Abstract

Background: The relationship between law, justice, and morality remains central in legal philosophy, yet much of the discourse remains normative and detached from real-world enforcement . Purpose: This study aims to empirically examine how moral frameworks influence the practice of law enforcement, particularly within contexts shaped by Islamic jurisprudence and local socio-cultural norms.. Methods: The research draws on semi-structured interviews with law enforcement officers, analysis of court cases, and ethnographic observation in Indonesian legal settings . Findings: Findings reveal that moral considerations rooted in religious values and communal ethics significantly shape interpretations and enforcement decisions, often mediating tensions between codified state law and local moral expectations. The evidence also shows that while positivist approaches dominate formal structures, natural law reasoning and socio-cultural ethics remain influential in practice. Theoretical and Practical Implications: The study bridges philosophy of law with empirical socio-legal research, offering insights into how morality operates as a determinant in justice delivery and conflict resolution. Originality/Novelty: This research contributes by integrating anthropological fiqh with legal philosophy, providing a culturally grounded and empirically validated framework for understanding morality in law enforcement

Abstract

Infrastructure development is a strategic sector in national development as mandated by the 1945 Constitution of the Republic of Indonesia and regulated under Law Number 2 of 2017 on Construction Services. However, the practice of law enforcement concerning building failures demonstrates inconsistency, particularly when applying the Anti-Corruption Law (UU Tipikor), despite such matters being more appropriately resolved through the legal mechanisms of construction law or civil contract law. The collapse of the Mandastana Bridge and the Sukamara Prison wall serve as concrete examples of legal uncertainty arising from improper application of the law, thereby raising issues of legality, the principle of ultimum remedium, and legal certainty. This study aims to analyze the application of Article 2 Paragraph (1) and Article 3 in conjunction with Article 18 of the Anti-Corruption Law and Article 55 Paragraph (1) of the Indonesian Criminal Code (KUHP) in relation to building failures in government goods and services procurement; to examine its legal implications; and to formulate an ideal, logical, consistent, and harmonious legal policy within the national legal system. Utilizing a normative approach, the research affirms that building failures are more effectively addressed through administrative and civil instruments, except where clear indications of corruption exist. The findings indicate that multiple interpretations of the elements of “unlawfulness,” “self-enrichment,” and “state loss” in the Anti-Corruption Law result in inconsistent law enforcement, protracted legal processes, and hesitation among officials in making decisions. Therefore, legal reform is required through the revision of the Anti-Corruption Law, the drafting of technical guidelines, capacity-building for law enforcement, and the protection of official discretion in accordance with the principles of good governance. Thus, a reconstruction of construction law focused on justice, legal certainty, and public benefit is expected to deliver infrastructure that is high-quality, sustainable, and capable of providing optimal economic benefits for society.

Abstract

Tujuan penelitian ini adalah untuk Apakah pemanfaatan kayu Halaban di kebun sendiri termasuk dalam lingkup hukum tidak pidana di bidang kehutanan dan Bagaimana kebijakan formulasi hukum pidana terhadap pemanfaatan kayu Halaban yang didapat dari kebun sendiri di masa mendatang. Metode penelitian yang digunakan dalam penulisan yaitu: berjenis penelitian yuridis normatif, dengan pendekatan masalah menggunakan pendekatan perundang-undangan, pendekatan konsep, dan pendekatan kasus. Hasil penelitian menunjukkan bahwa Hukum positif di Indonesia  pada dasarnya tidak melarang masyarakat untuk menanam dan membudidayakan jenis pohon tertentu, termasuk pohon Halaban, di atas kebun milik sendiri/pribadi atau yang disebut oleh undang-undang kehutanan dengan istilah Hutan Hak, Kekosongan hukum administratif-teknis dalam pengaturan pengangkutan kayu Halaban yang berasal dari kebun sendiri, khususnya di luar wilayah Pulau Jawa dan Bali timbul karena tidak diaturnya jenis kayu Halaban, ketiadaan pengaturan teknis dalam peraturan pelaksana (Verordnung) tersebut menimbulkan ketidakharmonisan antara norma hukum umum dalam undang-undang dengan norma pelaksanaannya, sehingga mengancam kepastian hukum, konsistensi penegakan hukum, dan perlindungan hak-hak masyarakat. Oleh karena itu, arah formulasi hukum pidana terhadap pemanfaatan kayu Halaban di masa mendatang perlu menyesuaikan dengan prinsip keadilan ekologis, keberlanjutan (sustainability), dan pengakuan terhadap hak masyarakat adat maupun lokal sebagai subjek utama pengelola hutan

Abstract

Studi ini mengkaji penerapan metode penyidikan berupa penyerahan narkotika di bawah pengawasan (controlled delivery) oleh penyidik dari Badan Narkotika Nasional (BNN). Latar belakang penelitian ini adalah semakin meningkatnya kompleksitas dan kecanggihan modus operandi dalam peredaran gelap narkotika, yang menuntut adanya strategi penegakan hukum yang efektif namun tetap sesuai dengan ketentuan peraturan perundang-undangan. Controlled delivery merupakan salah satu teknik penyidikan yang diatur dalam Pasal 75 huruf j Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika. Namun dalam praktiknya, teknik ini kerap memunculkan persoalan hukum, khususnya jika tidak dijalankan sesuai dengan prosedur yang ditetapkan. Penelitian ini menggunakan metode pendekatan yuridis normatif dengan tujuan untuk mengevaluasi penerapan teknik tersebut serta menelaah kebijakan kriminal yang menjadi dasar hukumnya. Temuan penelitian ini menunjukkan bahwa meskipun controlled delivery memiliki legitimasi hukum, pelaksanaannya harus didukung oleh sistem pengawasan yang ketat dan kelengkapan administratif, agar tidak menimbulkan pelanggaran yang dapat membatalkan proses hukum terhadap pelaku kejahatan narkotika

Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis adanya disharmonisasi hukum terhadap sanksi tindakan rehabilitasi bagi anak pelaku tindak pidana kekerasan seksual. Adapun jenis penelitian yang penulis gunakan adalah jenis penelitian hukum normatif. Pendekatan penelitian yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan, pendekatan konseptual dan Pendekatan Kasus. Menurut Hasil penelitian yang diperoleh bahwa terdapat disharmonisasi hukum pada Pasal 90 Undang-undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak dengan Pasal 59A Undang-Undang Nomor 35 Tahun 2014 tentang Perubahan atas Undang-undang Nomor 23 Tahun 2002 tentang Perlindungan Anak yang mana dalam Undang-Undang Perlindungan Anak yang mana dalam undang-undang ini mengatur bahwa anak yang berhadapan dengan hukum (anak pelaku) berhak mendapatkan perlindungan khusus berupa pemberian rehabilitasi baik fisik, psikis, maupun sosial sedangkan dalam Undang-undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak tidak ada aturan yang mengatur yang jelas dan konkrit didalam undang-undang tersebut perihal pemberian sanksi rehabilitasi bagi anak pelaku hanya ada aturan yang mengatur bahwa rehabilitasi diperuntukkan pada anak korban dan anak saksi saja padahal anak pelaku juga berhak mendapatkan rehabilitasi ini jika ditinjau pada undang-undang Perlindungan Anak.

Abstract

Tujuan Penelitian ini adalah untuk memberikan analisis mengenai penerapan asas ultra petita oleh hakim dalam perkara perdata dengan disertai dengan penerapan dan kedudukan asas ultra petita oleh hakim dalam perkara perdata. Penelitian ini memakai pendekatan peraturan perundang-undangan dan pendekatan sosio legal. Penelitian ini bersifat preskriptif analisis dengan sumber bahan hukum yang diperoleh melalui studi kepustakaan. Bahan hukum diolah dengan membagi-bagi bahan hukum sesuai dengan bagian permasalahan, kemudian disusun sedemikian rupa untuk menjawab isu hukum yang telah dirumuskan dan kemudian dituangkan kedalam pembahasan sebagai jawaban atas pokok permasalahan yang diteliti dan diakhiri dengan sebuah kesimpulan. Hasil penelitian ini menunjukkan bahwa Pertama, Ultra Petita adalah penjatuhan putusan oleh hakim atas perkara yang tidak dituntut atau memutus melebihi dari pada yang diminta. Asas ini digariskan dalam hukum acara perdata dalam ketentuan pada Pasal 178 Ayat (3) H.I.R dan Pasal 189 Ayat (3) RBg bahwa tindakan hakim yang melanggar asas ultra petita ini dapat dipersamakan dengan tindakan yang tidak sah karena dianggap sama dengan melakukan pelanggaran terhadap prinsip rule of law, Namun dalam penerapannya asas ultra petita dalam praktiknya boleh dilaksanakan selama di dalam batasan posita. Kedua, Dalam praktik peradilan ada beberapa persoalan yang bisa menimbulkan pemikiran yang berbeda-beda terkhusus bagi para Hakim di dalam memaknai asas ultra petita. Sehingga dalam hal ini hakim memiliki interpretasi dalam pelaksanaan asas ultra petita. Hakim dalam memberikan putusan harus mempertimbangkan tiap petitum dan posita para pihak, serta berpedoman pada peraturan perundang-undangan dan peraturan-peraturan internal peradilan di bawah Mahkamah Agung sehingga kedudukan ultra petita diperbolehkan karena yang diutamakan adalah keadilan, kemudian kemanfaatan setelah itu kepastian hukum.

Abstract

The Public Prosecutor holds a central role in the criminal justice system as the primary controller of the prosecution process. This authority is based on the fundamental principle of Dominus Litis, which literally translates to "master of the case." This paper aims to deeply analyze the implementation of the Dominus Litis principle and to examine the various interests underlying the Public Prosecutor's authority in controlling a criminal case. Using a normative juridical research method with a literature and conceptual approach, this study investigates how the principle legitimizes the prosecutor's power to determine whether a case is suitable for trial, to terminate it, or to resolve it through alternative mechanisms. The analysis reveals that the prosecutor's interest in case control is not merely limited to technical-juridical aspects but also encompasses broader considerations such as the public interest, law enforcement efficiency, and the achievement of restorative justice. While granting significant discretion, this absolute authority also raises discourse on the importance of effective oversight mechanisms to prevent potential abuse of power and ensure accountability. It is concluded that the implementation of the Dominus Litis principle must always be balanced with transparency and objectivity to ensure that case control by the prosecutor genuinely aims to achieve substantive justice

Abstract

This research aims to contribute to the development of criminal law policies addressing the widespread distribution of smartphone applications, both APK and iOS, that are used as tools for unauthorized online loan activities, online fraud, threats, and intimidation. These applications often disguise themselves as legitimate online loan platforms, wedding invitation apps, and parcel delivery services. Upon download, they illicitly debit mobile banking accounts or present themselves as government auction platforms for criminal goods at discounted prices, posing significant threats to consumers, debtors, and the general public. Theoretical framework: The foundation of this research lies in cyber law theory, which endeavors to create legal strategies to address cybercrimes and safeguard the digital community. This study utilizes a multidisciplinary approach, integrating legal analysis, policy assessment, and collaboration with stakeholders. Methods: This study utilized the normative juridical method to examine digital policies by criminalizing illegal smartphone applications through cyber law policies. This approach involves a systematic legal analysis of current regulations, assessing their effectiveness, and suggesting formal legal measures to address new threats posed by unauthorized applications, with an emphasis on protecting digital society from harm. Results and Conclusions: This indicates a pressing need for comprehensive criminal law policies specifically designed to effectively combat these unauthorized applications. Such policies are crucial in preventing and mitigating the harms caused by these applications before they impact society. The author's contribution lies in proposing formal offenses against the creators and disseminators of these applications. malicious applications, thereby bridging the current gap in legal measures to counteract digital criminal activities. Originality/Value: This research underscores the urgency of formulating and implementing cyber law policies to safeguard the public from the detrimental effects of illicit smartphone applications. Its originality lies in proposing innovative legal strategies to proactively address emerging digital threats.

Abstract

Diversi adalah pengalihan penyelesaian perkara anak dari proses peradilan pidana ke proses di luar peradilan pidana. Fokus permasalahan yang diangkat dalam tesis ini adalah Bagaimana penyelesaian perkara anak yang berkonflik dengan hukum melalui diversi ditinjau dari Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak dan Apakah syarat-syarat pelaksanaan diversi dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak memenuhi rasa keadilan bagi Anak yang berkonflik dengan hukum. Dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak di Indonesia, diversi merupakan salah satu mekanisme penyelesaian perkara anak yang berkonflik dengan hukum yang berfokus pada pemulihan dan reintegrasi anak, dengan melibatkan berbagai pihak terkait dan memperhatikan perlindungan hak-hak anak. Diversi bertujuan untuk mencegah penghukuman pidana yang berlebihan, memberikan kesempatan kepada anak untuk memperbaiki. Adanya syarat diversi yang kemudian memunculkan batasan terhadap pelaksanaan diversi dapat dikatakan tidak sesuai dengan konsep keadilan restoratif yang diadopsi dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Anak serta tujuan SPPA Yang mana nilai utama Keadilan Restoratif adalah penyembuhan, pemulihan keadaan dan bukan pembalasan, pembelajaran moral, pengampunan dan tanggung jawab dan tujuan SPPA yang dibuat untuk lebih melindungi Hak-Hak Anak baik sebagai pelaku maupun korban.

Abstract

The purpose of carrying out this journal is to find out that deforestation of mangrove forests in Kotabaru Regency carried out by the community is an environmental crime and they want to know the sanctions that can be imposed on perpetrators of mangrove forest deforestation in Kotabaru Regency which cause damage to the mangrove forest ecosystem. The results of this writing are that the act of deforestation of mangrove forests in Kotabaru Regency, South Kalimantan Province is caused by the local government's RTRWK inventory process being less than thorough because there are still mangrove forests that are included in residential areas and fisheries cultivation areas. Furthermore, the act of mangrove deforestation is a criminal act of environmental destruction because it pollutes and destroys the surrounding environment, destroying mangrove forests, and destroying the mangrove ecosystem. Normative research type, doctrinal legal research type using philosophical thinking by finding a concept, research approach, statutory approach, and conceptual approach. Prescriptive nature of research types and primary secondary and tertiary research. There are still mangrove forest plants based on the author's research which are located on the sea coast of Silver Street, Semayap Village, Kotabaru Regency which extends to the Semayap Village housing complex which is a residential area in the RTRWK Kotabaru Regency is located in a residential area, so the author can conclude that the regional government's inventory process in the RTRW process is not thorough enough and the need for the RTRWK to be revised again, as well as the sea coast area, city boundaries, the village of Stagen District. Kotabaru with the presence of fish and shrimp ponds included in the RTRWK for cultivation areas, the writer can conclude that the regional government inventory process in the RTRW process is not thorough enough and the RTRWK needs to be revised again so that the writer concludes that the local regional government is also responsible for the deportation carried out by residential business actors. and pond cultivation on the side of Silver Street, Semayap Village, Kotabaru Regency up to the Semayap housing complex as well as fish pond cultivation on the coast at the city limits of Stagen Village, Kec. North Sea Island District. new city. The current impact is that this location often floods when the sea water is at high tide. The act of deforestation of mangrove forests in Kotabaru Regency, South Kalimantan Province is an environmental crime. Sanctions that can be imposed on the perpetrators are Article 98 paragraph (1) of the Law of the Republic of Indonesia Number 32 of 2009 concerning Protection and Management of the Environment Article 35 Letter e of the Republic of Indonesia Law Indonesia Number 27 of 2007 concerning Management of Coastal Areas and Small Islands and article 73 letter b of Law of the Republic of Indonesia Number 27 of 2007 concerning Management of Coastal Areas and Small Islands and the regional government should be asked for criminal liability in article 112 and article 113 UUPPLH.
