PPAT diberi wewenang dalam membuatnya akta autentik mengenai hak yang dialihkan dikatakan Akta Jual Beli (AJB). AJB yaitu akta yang memberikan bukti sudah terjadi pengalihan hak terhadap pembeli dari penjual. Jual beli prinsipnya bersifat nyata serta tunai, yang mana dua pihaknya setuju dan persetujuan itu dituangkan pada akta autentik yang PPAT buat. Namun sesuatu yang tidak bisa PPAT hindari yaitu saat ada pihak yang dengan disengaja memberitahukan harga berdasar pada pedoman NJOP PBB untuk dicantumkannya pada akta PPAT, dikarenakan nilai yang lebih rendah daripada nilai transaksi yang sebetulnya, bermaksud agar terhindar dari pajak yang lebih banyak jadi terjadinya perbedaan harga transaksi pada AJB. Penelitian ini bertujuan dalam menganalisisnya tanggung jawab hukum bagi PPAT dalam AJB yang terdapat perbedaan harga transaksi dengan harga sebenarnya, untuk menjelaskan akibat hukum dari perbedaan harga transaksi dalam AJB dengan harga sebenarnya didalam sektor perpajakan, dan untuk mengetahui perlindungan Hukum bagi PPAT jika dalam AJB terdapat perbedaan harga transaksi dengan harga sebenarnya. Tipe penelitian ini yaitu yuridis normatif yakni dianalisis serta dikaji peraturan hukum yang sifatnya normal yaitu undang-undang. Pendekatan penelitian yang dipakai yaitu pendekatan undang-undang, konseptual dan kasus. Penulisan ini sumber bahan hukumnya memakai bahan hukum primer dan sekunder. Berdasarkan hasil penelitian tanggung jawab dari PPAT jika ada perbedaan harga transaksi pada akta jual beli yang dibuatnya apabila terbukti PPAT ikut andil dalam penentuan harga transaksi jual belinya yakni pertanggungjawaban baik dengan moral maupun hukum. Pertanggungjawaban secara hukum bisa seperti pertanggungjawaban administrasi (denda serta menjatuhkan sanksi seperti peneguran tertulis, skorsing dan pemecatannya dari jabatan), pertanggungjawaban secara pidana, dan perdata turut ditanggung PPAT apabila terbukti bersalah. Dampak hukum jika para pihak tidak taat pada peraturan hukum mengenai pajak yaitu Direktur Jendral Pajak waktu selama 0 bulan mulai ketika dikatakan utang pajaknya, sehingga surat ketetapan/penagihan BPHTP kurang bayaran akan diterbitkan. Perlindungan hukum terhadap PPAT yaitu mendampingi secara hukum pada proses pengadilan, yaitu membantu hukum kepada PPAT yang terkait pada permasalahan hukum sesuai yang terdapat pada Pasal 50 Peraturan Menteri Kepala Badan Pertanahan Nasional No. 2 tahun 2018.

Regulation of sanctions for criminal acts of human trafficking in Indonesia is specifically regulated based on Article 1 number 1 of the Law on the Eradication of Criminal Acts of Trafficking in Persons which defines human trafficking as various acts of surveillance, transportation, harboring, sending, transmitting or receiving a person in various ways for the purpose of exploitation, including sexual exploitation, with laws that cause dilemmas, especially regarding prospective Indonesian workers who are vulnerable to becoming victims of human trafficking. The research method used in this research is normative juridical using a statutory regulation approach and a context approach in answering problems. The results of the research show that the application of sanctions for criminal acts of trafficking in persons as regulated in Article 2 paragraph (1) of the Law on the Eradication of Criminal Acts of Trafficking in Persons against perpetrators who exploit victims, fraud in aggravation, sanctions are also applied to state administrators, corporations and their administrators, groups organized criminal acts of human trafficking. Legal uncertainty in the application of sanctions for criminal acts of human trafficking is a serious problem that can disrupt eradication and law enforcement. This primarily relates to legal provisions governing the crime of trafficking in persons, which is very important for effective law enforcement. This uncertainty is found in two main regulations: the Law on the Eradication of the Crime of Human Trafficking and the Law on the Protection of Indonesian Migrant Workers.

Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 memiliki amanat untuk mengembangkan sistem jaminan sosial dan telah diwujudkan dengan membentuk Badan Penyelenggara Jaminan Sosial Ketenagakerjaan (BPJS Ketenagakerjaan) yang terdapat dalam Undang-Undang Nomor 24 Tahun 2011 tentang Badan Penyelenggara Jaminan Sosial (UU BPJS). Dengan tujuan menjamin terpenuhinya dasar hidup yang layak bagi seluruh pekerja dan anggota keluarganya, sebuah perusahaan yang memperkerjakan pekerja alih daya mempunyai kewajiban untuk mendaftarkan pekerjanya pada program BPJS Ketenagakerjaan ini. Namun, faktanya masih banyak perusahaan dengan sengaja mengabaikan hak pekerja alih daya walaupun ada ketentuan tentang sanksi. Pokok pembahasan ini membahas pasal 15 ayat (1) UU BPJS yang menjadi dasar kewajiban perusahaan tersebut, kemudian dihubungkan dengan putusan MK nomor 82/PUU-X/2012 yang menghasilkan putusan bahwa pasal 15 ayat (1) UU BPJS ditetapkan berlaku dengan konstitusional bersyarat karena dimaknai meniadakan hak pekerja alih daya atas kepesertaan BPJS Ketenagakerjaan.Kata Kunci: Hak Pekerja Alih Daya; Jaminan Sosial; Ketenagakerjaan.The 1945 Constitution of the Republic of Indonesia has a mandate to develop a social security system and this has been realized by establishing the Employment Social Security Administering Body (BPJS Employment) contained in Law Number 24 of 2011 concerning the Social Security Administering Body (BPJS Law). With the aim of ensuring that a decent standard of living is met for all workers and their family members, a company that employs outsourced workers has an obligation to register its workers in the BPJS Employment program. However, the fact is that many companies still deliberately ignore the rights of outsourced workers even though there are provisions regarding sanctions. The main topic of this discussion is discussing article 15 paragraph (1) of the BPJS Law which is the basis for the company's obligations, then connected to the Constitutional Court decision number 82/PUU- interpreted as negating the right of outsourced workers to participate in BPJS Employment.Keywords: Outsourced Workers' Rights; Social Security; Employment.

Pandemi COVID 19 mengakibatkan sebagian besar Pengusaha dipaksa untuk menghentikan atau mengurangi kegiatan usahanya. Ini berarti akan terjadi Pemutusan Hubungan Kerja atau pengurangan para pekerjanya. Hal ini juga memaksa pekerja untuk Work From Home (WFH) atau tidak bekerja sama sekali. Ini berarti berkurangnya atau terhentinya sumber nafkah pekerja dan keluarganya. Akibat Pandemi COVID 19, bagi Pemerintah Pemutusan Hubungan Kerja adalah bertambahnya jumlah pengangguran yang dapat menimbulkan keresahan social. Ini berarti berkurangnya atau terhentinya sumber nafkah pekerja dan keluarganya. Number of companies stopped operations due to Covid-19 Pandemic. Income losses and work termination could not be avoided. The 2023 district minimum wages have been established by the Governor. Workers are benefited from wage increase which is almost 10 (ten) percent. On the other hand, the increase burdens the employers. The Regulation on wage payment does not provide a solution to the problems of remuneration during the Covid-19 pandemic. However, the legal effort to postpone wage payments due to the inability to pay has been removed by the legislation. Hence, wage regulation reformulation is required. This research aims to examine the legal issues of wage regulations to provide a solution to this issue that guarantees the continuity of business operations by providing legal protections for workers. This is a normative juridical research with various approaches according to legal research principles, including the statutory approach, concept approach, case approach, and comparative approach. The study first conducts a normative analysis to resolve remuneration problems. Second, it reformulates the concept of Contractus Sui Generis from a work agreement to an agreement between laborers and entrepreneurs. Third, it assesses the concept of Contractus Sui Generis as the correct arrangement in the field of remuneration. The conclusion and the legal solution to the wage payment problem is to urge the government to facilitate an employment agreement through which Contractus Suie Generis regulates labor wages after the pandemic.

The 2024 Regional Election are the first time simultaneous national Regional Election have been held. As a result, 271 regional head positions are vacant due to the expiration of their term of office. Acting Regional Heads were appointed to fill in temporarily. One of the polemics is that an active Indonesian National Armed Force’s member was appointed as Acting Regent of West Seram. This research is a normative juridical research with statutory, conceptual, and historical approaches. The results showed that the Good Governance Principles has been regulated in Law Number 28 of 1999 concerning Clean and Free State Administration from Corruption, Collusion and Nepotism and Law Number 30 of 2014 concerning Government Administration, which when juxtaposed, there is 1 principle in common, namely the principle of legal certainty. The appointment of active Indonesian National Armed Force as Acting Regional Heads is not by the principle of legal certainty. The appointment contrary to Article 47 paragraph (1) of the Law Number 34 of 2004 concerning the Indonesian National Armed Force as the “lex specialis”. The appointment is also not by the Good Governance Principles construction in Article 10 of the Law 30/2014 because it violates the principle of legal certainty, accuracy, not abusing authority, openness, and good service. It is recommended that the Government in making the appointment of Acting Regional Heads should be guided by the Good Governance Principles and provide opportunities for the people to be involved so becomes more transparent and by democratic values.

Tujuan dalam penelitian ini yaitu, Untuk menemukan konsistensi pengaturan perlindungan hukum terhadap pengguna jasa PPAT atas akta yang dibuat terhadap dengan prinsip-prinsip kepastian hukum, Untuk menemukan bentuk perlindungan hukum bagi pengguna jasa Pejabat Pembuat Akta Tanah yang sedang berproses menunggu penyelesaian pembuatan Akta Tanah sementara PPAT yang mengerjakan meninggal dunia dan untuk menemukan dan memahami pengaturan yang tepat terhadap perlindungan hukum pengguna jasa Pejabat Pembuat Akta Tanah akibat PPAT yang mengerjakan meninggal dunia. Metode yang digunkan yakni tipe penelitian yuridis normatif. Hasil penelitian dalam penelitian ini yakni Pertama, pengaturan perlindungan hukum terhadap pengguna jasa PPAT atas akta yang dibuatnya telah sesuai dengan prinsip-prinsip kepastian hukum. Kedua, Bentuk perlindungan hukum bagi pengguna jasa Pejabat Pembuat Akta Tanah yang sedang berproses menunggu penyelesaian pembuatan Akta Tanah sementara PPAT yang mengerjakan meninggal dunia yakni PPAT Pemegang Protokol diharapkan dapat melanjutkan proses hingga akta terbentuk, sehingga dalam hal ini pengguna jasa tidak merasa dirugikan dan hak-hak nya tetap terpenuhi. Ketiga, Pengaturan yang tepat terhadap perlindungan hukum pengguna jasa Pejabat Pembuat Akta Tanah akibat PPAT yang mengerjakan meninggal dunia yakni perlu dilakukan reformulasi hukum berupa penambahan norma atau dengan memberi penjelasan yang mendetail dalam penjelasan PP No. 37 Tahun 1998 khusunya dalam Pasal 28.

Act Number 2 of 2004 Concerning the Settlement of Industrial Relations Disputes (PPHI Act) has several paradigmatic issues. It has been almost two decades since the PPHI Act went into effect. To adapt to shifting needs and consider changes, amendments have never been implemented. The impartiality of mediators who are not chosen by the disputing parties, the existence of ad hoc judges who are not law graduates, inconsistent standards relating to one's ability to testify in court, government interference, punishments, etc. are the fundamental issues. These facts emphasize that the Pancasila Industrial Relations Paradigm is not followed by the PPHI Act as a legislative ideal. It is not surprising that the justice and certainty that workers hope for are only dreams. Laborers no longer hold a strategic position as actors and objectives of national development because they have normatively become victims of injustice in industrial relations. In addition to identifying the normative inconsistencies between the Pancasila Industrial Relations Principles and the PPHI Act, this research aims to promote a shift toward a more just and equitable approach to resolving industrial relations disputes. This study belongs to juridical normative research by adopting the legal regulations as the object. It applies statutory, conceptual, and comparative approaches. The results show that the PPHI Act has paradigmatic problems. Essentially, it does not adhere to the values of Pancasila industrial relations. Thus, reformulation is highly recommended.
