Abstract

The accountability system for elected officials in Indonesia is inherently linked with the electoral system that is applied to unravel the problem in the context of a symmetrical system of people's sovereignty. This article analyzes the dynamics of the current regulations on the accountability system of elected officials. However, this article would only focus on the accountability system for regional leaders (governor, mayor and regent), regional legislators (DPRD) and the senatorial regional delegates (DPD) in Indonesia and the participation of constituencies in proposing a recall system. The purpose of this research is to construct an accountability mechanism for regional heads, DPRD and DPD to their constituents that are appropriate and in line with the electoral system applied in Indonesia. This research is expected to be a material for consideration for policy makers and the Indonesian people in general in designing an accountability system for elected officials that is appropriate and in line with the applied electoral system. Abstract

Dalam pengetahuan hukum hidup (Wyaharacastra) membagi aparat penegak hukum menjadi beberapa nama, yakni Hakim yang dikenal dengan “Adhyaksa”, sedangkan Juris (ahli) ilmu hukum hindu dimaknai sebagai Pragwiwaka. Sedangkan hukum yang ada dan diterapkan disebut dengan Decadrasta yakni kebiasaaan dalam suatu daerah. Penamaan pemanam ini merupakan penamaa dalam struktur hukum yang ada di kerajaan Majapahit pada waktu itu. Menariknya dalam sistem hukum yang diberlakukan di Kerajaan Majapahit atau kerajaan sebelumnya seperti Sriwijaya, sumpah menjadi hukum tertinggi dalam rantai penerapan hukum di Kerajaan Majapahit. Dalam hal ini, Yamin menuliskan mengenai kesaktian sumpah kesetiaan menjadi kunci utama dalam ketertiban bermasyarakat dan bernegara dalam kerajaan – kerajaan pada masa lampau. Sumpah kesetiaan kepada kerajaan menjadi tumpuan utama bahkan dicantumkan dalam sebuah prasasti kerajaan tersebut.

Abstract

Wilayah perbatasan Indonesia-Malaysia di Pulau Sebatik, Kalimantan Utara, menghadapi tantangan dalam melaksanakan kebijakan pembangunan berdasarkan Peraturan Pemerintah Nomor 78 Tahun 2014. Meskipun mempunyai peran strategis dalam menjaga kedaulatan nasional, kesenjangan dalam implementasinya terlihat jelas dalam bidang ketahanan pangan, kesehatan, dan perekonomian. Kajian ini mengidentifikasi kesenjangan antara regulasi (das sollen) dan kenyataan (das sein) di Sebatik Utara. Dengan menggunakan pendekatan yuridis empiris, data dikumpulkan melalui wawancara dengan partisipan lokal. Temuan menunjukkan bahwa kebijakan pembangunan perbatasan belum sepenuhnya memenuhi kebutuhan Sebatik Utara, khususnya di bidang infrastruktur dan kesejahteraan ekonomi. Penelitian ini menawarkan perspektif baru dengan berfokus pada dimensi sosial dan ekonomi. Kesimpulannya merekomendasikan perbaikan kebijakan agar peraturan lebih selaras dengan implementasinya, dengan fokus yang lebih kuat pada pemberdayaan ekonomi lokal, kesehatan, dan ketahanan pangan.

Abstract

To administrative effort in the form of an objection, a maximum time of 21 working days is given. However, there are differences in the application of these administrative efforts between judex facti judges and judex juris judges. Judex facti judges through decisions number 21/G/2020/PTUN and 76/B/2021/PT.TUN JKT implementing administrative measures are mandatory, this decision was upheld by judges at the State Administrative High Court. However, the decision was annulled by the judge judex juris (Supreme Court level) through decision number 420 K/TUN/2021. The basis for the judex juris to cancel the judex facti decision is based on the phrase "can" as stated in Article 75 paragraph (1) of Law Number 30 of 2014 concerning Government Administration. So that administrative efforts through objections or administrative appeals are an option, not mandatory. Administrative efforts are efforts to realize the principles of Pancasila into the settlement of administrative problems, namely in the resolution of administrative problems so that they are first resolved through deliberation and consensus. If consensus deliberation cannot find a point of peace, it can be resolved through the State Administrative Court
