Abstract

Abstract The speed of the development of internet technology is very fast, not in line with the development of law. In accordance with the motto in the Dutch language "Het recht hink achter de feiten aan" which translates to "law limping following the development of society". Laws must be twisted in various ways in order to answer the growing problem. This is not so different from the laws and regulations regarding copyright, especially in the world of Youtube. Infringement of copyright content in the world of Youtube can be seen in the emergence of song content sung by other people or commonly known as covers. The closing song that is performed in the world of Youtube does not require the name of the composer to be sung again. Based on the above background, the problem that the author will discuss is how the legalism of moral rights for copyright protection in cover content on Youtube? This study uses a juridical empirical research method, with a sociological juridical approach. Namely an approach in legal research that aims to identify and conceptualize law as real and functional in everyday life. And it is hoped that it will produce empirical legal knowledge directly to the object. Based on the provisions of the Copyright Law, moral rights have been increased in a creation. The elaboration of article 5 of the Copyright Law provides guidance on moral rights which states that moral rights are absolute rights owned by the creator to his / her creation. This provision of moral rights covers the inclusion of names or aliases, use of title names, prosecution for the use of works that are distorted and mutated by other parties. The application of moral rights in the Copyright Law does not only use works in everyday life but has also targeted the Internet world specifically in the media of YouTube. Abstract

Undang-undang Nomor 3 Tahun 1997 tentang Pengadilan Anak yang telah disempurnakan dengan berlakunya Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Anak, mengatur anak yang berkonflik dengan hukum, mereka juga wajib memperoleh haknya berupa dari perlindungan hukum. Tidak terkecuali bagi siswa pemasyarakatan yang masih memiliki hak, sebagaimana diatur dalam Undang-Undang Nomor 11 Tahun 2012 tentang Peradilan Anak, metode pengajaran yang digunakan dalam penelitian ini menggunakan pendekatan yuridis empiris, yaitu dengan melakukan penelitian dengan melihat peristiwa dan fakta yang terjadi. terjadi di lapangan. Dampak penempatan anak dalam lembaga pemasyarakatan terkait dengan tujuan pembinaan dalam sistem pemasyarakatan yaitu dampak negatif yaitu dampak psikologis, dampak sosial, dampak fisik dan biologis, putus sekolah dan siswa pemasyarakatan juga berpeluang besar untuk menjadi reseptif. Konsep pembinaan bagi siswa pemasyarakatan di Lembaga Pemasyarakatan Kelas IIB Merauke mengacu pada Undang-Undang Pemasyarakatan Nomor 12 Tahun 1995.

Abstract

There are still many children who are victims of crime, one of which is the crime of sexual violence. Sexual violence against children can impact children's health and cause lasting trauma even until the child grows up. The form of legal protection for children who are victims of crime is by providing restitution for the child. Restitution is a compensation payment charged to the offender based on a court decision with permanent legal force. This study aims to determine how restitution is arranged for children who are victims of sexual violence and to find out the application of the right of restitution to child victims of sexual violence in the Merauke Regency. This research is a type of empirical juridical research, with bibliographical and field data collection techniques and analyzing data qualitatively. The results of the research conducted by the author show that the legal basis for carrying out requests for restitution is Law Number 35 of 2014 concerning Child Protection and Government Regulation Number 43 of 2017 concerning Implementation of Restitution for Children who are Victims of Crime. The government or law enforcers can provide socialization to the public regarding the rules regarding criminal acts of sexual violence against children. Children who have become victims of criminal acts have rights regulated in laws and regulations. And in Merauke Regency, the implementation of the right of restitution for child victims of sexual violence has not yet been fulfilled because there are still several obstacles, one of which is that in Merauke Regency itself, there is no LPSK which makes it difficult for the public prosecutor to determine the amount of the cost of restitution. The government is expected to be able to open LPSK representatives in Merauke Regency so that the provision of compensation and reimbursement can run effectively and efficiently.

Abstract

The purpose of the community service activity program is a program which equips teachers in providing understanding to students to have my anti-corruption child character by instilling anti-corruption values in students. The targets of PKM activities are: an increase in the knowledge of SD Muhammadiyah Merauke teachers in implementing anti-corruption programs based on learning media for students regarding anti-corruption values. The output of this activity: (1) Journal, (2) Anti-Corruption Education Module. The methodology used by the Mentoring Program is implemented through seminars, workshops and guidance in the preparation of my anti-corruption program. This includes the development of Lecture Training materials from resource persons, group discussions and brainstorming. This mentoring activity is carried out in three stages, the first stage: for outreach, the second stage: the workshop and technical guidance for module preparation, and the third stage for evaluation of assistance in the preparation of learning media according to my anti-corruption program. assistance in making anti-corruption education teaching materials where the team and resource persons who were taken from the Elementary School Teacher Education Expert Team provided understanding to participants, in this case the teachers of SD Muhammadiyah Merauke on how to implement anti-corruption values in the process of teaching and learning activities with teams and experts providing understanding through the module "Anti-Corruption Education for small classes (grades 1,2 and 3) Syantik (I'm an anti-corruption child)" which is one of the outputs of this community service activity. Where the module contains anti-corruption values that have been set by the corruption eradication commission, namely the value of honesty, the value of simplicity, the value of responsibility, the value of courage, the value of caring, the value of independence, the value of discipline, the value of justice and the value of hard work made in the form of pictures and language that is easily understood by small graders (grades 1,2 and 3). SD Muhammadiyah Merauke and is expected to become a pilot project for schools in Merauke district in terms of implementing anti-corruption values.

Abstract

ABSTRACTPrevention of crime through the criminal law, an activity that preceded the determination of criminal acts and determination of the sanctions that can be imposed on the perpetrators of the crime or offense. Sanctions in criminal law is suffering as a reward of his actions that have hurt other people or society. Correctional as a coaching system that is essentially an activity that is multi dimensial, this is due to the recovery efforts unitary relationship of life, life and livelihood is a very complex issue. For it is necessary guidance to prisoners and correctional clients within a framework.However, in reality the convict after finished serving a prison sentence instead of a deterrent but instead repeat criminal offenses (recidivism). So in this case unquestionable effectiveness of coaching inmates in prisons class II B Merauke.This study juridical sociological. This research was conducted in the Penitentiary Class II B Merauke, namely data sources of primary data through observation and interviews and secondary data, legislation, books related to the research.Development patterns prisoners committed at the Correctional Institution Class IIB Merauke, divided into two (2) areas of the coaching personalities include: development of religious awareness, fostering awareness of state and nation, fostering intellectual abilities (intelligence), development of legal awareness, coaching integrate themselves with the community. Fostering Independence which include: skills to support the efforts of independent, skills to support the efforts of small industries, the skills developed in accordance with the talent of each, skills to support the efforts of industrial or agricultural activities (plantations) using technology associate.

Abstract

The background of the keyword is the agenda of customary justice in the government which is clearly burdened by rules that are recognized and carried out well, making it possible to provide recognition of the prevailing customs in the community. The "confession" here is formal approval. The focus of the research is the implementation of customary justice in Papua in terms of Law Number 21 Year 2001 concerning Special Autonomy for Papua. The research objective is to design or formulate a model of customary justice in Papua. The target of the study is to get the right model of customary justice that is understood in their decisions in solving problems that occur in Papua. Merauke.Metote research in this research is qualitative research. The research conducted is learning, literature, taking data and interviews in depth. After that the data obtained are described and analyzed with quantitative methods to formulate economic empowerment models. The results of this study are the existing customary models, so that in the context of customary cases there are also cases where adat cases can be issued by the community.

Abstract

Land has a very important value due to its nature and fact. Land, by its very nature, is immutable and fixed, making it a promising investment value for most people. This is because land prices or sales prices tend to continue to rise. Kampung Buti generally do not understand the importance of owning land certificates and many people still believe that the cost of issuing these certificates is high. Most of the proofs are in the form of Kikitir or SPPT (they consider proof of ownership of property). The rest are in the form of sales agreements (AJBs), but very few are in the form of title deeds. Result of this activity: (1) Journal, (2) Land Title Registration Procedures and Conditions, (3) Land Title Registration Paperback. Methodologies used in aid programs are implemented through seminars, workshops, and guidance in the preparation of the I-Kind Anti-Corruption Program. This includes developing training materials for caregiver lectures, case studies, group discussions, games, and brainstorming. This mentoring activity was carried out in three phases: the seminar in the first phase, her in the second phase. Third phase of workshops and technical guidance, and support and training for land title registration. It is hoped that this service will raise awareness of the importance of land title registration.

Abstract

The importance of rules in the order of organizational life means that each village should have its own rules according to the specifics and potential of that village. Village regulations issued in Wasur Village sometimes do not take into account the needs or conditions of the village and do not match the level of drafting of statutory regulations such as the level of preparation, determination, implementation, assessment and reintegration of finished products. With all the problems, the resulting Village Regulations are not in accordance with the procedures for their formation.Assistance in drafting village regulations, the ultimate goal is to realize the quality and quantity of Wasur village regulations by involving the village head, village deliberation body and also facilitating gerpamat (indigenous community participation movement.The Training Program is implemented through Socialization, Training and Technical Guidance activities. Techniques for Preparing Village Regulations are implemented through Socialization and Training activities including the development of training materials, Lectures from Resource Persons, Case Studies, Brainstorming.The result of this activity is the achievement of an independent/local village that is able to make good village regulations that are in accordance with legal principles and village conditions by involving the Indigenous Community Participation Movement (Gerpamat), so that peace is guaranteed in Wasur village. The outcomes of the achievements of this activity are 1) increasing the knowledge of community members 2) publication of articles in the accredited Service Journal Sinta 3 (Jurnal of Service, 3) activities that have been carried out can be published through the Arafura News newspaper, both print and online and 1 Village Regulation legal product

Abstract

Penelitian ini bertujuan untuk mengetahui efektivitas peran pembimbing kemasyarakatan dalam penanganan anak yang berhadapan dengan hukum pada Balai Pemasyarakatan Kelas II Merauke, maupun untuk mengetahui faktor-faktor yang menghambat. Penelitian ini menggunakan jenis penelitian yuridis empiris yang dilakukan pada Balai Pemasyarakatan Kelas II Merauke dengan populasi pembimbing kemasyarakatan. data yang digunakan adalah data yang bersifat primer dan sekunder dengan menggunakan tiga teknik pengumpulan data berupa penelitian kepustakaan, penelitian lapangan dan dokumentasi yang kemudian di analisis secara deskriptif kualitatif. Hasil yang diperoleh penulis dalam penelitian ini menunjukkan bahwa peran pembimbing kemasyarakatan dalam penanganan anak yang berhadapan dengan hukum pada Balai Pemasyarakatan Kelas II Merauke masih kurang dapat berjalan secara efektif, disebabkan masih terdapat kendala internal maupun eksternal sehingga perlu dilakukan peningkatan kualitas dalam penanganan anak yang berhadapan dengan hukum. adapun faktor-faktor yang mempengaruhi efektivitas peran pembimbing kemasyarakatan dalam penanganan anak yang berhadapan dengan hukum pada Balai Pemasyarakatan Kelas II Merauke adalah kurangnya sumber daya manusia pembimbing kemasyarakatan, jangkuan wilayah kerja Bapas, kurangnya sarana prasarana, kurangnya partisipasi orang tua dan pelaku, dan lambatnya koordinasi antar lembaga yang menangani anak yang berhadapan dengan hukum.

Abstract

This article explores the significance of safeguarding customary rights of indigenous peoples in Indonesia, especially in border regions, with a specific focus on Sota District, Merauke Regency, South Papua. Customary rights, representing the supreme right to land inherited intergenerationally, hold profound social, cultural, and economic value for indigenous communities. Nevertheless, their protection is frequently impeded by agrarian conflicts, deficiencies in the legal system, and the repercussions of climate change. In border areas, customary rights become even more susceptible due to economic interests and the incongruence between government policies and local wisdom. This research employs a qualitative approach, utilizing literature reviews, interviews, field observations, and document analysis, to assess the effectiveness of the legal framework in safeguarding customary rights. Findings indicate that despite a solid legal foundation, the implementation of customary rights protection encounters numerous challenges, necessitating collaborative endeavors from various stakeholders to bolster protection and the well-being of indigenous peoples in border regions.
