Abstract

The exploitation of natural resources in Indonesia often leads to conflicts between indigenous communities and government or private entities. This article examines the role of law in protecting the rights of indigenous peoples concerning the utilization of natural resources within their territories. Employing a normative legal research method based on secondary legal materials. The findings reveal that, although the rights of indigenous peoples are constitutionally recognized, as stipulated in Articles 18B(2) and 28I(3) of the 1945 Constitution of the Republic of Indonesia, their practical implementation remains inadequate. A significant challenge lies in the conflict between customary law and state law, particularly in the management of natural resources. Indigenous communities frequently face barriers in accessing and utilizing their resources due to regulatory frameworks that often disregard their interests. This article highlights the urgent need for harmonization between customary and state laws and emphasizes the importance of strengthening institutional capacities to support sustainable natural resource management. Preventive and repressive legal protections are essential to ensure that the rights of indigenous communities are not only formally acknowledged but also effectively safeguarded and implemented. By integrating UNDRIP principles into the national legal framework, Indonesia can promote social justice and environmental sustainability, ensuring that indigenous rights are respected and protected.

Abstract

Tujuan dari penulisan jurnal ini adalah untuk memahami lebih jauh mengenai kejadian-kejadian mafia tanah yang sedang marak terjadi saat ini. Solusi baru atas permasalahan yang ada kemudian diberikan dengan menggunakan pendekatan hukum preskriptif yang relevan dan konsisten dengan peraturan perundang-undangan terkait. Metode-metode ini didukung oleh bahan-bahan sekunder dari berbagai sumber. Peneliti tertarik untuk menulis artikel ini setelah mengetahui kejadian terkini Nirina Zubir yang baru- baru ini terjadi terkait perampasan harta benda ibunya oleh anggota mafia tanah. Ada beberapa undang-undang yang bertujuan untuk memberantas mafia tanah, seperti Peraturan Pemerintah Nomor 18 Tahun 2021 tentang Kekuasaan Administratif, Hak Atas Tanah, Satuan Perumahan, dan Pendaftaran Tanah yang dimaksudkan untuk memberikan hak kepada pemilik tanah dan satuan properti tempat tinggal dan hak terdaftar lainnya, mafia tanah dapat melanjutkan operasinya. Meningkatnya sengketa pertanahan dan sengketa akibat campur tangan mafia tanah membuat proses pengurusan perkara pertanahan terhambat dan memakan waktu lama dalam penyelesaiannya. Lemahnya undang-undang pertahanan merupakan permasalahan mendasar, dan undang-undang tersebut mempunyai celah yang dapat dieksploitasi oleh mafia tanah. Oleh karena itu, reformasi hukum pertanahan diperluan untuk memperbaiki dan menyempurnakan hukum guna mencapai kepastian hukum yang bermanfaat bagi masyarakakat.

Abstract

The role of humans, organizations and government policies contributes to dealing with various problems in Indonesia, one of which is environmental pollution. This is the background to the birth of Corporate Social Responsibility (CSR). CSR is a business commitment to operate legally and contribute to improving the quality of life and partnership responsibility of the company, employees and their families, government, local community and wider community. CSR can be carried out by empowering local communities in a real way which has an impact on environmental sustainability. Government policies related to sustainability commitments are important in order to support the success of sustainable forest management for climate change mitigation. For this reason, more strategic government policies are needed in order to realize this action. This type of research is juridical-normative by examining the provisions and juridical aspects related to legal issues with secondary data from the literature as a primary source by conducting a search of laws and regulations, the results of the research show that CSR policies create companies that are accountable to the environment, this is will support the Indonesia Forest and Other Land Use (FOLU) Net Sink 2030 mitigation actions.

Abstract

Traditional games are part of our cultural heritage and hold significant educational value, particularly in shaping children's character. However, rapid technological advancements have shifted children's attention to digital games, leading to reduced social interaction and increased use of profanity in everyday communication. This activity seeks to implement the traditional game NPM (Ngentep Mahkota Jaga), a modification of Gobak Sodor, with additional rules prohibiting profanity and a bonus point system. This activity aims to enhance social interaction and reduce dependence on mobile phones among children. This activity was conducted with children from Ngentep Village participating in an NPM competition. The results showed that this game increased children's awareness of the importance of polite communication, fostered camaraderie, and reduced the intensity of mobile phone use during play. Thus, traditional games can be an effective educational alternative for shaping children's character in the digital age.

Abstract

Abstract Introduction to the Problem: the urgency of this research is that there’s so many challenge and major changes due to digital transformation in commercial law practice in Indonesia, Introducing new difficulties and opportunities in the field of electronic transactions, digital consumer protection, and intellectual property rights. This study explores fundamental changes in the legal structure and mechanisms needed to accommodate evolving digital business models. Purpose/Study Objectives: The Purpose of this study are to explore the dynamics of digital transformation in the context of Indonesian commercial law, focusing on three key aspects: mechanisms for changing legal practices, regulatory challenges, and strategies for adapting the legal framework to digital innovation. Design/Methodology/Approach: This piece of writing relies on normative law research. The statutory and conceptual approach models were applied. Findings: The findings indicate that although regulations have attempted to keep pace with technological developments, there is still a need for improvement in terms of transaction security, electronic legal proof, and personal data protection. The study's findings are expected to provide policymakers with recommendations for developing policies that are responsive and adaptive to the digital age.. Paper Type: Research Article.

Abstract

public speaking is an important communication skill in conveying messages, ideas or information orally in front of an audience. FH UNIPMA collaborates with Neust Philippines. Providing socialization on public speaking with the target being students and Cendikia High School students. The activities were divided into three sessions, namely providing material, and practicing public speaking and asking questions.The problems faced by Cendikia High School students related to public speaking are: (1) Lack of ability to appear and speak in public; and (2) Lack of public speaking skills both face to face and online.The solutions offered to solve this problem are through community service activities, namely providing training/workshops to provide tips and tricks regarding: (1) How to have the ability to appear and speak in public; and (2) Skills in public speaking both face to face and online. Implementation of this community service activity consists of 3 stages, namely; (1) Preparation stage, to identify problems, apply for permits from Cendikia High School, and make preparations for implementing public speaking training; (2) Stage of implementing public speaking training; and (3) Evaluation stage, with questions and answers as well as evaluation with the participants, to find out how much the participants' knowledge, abilities and skills regarding public speaking have increased after participating in the training activities. As a result of this activity, the audience was able to overcome nervousness and improve their ability to speak in public with more confidence and structure.

Abstract

This community service activity aims to enhance the understanding, legal awareness, and administrative capabilities of business actors in managing intellectual property documents and business legality. The partner in this program is CV. Herba Sedunia Ponorogo, a company engaged in the production of traditional herbal medicines and beverages, which previously lacked complete legal documentation such as risk-based business permits, halal certification, and trademark registration. The implementation method consisted of three stages: needs assessment and partner analysis, legal counseling and technical assistance, and evaluation of the program outcomes. A participatory approach was applied to ensure that the partner was actively involved in each stage of the legal documentation process and could understand the practical mechanisms directly. The counseling materials covered the basic concepts of Intellectual Property Rights (IPR), the importance of trademark protection, the online registration procedure through the DJKI system, and business licensing through the Online Single Submission (OSS) platform. The results of the activity showed a significant increase in the partner’s knowledge and skills. Based on the pre-test and post-test results, the participants’ average score increased from 50 to 88, indicating the success of the program in strengthening legal literacy and administrative awareness among business actors. Furthermore, the partner successfully prepared trademark registration documents, obtained a risk-based business license, and secured halal certification for its herbal products. This activity has proven effective in fostering a culture of legal awareness among MSME entrepreneurs and serves as a model for local economic empowerment based on intellectual property protection and product innovation.

Abstract

Abstrak: Klien pemasyarakatan membutuhkan kepercayaan diri untuk berbaur kembali dengan masyarakat setelah menjalani masa hukuman. Tujuan umum kegiatan ini adalah untuk meningkatkan softskill berupa kepercayaan diri dan kreativitas klien di Bapas Kelas II Madiun dengan pelatihan Javanese Content Creator. Tahapan program ini meliputi persiapan, pelatihan, dan evaluasi. Metode pelatihan yang dilakukan dengan sosialisasi dan dilanjutkan dengan pendampingan keterampilan klien pemasyarakatan untuk bisa membuat video konten sederhana. Setelah dilakukan pelatihan dan pendampingan, hasilnya diukur menggunakan teknik wawancara dan juga angket. Dari hasil evaluasi, pengetahuan klien tentang video konten telah meningkat sebesar 80%, selanjutnya kepercayaan diri klien meningkat sebesar 81%, dan akhirnya sebanyak 86% klien berani untuk membuat video konten. Dengan demikian dapat dinyatakan bahwa kepercayaan diri klien telah meningkat dengan adanya peningkatan jumlah video konten yang dihasilkan. Program ini juga memberikan manfaat tambahan berupa keterampilan baru dan peningkatan kesejahteraan ekonomis dan psikologis. Keberhasilan program ini diharapkan dapat menjadi model untuk program serupa di masa mendatang. Abstract: Correctional clients need confidence to reintegrate into society after serving their sentence. The general objective of this activity is to increase softskill that the confidence of correctional clients at Bapas Class II Madiun with Javanese Content Creator training. The stages of this program include preparation, training, and evaluation. The training method is carried out through socialization and continued with mentoring of correctional client skills to be able to make simple video content. After training and mentoring, the results were measured using observation techniques and questionnaires. From the evaluation results, client knowledge about video content has increased by 80%, then client confidence has increased by 81%, and finally 86% of clients dare to make video content. Thus, it can be stated that client confidence has increased with the increase in the number of video content produced. This program also provides additional benefits in the form of new skills and increased economic and psychological well-being. The success of this program is expected to be a model for similar programs in the future.

Abstract

The Indonesian government is implementing an electronic system in every aspect of government activities, and the land registration system in our country is no exception. The dynamics of the policy were turbulent in the community, Electronic land registration for community land was suspended because the regulation was rejected by some community members. The effort of government services in electronic form is the digitalization of government which refers to the transformation of manual systems and processes to digital systems in governance. This transformation aims to improve public services that are efficient, effective, transparent and accountable. Since the law regulating electronic land registration is still relatively new and has become a debated issue in the community, the author is interested in examining how the juridical aspects of electronic PPAT deeds in the land registration system in Indonesia relate to these issues. The research method used is normative juridical with a statutory approach. The results show that Ministerial Regulation No.3 of 2023 concerning the Issuance of Electronic Documents in Land Registration Activities is the latest reference in the land registration system in Indonesia which aims to convert land certificates into a digital system to oversee land activities, but there is no legal certainty in PPAT's policy to make authentic deeds electronically at this time because it does not have a legal basis.

Abstract

The seizure of living space of indigenous peoples in Indonesia is a crucial issue that reflects the inequality in the management of agrarian resources. This phenomenon is often triggered by conflicts of interest between indigenous peoples, the government, and corporations, which results in the loss of indigenous peoples' access to land and natural resources, and threatens their cultural, social, and environmental sustainability. This article discusses the main challenges in efforts to realize agrarian justice, including weak recognition of customary rights, overlapping regulations, and minimal participation of indigenous peoples in decision-making. In addition, this article explores the hopes that can be realized through equitable agrarian reform policies, such as strengthening regulations, accelerating the recognition of customary land rights, strict law enforcement, and active involvement of indigenous peoples in the management of agrarian resources. By integrating an inclusive approach and the principle of sustainability, agrarian justice in Indonesia can be achieved, not only to protect the rights of indigenous peoples, but also to create harmony between economic development and environmental sustainability.
