Abstract

Law enforcement is a process to translate the wishes of the law into reality. The law enforcement process will culminate in the implementation of laws and regulations by the law enforcement officers themselves. Law enforcement agents in the Indonesian public criminal justice system include: Police, Prosecutors, Judges, Lawyers, and Penitentiaries. Meanwhile, law enforcement agents in the Indonesian armed forces criminal justice system include: Military Judges, Military Prosecutors, Military Police, Military Defense Attorneys, and Military Penitentiaries. Elucidation of Article 57 of Law Number 31 of 1997 stipulates that the Military Prosecutor General in performing prosecution function shall be responsible to the Attorney General of the Republic of Indonesia as the highest public prosecution service in the State of the Republic of Indonesia through the Commander-in-Chief, while in performing duties to develop the Military Prosecution Service, shall be responsible to the Commander-in-Chief. Although the Law Number 31 of 1997 has governed the relationship between the Military Prosecutor General and the Attorney General in performing their duties in technical prosecution function, but in the practice, those duties have not been performed as mandated by a statutory law. Keyword: Law Enforcement in Prosecution Function

Abstract

Problem hukum termuat dalam proses pembentukan Pembentukan Undang-Undang Republik Indonesia Nomor 11 Tahun 2020 Tentang Cipta Kerja. Kritikdari masyarakat bermunculan pasca draft rencana undang-undang itu diusulkan keDewan Perwakilan Rakyat dan telah diundangkan, karena ada beberapakekeliruan didalam proses pembentukan. Penelitian ini akan mengkaji prosespembentukan Undang-Undang Cipta Kerja dilihat dari Asas-Asas PembentukanPeraturan Perundang-undangan Yang Baik sebagaimana dimaksud dalamUndang-Undang Republik Indonesia Nomor 12 Tahun 2011 tentang PembentukanPeraturan Perundang-undangan. Adapun metode yang digunakan adalah normatifdan pendekatan kasus. Abstract

The tender process at the Ministry of Transportation uses an Electronic Procurement System (SPSE) and a supporting system where the final results in the application tendered by the Selection Working Group are only in the form of Minutes of Election Results (BAHP), which are then reported to the Commitment Making Officer (PPK). to be followed up in the form of a Letter of Appointment of Goods/Services Provider (SPPBJ) whether to accept the results of the Working Group or reject it. In the process of determining this, it turned out that there was a legal debate which resulted in legal uncertainty where the Selection Working Group's determination was in the form of BAHP as the result which was used as the object of the lawsuit. Meanwhile, the opinion of the other panel of judges is inversely proportional to the BAHP issue as the object of this dispute. Apart from that, administrative efforts before filing a lawsuit were also a problem where some of the Panel of Judges passed the dismissal stage and some did not. From the results of the study it was found that the determination of the object of dispute state administrative decisions on the procurement of government goods/services, especially at the Ministry of Transportation of the Republic of Indonesia, was normatively in the basic regulations regarding Government Procurement of Goods/Services, showing the decision to determine the winner of the Working Group in the form of BAHP even though it required approval with PPK can be used as th e object of dispute in disputes over state administrative decisions. In addition, the results also show that the explanations and decisions at the State Administrative Court, the administrative e arrangements for the procurement of goods/services are objections and appeals and a guarantee of 1% (one percent). Abstract

Indonesia merupakan salah satu negara yang berkembang dan memiliki jumlah penduduk terbesar di dunia. Untuk memberikan kesejahteran kepada masyarakat, pemerintah Indonesia berusaha menyediakan lapangan kerja seluas-luasnya. Tetapi saat ini lapangan pekerjaan yang tersedia belum mencukupi jumlah angkatan kerja Indonesia. Oleh sebab itu, untuk memenuhi kebutuhan hidupnya, banyak Warga Negar Indonesia mencari pekerjaan diluar negeri. Hal ini telah menjadi perhatian bagi pemerintah Indonesia mengingat banyaknya Warga Negara Indonesia bekerja secara ilegal dan menjadi korban penyeludupan orang di luar negeri. Penulis melakukan penelitian terkait tinjauan yuridis pencegahan pemberian Paspor Republik Indonesia kepada Pekerja Migrasi Nonprosedural dengan modus berprofesi sebagai pelaut. Metode penelitan yang digunakaan metode pendekatan peraturan perundang-undangan. Penulis melakukan tinjauan hukum terkait peraturan perundang-undangan yang berlaku untuk melakukan upaya preventif pencegahan Pekerja Migran Indonesia Nonprosedural.

Abstract

There are two main problems in this research, first regarding the impact of the emergency, in this case the Covid-19 pandemic, on the implementation of passport issuance services at the TPI Tanjung Priok Class I Immigration Office. Second, regarding the obstacles faced during the implementation of passport issuance services in an emergency (Covid-19 pandemic) at the TPI Tanjung Priok Class I Immigration Office. This research is a descriptive qualitative research, which means that the data collected is not in the form of numbers, but rather the data comes from interview texts, field notes, personal documents, and other official documents. The data collection method used in this research is triangulation, namely, literature study, interviews, and observation. The results of this study indicate that the Covid-19 Pandemic has an impact on public services, especially in the service of issuing passports at the TPI Tanjung Priok Class I Immigration Office. The government issued a Large-Scale Social Restriction policy to prevent the transmission of Covid-19. This policy is also supported by the Director General of Immigration regarding a Circular regarding Limitation of Immigration services, people must be able to adapt through changes in lifestyle in the Covid-19 situation which is called the New Normal Period. So in this case the issuance of a Circular on the Implementation of Immigration Duties and Functions in the New Normal Order Period. There were several obstacles in implementing passport issuance services during the Covid-19 pandemic at the TPI Tanjung Priok Class I Immigration Office.

Abstract

Etnis Rohingya datang ke Indonesia sebagai pencari suaka dimana status mereka adalah stateless person. Apabila para pencari suaka memiliki anak yang lahir di Indonesia, berdasarkan pasal 4 huruf i dan k Undang-Undang Nomor 12 Tahun 2006, anaknya merupakan Warga Negara Indonesia, tetapi tidak ada bukti tertulis berupa dokumen kependudukan yang dapat diperoleh bagi anak dari orang tua berstatus stateless person. Dengan tidak adanya bukti tertulis, berakibat pada tidak dimungkinkannya menerbitkan paspor bagi anak, padahal kepemilikan paspor merupakan salah satu hak bagi seorang warga negara. Penelitian ini menggunakan metode normatif, yaitu mengkaji ketentuan-ketentuan hukum dan menarik asas-asas hukum yang ada dalam masyarakat serta apa dampak dan akibat yang timbul dari ketentuan hukum tersebut dalam kehidupan masyarakat. Dari undang-undang maupun peraturan-peraturan pendukung undang-undang dapat terlihat bahwa di Indonesia sudah diatur mengenai status kewarganegaraan anak dari orang tua berstatus stateless person tetapi tidak ada aturan dalam bentuk undang-undang ataupun peraturan lain yang mengatur mengenai bentuk dokumen tertulis kependudukan atau kewarganegaraan untuk kondisi seperti ini. Tidak adanya dokumen tersebut maka prosedur penerbitan paspor tidak dapat terpenuhi sehingga pemenuhan hak seseorang untuk memiliki paspor tidak dapat dilakukan.

Abstract

The purpose of the study is to get an idea of the implementation of firearms use for immigration officers using empirical normative-research methods with a constitutional approach, and a qualitative approach. Result of research has shown that immigration officer, and the civil servant investigator of immigration are the examples of law enforcement officer who have threat in carry out their duties. Therefore, allowed to be equipped with firearms in the performance of his duties as a martial arts device. But, facts in the immigration office (class I) of Tanjung Priok were found that there had been no use of firearms by immigration staff particularly immigration officers, and the civil servant investigator of immigration in performing duties of immigration law enforcement. As a fact there's only one person in the field who has a licensed for ownership firearms. The obstacle faced by immigration officers, and the civil servant investigator of immigration in the use of firearms, namely There is no chief of immigration office policy yet on which to plan the use of service firearms, There is no rule review of the service firearms ordinance in the Directorate General of Immigration, There are no have qualifications immigration officer and the civil servant investigator of immigration yet, are supported to have a permit, and the use of firearms, And facilities for storage, as well as the treatment of firearms.

Abstract

In Indonesia's constitutional system, the Regional Representative Council (DPD) plays a crucial role in representing regional interests. The legislative function of the DPD is explicitly regulated under Article 22D of the 1945 Constitution (third amendment). Although the DPD is granted the authority to propose and provide considerations on certain bills, the main issue lies in the limited scope of its authority, which does not include the final decision-making power in the legislative process. The theories employed in this study are the theory of legal politics and the theory of the constitution.The type of research in this study is categorized as normative or doctrinal legal research, involving a statutory approach and an analytical approach. The legal materials used are sourced from secondary data, comprising primary legal materials, secondary legal materials, and tertiary legal materials, collected through a literature review. The data analysis in this legal research employs a qualitative approach.The research findings indicate that the regulation of the DPD in the 1945 Constitution, the MD3 Law, and the P3 Law highlights its strategic role in proposing and providing input on bills related to regional interests, despite its limited authority often being overshadowed by the dominance of the House of Representatives (DPR). For instance, the MD3 Law, particularly Article 122, weakens the legislative function of the DPD by regulating the tasks and powers of the DPR without allocating adequate participation for the DPD in the legislative process. Furthermore, legal policy through Constitutional Court Decision No. 92/PUU-X/2012 has strengthened the legislative role of the DPD by recognizing its equal standing with the DPR and the President in proposing, discussing, and providing views on bills, particularly those concerning regional autonomy, central-regional relations, and fiscal balance, ensuring that national policies are more equitable and inclusive

Abstract

DPD sebagai representasi kepentingan daerah keberadaannya sangat signifikan dalam sistem ketatanegaraan Indonesia. Kedudukan DPD diakomodir dalam UUD NRI Tahun 1945. Dalam perkembanganya kewenangan DPD sebagaimana diatur dalam Pasal 22D UUD NRI Tahun 1945 menunjukkan bahwa peran DPD terbatas sebagai co-legislator dari DPR. Dalam penelitian ini, penulis menggunakan teori pembagian kekuasaan negara dan teori kewenangan.Penelitian ini dilakukan dengan pendekatan yuridis normatif. Dari sekian banyak pendekatan dalam penelitian hukum, penulis memilih untuk menggunakan pendekatan undang-undang (statute approach), pendekatan komparatif (comparative approach), dan pendekatan konseptual (conceptual approach). Selain itu, penelitian ini dilakukan dengan mengkaji bahan pustaka atau data sekunder, yang meliputi bahan hukum primer, bahan hukum sekunder, dan bahan hukum tertier. Data tersebut dikumpulkan melalui penelitian kepustakaan (library research) dan hasilnya dianalisis menggunakan metode deskriptif kualitatif.Hasil penelitian ini menjelaskan bahwa kedudukan DPD dalam sistem parlemen bikameral di Indonesia diatur dalam UUD NRI Tahun 1945, khususnya Pasal 22C dan 22D, yang menegaskan perannya sebagai perwakilan daerah dengan kewenangan terbatas dalam legislasi dan pengawasan. Undang-Undang Nomor 17 Tahun 2014 jo. Undang-Undang Nomor 13 Tahun 2019 mengatur sembilan kewenangan DPD, yang kemudian diuraikan menjadi sebelas kewenangan dalam Peraturan DPD Nomor 2 Tahun 2024. Namun, DPD masih menghadapi kendala dalam menjalankan fungsinya sebagai kamar kedua dalam sistem legislatif, terutama karena keterbatasan kewenangan yang diberikan oleh konstitusi, sehingga perannya lebih bersifat sebagai dewan pertimbangan DPR. Selain itu, rekonstruksi kewenangan DPD dalam sistem parlemen bikameral di Indonesia perlu dilakukan dengan memberikan kewenangan yang seimbang dengan DPR, khususnya dalam legislasi, pengawasan, dan anggaran. Ketimpangan yang terjadi akibat sistem bikameral asimetris, di mana DPR memiliki kewenangan lebih dominan, membuat mekanisme checks and balances kurang efektif, terutama dalam pengawasan kebijakan yang berdampak pada daerah. Oleh karena itu, penguatan DPD melalui keseimbangan kewenangan menjadi langkah penting untuk meningkatkan efektivitas sistem parlemen bikameral di Indonesia.

Abstract

The phenomenon of abuse of power in government procurement of goods and services often occurs due to opportunities arising from weaknesses in the system of oversight and internal control. State officials involved in this process often exploit their positions and authority to gain personal or group benefits. Abuse of power by state officials in the procurement of goods and services is one form of corruption that has serious consequences for national development. The theories employed in this study are the theory of law enforcement and the theory of legal certainty.This research is a normative law research utilizing the statute approach, case approach, and conceptual approach. The types and sources of legal materials used in this research are categorized into three groups: primary legal materials, secondary legal materials, and tertiary legal materials. To obtain relevant materials for the discussion in this paper, the author used library research techniques, analyzed through a normative approach (descriptive-qualitative).The research findings indicate that the authority of state officials in the procurement of government goods and services is regulated in the Penal Code (Articles 209, 415, 417, and 421), as well as other legislative regulations such as Article 3 of Law Number 31 of 1999 jo Law Number 20 of 2001, and Presidential Regulation Number 16 of 2018 jo Presidential Regulation Number 12 of 2021, to prevent abuse of office for personal gain. Law enforcement against state officials who abuse their authority in procurement should be carried out fairly, transparently, and decisively to prevent corruption that harms the state. Deviations such as collusion, bribery, and abuse of office often occur due to weak oversight and a corrupt bureaucratic culture. The imposition of criminal sanctions based on Law Number 31 of 1999 jo Law Number 20 of 2001 as a last resort (ultimum remedium) aims to create a deterrent effect and ensure legal certainty.
