Abstract

The seizure of living space of indigenous peoples in Indonesia is a crucial issue that reflects the inequality in the management of agrarian resources. This phenomenon is often triggered by conflicts of interest between indigenous peoples, the government, and corporations, which results in the loss of indigenous peoples' access to land and natural resources, and threatens their cultural, social, and environmental sustainability. This article discusses the main challenges in efforts to realize agrarian justice, including weak recognition of customary rights, overlapping regulations, and minimal participation of indigenous peoples in decision-making. In addition, this article explores the hopes that can be realized through equitable agrarian reform policies, such as strengthening regulations, accelerating the recognition of customary land rights, strict law enforcement, and active involvement of indigenous peoples in the management of agrarian resources. By integrating an inclusive approach and the principle of sustainability, agrarian justice in Indonesia can be achieved, not only to protect the rights of indigenous peoples, but also to create harmony between economic development and environmental sustainability.

Abstract

The dispossession of Indigenous Peoples’ living spaces in Indonesia represents a persistent manifestation of structural inequality in agrarian resource governance. This phenomenon is largely driven by competing interests among Indigenous communities, the state, and corporate actors, resulting in the loss of access to ancestral lands and natural resources, and posing serious threats to cultural integrity, social cohesion, and environmental sustainability. This article examines the key challenges in achieving agrarian justice in Indonesia, particularly the weak legal recognition of customary land rights, regulatory overlap between sectoral laws, and limited substantive participation of Indigenous Peoples in decision-making processes concerning land and resource allocation. Employing a normative legal analysis supported by socio-legal perspectives, this study also explores prospects for strengthening agrarian justice through equitable policy reform. These include the harmonization of agrarian regulations, acceleration of formal recognition of customary territories, strengthening of law enforcement mechanisms against unlawful land appropriation, and meaningful inclusion of Indigenous Peoples in resource governance frameworks. The findings indicate that despite ongoing agrarian reform initiatives, legal and institutional fragmentation continues to undermine effective protection of Indigenous territorial rights. This article contributes to the discourse on agrarian justice by emphasizing the need to reconceptualize land governance through an Indigenous rights-based and sustainability-oriented approach. It argues that achieving agrarian justice in Indonesia requires not only regulatory reform but also a paradigm shift toward participatory and inclusive governance that balances economic development with ecological and cultural preservation.

Abstract

A land title certificate is a document that indicates ownership or control over land. Therefore, the government requires land registration throughout Indonesia so that each landowner receives legal guarantees and protection for their land ownership. One type of initial land registration is sporadic land registration, which is the first registration of one or more land registration objects within a village/sub-district, either individually or collectively. Based on this background, the author wishes to examine the use of Letter C in sporadic land registration in Regency. The research method used is empirical juridical, looking at social phenomena related to law in legislative practice in Indonesia. The empirical juridical approach examines how normative provisions are actually realized in society. The results of the study show that Letter C is still used today as an absolute requirement for sporadic land registration

Abstract

Permasalahan agraria merupakan permasalahan atau sengketa mengenai objek agraria yang sering terjadi yaitu sengketa mengenai kepemilikan hak atas tanahnya, termasuk di dalamnya adalah peralihan hak atas tanah melalui jual beli dengan objek tanah Letter C. Berdasarkan konteks tersebut, penulis akan membahas mengenai keabsahan akta notaris terhadap jual beli objek tanah letter c. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Penelitian memahami konsep keabsahan akta notaris terhadap objek tanah Letter C yang diteliti, kemudian menguraikan bahan-bahan hukum yang relevan yang telah diperoleh kemudian diklarifikasikan berdasarkan rumusan masalah. Hasil penelitian menunjukkan bahwa akta jual beli dengan objek tanah Letter C dianggap sah apabila telah memenuhi syarat sahnya suatu perjanjian berdasarkan Pasal 1320 BW, dan dalam praktek jual beli objek tanah yang belum bersertipikat berdasarkan hukum adat telah memenuhi asas terang, tunai dan riil, serta dalam proses pendaftaran sertipikat untuk pertama kali harus melampirkan dokumen pelengkap. Kewenangan pembuatan Akta Jual Beli apabila objek tanah belum bersertipikat atau Letter C/Girik/Petok yang mayoritas berada di desa, maka akta jual beli dapat dibuat oleh PPAT Camat. Saran dalam penelitian ini adalah masyarakat yang akan atau ingin memperjualbelikan tanahnya, sebaiknya menghindari jual beli dengan akta di bawah tangan, hal ini akan mengakibatkan objek tanah tersebut rentan terjadi sengketa karena tidak memiliki bukti yang kuat untuk membuktikan kepemilikan hak atas tanahnya, alangkah lebih baik jual beli tanah dilakukan sesuai dengan ketentuan yang telah ditetapkan oleh pemerintah.

Abstract

The annual report is an instrument of accountability and legal compliance that the Board of Directors of a Limited Liability Company (PT) is obliged to submit to the General Meeting of Shareholders (GMS), as mandated by Article 66 and Article 78 paragraph (2) of Law Number 40 of 2007 on Limited Liability Companies. The enactment of Regulation of the Minister of Law Number 49 of 2025 introduces new technical provisions on the approval, registration, and uploading of annual reports through the Legal Entity Administration System (SABH). However, understanding among business actors, accounting practitioners, and company management regarding this obligation remains limited, creating a risk of administrative sanctions, ranging from written warnings to the blocking of access to General Legal Administration (AHU) services. This community service activity aims to enhance participants' understanding of the legal basis, procedures, content, audit obligations, and legal consequences of a PT's annual report. It was carried out as a webinar organized by the Indonesian Institute of Accountants (IAI) Banten Chapter on Wednesday, 24 June 2026, using interactive lectures, regulatory exposition, case studies, and a question-and-answer session. The results show improved participant understanding of Article 66 and 78 paragraph (2) of the PT Law, the mechanism for submitting annual reports through a notary and SABH, criteria triggering mandatory audit by a public accountant, shareholders' rights at the annual GMS, and legal consequences including release and discharge and administrative sanctions. This activity is expected to encourage better corporate compliance and strengthen synergy between the legal and accounting professions in realizing good corporate governance.

Abstract

Land administration institutions play a central role in ensuring legal certainty over civil rights attached to land. This article comparatively examines the legal status, legal basis, and institutional structure of the National Land Agency (Badan Pertanahan Nasional/BPN) in Indonesia and the Dutch Cadastre, Land Registry and Mapping Agency (Het Kadaster) in the Netherlands, two institutions historically connected through the legacy of Dutch colonial law. Using a normative juridical legal research method with statutory and conceptual approaches, this study finds that although Indonesia's land law system has been significantly influenced by the Dutch legal tradition, the two countries have developed different institutional models. The National Land Agency (BPN) remains a centralized government institution under the authority of the President of Indonesia, whereas the Dutch Kadaster has operated as an autonomous administrative body (zelfstandig bestuursorgaan) since 1994. These institutional differences have implications for the level of flexibility, accountability, and the pace of digital transformation in each organization. This article recommends strengthening the functional independence of BPN and accelerating the digitalization of land administration services as key priorities for future institutional reform.
