Abstract

Ada satu prinsip mendasar yang harus diperhatikan dalam implementasi lembaga keuangan di Indonesia, yaitu Prinsip Mengenal Nasabah. Penerapan prinsip mengenal pelanggan Anda untuk perusahaan asuransi secara khusus diatur dalam Peraturan Ketua Badan Pengawas Pasar Modal dan Lembaga Keuangan (Bapepam dan LK) Nomor Per-01 / BL 2011 tentang Pedoman Prinsip Mengenal Pelanggan Anda Pedoman Pelaksanaan untuk Perusahaan Asuransi . Setiap perusahaan asuransi diharuskan membuat Pedoman Prinsip Mengenal Nasabah dan SOP Anda untuk mengetahui dan menganalisis calon pelanggan dan memantau transaksi yang dilakukan oleh pelanggan mereka. Penerapan prinsip mengetahui pelanggan adalah bentuk perlindungan hukum preventif dalam upaya mencegah pencucian uang dari perusahaan jasa keuangan. There is one fundamental principle that must be considered in the implementation of financial institutions in Indonesia, namely the Know Your Customer Principle. The application of know your customer principles to insurance companies is specifically regulated in the Regulation of the Chairperson of the Capital Market and Financial Institution Supervisory Agency (Bapepam and LK) Number Per-01/BL 2011 concerning Know Your Customer Principles Implementation Guidelines for Insurance Companies. Every insurance company is required to make the Know Your Customer Principles Guidelines and SOP to know and analyze prospective customers and monitor transactions carried out by their customers. The application of the principle of knowing customers is a form of preventive legal protection in an effort to prevent money laundering from occurring in financial service companies.

Abstract

Penelitian ini untuk mengetahui dan menganalisis kewenangan dan hakikat kedudukan notaris dalam membuat grosse akta pengakuan hutang yang memiliki irah-irah eksekutorial dikaitkan dengan kedudukan notaris sebagai pejabat umum. Penelitian ini merupakan penelitian hukum normative dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan sejarah. Hasil penelitian menunjukkan bahwa kewenangan notaris dalam membuat grosse akta pengakuan hutang yang memiliki irah-irah eksekutorial dikaitkan dengan kedudukan notaris sebagai pejabat umum adalah bersifat atributif. Grosse akta pengakuan hutang sebagai produk hukum dari notaris yang notabene bagian dari eksekutif memang memiliki karakteristik yang sama dengan produk hukum yudikatif, sehingga dalam eksekusinya diperlukan penetapan dari pengadilan sebagai bentuk legalitas dari pelaksanaan eksekusi grosse akta pengakuan hutang. Irah-irah eksekutorial pada grosse akta pengakuan hutang pada hakikatnya tidak mempunyai kekuatan eksekutorial langsung, tetapi harus melalui penetapan dari pengadilan sebagai bentuk legalitas pelaksanaan eksekusi. Namun demikian, kedudukan grosse akta pengakuan hutang yang memiliki irah-irah eksekutorial sebagai salinan dari suatu minuta akta berbeda dengan salinan dari akta-akta lainnya yang tidak memiliki irah-irah eksekutorial. Kekuatan hukum dari suatu grosse akta pengakuan hutang yang memiliki irah-irah eksekutorial hanya untuk memberikan kepastian hukum mengenai adanya suatu hubungan hukum utang piutang saja serta memberikan kepastian hukum kepada kreditor perihal eksekusinya yang tidak perlu lagi melalui pengajuan gugatan, namun hanya didasarkan atas permohonan kreditor.

Abstract

This study aims to analyze and explain the form of responsibility of the supervisors of the Regional Supervisory Board (MPD) towards notaries who leave their territory of office without valid reasons and formulate and identify the effectiveness of the supervisory function of the Regional Supervisory Council (MPD) against notaries who leave their territory of office without valid reasons. This research is an empirical legal research. The research was conducted in Makassar City, South Sulawesi. The results of the study show that the supervision carried out on a Notary is intended so that the Notary in carrying out his duties is based on the rules according to the provisions of the laws and regulations governing the position of a Notary. The laws and regulations governing office do not only require laws or laws, but also based on the trust given by the parties to the notary. Notaries must act professionally in carrying out their duties, because the position of Notary is a position of trust that must be aligned with those who carry out the duties of a Notary's position as a person who can be trusted. Notary as a position of trust does not mean anything if it turns out that those who carry out their duties as a Notary are people who cannot be trusted, including leaving their area of office without a valid reason.

Abstract

This research aims to analyze the regulation of the use of the customary land of the Bunggu Tribe Customary Law Community in Pakawa Village, Pasangkayu Regency, West Sulawesi Province and to analyze the role of the Regional Government of Pasangkayu Regency in terms of recognizing and protecting the customary land of the Bunggu Tribe Customary Law Community. This research is an empirical type of research, the location of this research was carried out in Pakawa Village, Pasangkayu Regency, West Sulawesi Province. The results of the research show that the regulation of the use of the customary land of the Bunggu Tribe Customary Law Community in Pakawa Village, Pasangkayu Regency, West Sulawesi Province, is still being regulated using customary mechanisms, meaning that every person who owns or will manage land must have the knowledge of the traditional stakeholders. And the role of the Regional Government of Pasangkayu Regency in terms of recognizing and protecting the customary land of the Bunggu Tribe Traditional Law Community in Pakawa Village, Pasangkayu Regency, West Sulawesi Province, is only limited to recognizing the existence of the Bunggu Tribe culturally and customarily, not yet providing legal or regulatory recognition through Regional Regulations ( Regional Regulation).

Abstract

This study aims to analyze the implementation of cyber notary services in Makassar City and to analyze the inhibiting factors for implementing cyber notary services in making deed in Makassar City. This research is an empirical research type, the location of this research was conducted in Makassar City, South Sulawesi Province.  The results of the study show that the application of cyber notary services to date has not had a notary in Makassar City who has made a notary deed using the cyber notary system because a notary does not have the authority granted by law to make it. The authority granted by UUJN is limited to the authority to certify transaction activities between notaries and appearers, including data collection. But not for the Notary's authority as a whole, namely the preparation of authentic deeds or the making of authentic deeds. The existence of legal implications for the delay in implementing cyber notary services is due to the ambiguity of norms (inconsistency) regarding Article 16 paragraph (1) letter m UUJNP 2014 with Article 15 paragraph (3) UUJNP 2014 which has implications for the implementation of a notary's authority such as the application of cyber notary in making deed authentic. Including the existence of several existing laws, namely: Article 1 paragraph (7) UUJN; Article 16 paragraph (1) letter m UUJN; Article 1868 Civil Code; and Article 5 paragraph (4) of the ITE Law which has legal implications for delays in the implementation of cyber notary services. So that if a notary insists on making an authentic deed in a cyber notary way, it will result in the degradation of the authentic deed into an underhanded deed.

Abstract

Due to disharmony between Law on the Office of Notaries and Regulations of the Minister of Law and Human Rights Number 9 of 2017 in recognizing service users for notaries, in this case the lack of clarity regarding the regulation of service user transaction monitoring obligations so that notaries experience a dilemma in implementing Know Your Customer (KYC) and are more inclined to implement KYC according to Law on the Office of Notaries and Regulations of the Minister of Law and Human Rights Number 9 of 2017 considering Law on the Office of Notaries than the Notary Code of Ethics are the legal basis for a notary in carrying out his duties and authorities which in terms of the hierarchy of laws and regulations have a higher position than the Regulations of the Minister of Law and Human Rights Number 9 of 2017, this is in accordance with the principle of Lex Superior Derogate Legi Inferiori where higher regulations overrule lower regulations.Keywords: Transaction Monitoring, Notary, Money Laundering

Abstract

Penelitian ini bertujuan untuk menganalisis pengaturan penggunaan instrumen kontrak dalam pembangunan Centre Point of Indonesia (CPI) di Kota Makassar. Penelitian ini adalah penelitian normatif dengan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian menunjukkan bahwa pengaturan penggunaan instrumen kontrak dalam pembangunan Centre Point of Indonesia (CPI) di Kota Makassar dimungkinkan oleh peraturan perundang-undangan, yakni Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan, Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah, dan Undang-Undang Nomor 27 Tahun 2007 jo. Undang-Undang Nomor 1 Tahun 2014 dan Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil. Kontrak yang dimaksudkan dalam konteks ini adalah kontrak publik oleh karena salah satu pihaknya adalah Pemerintah Provinsi Sulawesi Selatan. Tanggung jawab para pihak dalam kontrak untuk pembangunan Centre Point of Indonesia (CPI) di Kota Makassar lahir dari adanya hak dan kewajiban masing-masing pihak yang diatur dalam Perjanjian. Selain itu, tanggung jawab yang dimaksud juga tibul dari peraturan perundang-undangan yang terkait dengan kegiatan reklamasi tersebut. Untuk itu, maka para pihak memikul beban tanggung jawab, baik secara personal maupun secara institusional sehingga para pihak dapat dinakan sanksi administratif, sanksi perdata, maupun sanksi pidana.

Abstract

Penelitian ini bertujuan untuk menganalisis dan evaluasi Peraturan Daerah Kabupaten EnrekangNomor 5 Tahun 2005 tentang Pandai Baca Al-Qur’an dan relevansinya terhadap nilai-nilaiPancasila. Penelitian ini adalah metode penelitian yuridis normatif. Pendekatan menggunakanpendekatan perundang-undangan, pendekatan konseptual, dan pendekatan analitis. Hasilpenelitian menunjukkan bahwa indikator nilai dalam Pancasila, jika dikontekstualisasikandengan Peraturan Daerah tentang Pandai Baca Al-Qur’an di Kabupaten Enrekang, terdapatbeberapa indikator yang tidak sejalan, bahkan dapat dikatakan cenderung bernuansadiskriminatif. Perda yang diterbitkan pada suatu daerah tidak boleh mengatur untuk 1 (satu)golongan saja, namun harus mampu menjangkau seluruh lapisan masyarakat tanpa mengenalperbedaan suku, agama, ras, dan golongan. Dapat pula dikatakan tidak memberikan keadilansecara lahir maupun batin terhadap pemeluk agama Islam oleh sebab adanya beberapapenambahan persyaratan pada wilayah-wilayah tertentu. Terdapat ketentuan sanksi yang dapatmenggugurkan pemeluk agama Islam untuk berkompetisi pada sektor tertentu.

Abstract

This study investigates the connection between agrarian reform and human rights, exploring how agrarian reform, as a strategy to address structural inequalities in land distribution, is fundamentally linked to human rights principles. Through a normative approach incorporating statutory, theoretical, and philosophical analyses, this research highlights that agrarian reform is not merely a policy choice but an obligation for States, stemming from their duty to uphold the human right to land. International frameworks, including the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP 2007) and the United Nations Declaration on the Rights of Peasants (UNDROP 2018), recognize the right to land as a central element of human rights. In the context of Indonesia, where land inequality remains a significant issue, agrarian reform is essential for achieving social justice and redressing historical injustices, particularly for marginalized groups such as peasants and Indigenous peoples. The study argues that agrarian reform should not be viewed merely as land redistribution but as a broader effort to promote human dignity, equality, and prosperity, thus aligning with the principles of social justice and the State’s responsibility to ensure equitable land access. This research contributes to the understanding of agrarian reform as a human rights imperative, offering insights into its theoretical underpinnings and practical implications for legal and policy reforms.

Abstract

Pengaturan di bidang pengelolaan sumber daya alam di Indonesia saat ini sudah sangat banyak dan cukup komprehensif. Beberapa peraturan perundang-undangan tersebut juga sudah menguraikan mengenai izin yang dapat dilakukan dalam hal pengelolaan sumber daya alam di berbagai bidang sektoral. Instrumen izin dalam pengelolaan sumber daya alam merupakan salah satu bentuk konkrit dari Hak Menguasai Negara atas sumber daya alam. Izin merupakan instrumen pengelolaan sumber daya alam sekaligus sebagai mekanisme kontrol pemerintah melalui persyaratan izin yang ditentukannya. Penerbitan izin pengelolaan sumber daya alam wajib untuk memperhatikan ketentuan dalam UU PPLH dan bahkan Izin Lingkungan menjadi syarat mutlak untuk mendapatkan izin pengelolaan sumber daya alam.
