Abstract

This paper aims to examine the extent of the impact of the decision of the Constitutional Court of the Republic of Indonesia No. 1/PHPU.PRES-XII/2014 related PHPU 2014 presidential election dispute  in relation to  the  strengthening  of the constitutional legitimacy of the democratic state based on law and the constitution. Constitutional Court Decision No. 1/PHPU.PRES-XII/2014 gives importance to the development of our constitutional democratic system of government in the modern era. The Constitutional Court’s decision gives the meaning of democracy in a substantial sense of justice substantive. As a state agency to maintain and oversee the constitution, the Constitutional Court has been performing its functions and powers under the provisions of Section 24C of the 1945 Constitution and Law No. 24 of 2003 on the Constitutional Court. The Constitutional Court is a high state institution that is authorized through Section 24C of the 1945 Constitution, which is the authority to hear at the first and last are the final and binding nature of the decision, which among other things PHPU deciding the case, and based on Law No. 24 of 2003 as amended by Law Law No. 8 of 2011 concerning Amendment to Law Number 24 of 2003 on the Constitutional Court, and Article 29 paragraph (1) letter d Act No. 48 of 2009 on Judicial Power of the Constitutional Court, in essence the same, which is authorized to hear at the The first and last are the final and binding nature of the decision, including the case PHPU. In this sense the decision of the Constitutional Court put an end to various political opposition including the closing of all the dynamics of the political interpretation of the law that developed in the community.

Abstract

In recent years, Indonesia has experienced a decline in morals, akhlakul madzmumah (despicable morals), a decline in the quality of good behavior due to lack of parental supervision and the influence of gadgets, online media that can be accessed, with any livelihood in the palm of your hand. The rise in cases of delinquency and crime such as cases of drug abuse, and sexual deviations among lesbians, gays, bisexuals and transgender people, where sexually transmitted diseases are transmitted. According to data from the National Narcotics Agency, as many as 2.2 million Indonesian teenagers are drug abusers, according to Imelda to Radio Republik Indonesia on Wednesday, June 26 2024. . Indonesia has a population of 3% LGBT. In other words, of the 250 million Indonesian population, around 7.5 million of whom are LGBT due to parental negligence in educating their children, meaning that out of 100 people gathered, 3 of them are LGBT (CIA research reported by sixpackmagazinedotnet, research by Hasnah journal of the Nursing Study Program, FKIK UIN Alaudi Makasar). Family in Arabic is called ahlun from ahal which means marriage, apart from the word ahlun the words which mean family are, asyirah (family of descendants), and qurba (those related to kinship). Home and family are the main basis for religious education from an early age which is usually carried out by the mother (Al-Ummu Madrasatul “Ula). As Rasulullah SAW said, "Sun your homes with prayer and reading the Koran."Strengthening family resilience can be a way to produce the next generation who are strong, like religious injunctions, so they can survive in overcoming life's problems. As Allah SWT says in Surah An-nisa verse 9 "And fear Allah, those who leave behind them weak children, whose welfare they fear. Therefore, let them fear Allah, and let them speak the right words."Family resilience through optimizing the role of the Muslim congregation plays an important role in the nation's resilience. A quality family will give birth to a quality next generation of the nation (qurrata a'yun). In this research we used qualitative descriptive methods, journals and e-journals, scientific books and e-books, because they are systematic, in collecting data through data triangulation, validation, observation and interviews. It is hoped that the results of this research will give birth to the nation's next generation towards baldatun thayyibatun wa rabbun ghafur. Amen, Ya Rabbal'alamin.

Abstract

Islam Rahmatan Lil Alamin is a concept that affirms that Islam exists as a blessing for the entire universe, including humans, animals, and the environment. In the era of globalization, this principle has become relevant to strengthen social harmony in the midst of plurality of society. This article aims to analyze how Islamic da'wah based on Rahmatan Lil Alamin can be an effective means of building social harmony in the global era. Using a qualitative approach and literature study, this article discusses moderate da'wah strategies, principles of social justice, and tolerance between religious communities. The results of the study show that Islamic da' wah Rahmatan Lil Alamin plays an important role in strengthening religious moderation, reducing the potential for social conflicts, and promoting the values of compassion and justice for all elements of society. This finding strengthens the urgency of integrating the concept of Rahmatan Lil Alamin in contemporary da'wah strategies in order to maintain social harmony.

Abstract

Etika Yunani maupun dalam diskursus tentang etika modern secara substansial memiliki persamaan, di mana etika memberikan arahan agar manusia dapat hidup dengan baik dan bermakna berdasarkan nilai-nilai kebaikan. Agar manusia hidup baik maka yang perlu ditempuh ialah dengan menggunakan etika kebijaksanaan. Etika kebijaksanaan inilah yang memunculkan orang-orang bijaksana, karena orang-orang bijaksana memahami kehidupan atas kosmos dan realitas. Plato mengatakan, negara dan pemerintahan haruslah di bawah kendali orang-orang bijaksana. Karena orang-orang bijaksana tidak hanya menggunakan rasionalitasnya tetapi juga akal budi untuk memahami realitas. Dalam kehidupan sosial tidak semua individu memiliki kualitas dan kapasitas kepribadian yang pantas dijadikan sebagai rujukan atas suatu perintah. Dalam dunia organisasi sosial maupun organisasi pemerintahan sekalipun tidak semua individu dapat tampil dengan baik memberikan instruksi tertentu kepada bawahannya dengan mengatasnamakan organisasi. Pembahasan mengenai etika selalu menekankan dimensi integritas seseorang, apakah dapat dipercaya atau tidak. Sebaik apapun sistem, namun di bawah kendali orang yang tidak pantas menjalankannya maka tidak akan menghasilkan perubahan yang diinginkan. Greek ethics and modern ethics have substantial similarities, in which ethics provides direction so that humans can live well and meaningfully based on the values ​​of goodness. In order for humans to live well, what needs to be done is to use ethical wisdom. It is this wisdom ethic that gives rise to wise people, because wise people understand life over the cosmos and reality. Plato said, the state and government must be under the control of wise people. Because wise people use not only their rationality but also reason to understand reality. In social life, not all individuals have the qualities and capacities of personalities that deserve to be used as a reference for an order. In the world of social organizations and governmental organizations, not all individuals can perform well giving certain instructions to their subordinates on behalf of the organization. Discussion on ethics always emphasizes the dimension of one's integrity, whether it can be trusted or not. No matter how good the system, but under the control of people who do not deserve to run it will not produce the desired changes.

Abstract

Human philosophy is a servant of Allah SWT who has the task of preaching to command goodness and avoid the prohibitions of Allah as stated in the At-Tahrim Letter verse 6 "Protect yourselves and your families from the fire of hell". Humans as believers or people who believe should ensure the improvement and enhancement of their personal lives. Islam is not a religion that only consists of dogma, worship and ceremonies. Islam is actually a complete way of life, which guides humans according to the guidance given by Allah to His Messenger, Muhammad. Islam is a system and rule of life.the spiritual and moral values ​​taught by sharia. Islamic legal system derived from the Qur'an and Sunnah. Sharia regulates various aspects of human life, from worship, muamalah (social interaction), to social sharia. The philosophy of a knowledgeable or knowledgeable person is an achievement that is in the process of seeking the ultimate truth. This article will discuss the relationship between humans and sharia, and how sharia guides humans towards a blessed life in social society. To answer this problem, the researcher uses a qualitative descriptive research method through library data such as online journals, e-books and scientific books, law of books, yuridis normatif in order to obtain systematic, good and correct results. The social benefits of religion are building solidarity and unity, increasing community welfare, maintaining harmony between religious communities.

Abstract

This study investigates the educational and political da'wah thought of KH. Abdurrahman Wahid (Gus Dur), emphasizing the intertwined values of citizenship and pluralism within the Indonesian Islamic context. As a renowned Muslim intellectual, former President, and social reformer, Gus Dur envisioned Islam as a moral force that upholds democracy, respects human rights, and nurtures interfaith harmony. Employing a qualitative-descriptive approach, this research draws upon an extensive literature review and content analysis of Gus Dur’s writings, speeches, and public interventions. The study reveals that Gus Dur’s da'wah was not limited to ritualistic preaching but extended into socio-political advocacy rooted in inclusive education. His concept of “civic Islam” sought to transcend ethnic, religious, and ideological boundaries, emphasizing universal values such as justice, tolerance, and human dignity. He actively challenged sectarianism and authoritarianism, positioning Islam as compatible with democratic governance and civil society. Furthermore, Gus Dur’s political da'wah prioritized the protection of minority rights and the preservation of national unity, framing diversity as a divine gift rather than a threat. These insights contribute significantly to contemporary discourses on Islamic education, da'wah strategies, and the role of religion in multicultural societies. The study concludes that Gus Dur’s legacy offers a transformative model for integrating religious, civic, and pluralist values in the Muslim world.

Abstract

Social media has an important and strategic role in building public opinion, even in certain conditions, social media becomes one of the determining forces of voters' preferences. The socio-political construction played by social media in the era of digital democracy is able to change the political choices of citizens in a short time. Temporary truth is played by social media because the community is faced with various information facilities and without delving more seriously into a news report. At the presidential election campaign stage, the propaganda of the campaign team and actors using social media is very massive, including personal social media instruments such as Twitter, Facebook, YouTube, Instagram, and TikTok. The political communication instrument using Twitter social media by AMIN is one of the strategies in building positive propaganda opinions that are commonly used by other candidate pairs. This propaganda concept is considered effective for use in implementing the 2024 Presidential Election campaign stage. Propaganda has effective power to gain public sympathy. It seems that the propaganda concept approach is important because by moving this propaganda theory in an educational way, it can change public perception. The use of propaganda theory, which is an important part of political communication, determines the attitude of public preferences. The AMIN candidate pair is well aware that this propaganda approach can change a person's choice of attitude. So Twitter was chosen as one way to socialize and convey to the public about AMIN's vision and mission.

Abstract

ABSTRACT. Studi hukum Islam (fiqih) kontemporer menghadapi tantangan dalam merespons persoalan baru yang tidak secara eksplisit tercantum dalam teks primer Al-Qur’an dan Sunnah. Artikel ini bertujuan menganalisis peran Perbandingan Mazhab dan epistemologi Ushul Fiqih sebagai metodologi dinamis untuk menghadapi tantangan tersebut. Penelitian ini menggunakan pendekatan kualitatif melalui kajian pustaka (library research) yang menelaah literatur klasik dan kontemporer. Temuan menunjukkan bahwa: (1) Keragaman mazhab fiqih (Hanafi, Maliki, Syafi‘i, Hanbali) merupakan kekayaan intelektual yang lahir dari perbedaan metodologi istinbath hukum yang sah, bukan indikasi perpecahan; (2) Dialektika historis antara Ahl al-Ra’y (nalar) dan Ahl al-Hadits (teks) melahirkan Ushul Fiqih sebagai epistemologi yang menjembatani wahyu dan penalaran kontekstual; (3) Pendekatan Perbandingan Mazhab berbasis Ushul Fiqih menghasilkan solusi hukum yang inklusif, toleran, dan relevan dengan isu modern, seperti ekonomi digital, bioetika, dan keadilan sosial. Studi ini menyimpulkan bahwa revitalisasi Perbandingan Mazhab dan Ushul Fiqih dalam pendidikan dan dakwah Islam penting untuk membentuk Muslim yang kritis, moderat, dan mampu melakukan ijtihad kontekstual.
