Abstract

This study aims to determine how the function of the tongkonan traditional institution towards the implementation of pawning on agricultural land, to find out and analyze the factors that become obstacles to the implementation of pawning on agricultural land at the tongkonan customary institution. This type of research is a descriptive empirical legal research. Using qualitative and quantitative legal research approaches. The location of the legal research was conducted in Lemo Village, Makale Utara District, Tana Toraja Regency. Types and sources of legal research data include primary data and secondary data. Data collection techniques using literature study, interviews and questionnaires. Based on the results of research and discussion, the conclusion is that the function of the Tongkonan Traditional Institution for the implementation of pawning for agricultural land in Toraja is as a bridge as well as a link between the pawner and the pawner recipient, the Tongkonan Traditional Institution also functions for the welfare of the community with the value of the customary law order, preserving customs and culture. The factors inhibiting the implementation of pawning of agricultural land at the tongkonan customary institution in Toraja are that the community prefers to mortgage their agricultural land directly without involving the tongkonan customary institution again as a witness, the next factor is the agreement between families, because most agricultural land owned by the Toraja community is family land.

Abstract

Abstrak: Ahmad Syauqi Dzulfikri, 04020170696: “Tinjauan Yuridis Terhadap Pelaksanaan engadaan Tanah Skala Kecil”. Di bawah bimbingan Syamsuddin Pasamai. Selaku ketua pembimbing dan Muhammad Rutan, Selaku pembimbing anggota. Penelitian ini bertujuan untuk mengetahui bagaimana prosedur pelaksanaanpengadaan tanah skala kecil di Jalan H.M Patompo (Metro Tanjung Bunga) Kota Makassar serta faktor apa saja yang mendukung dan menghambat pengadaan tanah skala kecil di jalan H.M Patompo (Metro Tanjung Bunga) Kota Makassar. Metode penelitian yang digunakan dalam penulisan skripsi ini adalah metode normatif-empiris. Jenis dan sumber data yang digunakan adalah data primer, datasekunder dan tersier dengan teknik pengumpulan data yaitu penelitian pustaka (Library Research) dan penelitian Lapangan (Field Research). Data yang telahdiperoleh akan dianalisis dan disajikan secara deskriptif kualitatif . Hasil penelitian menunjukkan bahwa prosedeur Pelaksanaan Pengadaan Tanah Skala di Jalan H.M Patompo (Metro Tanjung Bunga) Kota Makassar dilakukan secara langsung. Adapun faktor pendukung berupa hibah tanah dari pemilik tanah kepada Pemerintah Kota Makassar, sementara faktor penghambat adalah ganti rugi. Rekomendasi Penelitian, kepada Pemerintah Kota Makassar, perlu dilakukan upaya maksimal mensosialisasikan Undang-Undang No. 2 Tahun 2012 serta memperhatikan regulasi lainnya yang terkait Pelaksaan Pengadaan Tanah untuk Kepentingan Umum khususnya Pengadaan Tanah dengan Skala Kecil serta perihal ganti rugi untuk lebih memperhatikan kelayakan dalam menjamin kelangsungan hidup warga terdampak atau masyarakat yang tanahnya dipergunakan untuk pembangunan infrastruktur.

Abstract

Abstract: This study aims to determine and analyze when the transfer of ownership rights to land is carried out, and to identify and analyze the factors thathinder the implementation of the transfer of land ownership rights in Sidenreng Rappang district. The research method used in writing this thesisis the empirical method, with secondary and primary data coverage, the research was conducted at the National Land Office of Sidenreng RappangRegency. This study shows that, the transfer of ownership rights to land due to sale and purchase is carried out after the agreed price between the seller and the buyer is confirmed by a letter of agreement for the sale and purchase of both parties and witnessed by at least two witnesses and in front of the local government authorized to do so. must require plot checks related to digitalization towards electronic services, Communities are reluctant to certify the transfer of land rights because the transition costs according to them are relatively expensive and take quite a long time. the person concerned imagines that the matter of buying and selling land rights is difficult and convoluted. Research recommendations There are still land sales that do not go through this procedure, this shows a lack of public understanding of the applicable regulations, therefore the National Land Agency of Sidenreng Rappang Regency needs to carry out intensive legal counseling so that people understand how to buy and sell land and want to do it. people whose land has not been registered and do not have acertificate, to register their land at the local Land Office. This is done to avoid land disputes in the future. Abstrak: Penelitian ini bertujuan untuk mengetahui dan menganalisis kapan pelaksanaan peralihan hak milik atas tanah dan untuk mengetahui danmenganalisis faktor yang menjadi penghambat dalam pelaksanaan peralihan hak milik atas tanah di kabupaten sidenreng rappang. Metode penelitian yang digunakan dalam penulisan skripsi ini adalah metode empiris, dengan cakupan data sekunder dan primer, penelitian dilakukan di Kantor pertanahan nasional Kabupaten Sidenreng Rappang. Penelitian ini menunjukkan bahwa, Pelaksanaan peralihan hak milik atas tanah karena jual beli dilakukan setelah disepakati harga antara penjual dan pembeli yang dikuatkan surat kesepakatan jual beli kedua pihak dan disaksikan minimal dua saksi dan dihadapan pemerintah setempat yang berwenang untuk itu, adapun faktor penghambat Sertifikat lama yang harus memerlukan cek plot terkait adanya digitalisasi menuju layanan elektronik, Masyarakat merasa enggan untuk mensertifikatkan peralihan hak atas tanahnya karena biaya peralihan yang menurut mereka relatif mahal dan memakan waktu yang cukup lama, Ketidaktahuan orang yang bersangkutan terhadap proses atau prosedur jual beli hak atas tanah, Orang yang bersangkutan membayangkan bahwa urusan jual beli hak atas tanah itu sulit dan berbelit-belit. Rekomendasi penelitian Masih adanya jual beli tanah yang tidak melaluiprosedur hal ini menunjukkan kurangnya pemahaman masyarakat terhadap peraturan yang berlaku, oleh karena itu Badan Pertanahan Nasional Kabupaten Sidenreng Rappang perlu melakukan penyuluhan hukum yang intensif agar masyarakat mengerti cara melakukan jual beli tanah dan maumelakukannya, Bagi masyarakat yang tanahnya belum terdaftar dan belum memiliki sertifikat, supaya mendaftarkan tanahnya ke Kantor Pertanahansetempat. Hal ini dilakukan untuk menghindari terjadinya sengketa tanah di kemudian hari.

Abstract

Land disputes are one of the complex and frequent agrarian problems in Indonesia. Therefore, systematic and targeted efforts are needed to resolve land disputes in Indonesia. The National Land Agency (BPN) as a government agency tasked with managing land has an important role in resolving land disputes. This research aims to examine the role of BPN in resolving land disputes in Indonesia. The research method used in this study is a qualitative method. The data collection technique in this research is literature study. The data that has been collected is then analyzed in three stages, namely data reduction, data presentation and drawing conclusions. The research results show that BPN has a central role in resolving land disputes in Indonesia. As an institution responsible for land administration and management, BPN plays a role in facilitating legal and administrative processes related to ownership, utilization and resolution of land disputes. BPN is tasked with providing legal certainty regarding land status, verifying ownership claims, and providing land certificates to the legal owners. Apart from that, BPN also plays a role in mediating and resolving conflicts between parties involved in land disputes, whether between individuals, traditional communities, or private parties. BPN's role is not only limited to administrative aspects, but also includes efforts to create fair and sustainable solutions, taking into account various social, economic and environmental aspects.
