Abstract

Interaksi antara hukum Indonesia yang dinamis dan kearifan lokal telah menghasilkan berbagai macam aturan hukum yang berlaku. Salah satu contoh kedinamisan ini tercermin dalam pengaturan mengenai peternakan. Hal ini bertujuan untuk melindungi sumber daya hewan dan meningkatkan kualitas makanan yang aman, sehat, utuh, dan halal, serta meningkatkan derajat kesehatan masyarakat, hewan, dan lingkungan, serta menyediakan jasa dan bahan baku industri. Selain itu, regulasi tersebut juga bertujuan untuk memperluas peluang berusaha dan kesempatan kerja serta meningkatkan kesejahteraan masyarakat. Oleh karena itu, peran pemerintah dalam regulasi yang berkaitan dengan peternakan, khususnya Asosiasi Peternak Sapi Perah, tidak boleh diabaikan. Asosiasi ini merupakan cara yang logis untuk menjalankan kebijakan-kebijakan yang terkait dengan kewajiban dan hak-hak para peternak sapi perah. Secara keseluruhan, tugas dan fungsi Asosiasi ini untuk memberikan perlindungan melalui penerbitan regulasi berupa peraturan perundang-undangan.

Abstract

This study aims to determine the implementation of investigations into medical practice crime (medical malpractice) in the South Sulawesi Regional Police and also know the factors that influence the investigation of medical practice criminal acts in the South Sulawesi region. The study was conducted at the South Sulawesi Regional Police Headquarters (Mapolda Sulsel) Directorate of Special Criminal Investigation, South Sulawesi Regional Police located in Makassar, with the Field Research method by obtaining data by conducting direct research in the field through interviews or direct talks with Investigators, and also Literature Research Method This method is an attempt to obtain secondary data through reading material in the form of scientific writings, legislation, theories of experts through various media. The results of this study indicate the implementation of investigations into medical practice crimes based on Article 5 of the Criminal Procedure Code, Law Number 2 of 2002 concerning the Republic of Indonesia Police, Police Headquarters Exchange Number 6 of 2019 and Regulations on Kabareskrim Number 3 of 2014 plus Law Number 29 of 2004 concerning Medical Practices, Law No 36 of 2009 concerning health, Law Number 36 of 2014 concerning health workers and internal regulations on other medicine for the handling of medical malpractice cases is the basis for investigators and auxiliary investigators perform a series of actions to find 2 legal preliminary evidence, to search for and find criminal acts. or not, the implementation of investigations into medical practice in golongka in very difficult cases that require science-type crame investigation in handling, this case requires many scientific disciplines and many experts who are involved in the disclosure of the case whether it is from medical experts and criminal law , this case is classified as a case that is considered to be a very difficult case.

Abstract

This study aims to determine the process of using fingerprints in proving a murder crime at the investigation stage and to determine the constraints in the use of fingerprints in proving a murder crime at the investigation stage. This research uses descriptive analysis type of research that uses empirical juridical research type. This study states that fingerprints (dactyloscopy) are used as evidence in uncovering murder crime cases in order to find suspects, fingerprints are also very effective and have advantages, the obstacles encountered in using fingerprints in proving murder crimes at the investigation stage, are resource constraints human resources, few members of the police who have expertise in the field of ductyloscopy, weather, facilities in the field of fingerprints and the community will lack knowledge of the crime scene.

Abstract

The research aims to know: 1) the application of criminal penalties on clearing the land by incinerating as the first alternative indictment in criminal No.27/Pid.b/Lh/2020/Pn.Enr; 2) a judge's legal consideration in rendering a criminal verdict against clearing by searing in a verdict of No.27/Pid.b/Lh/2020/Pn.Enr. The method of research used is qualitative descriptive research by conducting interviews with those involved in the case. Research shows: 1) application of criminal penalties on clearing the land by searing at a verdict of No.27/Pid.b/Lh/2020/Pn.Enr. Has not created a sense of justice for the actions of the accused, who opens the land by searing into the forest preserve, due to a consideration of only aspects of the plantation 2) judge's legal judgment on clearing the land by searing at the verdict No.27/Pid.b/Lh/2020/Pn.Enr, in consideration of this it appears that the judge has not considered a few other factors so as not to reflect a sense of justice for the accused's actions

Abstract

This study aims to find out all the obstacles experienced in overcoming climate change by handling single-use plastic waste in Makassar City, that makes Makassar City becomes the largest waste-producing area in Eastern Indonesia, and the legal rules used related to controlling the use of plastic do not can be implemented optimally. The research method used is descriptive qualitative. The research location is in Makassar City. Data collected by using literature review methods, interviews, observations, and documentation. The results showed that the obstacles to handling single-use plastic waste in Makassar City were local regulations that did not regulate the control of all types of single-use plastics, lack of public knowledge about the impact of single-use plastics, lack of long term assistance, inadequate and environmentally unfriendly waste processing facilities, and lack of awareness of perpetrators efforts to overcome the problem of single-use plastics.

Abstract

This study aims to determine the judge's consideration in imposing sanctions under the minimumsentence in the verdict case number 33 / Pid. Brief / 2020 / PN.Mks and to find out the sanctionsfor judges who impose sentences under the minimum criminal sanction. The research methodused is normative legal research. Types and sources of data consist of primary data in the formof statutory regulations, Supreme Court Circular Letters and Court Decisions as well assecondary legal materials consisting of books, articles and journals related to this research. Alllegal materials were analyzed qualitatively and presented descriptively analysis.The results show that the judge's consideration in imposing criminal sanctions under theminimum sentence is based on the Supreme Court Circular (SEMA) Number 3 of 2015 whichbasically allows judges to deviate from the minimum crimes in Article 111 and Article 112 of theNarcotics Law. Then there are no sanctions for judges who impose a sentence under theminimum sentence, but every judge's decision that deviates from the minimum sentence must be followed by sufficient consideration, both juridical and sociological considerations.

Abstract

The aims of the research are to investigate: Implementation of the 1973 Convention onInternational Trade in Endangered Species of Wild Fauna and Flora against the protection oftarsius fuscus; Legal action to be taken by the Government of Maros Regency againstperpetrators who hunt and trade tarsius fuscus which is classified as a protected animal.The research method used is Normative Empirical research located in Maros Regency andMakassar City. Data collection techniques through literature and interviews. The results of thestudy; 1) Implementation of the 1973 Convention on International Trades in EndangeredSpecies of Wild Flora and Fauna on the protection of the tarsier fuscus animal in theBantimurung Bulusaraung National Park, Maros Regency, has been implemented nationally,but the real implementation in the community is still not implemented optimally because theabsence of the formation of regional regulations which in this case can be a pillar to reach thecommunity to the fullest. 2) The legal action given by the Government of Maros Regency to theperpetrators of burial and trafficking is in the form of a criminal sanction of five years in prisonand an administrative sanction in the form of a fine or a warning letter.

Abstract

This study aims to determine 1) The implementation of parole for psioners in correctional institution class II A Bulukumba, 2) Factoes that prevent psioners from getting parole outside the penitentiary. The research uses the type of empirical normative research, the type of data used is primary and secondary data, data from primary materials, namery data obtained directly through information using interview techniques with the correctional institutions clas II A bulukumba, anddata from secondary materials refer to laws, book, journals and data from correctional institutions class II A Bulukumba relating to the problems studies as awll as sources and information obtained from the result of questionnaires with prisoners in correctional institutions clas IIA Bulukumba. The results of thisstudy indicate that 1) Implementationof parole in correction institutional class II A Bulukumba the 2021 period its been optimized its running well although in itsimplementation there are still obstacles,2)The inhibiting factors are external and internal factors, including the guarantor from thefamily of the inmate whose where abouts are unknown and the existence of psioners who violate disxipline in the correctional institution whih causes the inmate to fail to get parole.

Abstract

This study aims to determine the protection of the suspect's rights in the investigation process in terms of the psychological aspects of the applicable law, so that this problem can be answered clearly both in theory and practice orbdirect observationeinnthenfield. Thiseresearchtwaseconductedeat the Resort Police Office (POLRES) Maros, thefresearch .methodwusediisqa normative researchtmethodothat uses data collectionctechniques, interviews and literature9studies to analyze data using descriptive analysis methods. The resultskof.the study sindicate that in the psychological.aspectkof the investigation, both the investigator and the suspect in providing clear and free information are implemented in Article 50 of the Criminal Procedure Code concerning the Protection of the Rights of Suspects during the Investigation Process. In connection with the objectives of the KUHAP above, in an effort to find material truth in the investigation process by investigators, a suspect or defendant has rights that must be protected by law, namely, the right to receive an immediate examination, the right to make a defense, the right to give information freely and without pressure, the right to legal aid, the right to choose one's own legal counsel, the right to present witnesses, the right not to be burdened with the obligation of proof, the right to visit family and relatives during detention, the right to be tried in a trialsopen too the public, the right to receive compensation and rehabilitation. In relation to the criminal psychology aspect of the suspect, it was during the detention period and the interrogation process felt by the suspect who was interviewed. The suspect personally felt anxious about other suspects and clearly had a psychological impact on him while in detention due to being the only female detainee available.

Abstract

This study aims to find out: 1) How is the implementation of the Marrakesh Treaty to personswith blind disabilities for accessing information on printed works in Indonesia; 2) Factors thathinder persons with blind disabilities for accessing information of printed works in Indonesia.The research method used is empirical normative. Research location in Makassar City. Datacollected by literature study method and interview. The results showed: 1) Marrakesh Treatywas implemented in Law Number 28 of 2014 which was further regulated in GovernmentRegulation Number 27 of 2019 which was perfected by ratifying the Marrakech Treaty in theform of Presidential Regulation Number 1 of 2020, although the implementation in thecommuinty is constraind by the Covid-19 pandemic; 2) Factors that hinder persons with blinddisabilities for accessing information of printed works in Indonesia are limited availability ofaccessible books or printed works, the existence of copyright barriers in converting basic booksinto book formats that can be accessed by peoples with visual impairments, and the absence ofexternal institutional support to fight for the rights of persons with visual impairments inIndonesia.
