Abstract

Rape victims are those who experience serious violations of human rights, both physically and psychologically. Pregnancy resulting from rape often causes ongoing suffering for the victim, so that in certain conditions the victim chooses to have an abortion. To find out and analyze the legal regulations related to the legalization of abortion for rape victims in Indonesia. To find out and analyze the form of criminal legal protection for rape victims who have abortions. To find out and analyze the criminal liability of the perpetrator of abortion by rape victims in criminal law. The research method used is normative juridical with a statutory and conceptual approach, through a study of laws, regulations related to reproductive health, and human rights principles. The results of the study show that Indonesian law basically prohibits the practice of abortion, but provides limited exceptions for rape victims under certain conditions. However, the legal protection provided is not fully optimal due to normative obstacles, law enforcement officers, and social stigma against victims. Therefore, it is necessary to emphasize regulations and a victim-oriented legal approach to ensure certainty, justice, and legal protection for rape victims. The emergence of the abortion problem in Indonesia needs attention from various parties who provide alternative solutions. Moral and religious conflicts are the biggest issues that continue to complicate policy agreements to address abortion.

Abstract

Abstract: The Criminal Code does not clearly state what is meant by evidence, but from the way of obtaining the evidence, it can be concluded that the definition of evidence is the result of a series of investigators' actions in confiscation and/or searches and/or examination of letters to take over and/or store under their control movable or intangible objects for the purpose of evidence in investigations, prosecutions and trials. In practice, confiscations carried out by investigators still often involve the rights of third parties, one of which is the confiscation of fiduciary collateral objects used to commit narcotics crimes. This study uses a normative legal research type supported by empirical data with data collection techniques in the form of interviews and literature studies. Data analysis is carried out qualitatively and produces research in the form of analytical description. The study concluded that there is a conflict between the state's authority to confiscate narcotics evidence and the rights of third parties as fiduciary recipients through the principle of droit de suite. In practice, investigators have difficulty accommodating requests for the return of evidence due to the complex process, limited time, and the weak legal standing of third parties. This requires consideration of utility and fairness, in accordance with the Fiduciary Guarantee Law's objective of supporting the development of the financing sector. The Padang Sidempuan District Court's decision No. 323/Pid.Sus/2023/PN Psp, which confiscated a vehicle belonging to a third party, demonstrates a lack of legal protection, while decision No. 38/Pid.Sus/2024/PN Psp, which returned the vehicle to the fiduciary recipient, reflects the appropriate, fair, and beneficial application of the droit de suite principle for third parties not involved in the crime. Keywords: droit de suite principle, fiduciary guarantee, confiscation, evidence, narcotics case.

Abstract

Abstract

Economic globalization has increasingly shaped the field of intellectual property rights (IPR), transforming copyright protection from a domestic matter into a strategic tool of global trade. Through international instruments such as the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs) and the Berne Convention of 1886, universal copyright standards are enforced across jurisdictions. Yet this harmonization generates tension between international obligations and national legal sovereignty. This article employs a juridical-normative method with doctrinal, case study, and comparative approaches to examine these dynamics. The case of Auld Lang Syne illustrates how public domain works evolve into shared cultural heritage, while the dispute of Ahmad Dhani v. Once Mekel reveals persistent enforcement challenges in Indonesia. Comparative analysis of the United States, United Kingdom, Japan, and Indonesia demonstrates divergences in copyright duration, derivative work protection, and exceptions such as parody. The article argues that Indonesia must ground its response to globalization of IPR in Pancasila and the 1945 Constitution, thereby ensuring that national copyright law is not merely a passive rule taker within the global system but an active framework that safeguards cultural identity and national interests.

Abstract

The exclusivity of a trademark as a distinguishing sign for goods and/or services must be registered. An application for trademark registration must be submitted by an applicant acting in good faith. A trademark registration may be cancelled by the Commercial Court within a period of 5 (five) years after the trademark has been registered, and there is no time limitation if it is proven that the trademark registration was filed in bad faith. This study aims to analyze the legal regulation of good faith in trademark registration, examine the concepts and criteria of bad faith in trademark cancellation practices, and analyze judges’ legal considerations in deciding trademark cancellation cases involving bad faith. This research is descriptive-analytical in nature and employs statutory, conceptual, and case approaches supported by secondary data. The data were analyzed qualitatively. The results of the study indicate that the concepts and criteria of bad faith are not clearly regulated in Law Number 20 of 2016 concerning Trademarks and Geographical Indications, resulting in inconsistencies in legal certainty and law enforcement. The contribution of this research is to provide a deeper understanding of the importance of clearer regulations regarding indicators of bad faith as a basis for legal protection for rightful trademark owners, as well as to serve as a consideration for lawmakers in improving trademark regulations in Indonesia. Therefore, it is recommended that provisions regarding the good faith of trademark applicants be regulated more clearly, specifically, and comprehensively.

Abstract

Cinematographic piracy on TikTok presents a significant challenge to the enforcement of criminal copyright law in Indonesia. The platform’s short-video format, viral nature, and monetization potential have facilitated the widespread distribution of unauthorized film excerpts. Although Law Number 28 of 2014 on Copyright provides criminal sanctions for copyright infringement, its enforcement remains ineffective, primarily due to the classification of copyright offenses as complaint-based crimes. This study aims to examine the regulation of criminal copyright law in addressing film piracy on TikTok and to analyze the urgency of reforming the offense classification and adopting more adaptive criminal sanctions. This research employs a normative legal method with a juridical-normative approach, relying on statutory analysis, legal doctrines, and relevant scholarly literature. The findings indicate that the complaint-based offense mechanism and non-proportional sanctions relative to the perpetrators’ economic gains undermine deterrence and weaken copyright protection. Therefore, legal reform is necessary through the adoption of a mixed offense model based on the perpetrator’s characteristics and the implementation of adaptive sanctions to enhance the effectiveness of copyright law enforcement in the digital era.

Abstract

Abstract

This study examines the balance between public access to information and the protection of suspects’ rights in the practice of law enforcement press conferences in Indonesia, as well as its comparison with international standards. Public access to information is a constitutional right guaranteed by the 1945 Constitution and the Law on Public Information Disclosure, yet in practice it often clashes with fundamental rights of suspects protected under the Criminal Procedure Code, such as the right to privacy, humane treatment, and the presumption of innocence. Press conferences frequently disclose suspects’ identities or images and present official narratives that may create public perceptions of guilt before a final court judgment. Such practices generate social stigma, undermine dignity, and violate the principle of due process of law. This normative legal research employs statutory and comparative approaches, showing that the United Kingdom and France impose strict restrictions on the publication of suspects’ identities, while Indonesia tends to resemble Thailand, where protection remains weak. The comparison highlights a regulatory gap in Indonesia, indicating the need for more detailed rules governing press conferences, limitations on disclosed information, and independent oversight mechanisms. Accordingly, a proportional balance between the public’s right to information and the protection of suspects’ rights can be realized within the framework of a democratic rule of law.

Abstract

Abstract The development of digital financial transactions has opened up new space for fraudulent practices that no longer stand as a single criminal act, but are often arranged through money laundering schemes to disguise the origin of funds from crimes. In this context, perpetrators use layered accounts, digital wallets, payment gateways, crypto assets, fake identities, and cross-platform fund transfers to break the connection between victims, perpetrators, and fund flows. This study aims to analyze the role of digital forensics in uncovering fraudulent practices based on money laundering schemes in digital financial transactions, especially in tracking digital evidence, reconstructing transaction patterns, and strengthening legal evidence. This research shows that digital forensics plays an important role in uncovering transaction trails, analyzing metadata, tracing inter-account relationships, mapping placement, layering, and integration patterns, and maintaining the integrity of evidence through accountable acquisition, preservation, analysis, and reporting procedures. Digital forensics also helps uncover the construction of fraud disguised through digital financial transactions, so that proof rests not only on the victim's losses, but also on the systematic relationship between fraud modes, fund flows, and attempts to disguise the proceeds of crime. The contribution of this research lies in the argument that digital forensics needs to be placed as a strategic instrument in criminal law enforcement that is integrated with money laundering schemes, as well as as a basis for strengthening regulations, investigative capacity, and the validity of digital evidence-based evidence.

Abstract

The rapid advancement of artificial intelligence (AI) and digital creativity has introduced new challenges to Indonesia’s Intellectual Property Rights (IPR) legal framework. The fair use doctrine has not been explicitly regulated under Indonesia’s Copyright Law, resulting in legal uncertainty when copyrighted works are utilized as AI training data or incorporated into digital content. From the perspective of Islamic law, maqāṣid al-sharīʿah offers an ethical and normative framework that balances copyright protection (ḥifẓ al-māl) with the promotion of innovation and intellectual development (ḥifẓ al-ʿaql), thereby fostering justice, public welfare (maṣlaḥah), and an adaptive IPR system. This study aims to analyze the relevance and limitations of the fair use doctrine in the context of AI and digital creativity and to formulate an appropriate direction for legal reform in Indonesia. Unlike previous studies that have tended to examine fair use, software development, or AI-related copyright issues separately, this research integrates intellectual property law, AI governance, and Islamic legal principles within a comprehensive analytical framework. This integrative approach constitutes the novelty of the study by positioning maqāṣid al-sharīʿah as a normative foundation for reforming the fair use doctrine in the era of artificial intelligence and digital creativity. The study employs a normative legal research method using conceptual and statutory approaches through the analysis of primary, secondary, and tertiary legal materials. The findings demonstrate the necessity of reforming the fair use doctrine through explicit legal regulation, clear assessment criteria, equitable compensation mechanisms, and broader coverage of AI-related activities. The study further proposes a maqāṣid al-sharīʿah-based fair use reform model that balances the economic rights of copyright holders (ḥifẓ al-māl) with the advancement of innovation and knowledge (ḥifẓ al-ʿaql), while distinguishing between commercial and non-commercial AI utilization. Such reform is consistent with the objectives of maqāṣid al-sharīʿah in safeguarding intellectual property rights while simultaneously encouraging innovation, thereby contributing to the development of an adaptive and equitable IPR system in Indonesia
