Abstract

The Green Constitution concept emphasizes that environmental protection is a constitutional mandate that must be reflected in every legal policy, including regional regulations. This research aims to analyze to what extent the Green Constitution concept has been adopted in Kudus Regency regional regulations, while also assessing the effectiveness of regional regulations in supporting law enforcement and compliance with environmental regulations. This research uses normative and empirical juridical methods with a qualitative approach. Data was obtained through a review of legislation, literature studies, as well as observations and interviews with policy makers and stakeholders in Kudus Regency. The research results show that normatively, a number of regional regulations have included provision related to environmental preservation, especially in spatial planning and waste management. However, empirically, its implementation has not been optimal because it is still limited to administrative aspects, weak law enforcement, minimal coordination between institutions, and low community participation. Nevertheless, there are positive initiatives by local governments in integrating sustainability principles through community-based programs. Thus, the implementation of the Green Constitution concept in Kudus Regency requires strengthening of legal substance, harmonization of regulations, and strengthening of implementation capacity so that regional regulations do not stop as normative texts, but truly become effective and equitable instruments for environmental protection.

Abstract

Isu lingkungan telah menjadi salah satu masalah global yang semakin mendesak untuk diselesaikan. Pemahaman edukasi terkait peduli lingkungan dengan pencegahan membuang sampah pada tempatnya dan sesuai jenisnya perlu dilakukan sejak dini. Penelitian ini bertujuan untuk meningkatkan kesadaran siswa SDN 1 Karangampel dalam pemilahan sampah organik dan anorganik melalui permainan ular tangga. Metode pembelajaran dilakukan melalui sosialisasi dan penerapan pembelajaran melalui media permainan ular tangga. Selama permainan, siswa dihadapkan pada pertanyaan seputar pengelolaan sampah dan jenis sampah. Hasil kegiatan edukasi peduli lingkungan mampu menunjukkan peningkatan pengetahuan siswa terkait dampak sampah  dari 36% menjadi 92% sedangkan pengetahuan cara pemilahan sampah dari 24% menjadi 86%. Pendekatan pembelajaran yang menyenangkan seperti permainan ular tangga, diharapkan siswa dapat lebih mudah mengingat dan mengaplikasikan pengetahuan tentang pengelolaan sampah dan menjaga lingkungan sekitar.

Abstract

Omnibus law adalah undang-undang yang menitikberatkan pada penyederhanaan jumlah regulasi, di Indonesia konsep ini merupakan konsep yang dianggap baru. Pengadopsian konsep omnibus law bertujuan untuk melakukan revisi undang-undang yang bermasalah dengan perizinan, hal ini dikarenakan Presiden Joko Widodo ingin membuka akses investasi sebesar-besaranya bagi investor, akan tetapi konsep ini dinilai teralu prematur dan tergesa-gesa, yang akibatnya menimbulkan konflik dan berakhir di Mahakamah Konstitusi lewat judicial review. Mahkamah Konstitusi akhirnya melahirkan keputusan inkonstitusional bersyarat, putusan tersebut bersifat final dan harus dipatuhi, akan tetapi pemerintah mengeluarkan intruksi lewat kementrian dalam negeri untuk tetap berpedoman terhadap Undang-Undang Cipta Kerja. Berdasarkan uraian tersebut tindakan pemerintah menimbulakn sebuah ketidakteraturan hukum (disorder law). Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normative, data hukum yang digunakan berasal dari peraturan perundang-undangan, buku-buku, jurnal ilmiah dan sumber-sumber ataupun bahan dari media berita online dan Putusan Mahkamah Konstitusi.Kata Kunci: omnibus law, putusan inkonstitusional bersyarat, mahkamah konstitusiAbstractOmnibus law is a law that focuses on simplifying the number of regulations, in Indonesia this concept is a concept that is considered new.
