Abstract

Fiqh is a product of ijtihad, developed through a dialectical process between textual sources and real-world contexts. Fiqh possesses various characteristics, some of which are rigid and complex, while others are more flexible and adaptable. Rigid fiqh arises from an ijtihad that is fixated on textual understanding without exploring its objectives (maqashid), whereas excessively flexible fiqh is formulated from an ijtihad that prioritises maqashid while disregarding the texts (al-naṣ). Both patterns of ijtihad represent extremes that are not justified within the framework of Islam. Consequently, it is essential to examine and apply a flexible and dynamic fiqh derived from moderate ijtihad. This article aims to analyse and identify applicable concepts related to the theory of moderate ijtihad as articulated by Abdullah bin Bayyah, subsequently implementing these concepts in response to contemporary issues. This research constitutes a literature review that investigates the thoughts of contemporary scholars and analyses them employing a descriptive-analytical approach to derive meaningful insights. This study plays a crucial role in examining and applying the concept of moderate ijtihad to address contemporary matters in Islamic jurisprudence, which continue to evolve alongside the progress and transformation of human civilisation. Furthermore, moderate ijtihad has the potential to produce Islamic legal rulings that are not only flexible and adaptive but also firmly grounded in the higher objectives of sharia (maqashid sharia). The research findings indicate that Abdullah bin Bayyah's method of moderate ijtihad involves linking al-nuṣūṣ with maqashid sharia, observing and distinguishing between al-thawābit and al-mutaghayyirāt, considering the context of changing times in formulating Islamic law, acknowledging customs, ‘urf, or local traditions, contemplating the consequences, and considering conditions, as well as personal and community psychology. The application of moderate ijtihad results in the formulation of legal rulings, such as the prohibition of gelatin derived from pigskin and bones—except in cases of necessity—and the obligation of marriage registration.

Abstract

The purpose of this community service paper is to find the basic framework for the construction of Islamic economics for the development of civil society, an offer for government authorities, the Association of Islamic Economic Experts (IAEI), the National Islamic Economic Committee (KNEKS), Islamic boarding schools and Muslims. The economic system adopted by most people in this part of the world has failed to create a prosperous society and build harmony. However, has created economic pressure. They have failed to reduce poverty. This community service paper model is a proposal, socialization and advice for government authorities, Islamic institutions and boarding schools to implement Islamic Economic Construction towards civil society. This paper concludes that the construction of Islamic economics towards the development of civil society includes: 1. Tauhid, all economic resources are God's creation, and their arrangement and distribution must be by the rules. 2. Nubuwwah, all sources and economic policies must be guided by the Prophet, who has successfully created social welfare. 3. Adl (justice), the principle of justice, is the basis for building civil society and creating equal access to meeting needs. 4. The Khilafah government is essential for the sustainability of the Islamic economy, which aims at the welfare of society. Without the role of the government, implementing Islamic economics is impossible to materialize. 5. Maad, profit from Islamic economics is the goal of economics, especially the results that can later be taken in the hereafter, and has two dimensions, namely profit (economic) and success in the hereafter.

Abstract

Investment strategies based on Environmental, Social, and Governance (ESG) principles are gaining popularity as a response to global sustainability challenges. This study evaluates the performance of an ESG-based stock portfolio derived from the IDX ESG Leaders index, representing a green investment strategy in the Indonesian market. Five constituent stocks—BBCA, UNVR, TLKM, SMGR, and DSNG—were selected based on ESG risk ratings and market capitalization. Using daily return data from January 2021 to April 2025, the portfolio performance was assessed through Sharpe Ratio, Treynor Ratio, and Jensen Alpha. The results show that BBCA demonstrated the highest risk-adjusted efficiency with a Sharpe Ratio of 0.00445, while DSNG showed the strongest performance relative to market expectations with a positive Jensen Alpha of 0.000003. TLKM recorded the highest Treynor Ratio at 0.00057. These findings suggest that ESG-oriented stock selection, when combined with rigorous risk-return analysis, can support the development of competitive and sustainable portfolios. This study highlights the financial viability of green investing and its potential contribution to sustainable capital markets.

Abstract

Investments that incorporate Environmental, Social, and Governance (ESG) principles are increasingly recognized as a strategic approach to support the transition toward a green economy. This study aims to optimize a stock portfolio composed of constituents from the IDX ESG Leaders index by employing three performance evaluation indicators: Sharpe Ratio, Treynor Ratio, and Jensen’s Alpha. Five stocks—ADRO, INKP, EXCL, BFIN, and KLBF—were selected based on strong ESG scores, large market capitalizations, and consistent inclusion in the ESG index for the past two consecutive years. The data used consist of daily closing prices from January 2021 to April 2025, with the BI 7-Day Reverse Repo Rate serving as a proxy for the risk-free rate. The results indicate that certain ESG-based portfolios can deliver competitive risk-return performance, with ADRO and KLBF exhibiting superior Sharpe Ratios and positive Jensen’s Alpha values compared to the other stocks. These findings reinforce the role of ESG in constructing investment portfolios that are not only financially viable but also aligned with long-term sustainability goals.
