Abstract

Local governments have undergone various regulatory developments since Indonesia's independence 75 years ago. Various aspects underlying the development and changes in local government policies can be analyzed using several approaches, such as historical, philosophical, and sociological. This paper will discuss how the legal politics of the development of local government implementation, especially in terms of decentralization. Furthermore, the author will explain about the opportunities for implementing decentralization based on regional capacity to promote welfare of society. This research is normative juridical research using historical approach, conceptual approach, and legal approach. It can be said that the implementation and development of local government implementation is strongly influenced by various aspects other than the legal factor itself. Furthermore, there is still the possibility of implementing decentralization based on regional capacity as an effort to promote social welfare.

Abstract

This research explores the absence of the peoples of customary law in returning Lombok treasures before, during, and after repatriation, while international law and law in Indonesia recognise and respect the right to self-determination and participation of the people of customary law in a cultural sector. This article employed a normative-legal method supported by conceptual and case approaches. A descriptive-prescriptive method was employed, and data were analysed using content analysis. The results show that the government faces the challenge of determining official representatives of tribal peoples. Another challenge came from inadequate infrastructure and budget. The absence of the tribal peoples has led to the failure of achieving the reconciliation of unfair history, blocked access to helping with the research on the origin of the objects of cultural heritage, reinforced the content of agreements and cooperation of repatriation, and reintegrated the missing objects into their cultural context. This gap can be solved with two strategies reinforcing the role and participation of the tribal peoples in the repatriation process, namely by setting up the legal framework for the repatriation of cultural heritage objects and strengthening the involvement and legal standing of the tribal peoples. Through the study of Lombok treasures, this research contributes a valuable lesson and awareness, indicating that the State should recognise the right to participation of the peoples of customary law in an attempt to repatriate other objects of cultural heritage in the time to come.

Abstract

Karimun Jawa Island is a promising maritime asset, enriched by abundant water resources in Central Java. However, the allure of this location poses a potential threat to the sustainable ecosystems of marine biota unless prompt government action is taken to safeguard its underwater cultural heritage. This research proposes a comprehensive policy design for legal protection and ecotourism development in Karimun Jawa, balancing economic considerations and environmental preservation. Employing a socio-legal methodology encompassing interviews, observation, and focus group discussions, the study identifies substantial challenges in managing underwater cultural heritage in Karimun Jawa. These challenges encompass over-exploitation, shipwreck theft, damage from trawlers, natural disasters, and plastic pollution. The research underscores the imperative for the government to formulate measures ensuring legal protection on international, national, and regional fronts. At the global level, immediate ratification of the Convention on the Protection of Underwater Cultural Heritage 2001 is recommended. Moreover, effective collaboration among stakeholders—central and regional governments, local communities, and maritime enterprises—is deemed crucial for sustainable, culturally informed policy formulation fostering responsible management, utilization, and protection of this unique marine heritage.

Abstract

Napan Village, North Bikomi District - North Central Timor Regency - East Nusa Tenggara is some of the areas that border Indonesia on land with neighboring countries. Napan Village shares a land border with Timor Leste. Various issues regarding security, prosperity and the environment in development often arise. This research was conducted to develop models dynamically in three development scenarios using these three approaches. The research sample was obtained using a questionnaire distributed to 78 respondents consisting of village soldiers and police, Napan village officials, the North Bikomi sub-district head, and border officers in Napan village. From the results of the questionnaire, descriptive analysis and multiple regression analysis were carried out to obtain a regression model of the influence of security, prosperity, and environmental approach variables on border area development. Next, the analysis results are used to develop a system dynamics model with three simulation scenarios. The reference used in this simulation is the average data value for each variable minus and adding one standard deviation and the equation resulting from multiple regression analysis. The simulation results show that the target for achieving development in border areas will reach 73% within 5 years if input from security, prosperity, and environmental factors is increased from the current condition of 8% for security, 6% for prosperity, and 9% for the environment. Furthermore, it is recommended to increase development on factors in security, prosperity, and environmental approaches according to these results so that in the next five years significant progress can be achieved, which reaches almost double the current conditions.

Abstract

AbstractLaw no. 30 of 2014 concerning Government Administration is a material law that regulates the relationship between the State and citizens where the actions of Government Officials can be tested by the Administrative Court. This is normative juridical legal research, with Data Secunder. This research will analyze the legal position and right to sue organizations and community members regarding the Onrechtmatige Overheidsdaad dispute. The results that both organizations and community members have the right to sue and legal standing which is also regulated in the 2014 Law on Government Administration and other regulations. The 2014 Law is also explicitly aimed at citizens. Second, according to Article 51 paragraph (1) of Law no. 8 of 2011, organizations and community members are included in the applicant category. Third, discretionary policies can also be implemented by PTUN as long as the policy is for the sake of creating good government.Keywords: Legal Position, Right to Sue, Onrechtmatige Overheidsdaad Dispute. AbstrakUndang-Undang No. 30 Tahun 2014 tentang Admi­nistrasi Pemerintahan ini merupakan hukum materiil yang mengatur hubungan antara Negara dengan warga negara dimana tindakan Pejabat Pemerintah memungkinkan untuk diuji oleh PTUN. Ini merupakan penelitian hukum yuridis normatif dengan data sekunder. Penelitian ini menganalisis kedudukan hukum dan hak menggugat organisasi dan warga masyarakat terhadap sengketa Onrechtmatige Overheidsdaad. Hasil penelitian menunjukkan bahwa baik organisasi maupun warga masyarakat memiliki hak menggugat dan legal standing yang juga telah diatur dalam Undang-Undang Tahun 2014 tentang Administrasi Pemerintahan dan peratuan lainnya. Secara eksplisit UU tahun 2014 tersebut juga ditujukan kepada warga masyarakat. Kedua, menurut Pasal 51 ayat (1) UU No. 8 Tahun 2011, organisasi dan warga masyarakat masuk kategori pemohon. Ketiga, kebijakan diskresi juga dapat dilakukan oleh PTUN selama kebijakan tersebut demi terciptanya pemerintahan yang baik.Kata Kunci: Kedudukan Hukum, Hak Menggugat, Sengketa Onrechtmatige Overheidsdaad.

Abstract

UU no. 30 of 2014 concerning Government Administration explicitly states that it is possible for Government Officials to be tested by the PTUN. This is of course in order to create good government. This research is normative juridical legal research. This research will analyze the legal position and right to sue the community regarding the Onrechtmatige Overheidsdaad dispute. The research results concluded three things; First, the public has sufficient requirements to file a lawsuit because the legal position and right to sue are regulated in the Decree of the Chief Justice of the Supreme Court Number 36/KMA/SK/II/2013, Law Number 5 of 1986 concerning Administrative Justice, and others. Second, UUAP No. 30 2014 also explicitly states that the government is prohibited from abusing its authority and the PTUN has the authority to decide whether there are elements of abuse of authority. This means that Law Number 30 of 2014 provides space for the public to file a lawsuit. The three definitions of 'Community Citizens' in UUAP No. 30 2014 must be changed after the publication of PERMA Number 01 of 2023 concerning Guidelines for Adjudicating Environmental Cases.

Abstract

This paper aims to analyze the publishing of photographs and notary signs on Instagram as a violation of the notary code of ethics and the efforts of the Malang City Honorary Council to provide sanctions regarding violations of the notary code of ethics. This type of research is empirical juridical research. Data collection uses observation, interviews, and documentation. The results of the study show that loading photos and signage on Instagram is a form of violation of the notary code of ethics. The efforts of the Malang City Honorary Council to overcome violations of the Notary Ethics Code is to impose sanctions following the violations that have been committed.

Abstract

Asupan gizi pada anak sangat berpengaruh dalam proses tumbuh kembang mereka, kebutuhan gizi pada anak bermacam macam seperti karbohidrat, lemak, mineral, vitamin dan yang terpenting adalah protein, pemenuhan protein itu sendiri bisa kita dapatkan melalui konsumsi produk hasil ternak, contohnya daging, susu, dan telur, dengan mengkonsumsi makanan dengan gizi yang cukup maka dapat mencegah terjadinya stunting dan gizi buruk pada anak. Kegiatan pengabdian kepada masyarakat (PKM) ini dilakukan untuk mengedukasi anak anak di SD Negeri Batuilo tentang pentingnya mengkonsumsi makanan dengan gizi seimbang serta memperkenalkan produk peternakan sebagai makanan pemenuhan gizi tersebut, kegiatan PKM ini dilakukan pada tanggal 9 maret 2024 selama kurang lebih 60 menit di SD Negeri Batuilo Kabupaten Tolitoli, Sulawesi Tengah. Kegiatan ini dimulai dengan perkenalan, selanjutnya penyampaian materi, sesi tanya jawab dan di akhiri dengan aksi gizi yaitu pembagian produk peternakan berupa susu, dan sosis daging sapi, hasil kegiatan menunjukkan bahwa setelah mengikuti kegiatan banyak anak anak yang semakin mengenal dan tertarik untuk lebih mengkonsumsi produk peterakan, dengain demikian diharapkan dapat meningkatkan gizi pada pada anak.Kata kunci : peternakan, protein, gizi

Abstract

This paper focuses on the utilization of sea mineral resources in areas within national jurisdiction and in the international seabed area (hereafter known as the Area). It discusses Indonesian laws relevant to seabed mining and the need for such laws to take into consideration the maritime zones and activities in the Area, as stipulated by UNCLOS 1982. This paper begins with the identification of potential sea minerals both within national jurisdiction and in the Area. Next, it analyzes the international legal framework on seabed mining, including a discussion on the meaning of "legitimate interests of coastal States" and on the participation of developing states in the Area, as stipulated in Article 142 and 148 of UNCLOS 1982. Then, the national legal framework relating to seabed mining is discussed. Using the juridical-normative method, this paper finds that Indonesia does not currently have comprehensive national regulations covering seabed mining within its jurisdiction and in the Area. Although there is a presidential decree on the exploitation of sea sand, it is limited to institutional arrangements and only focuses on sea sand. Thus, this paper recommends the formulation of national regulations regarding the use of the seabed, both within and beyond national jurisdiction.

Abstract

The escalating environmental crisis and pressing water resource conservation issues globally necessitate comprehensive research. This study investigates urban green space regulations and water resource conservation challenges in Indonesia and Australia. Employing a comparative analysis, it examines the legal frameworks, policies, and implementations in both countries. The research aims to identify innovative and sustainable strategies for water resource protection. Findings reveal substantial disparities in regulatory approaches, public involvement, and the integration of green technologies in green space management between the two nations. Indonesia needs help enhancing institutional capacity and integrating green space policies into urban planning, while Australia focuses on climate change adaptation and sustainable water resource management. The study advocates cross-sectoral collaboration and ecosystem principles in green space regulations for practical water conservation objectives. It contributes fresh perspectives on legal and policy frameworks for addressing water resource conservation challenges through urban green space management, offering recommendations for cohesive and sustainable policy development.
