Abstract

This study seeks to elucidate the challenges associated with compensation in marine pollution disputes through the lens of the Alternative Dispute Resolution (ADR) model. Governed by UUPPLH Number 32 of 2009, polluters are mandated to provide compensation for both affected parties and environmental restoration. However, the implementation of the ADR model in practice has seen polluters compensating only the affected communities, notably fishermen. This research endeavors to develop an ADR legal framework that encapsulates ecological justice, ensuring fairness for both society and the environment. The methodology employed in this study is non-doctrinal legal research, which involves analyzing legal phenomena within their social and cultural context. Findings from this research indicate that pollution disputes in the waters in Cilacap were resolved using the ADR model, with a disproportionate focus on compensating fishing communities. This results in environmental damage due to minimal environmental ADR legal framework grounded in the Polluter Pays principle. Such a framework should encompass legal provisions for environmental prevention, mitigation, and restoration. From a structural perspective, it is imperative to foster integration and connectivity between the community and ministries responsible for addressing marine environmental pollution, to facilitate effective environmental mitigation and restoration efforts. Additionally, in the realm of legal culture, there is a crucial need to cultivate legal awareness among the public regarding environmental conservation and management. This awareness should permeate all levels of society, including business entities, legislative bodies, the government, and law enforcement agencies. A robust legal system is essential for making ADR an equitable mechanism for resolving disputes, benefiting both victims of pollution and the environment.

Abstract

This research aims to analyze the effect of the MSME financing, capital adequacy ratio, non-performing financing, and net operating margin on profitability with inflation as moderating variable in islamic banking in indonesian. The population used is the monthly financial statements of Islamic commercial banks for the period 2017-2021. With the saturated sampling technique, the number of samples was determined to be 60 months. The data is managed using moderated regression analysis (MRA). The findings show that MSME financing has no effect on profitability and capital has no effect on profitability. However, financing risk has a positive effect on profitability and net operating margin has a positive effect on profitability. Meanwhile, on the moderating variable, inflation can moderate MSME financing towards profitability. However, inflation cannot moderate capital, financing risk, and net operating margin on profitability.

Abstract

This article discusses the theory and dynamics of economic growth in Indonesia with a focus on comparative analysis between conventional and Islamic economic approaches. The period studied covers the years 2018 to 2023, during which both economic systems show significant developments in their contribution to national economic growth. Conventional economics, with key indicators such as Gross Domestic Product (GDP) and per capita income, focuses on the accumulation of capital, labour, and technology. In contrast, Islamic economics prioritises the principles of justice, social welfare and the prohibition of usury, which are realised through instruments such as ZISWAF (Zakat, Infaq, Sadaqah and Waqf) and sharia-based finance. Through a descriptive-analytical approach, this article identifies the advantages and challenges of both approaches. Conventional economics offers rapid growth but often faces problems of inequality and social exclusion. On the other hand, Islamic economics contributes to financial inclusion, economic equity and poverty alleviation, although it faces constraints in legal and regulatory infrastructure. The analysis shows that integration between the two approaches can provide a holistic solution for inclusive and sustainable economic growth in Indonesia, and support the achievement of the Sustainable Development Goals (SDGs).

Abstract

Polygamy regulations are designed to protect the interests of Muslim families; however, ironically, in some Muslim countries, these regulations have been associated with triggering domestic violence. This study aims to examine the legal politics of polygamy in Southeast Asian Muslim countries: Indonesia, Malaysia, and Brunei Darussalam using a legal pluralism approach alongside Qur'anic perspective. The methodology employed is qualitative with a descriptive-interpretative approach. The findings indicate that these three countries regulate polygamy through two reforms: intra-doctrinal reforms that accommodate religious and cultural norms and extra-doctrinal reforms encompassing legal frameworks, judicial systems, and institutional structures. Three main factors influence these legal policies: religious understanding, local traditions, and political and social dynamics. As ūlū al-amri (authoritative leaders), the governments of these countries are committed to regulating polygamy to benefit families and children by integrating Islamic values, local traditions, and colonial legal influences. These regulations align with the Qur'anic message that permits polygamy under certain conditions and strict requirements, aiming to achieve marital goals of tranquility (sakīnah), affection (mawaddah), and compassion (raḥmah). However, stricter supervision and substantive legal reforms are necessary to reinforce these requirements and impose sanctions on violators.

Abstract

Praktik penyaluran zakat padi kepada buruh panen di Desa Tanuharjo, Kecamatan Alian, Kabupaten Kebumen, menimbulkan pertanyaan terkait kesesuaiannya dengan ketentuan syariat Islam, terutama menurut pandangan Wahbah Az-Zuhaili dan Yusuf Qardhawi. Buruh panen di desa tersebut umumnya bekerja secara musiman dengan penghasilan tidak tetap, di bawah standar upah minimum, serta belum mampu memenuhi kebutuhan pokok sehari-hari. Penelitian ini bertujuan untuk mengkaji status buruh panen sebagai penerima zakat padi dan menilai keabsahan praktik penyalurannya berdasarkan perspektif kedua ulama tersebut. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kepustakaan, yakni pengumpulan dan analisis data dari berbagai sumber literatur seperti buku, jurnal, dan karya ilmiah. Hasil Penelitian menunjukan bahwa menurut Yusuf Qardhawi dan Wahbah Az-Zuhaili, buruh panen di Desa Tanuharjo termasuk golongan fakir dan miskin yang berhak menerima zakat, karena penghasilan mereka rendah, bersifat musiman, dan tidak mencukupi kebutuhan pokok. Penyaluran zakat padi kepada buruh panen dinilai tepat untuk membantu memenuhi kebutuhan dasar dan mengurangi ketimpangan sosial, bahkan Wahbah Az-Zuhaili mendorong agar zakat dikelola secara produktif guna meningkatkan kesejahteraan ekonomi mereka secara berkelanjutan.Kata Kunci:  Praktik, Zakat Padi, Buruh Panen, Wahbah Az-Zuhaili, Yusuf al-Qardhawi

Abstract

The carbon trading mechanism as stipulated in the Minister of Environment and Forestry Regulation No. 21 of 2022 is understood as the buying and selling of carbon emission credits that exceed the threshold. In the eyes of Islamic law, carbon trading can be considered as buying and selling, but it does not seem to be fully appropriate. This study aims to analyze how carbon trading is considered as ta'wid (compensation) in the carbon trading mechanism in Permen LHK No. 21 of 2022. Using a normative approach, this research examines the provisions in the Minister of Environment and Forestry Regulation No. 21 of 2022 by comparing it with the concept of ta'wid in Islamic law. The results show that the sale and purchase referred to in Ministerial Regulation No. 21 of 2022 is understood as the sale and purchase of carbon emission credits that exceed the threshold, a concept that in the framework of environmental law is known as the Polluter Pays Principle. Companies that release carbon must pay losses to carbon sinks or have residual carbon, this can be seen as a form of compensation or indemnity related to environmental damage that harms society. Thus, the view that carbon trading as a ta'wid is in line with both sharia economic law and environmental law.

Abstract

The mechanism for the practice of gold pawn arisan at sharia pawnshops is increasingly rapid and in great demand, however this is the subject of a new problem in the concept of the application of prepaid rent which is set for the gold pawn arisan products offered. This research aims to understand how Islamic law views the status of down payments in pawn gatherings at the Purwokerto Syariah Pegadaian. The results of this research explain the issues of Sharia economic law on gold pawn products. The problem occurs with the provision of money being paid in advance. Basically, social gathering is a social system that leads to friendship within neighbors and between families. In Islamic Law, debt and receivables are a form of muamalah which is characterized by ta'awun (help) to other parties to meet their needs. Therefore, in this context, someone who provides debt must not take advantage of the goods owed. Debtors may not accept gifts or other benefits from debt borrowers. The money is paid in advance on the guarantee of a gold pawn gathering, which if you intend to help, you should be sincere and not impose additional burdens on returns, but there are business practices. This creates a bad image for Sharia banking if the down payment provisions become a negative thing in Sharia economic law.

Abstract

Artikel ini mengkaji Pemikiran Hukum Islam dalam perlindungan dan pengelolaan lingkungan hidup pada kultur pemerintahan daerah. Di era otonomi daerah kepedulian terhadap perlindungan dalam pengelolaan lingkungan menjadi sangat berkurang karena kepentingan ekonomi (peningkatan PAD) lebih dominan dari kepentingan  perlindungan lingkungan. Salah satu penyebab hal ini adalah pandangan anthroposentris dan kapitalis yang menganggap manusia sebagai penguasa alam, sehingga alam dieksploitasi untuk kepentingan hidupnya.  Manusia merupakan bagian tak terpisahkan dari alam (deep ecology) yang mempunyai peran dan posisi khusus sebagai khalifah, pelindung dan pengelola alam dengan penuh tanggung jawab. Pemerintahan daerah yang menjalankan prinsip-prinsip deep ecology sebagaimana prinsip-prinsip hukum Islam dalam perlindungan dan pengelolaan lingkungan hidup akan mampu mewujudkan keadilan ekologi.

Abstract

Resolution of disputes by way of litigation always takes a long time, expensive and results in a win and lose solution. Therefore resolution outside the court( non-litigation) is an alternative choice. This study analyses the resolution of insurance disputes using several methods or models outside the Court. This research is non-doctrinal legal research, with a socio-legal approach. It analyses a settlement model used by of Life Insurance AJB Bumiputera Purwokerto in the event of default of the insured/customer premium and the customer’s insurance claim against the company. The settlement involves several stages, first, by means of consultation and negotiation, second by means of mediation involving OJK (Financial Services Authority) as a neutral mediator, and the last, by means of conciliation and arbitration. In the perspective of Islamic law, this solution model is similar to the concept of sulh, a type of disputes resolution in which the conflicting parties drive to settle their dispute peacefully.

Abstract

This study discusses the implementation of the Polluter Pays Principle in Law Number 32 of 2009 regarding Environmental Management and Protection and relates it to Islamic Law. This research is normative juridical research, a study conducted to find legal rules, legal principles, and legal doctrine in order to address legal issues. This research finds that Law Number 32 of 2009 concerning environmental pollution and destruction contains the Polluter Pays Principle which is indicated by the affirmation that compensation does not only cover environmental restoration measures but also includes providing compensation to victims of pollution. The Law also regulates that responsibility for the perpetrators of pollution is instantaneous at the time of the occurrence of adverse action and not necessarily to be associated with an element of error. The application of this principle is in accordance with the Islamic law principles which explicitly state that environmental damage and pollution are included in actions prohibited by Allah. It's only that Islamic law does not specifically regulate the legal sanctions, but leaves it up to government policy (ta'zir).
