Abstract

This research was conducted in North Central Timor Regency regarding Foundation Legal Entities that have not made adjustments to the Foundation Articles of Association in accordance with Law No. 16/2001 and PP No. 2/2013 and as a result of the law if the foundation organ does not immediately make adjustments to the Foundation's Articles of Association based on laws and regulations, the institution cannot use foundation sentences. To achieve this goal, the author uses the technique of the approach of legislation (state approach) and concept approach (conceptual approach). The results of this study show that there are still many Foundation Legal Entities in North Central Timor regency that have not made adjustments to the Articles of Association of Foundation Legal Entities in accordance with the Foundation Law, in addition to the results of research, the author also found things that are factors that inhibit the implementation of Law No. 16/2001. These inhibitory factors include that many people do not know about the latest rules related to the foundation.

Abstract

The author is interested in conducting this research related to the Strategy of the Democratic Party in the Legislative Election in Malacca Regency in 2019. The type of research used is juridical-empirical research. The source of this research data is primary data, primary data is direct data that comes from Law Number 17 of 2017 concerning General Elections and interviews conducted in the field. In this study, primary data were obtained directly from the field, in the form of notes on observations and interviews with research subjects; and Secondary Data, Secondary data is supporting data for primary data. In writing, the researcher gets secondary data from books, journals, and other supporting sources related to the author's research so that it can be used as a reference in the preparation of the research. The results show that the strategies used by the Democrats are offensive strategies, defensive strategies, imaging strategies and character strategies. . Where the offensive strategy uses a market expansion strategy to form a new group of voters by lighting up the political base of the opponent's mass base. Ability to create new innovations in conducting campaigns. Offensive strategy played by the entire team which includes the Democratic Party Team, Volunteer Team and other small teams. Meanwhile, the defensive strategy used is the Democratic Party's approach to it intensively and continuously without getting tired. This approach is useful for introducing the Party and its programs and also introducing prospective legislative candidates. Imaging Strategy, the Democratic Party also uses communication, namely socialization, meeting directly with the community and conducting campaigns through electronic media, newspapers and radio. Character strategy, the figure of Susilo Bambang Yudhoyono (SBY) as a builder of the Democratic party, his expertise in building an image (as a polite, honest and benevolent leader), who loves the community. The Democratic Party first conducts a survey and selection of the figures who will enter the fight in the legislative election. The Democratic Party in carrying out an offensive strategy in coordinating between teams well. The Democratic Party needs to develop new programs that allow the people to be attracted again, and make the people prosperous by optimizing the socialization of the new program. The Democratic Party needs to design a schedule or work agenda that based on the whole community, location and time consistently run well

Abstract

Tulisan ini menganalisis perilaku Korup yang telah bertransformasi menjadi semacam suatu kebudayaan baru akibat gaya hidup Hedon. Dapat dijelakan dalam tulisan ini bahwa Praktik korupsi merupakan salah satu dampak sikap hidup hedonis dalam diri manusia yang lebih mengutamakan keinginan “daging” daripada keinginan roh. Ketidak mampuan untuk merasa puas dengan apa yang telah dimilikinya, menjadikan manusia semakin rakus, tamak, angkuh, dan jahat. Hal itu bertentangan dengan kehendak Tuhan dan juga tidak sejalan dengan misi negara, yakni menghadirkan kedamaian dan kesejahteraan bagi seluruh Rakyat Indonesia. Apabila nafsu korupsi itu tidak dapat dikontrol dalam diri manusia, korupsi seakan menjadi tindakan yang wajar yang tidak dilihat sebagai bentuk kejahatan. Selain dari pada itu, dalam rangka penegakan hukum bagi pelaku korup, dirasa sangat wajar apabila negara melakukan semacam reformasi dibidang hukum, dengan menciptakan regulasi baru yang lebih menakutkan untuk dapat memberi dampak takut yang nyata, tidak hanya efek shock terapi semata seperti adanya ancaman hukuman mati yang tidak perna diberlakukan. Dengan menggunakan metode kualitatif deskriptif yaitu pendekatan library research, diharapkan artikel ini dapat memberi gambaran nyata tentang isu besar yang dibahas yaitu Budaya korupsi sebagai kristalisasi hedonisme modern serta rekonstruksi hukuman ideal bagi koruptor dalam kajian politik hukum pidana Indonesia.

Abstract

Regulasi hukum Internasional pada prinsipnya mengharuskan setiap warga yang hendak melakukan perjalanan yang melintasi tapal batas dari negara lain ataupun memasuki daera teritorial dari negara lain haruslah suda dilengkapi dengan kelengkapan berkas berupa dokumentasi yang resmi dari badan atau lembaga negara yang berkewenangan untuk mengaturnya. Dalam penerapannya terkadang untuk melakukan perijinan masyarakat memilih untuk menyeberang ke negara tetangga tanpa dokumen yang resmi dari negara asal. Paham yang hidup dan melekat pada hampir keseluruhan orang Suku Dawan/Atoen Meto pah TTU dan Enclave Oecuse adalah bahwa “Negara boleh saja berbeda tapi bukan berarti dengan adanya batas negara dimaksud mampu menahan budaya saling berbagi dalam prinsip adat orang Suku Dawan/Atoen Meto pada dua Negara berbeda ini”. Keseragaman paham ini memang tidak saja diucapkan akan tetapi selalu dinyatakan dalam kehidupan sehari-hari sebagai warga masyarakat Suku Dawan/ Atoen Meto Pah TTU dan Enclave Oecuse.

Abstract

Indonesia as a plural country with a diversity of ethnicities, religions, races, customs, cultures, regional languages, will really rely on a single nation principle, namely Pancasila with the logical consequence that every aspect of its life will be governed by Pancasila which is chaired by the state through its tool, namely the government. fully sovereign. This means that all complex life of society is entrusted to the State, including in the field of law to achieve essential justice. In this regard, the state is obliged to carry out the orders of Pancasila through the constitution, which is used as a guideline and benchmark in every practice of state administration, including aspects of law enforcement that are just for all Indonesian people.

Abstract

Sistem pemilihan kepala daerah di Negara Republik Indonesia mengalami metamorfosa, ditandai  dengan adanya aturan mengenai mekanisme pemilukada selalu berubah-ubah. Dalam pemilihan kepala daerah, Undang-Undang Dasar tidak mengatur apakah kepala daerah dipilih secara langsung oleh rakyat atau dipilih oleh DPRD.Namun Pasal 18 ayat (4) menegaskan; kepala daerah dipilih secara demokratis.Hasil penelitian menunjukan bahwa  pemilukada yang  demokratis adalah pemilihan langsung oleh rakyat,  pada ketentuan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 Pasal 1 Ayat (2) Mengatakan bahwa “kedaulatan adalah ditangan rakyat dan dilaksanakan menurut Undang-undang Dasar”, menunjukkan bahwa negara Indonesia menganut jenis kedaulatan rakyat.

Abstract

Penelitian ini terkait dengan partisipasi masyarakat dalam pembangunan di Desa Letmaffo Kecamatan Insana Tengah Kabupaten Timor Tengah Utara. Jenis penelitian ini adalah penelitian yuridis empiris dengan menjelaskan dan menggambarkan peristiwa yang benar benar tejadi di lapangan selama penelitian. Adapun sumber data penelitian ini adalah Data Primer, Data primer merupakan data langsung yang berasal dari Undang-Undang Nomor 6 Tahun 2014 tentang Pemerintahan Desa, Peraturan Pemerintah Nomor 43 tentang Peraturan Pelaksanaan Undang-Undang Nomor 6 tahun 2014 tentang Desa dan wawancara yang dilakukan di lapangan Dalam penelitian ini data primer diperoleh langsung dari lapangan, berupa catatan-catatan hasil pengamatan dan wawancara yang dengan subyek penelitian; dan Data Sekunder, Data sekunder merupakan data pendukung data primer. Dalam penelitian ini mendapatkan data sekunder dari Buku-buku, jurnal, maupun sumber pendukung lainnya yang berhubungan dengan penelitian sehingga dapat dijadikan acuan dalam penyusunan penelitian tersebut. Hasil penelitian ini menunjukkan bahwa partisipasi masyarakat dalam pembangunan di Desa Letmaffo Kecamatan Insana Tengah Kabupaten Timor Tengah Utara dalam bentuk: 1. Partisipasi pikiran (Psychological participation), partisipasi masyarakat di desa Letmaffo masih sangat minim dalam proses Musrembang dan RPJMDes sehingga masyarakat belum mampu menyampaikan aspirasinya dengan baik. 2. Partsipasi tenaga (Physical participation), dapat partisipasi masyarakat di desa Letmaffo masih sangat minim dalam memberikan kontribusi berupa tenaga dalam kegiatan kerja bakti karena kurangnya komunikasi yang baik antar pemerintah dengan masyarakat setempat. 3. Partisipasi keahlian (Participation with skill), bahwa masyarakat di desa Letmaffo cenderung besifat apatis karena kurangnya pemahaman dan kesadaran sehingga masyarakat hanya terfokus pada kesibukan masing-masing. 4. Partisipasi barang (Material participation), dapat disimpulkan bahwa masyarakat di desa Letmaffo sudah ikut berpartisipasi dengan meminjamkan alat atau perkakas namun kualitasnya kurang baik. 5. Partisipasi uang (Money participation), masyarakat di desa Letmaffo belum mampu berpartisipasi secara langsung dalam bentuk uang secara tunai namun masyarakat bisa memberikan makanan seadanya kepada pekerja dalam proses pembangunan yang berlangsung.

Abstract

The adoption of the restorative justice approach for case resolution brings signifies a transformative in Indonesia's criminal justice system. The discretion of state officials plays a pivotal role in determining the feasibility of restorative justice approach. This paper formulated in two issues: the relationship between restorative justice approach and the authority of state officials, as well as the boundaries of their jurisdiction in determining restorative justice approach. Formulated with normative legal research methods and support by conceptual, analytical, and legislative approach. It concludes that the relationship between restorative jutice approach and the authority of state officials hinges on their discretionary interpretation of the suitability of utilizing the restorative justice approach for case resolution. Furthermore, the constraints on their discretionary authority are predominantly laid out in Law Number 30/2014 and in institutional regulations such as PERKAP 8/21 for police officials, PERJARI 15/20 for officials in the prosecutor's office, and judicial decisions like PERMA 1/2016 Jo. KMA Decision No. 108/KMA/SK/VI/2016.

Abstract

Integrity and trust are fundamental in the legal profession, yet diploma forgery threatens these values, leading to ethical violations and diminished public trust. This study examines the legal implications of diploma forgery in Case No. 20/Pid.B/2024/PN Tmg, where an individual used a fraudulent diploma to practice law. Using a normative legal approach, the study analyzes court decisions, legal doctrines, and statutory regulations, including Article 263 of the Indonesian Penal Code and Article 69 of Law No. 20 of 2003. Findings reveal weaknesses in verification systems, allowing unqualified individuals to enter the legal profession. To prevent such fraud, the study proposes blockchain-based diploma verification, offering tamper-proof credentialing and real-time authentication. Stricter regulations, enhanced verification, and ethical awareness campaigns are crucial to safeguarding legal integrity. Adopting blockchain verification can restore public trust, ensure professional accountability, and uphold the credibility of legal institutions.

Abstract

This study examines the disparity between the theoretical framework and practical implementation of arbitration in Tulungagung Regency. Employing an empirical legal approach, the research analyzes data collected from interviews with 12 lawyers and 12 individuals seeking justice. While arbitration offers several advantages, including time efficiency, lower costs, confidentiality, and procedural flexibility, its implementation in Tulungagung Regency encounters significant challenges. The findings indicate that arbitration remains largely unfamiliar to the public, primarily due to limited outreach efforts, the centralized location of arbitration institutions in major cities, and the high fees associated with arbitrators. Furthermore, ambiguities in the enforcement of arbitration decisions and inconsistencies between arbitration rulings and the jurisdiction of certain courts present additional obstacles. These results highlight the necessity for a comprehensive strategy to enhance accessibility and public awareness of arbitration as an effective alternative dispute resolution mechanism.
