Abstract

This article aims to answer why the tiger dance in Kerinci Regency, Jambi Province, has not developed widely despite being preserved for more than 30 years and becoming a popular dance in Jambi Province. Qualitative research methods were used to carry out this study. In-depth interviews and uninvolved observation of the artists’ activities were used to collect the data. The analysis focused on the development of the tiger dance and the preservation discourse created by the artists and residents of Pulau Tengah Village. This study discovered that the extinct Ngagoah Imo ritual was transformed into the tiger dance. The “tiger man” myth, which the Kerinci people still hold dear, forms the basis of the tiger ritual and dance. Initially, the tiger dance was not sacred but was made sacred due to encouragement from various parties. Because of its uniqueness, the tiger dance soon became popular in Jambi and became a cure for the longing of the Kerinci people for the Ngagoah Imo ritual. Realizing the potential of tiger dance as an economic resource and as Kerinci’s regional identity, the artists then created a discourse of property rights over tiger dance. They prohibited other villagers from learning or imitating it. This discourse is slowly making tiger dance endangered because it is only controlled by a small group of artists. Such a discourse on cultural property rights needs to be straightened out. Apart from being contrary to the dynamic character of Malay culture, it is also contrary to various principles of cultural preservation.

Abstract

At the end of the 19th century from the Riau Lingga Kingdom appeared a number of scholars, such as King Ali Haji, Raja Ali Kelana, King Khalid Hitam, and a number of other names who settled on Penyengat Island. The majority of these scholars are from the nobility of Riau Lingga Kingdom and are of Bugis blood. At the beginning of the 20th century, there appeared a Malay cleric of noble Riau Lingga Kingdom named Tengku Muhammad Saleh (TMS) who settled on Lingga Island, the area that became the center of Riau Lingga Kingdom in 1787-1900. This paper examines the biography of Tengku Muhammad Saleh (TMS): The Last Generation Ulama of Riau Lingga Kingdom 1901-1966. From the research, it was concluded that TMS was a nobleman and cleric of the Riau Lingga Kingdom who was anti- the Dutch government. Resistance against the Dutch was carried out through criticism through writing and also rejected positions in the government of the Riau Lingga Kingdom. He was arrested by the Dutch because he was considered a Japanese spy and taken to Batavia but was able to escape. During the Japanese occupation, TMS was appointed as a judge of the Sharia Court in Lingga. TMS's formal education is not high, but his figure is highly respected because he gave birth to a number of works, including the book Nur al Salah which is currently taught in mosques in Lingga. A figure of Hamka's caliber had come to Lingga to meet TMS in 1957. He actively preached from the islands and settled in his hometown.

Abstract

This article examines the legal liability of e-commerce platforms for selling counterfeit trademark products in Indonesia. The problem focuses on the extent of responsibility e-commerce platforms hold under Indonesian trademark law, particularly Law Number 20 of 2016 on Marks and Geographical Indications and Law Number 28 of 2014 on Copyrights. A statutory approach is used as a theoretical reference to approach this problem. The data is collected by qualitatively analyzing relevant legislation and policies. The study results show that the Trademark Law in Indonesia has not regulated the sale of products using counterfeit brands in e-commerce. The Copyright Law in Indonesia only regulates that the manager of a trading place can be held accountable if a sale of products violates copyright. In contrast, the Trademark Law does not restrict this. So that confusion arises: can the organizer of an electronic system in online buying and selling be held civilly liable if their e-commerce site provides products using counterfeit brands.
