Abstract

The transition to renewable energy became a current issue following the drafting of the New and Renewable Energy Bill. One problem with this transition is related to funding, which requires large funds, making it not possible to depend on funds derived from the state budget. Therefore, this article will analyze the optimization of funding from the private sector through green financing schemes. This is normative research through statute, conceptual and comparative approaches. The results show that reflecting on the implementation of green financing in China and South Africa, the formulation of Articles in the Draft Bill on Renewable Energy should explicitly mention green financing instruments such as green bonds and green sukuk as one of the sources of funding for the transition. The Draft Bill must also involve elements from the Financial Services Authority in its technical implementation. Moreover, the Financial Services Authority has issued POJK Number 18 of 2023 which can be linked to other funding sources for the transition to renewable energy.

Abstract

Era society 5.0 mengubah berbagai paradigma di tengah masyarakat. Tak terkecuali pada bidang profesi advokat. Artikel ini akan membahas hal yang harus dipersiapkan profesi advokat sebagai bagian dari profesi hukum di era Society 5.0. Artikel ini merupakan penelitian normatif berjenis eksploratif dengan pendekatan peraturan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa bila advokat memahami dan menjalankan secara optimal nilai esensial sebagai officium nobile, dapat dikatakan sejalan dengan konsep Society 5.0 yang berorientasi untuk membangun masyarakat dan semangat menyelesaikan permasalahan sosial serta menciptakan keberlanjutan. Salah satunya dengan mengembangkan desain Expert System untuk Praktek Hukum. Pengembangan desain expert system diharapkan mampu menjembatani knowledge gap antara senior lawyer dengan associate. Disamping itu juga untuk memberikan akses layanan pada masyarakat pengguna jasa lawyer melalui hak akses yang diberikan. expert system dalam fungsinya untuk melakukan penelusuran bahan hukum yang akan digunakan untuk melakukan applied legal research, merupakan kulminasi pengalaman dari senior lawyer yang dipadukan dengan bahan-bahan hukum untuk mempersingkat waktu yg dibutuhkan associate dan masyarakat pengguna jasa dalam memahami dan memberikan solusi pada beberapa kasus-kasus hukum tertentu. Pengembangan expert system juga dapat mendukung kerjasama secara kolaboratif beberapa advokat dari berbagai kantor hukum. Wacana pengembangan expert system untuk kepentingan praktek hukum diharapkan akan dapat menciptakan nilai-nilai baru dalam mewujudkan access to justice for all, sebagai goals ke 16 dari Sustainable Development Goals (SDGs).

Abstract

The partners are Micro, Small, and Medium-sized Enterprises (MSMEs) located in Babat Jerawat Village, Pakal District, Surabaya City. In light of the aforementioned background, the following issues have been identified: 1) Partners lack an understanding of food safety; 2) Product packaging is still not appropriate; 3) The use of production equipment is still lacking and traditional; 4) Processed cake products are only limited; 5) Partners do not maintain financial records in a proper and periodic manner; 6) In marketing, they do not utilize social media and eCommerce; and 7) There is a lack of attractive photo design for marketing. The program's objectives are as follows: 1) To increase the amount of product capacity, quality, and hygiene; 2) To increase product turnover; 3) To improve financial and business management; 4) To increase innovation to produce a new product; and 5) To expand product marketing areas. The implementation method commences with the following steps: 1) Team socialization with MSME partners; 2) Training in the fields of production, business management, and marketing is then implemented; 3) Appropriate technology is applied to MSME partners; 4) Assistance and evaluation are provided to MSME partners; and 5) Program sustainability is then addressed. The results of the activities are as follows: 1) Partners have demonstrated an increased understanding of food safety, sanitation, and personal hygiene; 2) Partners have obtained NIB and Halal certificates; 3) Partner production capacity has increased by 40%; 4) Partners have developed skills in the production of innovative processed cake products; 5)Partner turnover has increased by 25%; 6) Enhancement of partner competencies in the domain of routine financial documentation; 7) Availability of financial, social media, and eCommerce applications; 8) Elevation of partner abilities pertaining to the dissemination of information through social media, eCommerce, product photos, and product video content.

Abstract

Mitra pada program Pemberdayaan Berbasis Masyarakat ini adalah UMKM Kelurahan Babat Jerawat Kecamatan Pakal Kota Surabaya. Berdasarkan latar belakang masalah, yaitu:1) Mitra belum memahami keamanan pangan; 2) Dalam pengemasan produk masih belum tepat dan sesuai; 3) Penggunaan peralatan produksi masih terbilang kurang dan tradisional; 4) Produk olahan kue hanya terbatas karena kurangnya pengetahuan mitra; 5) Mitra tidak melakukan pencatatan keuangan dengan baik dan berkala; 6) Dalam melakukan pemasaran produk tidak menggunakan sosial media dan eCommerce; dan 7) Kurang menariknya desain foto produk untuk pemasaran. Tujuan program ini: 1)Meningkatkan jumlah kapasitas, kualitas, dan higienitas produk; 2)Meningkatkan omzet penjualan produk; 3)Meningkatkan manajemen dalam pengelolaan keuangan dan usaha; 4)Meningkatkan inovasi untuk menghasilkan suatu produk yang baru; dan 5)Memperluas area pemasaran produk. Metode pelaksanaan mulai dari 1) sosialisasi tim kepada mitra UMKM; 2) Pelaksanaan pelatihan pada bidang produksi, manajemen usaha, dan pemasaran; 3) Penerapan teknologi tepat guna kepada mitra UMKM; 4) Pendampingan dan evaluasi kepada mitra UMKM; dan 5) Keberlanjutan program. Hasil kegiatan yang diperoleh, yaitu: 1) Mitra mempunyai sertifikat penyuluhan pangan; 2) Mitra mempunyai peralatan yang higienis (celemek, penutup kepala, sarung tangan, dan penjepit makanan); dan 3) Mitra mempunyai sertifikat NIB, halal, merk dagang, kemasan yang kuat, mixer, mesin penggiling, dan oven.

Abstract

This research examined the legal implications of credit defaults in Indonesia, specifically assessing whether cases of payment default or bad debt fell under civil or criminal liability. It also investigated whether fraudulent activities in the credit process constituted predicate offenses, such as corruption, potentially leading to money laundering charges. The research aimed to develop a policy framework for resolving legal disputes related to non-performing banking credit. Employing a normative juridical approach, the research utilized conceptual, statutory, case, and philosophical analyses, drawing upon legal references and case studies to substantiate its findings. The results indicated that the legal resolution of banking credit disputes fell into two primary categories. If bad credit resulted from a violation of the Prudential Principles (the 5C’s), banks as creditors could initiate criminal proceedings by reporting the underlying offenses associated with credit disbursement. Conversely, if bad credit stemmed solely from contractual breaches without elements of illegality, banks could seek redress through civil litigation. Furthermore, instances of fraudulent conduct within the credit process could qualify as predicate offenses, thereby enabling criminal proceedings under the Corruption Criminal Act and the Money Laundering Crime Act.

Abstract

Social bonds are one of the types of bonds based on available themes regulated in POJK No 18 of 2023. The drafting of POJK 18/2023 did not consider regulations from either a theoretical or constitutional perspective, which should be the main consideration for any legislative regulation. This article is the result of research aimed at finding arguments and constitutional rationality related to the regulation of social bonds, sustainable bonds, and sustainability-related bonds. As a result, research on the constitutional analysis of Indonesia's social securities regulation becomes highly important, considering that the constitution serves as the source of legitimacy or the foundation of `authorization for laws and regulations beneath it. According to universal legal principles, laws and regulations that are subordinate to the constitution must not contradict higher laws This is where the concept of legal hierarchy and regulations becomes necessary, so that regulations do not conflict with those above them in the hierarchy, including the highest point, which is the constitution. The research method used in this study is normative exploratory legal research with a constitutional approach and a conceptual approach. It is clear that this article will closely examine several areas of social bond regulation from the perspective of the Indonesian Constitution .The research findings reveal juridical arguments and rationality that, as a welfare-oriented state in its constitution and born from its collectivist cultural background, social bond regulation aligns with the principles of the constitution applicable in Indonesia.
