Abstract

Criminal act of rape has received considerable attention among the public nowadays. The care and protection of the interests of the victims of the rape crime either through criminal justice process or certain social care facilities is an absolute part that needs to be considered in criminal law policies and social policies. Therefore, in the formulation of the criminal system, it is time to pay attention to the victims interest to realize the equitable distribution of justice for the rights of rape victims to be protected. In the effort of developing and renewing the criminal law in Indonesia, it is necessary to conduct an assessment related to the policy of punishment formation system which is oriented to the rape crime victims in the coming criminal law. This study employed a qualitative research using normative law research design. In an effort to achieve the research objectives that have been determined, this study used statute approach and conceptual approach. Based on the results and discussion, policy formulation of punishment system that is oriented to rape crime victims in future criminal law is as follows: (1) in the material criminal law, protection of rape crime victims in its development is regulated in a Bill of Criminal Law, including the formulation of passive national principles, the extension of the concept of criminal acts of rape, and the formulation of types of sanctions. (2) in formal criminal law, the protection of victims, especially the rape crime victims, has been regulated in a Bill of Criminal Procedure Law, with the granting of procedural rights such as the right of a translator and the right of reimbursement of expenses. It is because legal protection against victims of rape crime is in need of services such as psychosocial, medical, and safe house.

The protection provided by state law against women and children as victims of the crime of trafficking in persons scattered in several laws and regulations either general or specific nature, such as: Criminal Law, Criminal Procedure Code, Law No.21 of 2007 on Combating Criminal Acts trafficking in Persons, Law No.13 of 2006 on Protection of Witnesses and Victims. It is still not supported by the implementing regulation (Government Regulation) with regard to the mechanism of compensation or restitution which is a form of direct protection to the victim

Abstract

Violence against girls lately increasingly widespread, whether physical, psychological, and sexual.  To provide services and protection against the girl child victims of crime, especially the crime of sexual violence, the police have established Women and Children Unit (Unit PPA).  This study aims to identify and analyze the obstacles faced  Unit PPA Polresta Banjarmasin in providing legal protection for women victims of child sexual abuse. This research uses empirical legal research with the research conducted analytical descriptive and explanatory. The types of data used in this study included primary data in the form of interviews and the question as written, and secondary data.The results showed that the obstacles faced Unit PPA Polresta Banjarmasin in providing legal protection, among others: victims hesitate to report, the family and the community who do not understand and tend to blame victims for sexual violence, the revocation of a report from the victim, the suspect fled, sexual violence is usually carried out at night in bed days, and the lack of facilities and infrastructure owned Unit  PPA Polresta Banjarmasin.

Abstract

Efektifitas penegakan hukum harus memperhatikan dua hal yang sangat penting yaitu pertama faktor hukumnya dan yang kedua yaitu faktor penegak hukumnya. Artinya selain faktor hukumnya harus baik,  aparat penegak hukumnya juga  harus mampu bertindak secara profesional dan proporsional dalam penanganan perkara tindak pidana korupsi. Hasil Penelitian terhadap Kinerja Aparat Penegak Hukum Dalam Penanganan Perkara Tindak Pidana Korupsi Di Provinsi Kalimantan Selatan menunjukkan bahwa Kinerja Aparat yang dalam hal ini Kepolisian dan Kejaksaan di Provinsi Kalimantan Selatan sudah memberikan hasil yang maksimal meskipun masih terdapat beberapa kendala. Terkait Model penegakan yang dapat diakomodasikan  dalam hal penanganan tindak pidana korupsi adalah model koordinatif dan model regulatif.

Abstract

Tujuan dari Penelitian ini adalah Untuk menganaliasa hal-hal yang menjadi pertimbangan hakim dalam menjatuhkan putusan pidana sehingga terdapat disparitas terhadap putusan tindak pidana narkotika dan Pidana Mati. Dan kebijakan hukum pidana mengenai tindak pidana narkotika dimasa yang akan datang dikaitkan dengan Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana (KUHP). Adapun metode Penelitian yang digunakan adalah Normatif. Tipe Penelitian legal Reform Oriented dengan bahan hukum yang digunakan adalah Kitab Undang-Undang Hukum Pidana, Serta Putusan Pengadilan Terkait Hukum Pidana Mati. Hasil dari Penelitian ini adalah Perbedaan putusan yang dijatuhkan oleh hakim terhadap perkara yang sama, khususnya perkara narkotika merupakan bagian dari kewenangan hakim untuk memutus suatu perkara berdasarkan peraturan perundang-undangan yang berlaku dan hati nuraninya. Meskipun suatu perkara dituntut dan diputus dengan pasal yang sama, bukan berarti pemidanaannya juga harus sama. Hal ini disebabkan karena tidak ada perkara yang benar-benar sama, baik mengenai latar belakang pelaku melakukan tindak pidana, modus operandi maupun jumlah berat barang bukti yang ditemukan pada saat terjadinya penangkapan. Kedua Kebijakan hukum pidana mengenai tindak pidana narkotika dimasa yang akan datang dikaitkan dengan Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana (KUHP) khususnya mengenai penjatuhan putusan pidana mati masih diatur dan diperlukan dalam KUHP meskipun pidana mati dalam Undang-Undang Nomor 1 Tahun 2023 tentang KUHP tidak menjadi pidana pokok dan beralih menjadi pidana alternatif

Abstract

The purpose of carrying out this journal is to find out that deforestation of mangrove forests in Kotabaru Regency carried out by the community is an environmental crime and they want to know the sanctions that can be imposed on perpetrators of mangrove forest deforestation in Kotabaru Regency which cause damage to the mangrove forest ecosystem. The results of this writing are that the act of deforestation of mangrove forests in Kotabaru Regency, South Kalimantan Province is caused by the local government's RTRWK inventory process being less than thorough because there are still mangrove forests that are included in residential areas and fisheries cultivation areas. Furthermore, the act of mangrove deforestation is a criminal act of environmental destruction because it pollutes and destroys the surrounding environment, destroying mangrove forests, and destroying the mangrove ecosystem. Normative research type, doctrinal legal research type using philosophical thinking by finding a concept, research approach, statutory approach, and conceptual approach. Prescriptive nature of research types and primary secondary and tertiary research. There are still mangrove forest plants based on the author's research which are located on the sea coast of Silver Street, Semayap Village, Kotabaru Regency which extends to the Semayap Village housing complex which is a residential area in the RTRWK Kotabaru Regency is located in a residential area, so the author can conclude that the regional government's inventory process in the RTRW process is not thorough enough and the need for the RTRWK to be revised again, as well as the sea coast area, city boundaries, the village of Stagen District. Kotabaru with the presence of fish and shrimp ponds included in the RTRWK for cultivation areas, the writer can conclude that the regional government inventory process in the RTRW process is not thorough enough and the RTRWK needs to be revised again so that the writer concludes that the local regional government is also responsible for the deportation carried out by residential business actors. and pond cultivation on the side of Silver Street, Semayap Village, Kotabaru Regency up to the Semayap housing complex as well as fish pond cultivation on the coast at the city limits of Stagen Village, Kec. North Sea Island District. new city. The current impact is that this location often floods when the sea water is at high tide. The act of deforestation of mangrove forests in Kotabaru Regency, South Kalimantan Province is an environmental crime. Sanctions that can be imposed on the perpetrators are Article 98 paragraph (1) of the Law of the Republic of Indonesia Number 32 of 2009 concerning Protection and Management of the Environment Article 35 Letter e of the Republic of Indonesia Law Indonesia Number 27 of 2007 concerning Management of Coastal Areas and Small Islands and article 73 letter b of Law of the Republic of Indonesia Number 27 of 2007 concerning Management of Coastal Areas and Small Islands and the regional government should be asked for criminal liability in article 112 and article 113 UUPPLH.

Abstract

Penelitian ini bertujuan untuk mengkaji dan menganalisis bentuk larangan promosi webinar (seminar online) oleh Notaris melalui media sosial ditinjau dari Akta Jabatan Notaris dan Kode Etik Notaris. Penelitian ini merupakan penelitian hukum normatif, dengan menggunakan sumber hukum primer, sekunder, dan tersier yang diperoleh dari penelitian kepustakaan. Jenis penelitian ini adalah norma yang kabur, menggunakan pendekatan undang-undang dan konseptual, dan karakteristik penelitian adalah menganalisis perspektif. Hasil penelitian ini adalah kegiatan promosi webinar (seminar online) oleh Notaris melalui media sosial dapat dikategorikan sebagai promosi diri Jabatan Notaris, apapun bentuk publikasi dan promosi diri Jabatan Notaris, seperti kewajiban dan larangan telah diatur dalam Akta Jabatan Notaris dan Tata Tertib Notaris, berlaku jika Notaris diketahui melakukan promosi diri melalui media sosial. Notaris dapat dikenakan sanksi sesuai dengan bentuk pelanggaran yang dilakukannya, perilaku dan tindakan yang dilakukan oleh Notaris dimana tindakan tersebut tidak sesuai dengan Akta Jabatan Notaris dan Kode Etik Notaris (terkait promosi dan publikasi diri melalui media sosial) . Peraturan Undang-Undang Jabatan Notaris dan Tata Tertib Notaris tentang kegiatan promosi melalui webinar (seminar online) oleh Notaris melalui media sosial, kategori batasan apa yang boleh dan tidak boleh dalam kegiatan promosi tersebut melalui webinar (seminar online) oleh Notaris melalui sosial media, tidak secara jelas dan tegas dalam akta Jabatan Notaris dan Tata Tertib Notaris aturan mana yang dianggap sebagai pelanggaran atau tidak terhadap kenaikan pangkat yang dilakukan oleh Notaris.

Abstract

Secara yuridis, modal yang disertakan ke dalam perseroan bukan lagi menjadi kekayaan orang menyertakan modal, tetapi menjadi kekayaan perseroan itu sendiri. Hal tersebut terjadi pemisahan kekayaan antara kekayaan pemegang saham dan perseroan. Berkaitan dengan di persangkakan dan dituntutnya sejumlah mantan direksi atau direksi Persero atas perbuatan mereka yang merugikan Perserosehingga dikategorikan merugikan keuangan negara, perlu diberikan pemahaman mendalam karena keuangan Persero berdasarkan teori hukum dan teori lingkungan kuasa hukum bukan merupakan keuangan negara sehingga kerugian pada Persero bukan kerugian negara.

Abstract

AbstractFinancial statements are reports that show the financial condition of an entity at a certain period. With financial reports, a company can monitor the development of its business. The information in the financial statements is not only used by the owner or management, but also by several parties who are appointed to be able to use it. In the implementation of BUMDes activities, they are required to make financial reports as a means of communicating information about very important financial transactions as a form of accountability and evaluation of BUMdes activities. The preparation of BUMDes financial statements must refer to the Financial Accounting Standards for Entities Without Public Accountability SAK ETAP. BUMDes Mandiri which is located at Jalan Canal No. 33A Lalang Village, Tanjung Pura District, Langkat Regency, was established in 2015 whose BUMDes activities are engaged in Savings and Loans. This study analyzes whether BUMDes Mandiri has implemented and can apply SAK ETAP in its financial statements. The research used descriptive method. It can be seen that the process of presenting the annual financial statements at BUMDes Mandiri has not fully followed the applicable accounting standards and has not met the SAK ETAP guidelines.AbstrakLaporan keuangan (financial statements) merupakan laporan yang menunjukkan kondisi finansial suatu entitas pada suatu periode tertentu. Dengan laporan keuangan, sebuah perusahaan dapat memantau perkembangan bisnisnya. Informasi dalam laporan keuangan, tidak hanya digunakan oleh pemilik atau manajemen, melainkan juga beberapa pihak yang ditunjuk untuk dapat menggunakannya. Dalam pelaksanaan kegiatan BUMDes diharuskan membuat laporan keuangan sebagai alat mengkomunikasikan informasi mengenai transaksi keuangan yang sangat penting sebagai wujud dari pertanggungjawaban dan evaluasi terhadap kegiatan BUMdes. Penyusunan Laporan keuangan BUMDes harus mengacu pada Standar Akuntansi Keuangan Entitas Tanpa Akuntabilitas Publik SAK ETAP. BUMDes Mandiri yang beralamat Jalan Terusan No. 33A Desa Lalang Kecamatan Tanjung Pura Kabupaten Langkat didirikan pada tahun 2015 yang kegiatan BUMDes bergerak dibidang Simpan Pinjam. Penelitian ini menganalisis BUMDes Mandiri apakah telah menerapkan dan dapat menerapkan SAK ETAP dalam laporan keuangannya. Penelitian menggunakan metode deskriptif. Dapat diketahui bahwa proses penyajian laporan keuangan tahunan pada BUMDes Mandiri belum sepenuhnya mengikuti standar ilmu akuntansi yang berlaku dan juga belum memenuhi pedoman SAK ETAP.
