Abstract

The research on family law reform in Morocco aims to analyze the changes in family law in Morocco after the reform in 2004. The study discusses child marriage and the impact of the reforms on society, particularly in relation to gender equality and legal protection for women and children. This research is normative-explanatory and explains family law reform in Morocco by using a literature review to analyze policies. The results show that family law reform in Morocco has improved gender equality and provided better legal protection for women and children. However, there are still some challenges in the application of the law, such as changing attitudes towards tradition and culture and difficulties in applying the law in remote areas. This research can contribute to an understanding of the changes in family law in Morocco and can be used as a reference in efforts to improve legal protection for women and children in other countries that have similar legal systems.

Abstract

Pengangkatan anak dengan merubah nasab anak diharamkan dalam Islam. Dasar hukumnya diterangkan dalam Al-Quran Surah Al-Ahzab ayat 4 dan 5, kemudian pandangan Imam Syafi’i dan Fatwa MUI. Namun realita saat ini, banyak pengangkatan anak yang dilakukan olah masyarakat Kota Langsa dengan cara merubah nasab anak dan tanpa penetapan pengadilan. Faktor-faktor pengangkatan anak seperti pasangan yang tidak memiliki anak dan kepentingan anak yang diangkat. Masalah yang diambil dalam penelitian ini adalah Bagaimana praktik pengangkatan anak dibawah tangan yang dilakukan masyarakat Kota Langsa? Dan Bagaimana pandangan hukum Islam terhadap praktik pengangkatan anak dibawah tangan yang dilakukan masyarakat Kota Langsa? Metode penelitian ini menggunakan metode penelitian kualitatif. Sumber data primer diperoleh melalui observasi, dokumentasi dan wawancara dengan masyarakat maupun pihak yang bersangkutn lainya yang mengetahui secara jelas kasus pengangkatan anak yang terjadi. Berdasarkan hasil penelitian yang telah penulis lakukan, penulis mendapatkan kesimpulan bahwa adanya praktik pengangkatan anak yang masyarakat Kota Langsa lakukan, yang hanya menggunakan surat perjanjian tanpa penetapan pengadilan, lalu pada saat pencatatan anak juga terjadinya perubahan nasab secara tertulis di dalam akta kelahiran anak angkat tersebut. Praktik pengangkatan anak yang dilakukan masyarakat Kota Langsa dalam Islam hukunya haram karena merubah nasab secara tertulis, tidak melalui penetapan Pengadilan, layaknya seperti apa yang dipraktikan oleh orang-orang Arab terdahulu dengan merubah nasab anak tersebut.

Abstract

Abstrak Filosofis nafkah yang semulanya menjadi kewajiban suami memberi nafkah kepada istri, anak-anak, dan kerabat menjadi terbalik ketika pandemi covid-19 melanda masyarakat Indonesia. Alquran surah Albaqarah ayat 233 dan KHI dalam hal yang sama membebankan nafkah kepada suami tetapi karena situasi ekonomi yang semakin semerawut dan resesi mengakibatkan produk domestik bruto menurun. Artinya ada banyak suami-suami kehilangan pekerjaan akibat wabah ini. Metodologi yang digunakan adalah yuridis-sosiologis. Hasil penelitian sebagai berikut: bahwa dalam Albaqarah mewajibkan seorang suami memberikan nafkah kepada istri tetapi konteks lain, seorang istri atau anggota keluarga lain dapat berperan dalam menjaga ketahanan keluarga di masa pandemi ketahanan pandemi covid-19. Kemudian, Pasal 83 KHI menjelaskan seorang istri hanya berkewajiban utama berbakti lahir dan batin, makna berbakti boleh saja diinterpretasikan sebagai bentuk pembantuan atau meringankan sebagian tugas suami dalam hal nafkah ketika seorang istri dalam kategori mampu dan tidak ada unsur pemaksaan.  Abstract The philosophy of living, which was originally the husband's obligation to provide for his wife, children, and relatives, was reversed when the Covid-19 pandemic hit the people of Indonesia. Albaqarah verse 233  and KHI (Compilation of Islamic Law)  are imposes a living burden on the husband, but due to the increasingly chaotic economic situation and recession, the gross domestic product decreases. This means that many husbands have lost their jobs due to this epidemic. The methodology used is juridical-sociological. The results: Albaqarah requires a husband to provide a living, but in another context, a wife or other family members can. Then, the KHI explains that a wife has only the main obligation to serve physically and mentally, the meaning of filial piety may be interpreted as a form of assistance or easing some of the husband's duties in terms of living.

Abstract

Divorce is the breaking of the marriage bond for certain reasons. Economy is on of the reasons husband and wife can demand divorce at the syari’yyah court or the religious court. In the period 2015-2019, the Syari’yyah Langsa Court decided many divorce cases for various reasons, including the economic reason. The purpose of this study was to determine the economic impact of families on divorce in 2015-2019 and to determine the causes that dominated divorce in 2015-2019 at the Syar’iyyah Langsa Court. Researchers conducted research by processing data taken from the Syar’iyyah Langsa Court. The results obtained from this study are base on cases that have been decided by the Syar’iyyah langsa Court in 2015-2019, that the economy has an impact on divorce but the impact is not massive so that the economy does not really affect divorce. The most dominating cause of divorce, which reached 72.8% of the total cases that occurred in 2015-2019 was due to continuous disputes and arguments. Meanwhile, divorces due to economic causes accounted for 9.76% of the total cases that occurred in 2015-2019.

Abstract

Al-Qadi ‘Abd Jabbar dikenal sebagai seorang ahli dalam bidang hukum Islam dari mazhab Mu'tazilah. Ia berbeda pendapat dengan aliran-aliran mutakalimin yang lebih mementingkan otoritas tekstual. Salah satunya dalam kajian metode tarjih, ‘abd al-Jabbar mempergunakan akal dan ‘illlat yang berlawanan serta mengadakan tarjih diantara ‘illat manakah yang dapat diamalkan, maka bagi seorang mukallaf boleh memilih salah satu ‘illat diantara ‘illat-‘illat lainnya untuk menetapkan hukum. Metodenya Ini membuka jalan bagi pemikiran yang kontekstual dan responsif terhadap perubahan sosial. Tujuan penelitian ini yaitu untuk menganalisis konsep metode tarjih ‘Abd al Jabbar dan implikasinya terhadap ijtihad hukum Islam. Artikel ini merupakan penelitian kualitatif deskriptif dengan pendekatan konseptual. Adapun data dari kajian ini adalah karya 'Abd al-Jabbar yang paling terkenal adalah "al-Mughni" dan "al-Kitab al-Muhit. Hasil penelitian menunjukan bahwa metode tarjih dalam penyelesaian perbedaan hukum adalah pertimbangan pada kemaslahatan. Amplikasi terhadap ijtihad hukum Islam adalah penalaran akal dalam pengetahuan tentang konteks sosial dan pengaruh perubahan sosial terhadap kebutuhan masyarakat juga penting untuk menjalankan ijtihad hukum secara efektif.

Abstract

This paper aims to analyze the practice of murabahah contracts at Bank Aceh Syariah Langsa. So far, the paradigm for developing car ownership financing contracts has been the use of Murābahah contracts. In practice, banks often give customers money instead of cars, not in accordance with previously understood contracts, this becomes a dilemma for customers because in conditions like this, the inclusion of a wakalah contract which is part of the tabaru' contract to apply for financing at Bank Aceh Sharia. This research is included in non-doctrinal research with a conceptual approach. The context approach is used to analyze theoretically and practically related to the use of murabahah contracts. The research results show that Bank Aceh Syariah Langsa has not used a murabahah contract, this is because; first, the bank does not have sufficient expertise or experience in buying and selling cars; second, the tendency of customers and banks to use wakalah contracts as mandates for customers who want to buy a car. third, the banking sector does not have in-depth knowledge about the type of car, car price, car condition, or the legality of the customer's car transaction. Because the bank has handed over money to the customer to pay for the car to the seller. This article contributes to the importance of customer and bank understanding of the murabahah bil wakalah contract which requires collaboration between the bank, the seller and the customer for the monitoring process in purchasing a car to avoid conditions and gharar in buying and selling transactions. Because banks are not institutions that exclusively focus on buying and selling activities.

Abstract

Iddah merupakan tradis warisan pra islam yang eksistensinya tetap berlanjut hingga saat ini. Islam merekonstruksi tradisi iddah masyarakat jahiliyah pra islam menjadi lebih adil dan mengedepankan maslahah. Al-Qur’an dan hadis telah mengatur teknis pelaksaan iddah secara rinci. Meskipun demikian, belum ditemukan secara jelas didalamnya maqashid dari syariat iddah. Penelitian ini berusaha mengungkap maqashid atau tujuan yang ada dalam syariat iddah, kemudian menghubungkannya dengan ilmu psikologi keluarga. Para ulama salaf menyatakan bahwa maqashid umum dari iddah adalah untuk menjaga keturunan (hifdz al-nasl), khususnya dalam aspek pembebasan rahim (baraatur rahim). Namun seiring berjalannya waktu tujuan tersebut dianggap kurang relevan karena dapat digantikan oleh teknologi kedokteran yang lebih canggih. Sementara aspek psikologi dalam iddah dapat dapat ditemukan secara tersirat dalam beberapa ayat yang menjelaskan konsep iddah, misalnya dalam iddah perempuan hamil yang ditinggal mati suami dan perempuan steril (perawan) yang ditinggal mati oleh suami. Aspek psikologi dalam iddah hanya bersifat asumsi yang kebenarannya tidak bersifat mutlak, maka dari itu aspek ini tidak dapat digunakan untuk merubah atau menghapus beberapa ketentuan dari iddah yang telah disebutkan secara jelas dalam al-Qur’an dan hadis. Iddah is a pre-Islamic tradition whose existence continues to this day. Islam reconstructs the iddah tradition of pre-Islamic jahiliyah society to be fairer and prioritize maslahah. The Qur'an and hadith have regulated the technical implementation of iddah in detail. However, there has not been a clear maqasid found in the Iddah Shari'a. This research seeks to reveal the maqashid or goals contained in the iddah law, then connect it with the science of family psychology. Salaf scholars state that the general maqashid of iddah is to protect offspring (hifdz al-nasl), especially in the aspect of liberation of the womb (baraatur rahim). However, as time goes by, this goal is considered less relevant because it can be replaced by more sophisticated medical technology. Meanwhile, the psychological aspects of iddah can be found implicitly in several verses that explain the concept of iddah, for example in the iddah of pregnant women whose husbands die and sterile (virgin) women whose husbands die. The psychological aspect of iddah is only an assumption whose truth is not absolute; therefore this aspect cannot be used to change or delete several provisions of iddah which have been clearly stated in the Qur'an and hadith.

Abstract

This article aims to examine the patriarchal culture in the Marriage Law No.1 of 1974 and how gender relations and law strengthen gender equality in the context of marriage and family in Indonesia. This regulation is considered gender biased because of legal norms that are influenced by the patriarchal system. The Marriage Law states that a husband is obliged to protect his wife. Meanwhile, the wife is positioned as a companion and complement. This patriarchal concept has led women to stereotypes, subordination, marginalization, and domestic violence. The research method is a literature review to listen to women’s voices and examine articles (regulations) considered gender biased from a gender perspective, namely indicators of justice (access, control, participation, and benefits) and gender injustice (subordination, discrimination, stereotypes, double/multiple burdens, and marginalization). The research results show that the patriarchal culture is implied in Law no. 1 of 1974 (Article 7 Paragraph (1) implies Subordination, Article 3 paragraph (2) implies Discrimination, Article 4 paragraph (2) letters a, b, and c implies Discrimination, Article 31 paragraph (3) implies Subordination and Double/multiple burdens, Article 34 paragraph (1) implies marginalization and subordination, and Article 34 paragraph (2) implies subordinate and double/multiple burdens). Furthermore, Articles 2, 34, and 41 are considered to contain subordination (degrading women), which state that all men can automatically become heads of families who, in terms of work, are able to support their families. Meanwhile, the gender approach believes that the head of the family is a man or woman who has the power and ability to provide for their family. The conclusion is that reformulation of the Marriage Law is needed to increase the importance of a culture of gender equality in a long-lasting and happy marriage. Therefore, it is necessary to understand the new norms from a gender justice perspective to improve the lives of Indonesian people.

Abstract

The legal practice of adopting children carried out by some people in Langsa City also causes ambiguity in the process of making birth certificates, which is stated in Presidential Decree Number 25 of 2008 Article 87 Paragraph 2 concerning Requirements and Procedures for Population Registration and Civil Registration. After researchers conducted initial research on employees at the Population and Civil Registration office, they said that civil registration can only process birth certificates for adopted children if there is a court order, and so far no one has regulated otherwise.This type of research is Descriptive Analytical research, namely research that can provide an overview or explanation of the results obtained through data obtained from the field regarding several cases of child adoption in Langsa City. Therefore, the urgency of carrying out this research by the researchers themselves is to provide legal certainty and facts that actually occur regarding the requirements for making a birth certificate for an adopted child as a mandatory requirement that has been regulated in the Presidential Regulation in registering an adopted child.

Abstract

This thesis generally discussed the social change and its relationship to the practice of Islamic inheritance within the Acehnese community, especially those who live in Banda Aceh city. This study aims to investigate the impact of the social change in altering the inheritance law. Data for this study were primarily gathered through questionnaire surveys. In addition, secondary data were gathered through various Islamic literatures, books, articles, seminar papers and other related materials. The questionnaires were distributed to 230 respondents that were randomly chosen among Banda Aceh community. The findings of this study revealed that the social change has influence on the altering of the Islamic inheritance law within the community. The data shows that the practices of inheritance in Banda Aceh were mostly based on family approval. These practices were influenced by several of social change’s factors, such as role of wives in earning family income, economy, gender, justice and traditions. As this study has several limitations, it was recommended that future studies need to examine this matter more comprehensively due to some deficiencies in its application such as the use of fiqh and ushul methods.
