Abstract

Perbuatan melawan hukum dalam hukum perdata bisa terjadi dalam hal peralihan hak tanah, oleh karena itu manuscript ini bertujuan mendeskripsikan bentuk – bentuk perbuatan melawan hukum dalam hal peralihan hak atas tanah. Penelitian yang digunakan adalah penelitian normative/doctrinal, sumber data utama adalah data sekunder berupa dokumen hukum, jurnal dan literatur yang relecan dengan masalah yang diteliti. Hasil penelitian menunjukkan bahwa bentuk perbuatan melawan hukum dalam hal peralihan tanah itu adalah Tergugat tidak bersedia melakukan pemecahan hak atas tanah yang telah dibeli oleh Penggugat secara terang dan tunai, akibatnya Penggungat mengalami kerugian materiil disamping juga kerugian immaterril (depresi) yang tidak bisa dihitung secara materiil. Aplikasi dari penelitian memberikan informasi kepada masyarakat bahwa peralihan hak atas tanah dilakukan dengan jual beli secara terang dan tunai adalah sah dan memiliki akibat hukum jika penjual tidak segera melaksanakan kewajiban nya terhadap pembeli, tanpa alasan yang sah. Adapun akibat hukum pembayaran uang ganti rugi sebagai pengganti kerugian yang dialami oleh Penggungat (pembeli).

Abstract

The judge in making a decision must be based on two valid pieces of evidence and the conviction obtained by the judge that the criminal act really happened. Such juridical formulation truly guarantees the freedom of judges, so it seems that judges are not bound by the demands of the public prosecutor. Therefore, this study aims to examine the freedom of judges from the aspect of the reasons why judges do not accept the charges of public prosecutors. This research is a normative research, so the data needed is secondary data in the form of legal documents, journals and references relevant to the research problem. The data is analyzed descriptively based on the principles of substantive criminal law and formal criminal law. The results of the study showed that there was no seriousness of the public prosecutor in conducting the prosecution which was shown by the absence of guarantees to bring the defendant, thus violating the principles of fast, simple and low cost justice. This research provides information to the public that judges are not bound by the demands of the public prosecutor.

Abstract

Illegal logging is an illegal practice that damages the environment, threatens the sustainability of ecosystems, and causes significant economic losses. The main aim of this research is to investigate the regulation of criminal acts and the government's efforts to overcome the impact of illegal logging. The research method used in this study is normative which analyzes library materials and laws related to illegal logging. From this study, it was found that Law no. 18 of 2013 concerning Prevention and Eradication of Forest Destruction is a regulation that is often used in enforcing illegal logging laws. The government has taken various efforts to combat illegal logging in Indonesia. One of them is granting permits for selective felling of trees in forest areas to encourage tree cutters to comply with established regulations. Apart from that, the government is also active in making regional regulations to minimize cases of illegal logging in various regions of Indonesia. Collaboration with related agencies is also part of the government's efforts to tackle illegal logging. With effective implementation, criminal law enforcement can become a strong tool in efforts to combat illegal logging. However, these efforts must be accompanied by comprehensive steps, including increasing public awareness, protecting witnesses and whistleblowers, and promoting sustainable use of forest resources.
