Abstract

Pendaftaran perkawinan merupakan aspek penting dalam hukum perkawinan di Indonesia karena berfungsi sebagai sarana untuk memberikan kepastian hukum dan perlindungan terhadap status suami istri, anak-anak, serta hak-hak sipil yang timbul, termasuk dalam bidang warisan. Masalah timbul ketika perkawinan yang sah menurut hukum agama tidak didaftarkan, dan pendaftaran baru diajukan setelah suami istri meninggal dunia. Situasi ini menimbulkan keraguan hukum terkait keabsahan perkawinan dan status anak-anak sebagai ahli waris. Penelitian ini bertujuan untuk mengkaji ketentuan hukum yang mengatur pendaftaran pernikahan dan status ahli waris dalam hukum perdata Indonesia, serta menganalisis pendaftaran pernikahan yang dilakukan setelah kematian pasangan berdasarkan Putusan Pengadilan Negeri Medan Nomor 792/Pdt.P/2024/PN Mdn. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan legislatif, konseptual, dan berbasis kasus, serta analisis deskriptif kualitatif terhadap putusan pengadilan. Hasil penelitian menunjukkan bahwa pendaftaran pernikahan yang dilakukan setelah kematian suami dan istri dapat dilakukan secara sah asalkan pernikahan tersebut terbukti telah dilaksanakan sesuai dengan hukum agama, berdasarkan putusan pengadilan sebagaimana diatur dalam Pasal 36 Undang-Undang Nomor 23 Tahun 2006 tentang Administrasi Kependudukan. Keputusan ini memiliki implikasi terhadap pengakuan status anak sebagai anak sah yang memiliki hubungan hukum penuh dengan orang tuanya, sehingga anak-anak tersebut diposisikan sebagai ahli waris sah. Dengan demikian, pendaftaran pernikahan setelah kematian ahli waris memberikan kepastian hukum, baik secara yuridis maupun administratif, terkait status pernikahan dan hak waris ahli waris.

Abstract

Industrial relation between companies and employees are a fundamental factor in the world of employment that must be built on a sense of balance, fairness, and mutual respect. However, in practice, disputes between the two parties are not uncommon. The settlement of industrial relations disputes through mediation is a process in which the parties resolve their issues with the assistance of a neutral mediator. Mediation in the settlement of industrial relations disputes is an effective method because it provides the parties involved with greater access to the outcome compared to arbitration or court proceedings. This study aims to discuss the Procedure for Settling Industrial Relations Disputes and the Effectiveness of Mediation-Based Settlement of Industrial Relations Disputes by the All-Indonesia Workers Union as a mediator, using a case study at PT Sawit Panen Terus. The research method used is empirical juridical, namely a case study approach. The results of this study indicate that mediation is effective, as industrial problems are resolved peacefully. The agreements reached must be carefully implemented by both parties involved.

Abstract

Halal certification has a strategic position in the food industry, including SheShallBake products, as it serves as a mechanism to protect consumers from ingredients that do not comply with Islamic law. How are the regulations for halal certification registration for SheShallBake products, and what are the responsibilities of business actors and the legal consequences for food products that do not have halal certification. This study uses a normative juridical approach to analyze positive legal provisions, as well as an empirical juridical approach through interviews with business owners to understand practices in the field. The findings show that halal certification provides safety guarantees for consumers through a comprehensive verification process and serves as a means of legal protection against potential violations. This research encourages increased awareness among business actors regarding the importance of halal certification and the need for more transparent and accountable regulations. Thus, the implementation of halal certification on SheShallBake products is expected to increase consumer confidence while strengthening the halal food industry sector in Indonesia.

Abstract

Purchase Back Guarantee is an agreement made by the bank and developer to provide collateral for the mortgage to the developer. Article 8 Paragraph (1) of Law Number 7 of 1992 concerning Banking as Amended by Law Number 10 of 1998 (Banking Law) stipulates that bank credit distribution must be based on confidence in the debtor, which in the provisions explaining this confidence refers to the existence of credit guarantee. In addition, Article 11 of the Banking Law regulates the provisions for providing guarantees by Bank Indonesia. However, these articles do not further regulate the collateral that can be provided for bank credit. This shows that this regulation is still rigid and many problems arise due to the implementation and execution of the Buy Back Guarantee. The aim of this study is to examine and analyze the validity of the implementation of the Buy Back Guarantee and efforts to resolve disputes. This study uses normative legal research methods with a legislative and decision approach. The study results show that the implementation of the Buy Back Guarantee is valid if it is carried out in accordance with applicable regulations and the agreements made relating to the implementation of the Buy Back Guarantee are valid and made before a Notary. Dispute resolution can be done through litigation and non-litigation. Litigation can be taken through the courts, and non-litigation can be done through Alternative Dispute Resolution, namely arbitration, negotiation or mediation.
