyar dilihat dari indikator transparansi, pelaksanaan prosedur penerimaan ujian masuk kepolisian memenuhi aspek transparansi dari awal hingga akhir, dilihat dari indikator akuntabilitas; pelaksanan penerimaan Polri secara general sudah memenuhi aspek yang selaras dengan prinsip good governance. Kata Kunci : implementasi, good governance, kepolisian ABSTRACT This study aims to find out how the selection process for non-commissioned officers in the Gianyar Resort Police area. And whether during the selection process it has been aligned with the principles of good governance in order to produce human resources (HR) of the police who carry out managerial functions. The research method used in this study is a descriptive method with a qualitative approach oriented to naturalistic or natural phenomena, aimed at understanding human and social problems. The implementation of the 2022 police brigadier acceptance at the Gianyar Police Station, seen from the transparency indicators for the implementation of the police brigadier admission test stage process from beginning to end, has met the transparency aspect and when viewed from the accountability indicators for the implementation of the acceptance of the Police Brigadier in general has met aspects that are in line with the principles of good governance. Abstract

The Procedures and Requirements for Payment of Old Age Security stated that the benefits of Old Age Security at the Institution of Social Security Employment can only be taken when workers enter retirement or at the age of 56 years, which elicits opposition reactions from various parties. The focus of this research was conducted to examine and criticize whether the Old Age Security (OAS) and Job Loss Guarantee (JLG) policies for workers who have been terminated have reflected the conception of an Indonesian welfare state that is socially just for all Indonesians, as well as to find out how the future concept (Ius Constituendum) of OAS and JLG for workers reflects the welfare state for social justice. A statutory and conceptual approach are used to support the type of normative legal research in this research. The results of the study indicate that the OAS and JLG policies have not described the concept of an Indonesian welfare state with social justice. To describe the OAS and JLG policies that reflect the welfare state, future policies must still provide convenience for workers to receive OAS benefits and continue to carry out OAS benefits.

Abstract

Traditional alcoholic beverages hold a significant place in the culture of Indonesia, embodying the nation's rich heritage and diverse local wisdom. However, the regulation of these beverages presents critical concerns regarding public health and societal impact. This study critically examines how the principles of legal certainty and utility are reflected in Bali Governor Regulation Number 1 of 2020 (“Bali’s Alcohol Regulation”). The primary objective of this research is to analyze and evaluate the embodiment of these values within the regulation. Employing a normative legal research methodology, the study scrutinizes the regulation alongside the hierarchy of laws governing it. The findings reveal notable inconsistencies between Bali’s Alcohol Regulation and the definitions of traditional alcoholic beverages established in higher legislative frameworks, raising pertinent questions about the balance between legal certainty and the practical benefits offered by the regulation. Furthermore, the analysis indicates that the regulation fails to uphold several legal principles, leading to ambiguity in its enforcement. From a utility perspective, the regulation does not yield substantial benefits for artisans, producers, distributors, sellers, buyers, or the broader community. Consequently, it falls short of meeting adequate utility standards, underscoring the necessity for revision and enhancement to better accommodate the interests of all stakeholders involved in the traditional alcoholic beverage sector in Bali.

Abstract

The enactment of the health law in 2023 will have a fundamental impact on the development of health law, in which the Article 308 (2) implies for the civil liability, with the rules that patients who are harmed are required to request a letter of recommendation from the assembly. Meanwhile, Human Rights Law No: 39 of 1999 clearly stated that those who feel that their interests have been harmed can directly file a civil claim/lawsuit to a court institution. Thus, there is a conflict of norms between the two laws and regulations which has an impact in the legal uncertainty. For that reason an in-depth analysis of the issue was carried out. Axiologically this research was conducted aiming  for finding out the essence of the recommendation letter issued by the assembly. This research uses doctrinal research methods. The research results show that the requirement to request a letter of recommendation from the assembly as a condition for submitting civil legal action is a contradiction to the principles of basic rights (HAM) as mentioned in Law 39 of 1999

Abstract

Introduction: This article is to examine the arrangement of the Inventory of Communal Intellectual Property (ICP) in the perspective of the Culture Advancement or IPR and to locate the ideal future concept regarding the Inventory of Communal Intellectual Property (ICP).Purposes of the Research: The purpose of this research is to analyze the Communal Intellectual Property (ICP) inventory concept in the perspective of IPR or Cultural Advancement.Methods of the Research: This research uses normative legal research with the statutory approach and conceptual approach.Results of the Research: In this research was found that the inventory concept in the Cultural Advancement Law is more sustainable rather than Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 13 of 2017, subsequent to the inventory is conducted and it will be continued to the next stage are securing, maintaining, salvaging, and publishing.

Abstract

This study examines the legal protection mechanisms for participants in the benefit-sharing scheme between BPJS Kesehatan and commercial insurance providers. The background of this research is driven by the increasing collaboration between national health insurance administrators and private insurance companies, which raises legal challenges, particularly concerning the clarity of participants' rights and obligations. The research adopts a normative approach, involving regulatory document analysis and case studies. The findings indicate the existence of legal gaps that cause uncertainty in participant protection, with regulatory ambiguities and differing interpretations between national legal norms and commercial insurance practices emerging as key issues. These findings highlight the need for regulatory harmonization and policy adjustments to ensure the benefit-sharing mechanism operates transparently and accountably. The research recommendations include improving the regulatory framework, drafting clear operational guidelines, and enhancing supervisory roles to ensure fairness and legal certainty for all participants. Thus, this study is expected to contribute to the development of more adaptive and responsive health law policies in line with the evolving dynamics of Indonesia’s health insurance system.

Abstract

The aim of this study is to provide an overview of the latest phenomenon in the development of sources of embryonic stem cells in the world, as a criticism of the Health Act that closed Indonesia's opportunity to undertake health transformation. Now many countries have begun to legalize embryonic stem cells by exploiting the remains of the in vitro fertilization embryos left just by their owners. It responds to earlier debates about the method of embryonic stem cells that originate in a fetus or embryos taken from a mother's womb. Some research sources say that embryonic stem cells have more potential than non-embryonic. On that basis, it is interesting to study how the Indonesian Health Act responds to these developments and the commitment to transform in terms of health. The innovation in this research focuses on responding to existing research that more categorizes embryonic stem cells as violating the ethics of living beings and strictly prohibits the use of embryonal stem cell. This research method is normative, using statutory and comparative approaches. The results of this research are, first, that embryonic stem cells have greater potential than the adult stem cells currently used and countries around the world are starting to legalize the use of embryonic stem cells by utilizing leftover embryos from in vitro fertilization. Second, Indonesia is still unable to carry out health transformation by utilizing legal instruments, such as the preamble to the Health Law and Development Legal Theory.Tujuan penelitian ini ialah memberikan gambaran fenomena terbaru perihal perkembangan sumber dari sel punca embrionik di dunia, sebagai kritik terhadap Undang-Undang Kesehatan yang menutup rapat kesempatan Indonesia untuk melakukan transformasi kesehatan. Saat ini banyak negara-negara mulai melegalkan sel punca embrionik dengan memanfaatkan sisa embrio in vitro fertilazation yang ditinggalkan begitu saja oleh pemiliknya. Hal ini menjawab perdebatan dahulu terkait metode sel punca embrionik yang bersumber pada janin atau embrio yang diambil dari rahim seorang ibu. Beberapa sumber penelitian mengatakan bahwa sel punca embrionik lebih memiliki potensi besar dibanding sel punca non embrionik. Atas dasar itu, menarik untuk dikaji bagaimana Undang-Undang Kesehatan Indonesia menanggapi perkembangan ini dan komitment untuk bertransformasi dalam hal kesehatan. Pembaharuan dalam  penelitian ini berfokus pada menjawab penelitian yang sudah ada yang lebih mengkategorikan sel punca embrionik sebagai hal yang melanggar etika makhluk hidup dan melarang keras penggunaan sel punca embrionik. Metode penelitian ini adalah normatif dengan menggunakan pendekatan perundang- undangan dan komparatif. Adapun hasil dari penelitian ini ialah pertama, sel punca embrionik lebih memiliki potensi besar ketimbang sel punca dewasa yang saat ini digunakan dan Negara-negara di dunia mulai melegalisasi penggunaan sel punca embrionik dengan memanfaatkan sisa embrio in vitro fertilazation. Kedua, Indonesia masih belum mampu melakukan transformasi kesehatan dengan dengan memanfaatkan instrumen hukum, sebagaimana konsideran Undang-Undang Kesehatan dan Teori Hukum Pembangunan.

Abstract

Penelitian ini dibuat guna mengetahui serta menganalisa pertanggungjawaban pidana Korporasi terkait dengan pencemaran lingkungan hidup menurut UU PPLH dan Perbandingannya dengan UU Omnibus Law kluster lingkungan hidup dan Implikasi dari berlakunya UU Omnibus Law Kluster lingkungan hidup terhadap pencemaran lingkungan yang dilakukan oleh korporasi. Jenis penelitian hukum normatif digunakan dalam penelitian ini sehingga pendekatan yang dilakukan adalah pendekatan perundang-undangan dengan bahan hukum primer, sekunder dan tersier sebagai bahan hukum dan pendekatan perbandingan yakni dengan cara menggunakan perbandingan mickro yaitu dengan membandingkan antara undang-undang satu dengan yang lainnya. Teknik studi dokumen digunakan sebagai teknik pengumpulan bahan hukum, dan kemudian penilaian, peninjauan ulang, dan argumentasi akan dibahas secara deskriptif. Hasil penelitian menyimpulkan bahwa (1) dalam meminta pertanggungjawaban korporasi terhadap pencemaran lingkungan yang dalam pembuktiannya sangat sulit maka asas vicarious liability dan teori identifikasi digunakan, dalam perbandingannya beberapa ketentuan Pasal dirubah dan di hapus dan implementasi dari diberlakukannya Omnibus Law akan memberikan peluang terhadap korporasi untuk melakukan pencemaran lingkungan, dengan dikesampingkannya asas strict liability.
