Abstract

Keterlibatan masyarakat dalam pengelolaan wilayah pesisir merupakan suatu keniscayaan untuk mewujudkan pengelolaan wilayah pesisir yang berkelanjutan dan menyejahterakan. Konsekuensinya, keserasian antar kebijakan pengelolaan wilayah pesisir terkait keterlibatan masyarakat menjadi penting, guna mewujudkan kepastian hukum bagi masyarakat untuk berperan aktif dalam pengelolaan wilayah pesisir. Oleh karena itu, artikel ini akan menganalisis keserasian antara kebijakan pengelolaan wilayah pesisir Lampung dengan peraturan perundang-undangan yang lebih tinggi maupun yang setara, khususnya ketentuan mengenai pelibatan masyarakat dalam pengelolaan wilayah pesisir. Kajian ini berkesimpulan bahwa kebijakan pemerintah Provinsi Lampung terkait keterlibatan masyarakat dalam pengelolaan wilayah pesisir masih disharmoni dengan peraturan perundang-undangan yang lebih tinggi maupun yang setara. Disharmoni ini menimbulkan ketidakpastian hukum, kesenjangan dalam peruntukan dan pemanfaatan sumber daya pesisir, dan keterbatasan akses masyarakat untuk berpartisipasi dalam pengelolaan wilayah Pesisir Lampung. Sehingga kebijakan pengelolaan wilayah pesisir Provinsi Lampung perlu direvisi melalui harmonisasi secara vertikal maupun horizontal, guna mewujudkan pengelolaan wilayah pesisir berbasis masyarakat.Kata kunci: Lampung, Harmonisasi Kebijakan, Pengelolaan Pesisir

Abstract

The research aims to analyze the positive and negative implications of the omnibus law on job creation on the development of the forestry sector. In writing, this article is normative juridical. Based on this method, this research is conducted by examining and analyzing theories, doctrines, and laws and regulations that are relevant to the issues discussed. Based on research results, the main points of amendments to regulations in the forestry sector include affirmation of forest areas, forest areas, changes in forest area designation and function, utilization of production forests and protected forests, business permits, non-tax state revenues in the forestry sector, utilization of forest areas outside forestry activities, the authority of the central and regional governments in forest protection, prohibiting activities that cause forest destruction, and imposing sanctions and procedural law on criminal acts of forest destruction. These changes have implications for forest protection in Indonesia, including increasing forest area conversion, limiting community participation in forest management plans, and weakening sanctions (eliminating absolute responsibility). Therefore, in policy formulation, it is necessary to pay attention to forest protection to harmonize human and environmental interests. Based on the results of the research, it is therefore recommended that the government be firm and concrete in regulating forest protection efforts in future implementing regulations.

Abstract

Kegiatan ini bertujuan mengedukasi mitra dalam hal ini Dinas Pariwisata Kabupaten Pesawaran, mengenai regulasi dan dampak tindak pidana destructive fishing terhadap pengelolaan pariwisata bahari yang berkelanjutan. Metode yang digunakan dalam pencapaian tujuan tersebut yakni penyampaian materi melalui ceramah, diskusi terarah dan tanya jawab. Setelah pelaksanaan kegiatan, diketahui bahwa Kabupaten Pesawaran memiliki beberapa kawasan wisata yang berbasis pantai, kuliner, kerajinan, kawasan wisata berbasis bahari dan warisan budaya, serta kawasan wisata berbasis air terjun. Tindak pidana destructive fishing berdampak terhadap keberlanjutan sektor pariwisata di Kabupaten Pesawaran, karena menyebabkan kerusakan ekosistem dan berbagai biodata laut yang mengurangi daya tarik pariwisata. Kegiatan ini telah memberikan berbagai masukan terkait penanggulangan tindak pidana destructive fishing, guna keberlanjutan pengelolaan pariwisata bahari di Kabupaten Pesawaran.

Abstract

Abstract Sex is one of the basic human needs and is the basis of marriage. Sex becomes a means of gaining offspring, sexual pleasure, and sexual gratification. Sexual gratification is one of the determining factors in family life. Sexual violence is largely associated with violence against women. In the context of family life as the smallest institution, sexual violence also often occurs. Therefore, it is necessary to be given understanding to the community, especially the PKK drive team in Batanghari Nuban East Lampung District on the importance of prevention efforts on domestic sexual violence to realize resilience Family and country. The effort undertaken in this activity is to provide knowledge and understanding of the law on the prevention of sexual violence in households to the community, especially the PKK Drive team Sub-district Batanghari Nuban East Lampung District. Then proceed with discussion and question and answer, and test participants ' understanding by providing pre test and post test. The results showed that the focus group discussion (FGD) and education activities are important to do to improve the understanding and awareness of public law in preventing household sexual violence. Keywords: FGD and education, prevention, sexual violence, household Abstrak Seks merupakan salah satu kebutuhan dasar manusia dan merupakan dasar dari perkawinan. Seks menjadi sarana untuk memperoleh keturunan, kenikmatan seksual, dan kepuasan seksual. Kepuasan seksual merupakan salah satu faktor penentu dalam kehidupan keluarga. Kekerasan seksual pada umumnya sangat berhubungan dengan kekerasan terhadap perempuan. Dalam konteks kehidupan keluarga sebagai institusi terkecil, kekerasan seksual pun acap kali terjadi. Oleh karena itu, perlu diberikan pemahaman kepada masyarakat khususnya Tim Penggerak PKK Kecamatan Batanghari Nuban Kabupaten Lampung Timur mengenai pentingnya upaya pencegahan terhadap kekerasan seksual dalam rumah tangga untuk mewujudkan ketahanan keluarga dan negara. Upaya yang dilakukan dalam kegiatan ini yakni dengan memberikan pengetahuan dan pemahaman hukum tentang pencegahan kekerasan seksual dalam rumah tangga kepada masyarakat khususnya Tim Penggerak PKK Kecamatan Batanghari Nuban Kabupaten Lampung Timur. Kemudian dilanjutkan dengan diskusi dan tanya jawab, serta menguji pemahaman peserta dengan memberikan pre test dan pos test. Hasil kegiatan menunjukan bahwa kegiatan focus group discussion (FGD) dan edukasi ini penting untuk dilakukan guna meningkatkan pengatahuan, pemahaman dan kesadaran hukum masyarakat dalam mencegah kekerasan seksual dalam rumah tangga. Abstract

The progress of digital transformation requires efforts to protect personal data as a guarantee of individual rights to overcome the large number of cases of data leakage and misuse, one of which is population data. The concretization of the government's efforts based on Article 28 G of the 1945 Constitution is realized through providing access to population data to all institutions, both state and private institutions for data verification. In addition, there is an obligation for data user parties to implement a Zero Data Sharing Policy with provisions prohibiting the dissemination or sharing of population data with third parties. However, various basic factors are influenced by the limited aspects of legal protection related to the class of personal data, and the authority between the data owner and the user, which makes it imperative to enact the current regulation on personal data protection. In addition, the establishment of an Independent Surveillance Authority is a must in ensuring the implementation of these regulations, because their duties and authorities are in line with the government's efforts in protecting population data. This study uses a normative legal research method with an approach to legislation and literature study, and uses descriptive analysis in managing qualitative data by applying a deductive method. The results of the study indicate that the need for legal guarantees must be accompanied by an element of optimal supervision through the establishment of an Independent Surveillance Authority in accordance with the standardization of the European Union General Data Protection Regulation (EU GDPR). Its independent position will prevent intervention from various parties for certain interests. Functionally, it is considered appropriate in optimizing the implementation of the Zero Data Sharing Policy through the conception of investigative authority and collective rights as a guarantee of human rights.

Abstract

Conspiracy of tender and corruption are both have related in government’s procurements of goods and services, because the procure partially or completely are being financed by APBN/APBD or another state budgeter. The act in the conspiracy of tender also is categorized as an act of corruptions. Therefore, there are two law enforcement institutions which have the authority to punish the perpetrators, that are KPPU and KPK. The purpose from this journal is to find out about how the efforts in law enforcement on government’s procurements of goods and services by KPPU and KPK, and what are the influence factors in the law enforcements process. This research is used with law normative method which is supported with data and information from interview or questionnaire. Futhermore, these article is using with statue approach and comparative approach. The results from this research are the law enforcement in government’s procurements goods and services by KPPU on tender conspiracy case have implemented of based in Anti Monopoly Law, KPPU Law Number 1 of 2019 and KPPU Law Number 2 of 2010 (Guidelines of Article 22). Whereas, law enforcement in government’s procurements goods and services by KPK on corruption case have implemented of based in Corruption Law, KPK Law and KUHAP. Both institutions have scope and authority for each other, however both of them have cooperation in terms of supervision and the law enforcement in government’s procurements goods and services which is poured on Memorandum of Understanding (MoU) between KPPU and KPK. Other than that, there are many factors that influence the law enforcement in government’s procurements goods and services by KPPU and KPK, there are law factor, law enforcer factor, tools/facilities factor, public factor and culture factor.

Abstract

The configuration of fisheries policy before regional autonomy shows the hegemony of the country which adheres to the legal doctrines of collective ownership, centralism, and anti-pluralism. Since the era of regional autonomy, the provincial and district / city governments have had more coherent authority in managing their regional potential, including fishery resources. With the shift in authority in managing fishery resources, it is hoped that the regions can play a role in optimizing the utilization of fisheries potential. But on the other hand, optimal management of fishery resources is difficult to achieve without harmonious policies. Therefore, to prevent conflicts of interest in the fisheries sector, Pancasila values need to be revived in fisheries resource management policies. The problems studied in this study are the authority of local governments in managing fishery resources in the era of regional autonomy, problems of harmonizing local government authority in managing fisheries resources, and harmonizing local government authority in managing fisheries resources based on Pancasila values. By using a normative juridical approach, the results of the research show that the authority of the regional government in managing fishery resources in the era of regional autonomy includes authority in the capture fisheries sector, authority in the field of cultivation, authority in the field of supervision of marine and fishery resources, and authority in the field of processing and processing. fishery marketing. However, so far there have been various disharmony problems with local government authorities in managing fishery resources. In addition, although regional autonomy is believed to have various advantages in optimizing the potential of natural resources, the management of fishery resources carried out in the era of regional autonomy has not fully animated the values of Pancasila as the philosophy of the Indonesian nation.

Abstract

Memberikan edukasi kepada masyarakat tentang pentingnya meningkatkan pengetahuan dan kesadaran hukum terhadap Undang-Undang Cipta Kerja dan peraturan pelaksanaanya di bidang kelautan dan perikanan sebagai upaya penanggulangan Illegal Fishing sangat dibutuhkan, dalam hal ini Kantor Syahbandar Perikanan Pelabuhan Perikanan Lempasing (PP Lempasing). Adapun target khusus kegiatan ini yakni mewujudkan pengawasan terhadap praktik Illegal Fishing di Pelabuhan Perikanan Lempasing. Metode yang dipakai dalam pencapaian tujuan tersebut yakni penyampaian materi melalui sosialisasi dan Focus Group Discussuin (FGD). Sasaran kegiatan ini ialah Kantor Syahbandar Perikanan Pelabuhan Perikanan Lempasing dan masyarakat nelayan sekitar Pelabuhan Perikanan Lempasing. Kegiatan ini berlokasi di gedung Kantor Syahbandar Perikanan Pelabuhan Perikanan Lempasing. Setelah pelaksanaan kegiatan, diketahui bahwa 85% dari 25 peserta yang hadir belum memiliki pengetahuan yang cukup tentang illegal fishing berdasarkan hasil rekapitulasi penilaian tes tertulis pertama, karena masing-masing tes peserta dengan jawaban benar tidak ada yang mencapai 50% dari 10 soal yang diberikan. Namun setelah mengikuti pengabdian terjadi perubahan yang signifikan terhadap tingkat pengetahuan peserta, yakni sebanyak 75% dari 25 peserta dengan jawaban benar mencapai 50% dari 10 soal tes tertulis yang telah diisi pada akhir kegiatan.

Abstract

The cases of IUU Fishing often occurred in Indonesia. This is due to the lack of supervision by the Indonesian government towards foreign vessels that are still fishing in Indonesian territorial and EEZ.  IUU fishing caused huge losses to the country. One of the perpetrators of this illegal act was the Thai Silver Sea 2 ship. The ship entered Indonesian territorial waters precisely in Sabang waters, by flying the Indonesian flag to trick the Indonesian government patrolling around Sabang waters. However, gradually the Indonesian government became aware of the existence of foreign vessels which had been suspected by Indonesia for a long time because it often turned off VMS so that its existence could not be detected by the Indonesian government. This study will examine more deeply related to whether the action conducted by Silver Sea 2 Vessels violate Indonesian regulation and UNCLOS 1982? And is the legal enforcement of Illegal Unreported and Unregulated Fishing taken by Indonesian government compatible with UNCLOS 1982?. This research is a normative legal research with a statute approach, and a conceptual approach. Legal material collection techniques are carried out by examining the relevant literature, analyzing various legal references relevant to the problem related to the study to be analyzed further qualitatively and descriptively. The results showed that the actions of SS2 ships violated Indonesian legislation and UNCLOS 1982 and were appropriate when this case was handled by the Sabang district court.

Abstract

Illegal levies are the designation of all forms of levies that are unofficial, which have no legal basis, so the act of levies is referred to as illegal levies. One of the criminal acts of corruption that occurs in people's lives is illegal fees. An example of a criminal case of illegal fees is the case in Decision Number: 46/Pid.Sus-TPK/2018/PN.Tjk in that case the defendant  was acquitted. Judging from the judge's decision that acquitted the defendant, the authors conducted research on the identification of illegal fees as a criminal act of corruption and what was the basis for the considerations of the Panel of Judges in passing an acquittal in cases of criminal acts of corruption based on Decision Number: 46/Pid.Sus-TPK/2018/ PN. Tjk. The problem with this research is the identification of extortion as a criminal act of corruption. and what are the basic considerations of the Panel of Judges in passing an acquittal in a corruption case based on Decision Number: 46/ Pid.Sus -TPK/2018/PN. Tjk The research method used is normative juridical research method, sources of primary and secondary legal materials. From this study it can be concluded that illegal fees can be categorized as a criminal act of corruption, this action is regulated in Article 12 letter e of Law Number 31 of 1999 which has been amended and added to Law Number 20 of 2001 concerning Eradication of Corruption Crimes. That the basis for the judge's considerations in deciding that the corruption case was free of Decision Number: 46/Pid.Sus-TPK/2018/PN.Tjk Defendant did not meet the elements of "benefiting oneself or others" and the element of "receiving gifts or promises" as charged in the Alternative indictment by the Public Prosecutor, so that the defendant is not legally and convincingly proven guilty of committing a criminal act of corruption.
