Abstract

The objective of this research is to analyze legal protection of children who become child soldiers in areas experiencing armed conflict. Various international legal instruments that regulate the prevention, protection, and even enforcement for violators of certain international legal instruments on the recruitment of children as child soldiers have actually not been able to reduce the number of children who become victims in armed conflict, particularly those who are directly involved as child soldiers. This is because normatively, there are still some problems on the uniformity of definition of children age as well as the classic problem of the binding power of all related international legal instruments, being whether or not they create compulsory obligation. Legal protection for children who are recruited as child soldiers must be implemented because in the perspective of human rights, the right of children to live safely and comfortably for their proper growth and development is a fundamental right that must be complied by all states (ius cogens). If a state does not grant protection, and even allows children to be directly involved in armed conflict, then international legal sanctions may be imposed.

Abstract

United Nations (UN) Security Council (UNSC) resolutions (UNSCRs) are adopted by a vote of the five permanent members and ten non-permanent members of the UNSC. Each UNSCR is understood to be part of the “primary responsibility for the maintenance of international peace and security” of the UN. The Indonesian government has been encouraged by various parties to make a legal instrument that would enforce the UNSCRs. Such an instrument would serve to bridge and reduce gaps in the rule of law regarding the enforcement of UNSCRs for nations. However, the government of Indonesia faces several challenges in implementing legal instruments for the UNSCRs. This article maintains that it is crucial to study accommodative policies regarding the national enforcement of UNSCRs by considering the example of Singapore. Singapore has special laws that respond to UNSCRs (The UN Act Chapter 339-UN Act). UN Act 339 is the legal umbrella in Singapore for the government’s implementation of UNSCRs. The UN Act is also an attempt by the Singaporean government to carry out its international obligations to the United Nations.

Abstract

Dokumen tersebut terlebih dahulu harus dilakukan Pemateraian Kemudian pada saat akan dijadikan alat bukti di Pengadilan. Ketentuan ini menegaskan bahwa jenis dokumen dapat berubah menjadi jenis dokumen alat bukti di pengadilan karena digunakan untuk maksud yang berbeda dengan maksud saat dokumen tersebut dibuat. Dokumen yang merupakan objek Bea Materai yang telah dibayar Bea Materainya sesuai dengan ketentuan dalam Undang-Undang ini, saat digunakan sebagai Dokumen alat bukti di Pengadilan, tidak wajib dilakukan Pemateraian Kemudian. Pendekatan perundang-undangan dilakukan dengan menelaah semua undang-undang dan regulasi yang bersangkut paut dengan isu hukum ruang lingkup dogmatik hukum mutlak menggunakan pendekatan perundang-undangan serta pendekatan konseptual. Tata cara pengajuan SKB PPh Waris terdapat salah satu persyaratan didalam penjelasan Peraturan Direktorat Jenderal Pajak Per-8/PJ/2023 tentang Surat Pernyataan Pembagian Waris yang didalamnya terdapat pengenaan bea materai lebih dari 1 (satu) didalam suatu dokumen. pengajuan Surat Keterangan Bebas PPh Waris, Direktorat Jenderal Pajak (DJP) dipermudah karena didalam ketentuan Pasal 3 ayat (1) huruf d bahwa pengalihan harta berupa tanah dan/atau bangunan karena waris dikecualikan dari kewajiban pembayaran terhadap PPh Waris.

Abstract

Gagasan modernisasi koperasi bukan hal baru, gagasan ini muncul seiring dengan tuntutan globalisasi ekonomi yang menuntut peran koperasi untuk dapat bersaing dalam pertarungan pasar bebas. Namun nampaknya, hingga saat ini pemerintah belum menemukan formula yang jitu untuk mendongkrak koperasi di Indonesia agar mampu bersaing. Modernisasi koperasi dapat dilakukan dengan mengacu para aspek-aspek dalam koperasi yaitu dalam hal kelembagaan, usaha, dan permodalan koperasi. Modernisasi usaha mutlak harus dibarengi dengan digitalisasi. Modernisasi koperasi tidak akan berhasil hanya dengan mempermudah izin pendirian dan izin usaha koperasi semata, dalam pada itu sinergitas antar element yang tekait dengan koperasi termasuk didalamnya quadruple helix (pemerintah, masyarakat, perguruan tinggi dan dunia usaha) harus turut menumbuhkan usaha usaha koperasi. Tantangan modernisasi koperasi ada pada pola hubungan koperasi dan pemerintah. Dalam era globalisasi bersaingan bebas fase hubungan koperasi dan pemerintah sudah tidak bisa lagi berada pada fase officialisasi tetapi sudah harus pada fase otonom. Kebijakan-kebijakan modernisasi era omnibus law harus didasarkan pada semangat menumbuhkan kesadaran berkoperasi dengan kualitas sember daya manusia yang mumpuni, semangat sinergitas usaha koperasi dengan entitas bisnis lainnya dan semangat otonomi koperasi dengan meminimalisasi unsur-unsur politik - kekuasaan dalam pengembangan koperasi.

Abstract

Introduction: This issue was raised based on the fact that the COVID-19 investigation team in carrying out their duties did not always go well, one of which was the refusal of several people from the investigation team to enter Chinese territory.Purposes of the Research: This study aims to analyze the legal protection of the COVID-19 investigator team from WHO in the perspective of international law.Methods of the Research: The research method used is normative juridical research with a qualitative analytical descriptive nature, by examining legal materials, both primary legal materials and secondary legal materials through literature studies and other related literature.Results of the Research: The position of the WHO investigation team in the perspective of international law is as an expert on mission as well as an expert on mission in the United Nations. Expert on mission is an external organ to assist the functions and goals of organizations including WHO. In carrying out their duties, the expert on mission is equipped with all legal protections as stipulated in the Convention on the Privileges and Immunities of the Specialized Agencies. Protection is given when the expert mission is carrying out its duties but in the convention there is no guarantee that the expert on mission is allowed -unconditionally- to enter the territory of the country. This is very reasonable considering that the state has full sovereignty over its jurisdiction. The ban on the entry of the COVID-19 investigation team for reasons of sovereignty should have been avoided considering that the COVID-19 pandemic is a common problem that requires cooperation from all over the world. The existence of obstacles to the work of the Investigation Team by China, which incidentally is the country that initiated the formation of the Covid-19 Investigation Team, is a bad precedent and a violation of international obligations as stipulated in the Responsibility of States for International Wrongful Acts.

Abstract

The applicability of AEC has a profound impact on the development of economic policy in ASEAN countries, including in cooperatives. This paper examines important aspects related to the effect of MEA on cooperative policy in particular on cooperative oversight/supervision by the government. The supervision of cooperatives in Indonesia experienced a shift from de-officialisasi towards autonomy or independence of cooperatives. It is argued that Law No 25 Year 1992 on Cooperative is silent on the government oversight regulation for cooperative. With the AEC government oversight should not be eliminated completely because supervision aims at ensuring the quality and the cooperative to compete in the free market of AEC. Thus, the Law No. 25 Year 1992 could no longer be used as a basis of reference to deal with AEC. This paper proposes that Indonesian Cooperative Board (Dekopin) should have jurisdiction in supervising cooperative. Such supervision is done by promoting the strengthening of the cooperative that maintains the identity of cooperatives.

Abstract

AbstractLaw enforcement practices in the military environment are still not in line with sectoral egos. Law enforcement has not been able to guarantee substantive order, truth and justice. When carrying out law enforcement in the military environment, it should not only refer to normative legal rules, but what needs to be done more is to make legal breakthroughs that are more effective and efficient. The discipline of a soldier is an absolute thing that is inseparable from his duty to maintain the security of the Unitary State of the Republic of Indonesia. This study analyzes contemporary forms of threats related to security and resilience and explains the similarities and differences in national resilience studies which aim to realize a national security system and develop national security systems in other countries. This research is normative juridical research, using a statutory approach, conceptual approach, and analytical techniques in the form of grammatical interpretation and systematic interpretation. This research explains that the forms of threats that occur in Indonesia include problems at the border, intolerance between ethnicities and between governments and religions, inequality in bureaucratic reform, inadequate law enforcement, and transnational crime. This research shows that national resilience and security are influenced by the professionalism of the Indonesian National Army. The safe conditions of a country cannot be separated from just security and defense but are in synergy with other factors, namely economics, politics, law, socio-culture, ideology, geography, demography and resources

Abstract

This study explores the impact of the Entrepreneurship Education Program on student entrepreneurial resilience, focusing on internal and external factors, the mediating role of entrepreneurial intention, and the moderating effect of self-efficacy. Utilizing quantitative methods and Structural Equation Modeling (SEM) with Smart PLS, data from 100 students at Universitas Brawijaya revealed significant positive relationships between entrepreneurship education and key indicators, including entrepreneurial interest, innovation capability, resilience, self-concept, and self-efficacy. Results highlight that effective entrepreneurship education enhances students' entrepreneurial attributes and emphasizes the critical role of self-efficacy in boosting entrepreneurial interest. Additionally, the supportive influence of the family environment underscores the importance of a comprehensive approach in fostering entrepreneurial skills. These findings align with existing literature and suggest that educational institutions should focus on both practical and theoretical aspects to prepare students for entrepreneurial success.   Keywords:  Entrepreneurship Education, Entrepreneurial Resilience, Self-efficacy, Innovation Capability, Entrepreneurial intention, Family Environment
