Abstract

Village Government has a very significant role in managing social processes in the society. The purpose of this research is to examine the process of village regulations making in Kuningan District and the effectiveness of the Village Consultative Body (BPD) in implementing legislative function. The method used in this research was a juridical-empirical research method. A rational analysis based on juridical references was then conducted through literature and field research. The results showed that the Village Consultative Body as a legislative institution at the lower level has an important role in establishing government legal products to realize checks and balances system and accommodating the society’s aspirations. Normatively, the establishment of village regulations in Sukaharja village is not running properly, and in its implementation, the establishment of village regulation in Sukaharja has not fully contained the principles of good regulations making based on Law Number 12 of 2011 concerning Establishment of Legislation. In its process, there are some stages which are not implemented by both village head and BPD so that the regulation is less effective for the society. The Village Consultative Body has three main functions, namely legislation, supervision, and aspiration. Here, the Village Consultative Body is still less effective in implementing those three functions, especially the legislative function. It can be seen from the period of 2010-2015 in which the legal products produced by the BPD are very low, whereas there are many provisions that should have a legal umbrella in order to create legal certainty for the society. This situation happens because there is a lack of human resources in forming the village regulation draft, and the village government does not understand what the contents of the village regulations that should have a legal umbrella in village regulations making.Pemerintah Desa memiliki peran yang sangat signifikan dalam pengelolaan proses sosial di dalam masyarakat. Tujuan penelitian ini adalah untuk mengetahui dan mengkaji bagaimana proses pembentukan peraturan desa di Kabupaten Kuningan dan evektifitas Badan Permusyawaratan Desa dalam menjalankan fungsi legislasi. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian yuridis-empiris selanjutnya dilakukan analisa rasional berdasarkan acuan yuridis melalui penelitian kepustakaan dan lapangan. Hasil penelitian bahwa Badan Permusyawaratan Desa merupakan lembaga legislatif di tingkat bawah yang mana memiliki peranan penting dalam pembentukan produk hukum pemerintahan desa untuk mewujudkan sistem check and balences dan penyambung lidah masyarakat dalam menyampaikan aspirasi. Secara normatif pembentukan perdes di desa Sukaharja belum sesuai, namun dalam tarap implementasinya dalam pembentukan peraturan desa di desa Sukaharja belum sepenuhnya memuat asas-asas pembentukan peraturan yang baik menurut Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan. Dalam prosesnya masih terdapat tahapan-tahapan yang tidak dijalankan baik oleh kepala desa maupun BPD, sehingga peraturan tersebut kurang berdaya guna bagi masyarakat. Badan Permusyawaratan Desa memiliki tiga fungsi yaitu legislasi, pengawasan, dan menampung aspirasi masyarakat. Dalam menjalankan fungsi legislasi tertutama dalam hal ini masih kurang efektif dilihat dari kurun waktu tahun 2010-2015 produk hukum yang dihasilkan oleh BPD sangat rendah, seyogianya banyak ketentuan yang harus dibuatkan payung hukum agar terciptanya kepastian hukum bagi masyarakat setempat. Hal tersebut terjadi karena masih minimnya sumber daya manusia dalam menyusun draf rancangan perdes, serta pemerintah desa belum memahami apa saja materi muatan dari  peraturan desa yang harus dibuat payung hukum dalam pembuatan perdes.

Abstract

The study aims to examine the Regional Head authority in the regional autonomy and to investigate the authority relationship between the Regional Head authority and his Deputy from legal and political perspectives. This study employed a doctrinal research method involving legal material sources (the laws and regulations), court decisions/judgments, legal theories, and scholars' perspectives. The findings revealed the Regional Head authority is clearly stated in Article 65 of Law Number 9 of 2015 concerning Regional Government, such as to lead the implementation of government affairs–the regional authority based on the laws and policies established with the DPRD, to maintain public peace and orderliness, and to compile and to submit regional regulations draft. Normatively,  the Regional Head and his Deputy have their respective duties, the authority relationship. In this case, the Deputy Regional Head assists the Regional Head in the governance to acquire the fullest services for the community. In short, in terms of authority, the Regional Head is an extension of the President-- the full holder of goverment power. In terms of the authority relationship, different opinions between the Regional Head and his Deputy are frequently occurred as in the political views

Abstract

This study aims to determine the regulation of converting agricultural land into housing and the suitability of its implementations. This study employed a juridical empirical approach which is a research done by looking at and paying attention to applicable legal norms associated with existing facts from the problems encountered. In this case,  the local government policies on converting agricultural land into housing. The findings revealed the perpetrators of the land conversion process that occur in Kuningan Regency are the landowners. Some of the causes are: social, economic, population density, and the lack of socialization of Law Number 41 of 2009. Efforts made by local government officials and related agency officials to realize sustainable food land protection are still limited to carrying out their main duties and functions. The guideline in controlling the use of space, licensing and controlling mechanisms for the implementation of development, stated in the Regional Regulation of Kuningan Regency Number 26 of 2011 on regional Spatial Planning and Regulation of the Head of the National Land Agency Number 2 of 2011 concerning guidelines for technical land considerations in controlling location permits and determining locations and permits for changes in land use. The study concluded that converting the function of agricultural land to non-agriculture in Kuningan Regency is carried out by the landowner. In addition, efforts made by local government officials and related agency officials to realize sustainable food land protection are still limited to carrying out their main duties and functions. Accordingly, it is necessary to socialize Law Number 41 of 2009 on Protection of Sustainable Food Agricultural Land and Regional Regulation of Kuningan Regency Number 26 of 2011 concerning Regional Spatial Planning continuously to the community level. Furthermore, local governments need to coordinate with the village officials to monitor the use of agricultural land and the development of housing areas. This can be done by providing socialization to village officials.

Abstract

The present study aims to identify the regulations on the conservation of natural resources and their impact on community welfare. This study applied an empirical juridical approach. The primary and secondary data used in this study were collected through interviews, observation, and literature study. As results, it can be identified that fish conservation in Indonesia is regulated by various laws and regulations, including Law on Fisheries, Law on Environmental Protection and Management, Government Regulation on Conservation of Fishery Resources, Government Regulation on Fish Farming, Regulation of the Minister of Environment and Forestry on Recognition and Protection of Local Wisdom in the Management of Natural Resources and Environment, Regional Regulation on Implementation of Tourism, Regional Regulation on Preservation of Local Culture, as well as Regional Regulation on Conservation of Birds and Fish which give the authority to Kuningan District Regional Government in the conservation of ‘god fish’. The conservation of ‘god fish’ based on local wisdom of ‘pamali’ is in the form of prohibition on damaging the spring in Cibulan Tourist Attraction and prohibition on disturbing ‘god fish’. To conclude with, the conservation of natural resources, especially ‘god fish’, through water-based tourism management has positive implications for community welfare.

Abstract

As the main source of local revenue, tax has a very atrategic role for the continuity of development today. Therefore, tax should be managed well and properly. Although problem of general parking has been discussed repetedly, there is no obvius solution to the this problem. The problem of existence of parking on-street generally located in the center of a crowded placa accours because many owners of shopping centre do not provide parking area for vistors. The objective of the research is to know and reviewthe authority of Dispenda in the parking management, the tax management of parking tax by Dispenda and its influence to the increace of the regional income, and the obstacles found in the parking management. The research used by the wraiter in the paper is descriptive analysis, that is illustrating the data concerning a matter that is in progress at a certain place and at a certain time and then it is analyzed. The method is juridical normative method, that is the methode using source of secondary data date consists of legal rule ordered hierarchically: 1945 Constitution, laws, government regulation, and other rule under the law. Secondary legal material is legal material obtained from taxs books, foreign journals, opinions of scholars, legal case. Tertiary legal material is legal material that provides instructions or explanations to the primery or secondary legal materials, such as legal dictionary and encyclopedia. The result of the research shows that Dispenda does not have the authority to determine the amount of parking tariff managed by the privat sector. The management of parking tax is in accordance with applied regulations and it is effective. The obstacles found in parking management are the limitide parking area, the messy parking, and the parking arrangement that is not professional.  Key word : Authority, Management, Tax parks

Abstract

This research aims to analyze the regulation of Civil Servant Investigator based on Regional Regulation No. 6 of 2005 and the implementation of Regional Regulation No. 6 of 2005 concerning Regional Civil Servant Investigator at Office of Kuningan District Civil Service Police Unit. This descriptive-analytical research applied a normative juridical approach. The results showed that based on Regional Regulation No. 6 of 2005, Regional Civil Servant Investigator has the duties of conducting investigation on violations of Regional Regulations in which each Regional Civil Servant Investigator must be equipped with an investigation warrant signed by the supervisor of the Regional Civil Servant Investigator in conducting the investigation. Besides, Regional Civil Servant Investigator also has the duties of providing coaching which includes general, technical, and operational coaching for Civil Servant Investigator. Further, regarding the implementation of Regional Regulation No. 6 of 2005 concerning Regional Civil Servant Investigator at Office of Kuningan District Civil Service Police Unit, the Regional Civil Servant Investigator generally has carried out its duties in conducting investigation and inspection towards illegal buildings, places of business and business activities; conducting investigation and inspection towards community, apparatus or legal entities violating regional regulations, head district regulations, and head district decisions; and preparing material to be submitted to the National Police regarding follow up actions towards community, apparatus or legal entities violating regional regulations, head district regulations, and head district decisions. Thus, it can be concluded that, in general, Regional Regulation No. 6 of 2005 concerning Regional Civil Servant Investigator at Office of Kuningan District Civil Service Police Unit has been implemented well.Tujuan penelitian ini yaitu untuk mengetahui Penyidik Pegawai Negeri Sipil berdasarkan Peraturan Daerah Nomor 6 Tahun 2005 dan implementasi Peraturan Daerah Nomor 6 Tahun 2005 tentang Penyidik Pegawai Negeri Sipil Daerah di Kantor Satpol Polisi Pamongpraja Kabupaten Kuningan. Spesifikasi penelitian yang digunakan adalah penelitian bersifat deskriptif-analitis dengan pendekatan yuridis normatif. Hasil penelitian menunjukkan bahwa pengaturan Penyidik Pegawai Negeri Sipil berdasarkan Peraturan Daerah Nomor 6 Tahun 2005 dijelaskan bahwa Penyidik Pegawai Negeri Sipil Daerah mempunyai tugas melakukan penyidikan atas pelanggaran Peraturan Daerah; setiap Penyidik Pegawai Negeri Sipil Daerah dalam menjalankan tugas penyidikan harus dilengkapi dengan surat perintah penyidikan yang ditanda tangani oleh atasan Penyidik Pegawai Negeri Sipil Daerah; serta pembinaan terhadap Penyidik Pegawai Negeri Sipil meliputi: pembinaan umum, pembinaan teknis, dan pembinaan operasional. Selanjutnya implementasi Peraturan Daerah Nomor 6 Tahun 2005 tentang Penyidik Pegawai Negeri Sipil Daerah di Kantor Satpol PP Kabupaten Kuningan secara umum Penyidik Pegawai Negeri Sipil Daerah telah melaksanakan penyelidikan, penyidikan, dan pemeriksaan terhadap bangunan, tempat-tempat usaha dan kegiatan usaha tanpa izin; melaksanakan penyelidikan, penyidikan, dan pemeriksaan terhadap masyarakat, aparatur atau badan hukum yang melakukan pelanggaran atas peraturan daerah, peraturan bupati, dan keputusan bupati; dan menyiapkan bahan koordinasi kepada Keolisian Negara mengenai tindak lanjut berita acara pemeriksaan warga masyarakat, aparatur atau badan hukum yang melakukan pelanggaran atas peraturan daerah, peraturan bupati, dan keputusan bupati. Kesimpulan penelitian yaitu implementasi Peraturan Daerah Nomor 6 Tahun 2005 tentang Penyidik Pegawai Negeri Sipil Daerah di Kantor Satpol Polisi Pamongpraja Kabupaten Kuningan secara umum sudah dilaksanakan dengan baik.

Abstract

Dalam melakukan penelitian ini, peneliti mengambil tema tentang “Kewenangan BPD (Badan Permusyawaratan Desa) dalam Menjalankan Fungsi Legislasi Sebuaah Telaah Sosiologi Pembentukan Perdes di Desa Karamatwangi Kec. Garawangi Kab. Kuningan. Adapun yang menjadi lokasi dari penelitian ini sendiri dilakukan di Kabupaten Kuningan lebih tepatnya di Desa Karamatwangi. Penelitian ini akan difokuskan pada masalah pertama, bagaimana proses pembentukan peraturan desa di desa tersebut, kedua, bagaimana evektifitas Badan Permusyawaratan Desa dalam menjalankan fungsi legislasi. Tujuan penelitian ini adalah untuk mengetahui dan mengkaji bagaimana proses pembentukan peraturan desa di desa Karamatwangi Kec. Garawangi Kab. Kuningan dan untuk mengetahui dan mengkaji bagaimana evektifitas Badan Permusyawaratan Desa dalam menjalankan fungsi legislasi. Penelitian ini dapat berguna antara lain yaitu secara praktis dapat digunakan sebagai referensi dalam hal pembentukan peraturan khusunya peraturan desa, penelitian ini mencoba memberikan gambaran tentang kewenangan Badan Permusyawaratan Desa dalam menjalankan fungsi legislasi. Hasil penelitian ini diharapkan dapat memberikan referensi dalam bidang akademis ilmu hukum khususnya dalam bidang Hukum Tata Negara. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian yuridis empiris atau penelitian kuantitatif yaitu metode mengumpulkan dan menyajikan data yang diperoleh untuk menganalisis keadaan yang sebenarnya dan selanjutnya dilakukan analisa rasional berdasarkan acuan yuridis melalui penelitian kepustakaan dan lapangan. Badan Permusyawaratan Desa merupakan lembaga legislatif di tingkat bawah yang mana memiliki peranan penting dalam pembentukan produk hukum pemerintahan desa untuk mewujudkan sistem check and balences dan penyambung lidah masyarakat dalam menyampaikan aspirasi. Abstract

Beggars, vagabonds and derelicts need to be disciplined by the government in order to maintain public orderliness and peace. The purpose of this research is to analyze the authority of the Civil Service Police Unit in handling beggars, vagabonds and derelicts based on Regional Regulation Number 03 of 2015 and the factors inhibiting the Civil Service Police Unit in handling beggars, vagabonds and derelicts in Kuningan District. The method used in this research was an empirical juridical approach by using primary and secondary data in which the data were collected through field and literary studies. The results showed that the authority of the Civil Service Police Unit in handling beggar, vagabonds and derelicts based on Regional Regulation Number 03 of 2015 is as an organizer of public orderliness and peace related to social orderliness as stipulated in Article 28-30; and the factors inhibiting the Civil Service Police Unit in handling PGOT in Kuningan District, namely internal and external factors, such as PGOT knows when the Civil Service Police Units car comes to discipline them, PGOTs are repeatedly raided, lack of APBD funds, and there is no shelter for PGOT. In conclusion, it is proved that the authority of the Civil Service Police Unit in handling PGOT based on Regional Regulation Number 03 of 2015 concerning public orderliness and peace is repressive where the discipline actions are only in the form of non-judicial acts towards beggars, vagabonds and derelicts.Penulis melakukan penelitian ini dengan latar belakang yaitu untuk mengetahui kewenangan Satuan Polisi Pamong Praja dalam penanganan Pengemis, Gelandangan dan Orang Terlantar (PGOT) berdasarkan Peraturan Daerah Nomor 03 Tahun 2015 tentang Ketentraman dan Ketertiban Umum. Tujuan penelitian yaitu untuk mengetahui dan mengkaji bagaimana kewenangan Satuan Polisi Pamong Praja dalam penanganan masalah pengemis, gelandangan dan orang terlantar berdasarkan Peraturan Daerah Nomor 03 Tahun 2015 dan faktor-faktor apa saja yang menjadi penghambat Satuan Polisi Pamong Praja dalam penanganan pengemis, gelandangan dan orang terlantar di Kabupaten Kuningan. Metode yang digunakan dalam penelitian ini adalah dengan pendekatan yuridis empiris dengan menggunakan data primer dan data sekunder serta alat pengumpul data yang digunakan melalui studi lapangan dan studi kepustakaan. Hasil penelitian menunjukkan kewenangan Satuan Polisi Pamong Praja dalam penanganan masalah pengemis, gelandangan dan orang terlantar berdasarkan Peraturan Daerah Nomor 03 Tahun 2015 adalah sebagai penyelenggara ketertiban umum dan ketentraman masyarakat berkaitan dengan ketertiban sosial sebagaimana diatur dalam Pasal 28-30; dan faktor-faktor yang menjadi penghambat Satuan Polisi Pamong Praja dalam penanganan PGOT di Kabupaten Kuningan yaitu faktor internal dan eksternal PGOT berupa mengetahui ketika mobil Satpol PP datang untuk menertibkannya, PGOT berulang kali terjaring razia, kurangnya dana APBD, dan tidak adanya tempat penampungan bagi PGOT yang terjaring. Kesimpulan dari penulisan skripsi ini adalah kewenangan Satuan Polisi Pamong Praja dalam penanganan PGOT berdasarkan Peraturan Daerah Nomor 03 Tahun 2015 tentang Ketentraman dan Ketertiban Umum hanya bersifat represif yaitu hanya tindakan berupa penertiban nonyustisial terhadap pengemis, gelandangan, dan orang terlantar.

Abstract

The environment can be a resource or even a hazard when a disaster occurs. Natural disasters as natural phenomena that can occur at any time regardless of day or night with the risk of loss of property to the psyche must be anticipated with disaster management activities in accordance with the Disaster Law in Indonesia. The purpose of this research is to find out and analyze the regulations made by the government in efforts to deal with disasters in Indonesia, especially in Kuningan Regency. The method used in this study is an empirical juridical approach using primary data and secondary data as well as data collection tools used in the form of interviews, observation and literature studies. The results of this study are the implementation of work programs and activities from the Department of the Environment in disaster management based on Law Number 24 of 2007 concerning Disaster Management. The conclusion of this writing is that the arrangements related to disaster management are adequate from the central to the regional level with the Implementation of the Environmental Service in the basic efforts of disaster management that have been carried out but must be further improved. Suggestions for implementing the implementation of the Environmental Service are to cooperate with students to carry out counseling and outreach about environmental preservation in disaster management efforts based on the Disaster Law in Kuningan Regency.

Abstract

Abstrak : Reformasi dan otonomi daerah sebenarnya adalah harapan baru bagi pemerintah dan masyarakat desa untuk membangun desanya sesuai kebutuhan dan aspirasi masyarakat. Kewenangan Badan Permusyawaratan Desa (BPD) dalam melaksanakan fungsi pengawasan kepada pemerintah desa. Tujuan penelitian adalah untuk mengetahui kewenangan BPD dalam melaksanakan fungsi pengawasan sesuai Undang-undang Nomor 6 Tahun 2014 tentang Desa dan fakor-faktor yang menjadi kendala Badan Permusyawaratan Desa dalam melaksanakan fungsi pengawasan kepada pemerintah desa di Desa Sukaharja, Kecamatan Cibingbin, Kabupaten Kuningan. Metode penelitian ini dengan pendekatan yuridis empiris, yaitu menggunakan data primer dan sekunder dan dianalisis dengan metode deskriptif analisis. Hasil penelitian ini adalah kewenangan Badan Permusyawaratan Desa dalam melaksanakan fungsi pengawasan sesuai dengan Undang-undang Nomor 6 Tahun 2014 yaitu BPD memiliki hak untuk mengawasi dan meminta informasi tentang administrasi desa kepada pemerintah desa; menyampaikan pendapat tentang pelaksanaan pemerintahan desa, pelaksanaan pembangunan desa, pengembangan masyarakat desa, dan pemberdayaan masyarakat pedesaan; serta mendapatkan biaya operasional untuk pelaksanaan tugas dan fungsi anggaran pendapatan dan belanja desa serta faktor-faktor yang menjadi kendala yaitu dalam menerapkan fungsi supervisi kepada pemerintah desa terbagi menjadi 2 (dua) : faktor internal termasuk: sarana yang tidak memadai, pola komunikasi tidak berjalan dengan baik, dan anggota BPD tidak mengerti fungsi sedangkan faktor eksternal meliputi: masyarakat tidak mengerti fungsi BPD, ada sosialisasi pemerintah desa terkait fungsi Badan Permusyawaratan Desa , dan faktor sumber daya manusia masyarakat desa. Kesimpulan adalah kewenangan BPD dalam melaksanakan fungsi pengawasan sesuai Undang-Undang Nomor 6 Tahun 2014 tentang Desa yaitu BPD yang berhak mendapat pertanggungjawaban kepala desa dan meminta informasi kepada pemerintah desa.Kata kunci: Otoritas, BPD, Pengawasan, dan Pemerintahan Desa. THE IMPLEMENTATION OF AUTHORITY OF VILLAGE CONSULTATIVE AGENCY IN RUNNING CONTROL FUNCTIONS ON VILLAGE GOVERNMENT (STUDY IN KUNINGAN REGENCY) Abstract : The writer conducted this research with background to know the authority of Village Consultative Agency (Badan Permusyawaratan Desa) in implementing supervision function to village government. The purposes of writing this research  are to know the authority of Village Consultative Agency in implementing supervision function according to Law Number 6 of 2014 about Village and what factors that become obstacles are faced by Village Consultative Agency in implementing supervision function to village government in Sukaharja Village, Cibingbin District, Kuningan Regency. This research used descriptive analysis research with juridical-normative approach. Stage of research is through literature research using primary and secondary data collected through documentation and analyzed descriptive qualitative method. The result of this research was the authority of Village Consultative Agency  in implementing supervisory function according to Law Number 6 of 2014 namely VCB has the right to supervise and request information about the administration of village administration to village government; to express opinions on the implementation of village governance, implementation of village development, village community development, and empowerment of rural communities; as well as obtaining operational costs for the execution of duties and functions of the village income and expenditure budget. The factors that into two: internal factor including: inadequate means, communication patterns were not working properly, and members of Village Consultative Agency do not understand the functions while external factors include: the community does not understand the functions of Village Consultative Agency, there was a socialization of the village government related to the function of Village Consultative Agency, and the human resource factor of the village community. The conclusion of paper was the authority of Village Consultative Agency in implementing supervision function according to Law Number 6 of 2014 about Village namely VCB was entitled to hold accountability of village head and ask for information to village government.Keywords: Authority, VCB, Supervision, and Village Government.
