Abstract

In industrial activities, the precautionary principle in protecting the environment is very important. This research examines how judges use the precautionary principle in making legal decisions in cases of environmental pollution. This research is a doctrinal qualitative with a normative juridical approach. Based on the research findings, the Panel of Judges in the decision of the North Jakarta District Court Number: 735/PDT.G-LH/2018/PN.Jkt.Utr determined that PT. HAYI has carelessly disposed of B3 waste from textile industry activities. In that decision, the Panel of Judges expanded the understanding of the Precautionary Principle, from the level of management and preventive policies to the level of repressive dispute resolution. The judge has also changed the Rio Declaration which is only morally binding to a hard law which is directly used as a source of law in deciding a case. This development is a paradigm shift in environmental justice from homocentric to ecocentric. In Islamic Law, the precautionary principle is related to the concept of ihtiyāth(prudence) and correlates with sadd al-dzarī'ah, namely the maximum effort to suppress everything that can be a means of prohibited things to avoid the amount of damage. Within the framework of Usul Fiqh, avoiding damage is a priority step rather than reaping benefits.

Abstract

Energy management is closely linked to environmental concerns and community involvement. However, in electrical energy regulations, community participation is frequently overlooked, with the community treated solely as a consumer. This study examines the legal system for community participation in environmentally friendly micro-hydro power plants. The research method used was qualitative, with a socio-legal approach. Data was collected through observation and in-depth interviews with purposefully chosen informants. The findings show that the legal system, in the form of legal substance, such as management rules and legal structures, is implemented in a participatory manner by the residents of Karangtengah and Lebakbarang villages. Community participation is critical to the success of the two villages' micro-hydro power projects, which earned them the provincial award for the best management of micro-hydro projects in Central Java. Community participation in this project is strong because the community has a legal culture characterized by cooperation, environmental friendliness, deliberation, and family values. Based on the level of participation, community involvement in the micro-hydro project is at the highest level, namely partnership, delegation of authority, and citizen control.

Abstract

This study aims to examine the influence of brand trust and price on consumers' purchasing decisions of Aqua bottled water in the Padalarang District. The research was motivated by a decline in Aqua’s market share in recent years, driven by growing competition and social issues that have shaped consumer perceptions. A quantitative method with a case study approach was employed, involving 100 respondents selected through purposive sampling. Data were collected using questionnaires and analyzed using multiple linear regression with the help of SPSS version 30. The results indicate that both brand trust and price significantly affect purchasing decisions, both partially and simultaneously. Brand trust had a positive effect with a coefficient of 0.182, while price showed a stronger influence with a coefficient of 0.342. The correlation coefficient revealed a strong relationship between the independent and dependent variables. Therefore, the company should enhance brand trust and implement competitive pricing strategies to maintain consumer loyalty amid intense market competition.

Abstract

This study described the resolution of religious and social conflicts in Bantarkawung, Central Java, Indoensia; its contributing factors and how they aligned with the Qur'an's perspective. This study employed a qualitative approach by conducting interviews with participants in conflict resolution. During the Covid-19 period from 2020 to 2021, we collected data. This study found that the local government and religious leaders resolved conflicts based on the culture of togetherness in religious rituals and social works, fostering interactions and adhering to consensus-based "rembugan" to accept differences in religious understanding, particularly regarding ?l?l-amr. In this region, conflicts were typically resolved through conciliation, with a conciliator initiating the process. Additionally, the conciliator actively devised and formulated resolution steps for the disputing parties. This resolution was a combination of ?ul? (reconciliation) and ta?k?m (arbitration), according to the Qur'an. However, this research had limitations; consequently, it is necessary to conduct similar studies in other regions of Indonesia with distinct characteristics from the research area. Comparative studies would also be useful with countries that share similarities with Indonesia, such as Malaysia, Brunei Darussalam, and Singapore and those that differ, such as Middle Eastern, Australian, American, and European nations.

Abstract

Management of Hajj funds for investment is a necessity that must be done to subsidize the shortage of costs for organizing the Hajj. This type of research is field research (field research) where researchers collect data directly from the field, the community, Bank MuamalatPurwokerto which is the object of research that studies intensively the background conditions that occur in accordance with the research theme. Furthermore, the place used for research was Bank Muamalat Purwokerto Branch and this research was conducted from December 20 2021 to November 20 2022. The approach used by researchers is a qualitative approach to measure data in terms of quality. The primary sources in this study were interviews with 10 customers who registered for the pilgrimage at Bank MuamalatPurwokerto and interviews with the leadership of Bank MuamalatPurwokerto, Mr. Bambang Haryonugraha. The secondary sources used by researchers were journals, books or others related to the research theme. The investment made by BPKH is a must because the contract used between the three parties is in accordance with the Shari'a and the resulting benefits can be felt by all parties, especially the prospective pilgrims.

Abstract

Purpose  –  The problem in Islam is that economic activity is closely related to contracts. Ijab and Qabul are the essence of the contract, namely the will of the offeror and the will of the recipient of the consent.Method –  This relates to research that explains the concepts of assembly and sighat views in contracts and their relevance to contemporary economic dynamics.Result – The results of this research show that the majlis and sighat in the contract have several meanings according to the views of four madzhab scholars, some of whom argue that ittihad al-majlis does not have to be united in one place, but rather the ijab and kabul are in one place, meaning the person who will do the ijab and the kabul does not have to be in one place and neither do the witnesses.

Abstract

In the era of the industrial revolution 4.0, as it is now, digitizing the banking and financial sector is important, considering that technological disruption has touched almost all aspects of life. In the world of investment and banking, the system used is already digital-based. The financial literacy level of the Indonesian people in 2022 will increase to 49.68%. This means that people are now smarter when it comes to choosing the financial products they will use. Currently, many financial institutions offer the advantages of each product by offering quite competitive returns. As an effort to increase public literacy, this study intends to compare the two financial products, namely mutual funds in seed applications and financial products at Bank Neo Commerce (BNC). The methodology used in this research is descriptive qualitative. The results of this study state that mutual funds and money savings at BNC both have advantages in terms of features and convenience. However, both have differences in the returns offered and the risks borne. Where digital banks offer greater returns with a lower level of risk. Interestingly, investment activities have the concept of compounding interest which has the possibility of obtaining much greater returns on the condition that the investment period is extended.

Abstract

This study aims to analyze the forms and roles of inter-stakeholder collaboration in efforts to increase community participation and independence in the management of the Mina Padi Tourism Village in Cilongok District, Banyumas Regency. The research approach used was descriptive qualitative, with data collection techniques including in-depth interviews, observation, and documentation studies. The stakeholders involved included the village government, tourism awareness groups (Pokdarwis), local communities, academics, and the private sector. The results show that the multi-stakeholder collaboration that has been established contributes to increased community participation in planning, implementation, and evaluation of agriculture-based tourism activities (rice). In addition, synergy among stakeholders encourages economic independence through strengthening community capacity, tourism product innovation, and business diversification based on local potential. However, this study also found that the sustainability of collaboration still faces challenges in coordination, role distribution, and consistency of support from external parties. Therefore, a more structured strategy is needed to strengthen networks and collaborative governance to ensure sustainable and competitive development of the Mina Padi Tourism Village.
