Abstract

Until now, there has been no specific reference to customary offenses and customary courts in Papua, especially the South Papua Customary Court, except for the writings of some anthropologists who touch on this issue in discussing the leadership system or community structure or customary government system in Papua. The purpose of this study is to determine the existence or existence of customary law in the Anim Ha customary territory and the need for mapping customary law in force in South Papua by identifying customary violations and customary sanctions. This research uses a descriptive method of analysis with a normative juridical approach supported by empirical data, namely direct data from customary law communities and secondary data, namely legal material such as laws and regulations, legal doctrines, and court decisions/jurisprudence, and supported by primary data, namely by conducting interviews with related parties. There are three types of customary sanctions in South Papua, namely legal action in the form of imposition of fines (objects or goods), legal action in the form of imposing physical and spiritual suffering on violators (physical and psychological punishment), in the form of legal action to restore magical balance (punishment in the form of carrying out traditional ceremonies / rituals). Customary law communities in South Papua in fact although state law applies the principle of legal centralism, customary law is more dominant in regulating community life because it is considered more beneficial to the parties in resolving cases or disputes than positive law.

Abstract

Land has a very important value due to its nature and fact. Land, by its very nature, is immutable and fixed, making it a promising investment value for most people. This is because land prices or sales prices tend to continue to rise. Kampung Buti generally do not understand the importance of owning land certificates and many people still believe that the cost of issuing these certificates is high. Most of the proofs are in the form of Kikitir or SPPT (they consider proof of ownership of property). The rest are in the form of sales agreements (AJBs), but very few are in the form of title deeds. Result of this activity: (1) Journal, (2) Land Title Registration Procedures and Conditions, (3) Land Title Registration Paperback. Methodologies used in aid programs are implemented through seminars, workshops, and guidance in the preparation of the I-Kind Anti-Corruption Program. This includes developing training materials for caregiver lectures, case studies, group discussions, games, and brainstorming. This mentoring activity was carried out in three phases: the seminar in the first phase, her in the second phase. Third phase of workshops and technical guidance, and support and training for land title registration. It is hoped that this service will raise awareness of the importance of land title registration.

Abstract

Pengabdian kepada masyarakat merupakan suatu kegiatan yang esensial dalam membangun kesadaran hukum di kalangan masyarakat, terutama di wilayah-wilayah yang rentan seperti kampung kuper. Kampung kuper memiliki tingkat pengetahuan hukum yang rendah, sehingga dalam rangka meningkatkan kesadaran hukum di kalangan masyarakat Kampung Kuper, sebuah program edukasi dan pelatihan hukum telah dirancang. Program ini bertujuan untuk memberdayakan warga dengan pengetahuan hukum yang memadai, sehingga mereka dapat berpartisipasi secara aktif dalam proses hukum dan memperjuangkan hak-hak mereka dengan lebih efektif. Program edukasi dan pelatihan hukum menjadi metode utama melalui serangkaian kegiatan yang melibatkan diskusi interaktif, simulasi kasus hukum, dan sesi tanya jawab. Hasil yang dicapai dalam program ini yaitu  masyarakat kampung Kuper, Ibu Kepala Kampung, Ketua dan anggota Bamuskam serta aparat Kampung mendapatkan Penguatan kesadaran hukum masyarakat kampung kuper melalui edukasi dan pelatihan hukum. Khususnya Penghapusan Kekerasan Dalam Rumah Tangga serta Perlindumgan Anak. Adanya keinginan dari Masyarakat Kampung Kuper dalam Hal ini Ibu Kepala Kampung agar kegiatan ini dilakukan secara berkelanjutan karena sangat dibutuhkan dan membantu mayarakat untuk kenutuhan akan pengetahuan hukum, serta permintaan kerjasama dalam pembuatan peraturan kampung/ PERKAM yang sesuai kebutuhan kampung Kuper. Sehingga Ibu Kepala Kampung dan aparat kampung sangat antusias untuk kegiatan ini.

Abstract

This study aims to analyze the forms and mechanisms of legal protection for children as witnesses in the criminal justice process in Indonesia, as well as to identify obstacles and solutions in its implementation. The research method employed is a normative juridical approach with a literature study on relevant legislation and related literature. The results show that legal protection for child witnesses is comprehensively regulated in the Child Protection Act and the Juvenile Criminal Justice System Act, including rights to accompaniment, child-friendly examination, and provision of special facilities. However, implementation in the field faces challenges such as lack of training for law enforcement officers, inadequate facilities, weak inter-agency coordination, and cultural and social factors. Therefore, it is necessary to improve human resource capacity, institutional strengthening, and legal education to the public to ensure effective protection of children as witnesses. This study concludes that legal protection for child witnesses is an important indicator of a fair and civilized justice system in Indonesia. Abstract

This research aims to analyze the juridical synchronization between the diversion mechanism as regulated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (SPPA Law) and the child case resolution procedures according to the customary law of the Marind Tribe in South Papua Province. Utilizing a socio-legal research method analyzed through Legal Pluralism Theory and Restorative Justice Theory, the results indicate that philosophically, there is an alignment of values between the principles of national restorative justice and the local wisdom of the Marind Tribe, both of which prioritize the restoration of social balance. However, juridically and normatively, a significant obstacle exists in the formal requirements of Article 7, Paragraph (2) of the SPPA Law, which restricts diversion only to offenses punishable by less than seven years of imprisonment. This creates a legal gap where customary settlements completed at the community level are often not legally recognized within the formal judicial administration. This study concludes that procedural synchronization can only be achieved by optimizing the Papua Special Autonomy Law as a juridical bridge to provide discretion for the implementation of Marind customary law within the national juvenile criminal justice system. Abstract

Perkawinan sesama jenis sendiri memiliki arti perkawinan antara dua orang dengan jenis kelamin atau gender yang sama. Perkawinan sesama jenis sendiri merupakan perkawinan yang tidak sah di Indonesia karena tidak diakui dan bertentangan dengan nilai-nilai moral, agama, budaya, adat terutama hukum yang berlaku di Indonesia. Dalam penelitian ini, fokus yang akan dijadikan topik utama adalah pengakuan hukum perkawinan sesama jenis. Pengaturan hukum perkawinan sesama jenis berdasarkan perspektif Hukum Perdata Internasional dan perbedaan pengakuan legalitas perkawinan sesama jenis antara Indonesia dan Jerman. Penelitian ini menggunakan jenis penelitian yuridis normatif dengan mengaitkan pokok pembahasan terhadap topik utama di dalam penelitian ini yakni pengakuan hukum perkawinan sesama jenis serta analisis pengakuan hukum perkawinan sesama jenis dari perspektif Hukum Perdata Internasional antara Indonesia dan Jerman. Hasil dari penelitian ini akan memperlihatkan bagaimana pengakuan perkawinan sesama jenis antara Indonesia dan Jerman, dan keabsahannya ditinjau dari perspektif Hukum Perdata Internasional. Abstract

Era digital telah mendorong generasi muda, termasuk komunitas pemuda gereja, untuk aktif berkreasi dan menyampaikan pesan melalui platform video seperti YouTube. Namun, rendahnya literasi hukum digital, khususnya terkait hak cipta, menyebabkan tingginya risiko pelanggaran seperti copyright strikes yang dapat berujung pada penghapusan konten atau bahkan akun. Kegiatan pengabdian masyarakat ini bertujuan untuk memberikan edukasi hukum dan pendampingan (legal counselling) kepada Pemuda Gereja Immanuel Kodim Merauke mengenai hak cipta, jenis-jenis pelanggaran, serta cara berkarya secara legal dan etis di YouTube. Metode yang digunakan meliputi penyuluhan interaktif, diskusi kasus, dan pembagian buku saku edukatif. Hasil kegiatan menunjukkan meningkatnya pemahaman peserta mengenai konsep hak cipta dan langkah-langkah praktis untuk menghindari pelanggaran digital. Kegiatan ini diharapkan menjadi langkah awal dalam membangun budaya berkarya yang kreatif dan patuh hukum di lingkungan pemuda gereja.

Abstract

The Indonesia–Papua New Guinea border area in Sota District, Merauke Regency is characterized by high cross-border activities that require adequate legal understanding among the community. The research problem lies in the low level of legal literacy regarding immigration procedures, travel documents, and citizens’ rights and obligations. This study aims to improve legal literacy through cross-border legal education programs. The research method employs a participatory approach through legal counseling, interactive discussions, case studies, and the distribution of educational materials such as guidebooks and legal information sheets. The results indicate an increase in community understanding of cross-border legal regulations, the importance of compliance with laws, and applicable procedures in cross-border activities. Furthermore, the educational approach enhances legal awareness and strengthens the legal culture of the border community. In conclusion, cross-border legal education programs are effective in improving legal literacy and should be implemented sustainably through collaboration among stakeholders.

Abstract

Penelitian ini bertujuan untuk mengetahui efektivitas peran pembimbing kemasyarakatan dalam penanganan anak yang berhadapan dengan hukum pada Balai Pemasyarakatan Kelas II Merauke, maupun untuk mengetahui faktor-faktor yang menghambat. Penelitian ini menggunakan jenis penelitian yuridis empiris yang dilakukan pada Balai Pemasyarakatan Kelas II Merauke dengan populasi pembimbing kemasyarakatan. data yang digunakan adalah data yang bersifat primer dan sekunder dengan menggunakan tiga teknik pengumpulan data berupa penelitian kepustakaan, penelitian lapangan dan dokumentasi yang kemudian di analisis secara deskriptif kualitatif. Hasil yang diperoleh penulis dalam penelitian ini menunjukkan bahwa peran pembimbing kemasyarakatan dalam penanganan anak yang berhadapan dengan hukum pada Balai Pemasyarakatan Kelas II Merauke masih kurang dapat berjalan secara efektif, disebabkan masih terdapat kendala internal maupun eksternal sehingga perlu dilakukan peningkatan kualitas dalam penanganan anak yang berhadapan dengan hukum. adapun faktor-faktor yang mempengaruhi efektivitas peran pembimbing kemasyarakatan dalam penanganan anak yang berhadapan dengan hukum pada Balai Pemasyarakatan Kelas II Merauke adalah kurangnya sumber daya manusia pembimbing kemasyarakatan, jangkuan wilayah kerja Bapas, kurangnya sarana prasarana, kurangnya partisipasi orang tua dan pelaku, dan lambatnya koordinasi antar lembaga yang menangani anak yang berhadapan dengan hukum.

Abstract

Indigenous peoples in Indonesia systematically face normative and structural barriers that trigger the marginalization of their living spaces and the failure to fulfill their right to justice. This study aims to assess the degree of alignment between national regulations and international instruments, particularly the 2007 United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP), regarding the right to access to justice for indigenous peoples, while mapping the normative barriers in domestic agrarian disputes. The research method employed is normative juridical, utilizing statutory, comparative, and conceptual approaches. The results demonstrate a sharp paradigm misalignment. UNDRIP promotes the recognition of inherent rights (sui generis) and the principle of Free, Prior, and Informed Consent (FPIC). Conversely, Indonesian positive law is characterized by state-centered positivism (positivisme etatis), which reduces customary land rights (hak ulayat) to state-granted rights through restrictive administrative prerequisites via Regional Regulations (Peraturan Daerah). At the judicial level, civil procedural law is highly formalistic-positivistic, elevating written evidence (Article 1867 of the Indonesian Civil Code) and thereby sidelining customary evidence based on oral traditions or natural boundaries. This condition is exacerbated by contemporary regulations, such as the Job Creation Law through the Land Bank institution and the New Criminal Code, which escalate conflicts and structural criminalization, as seen in Rempang Island and Nangahale. The prolonged delay in enacting the Indigenous Peoples Bill creates an absolute norm vacuum that perpetuates a pseudo formalistic-procedural justice. Therefore, a progressive reconstruction of legal policy is required through the accelerated enactment of the Indigenous Peoples Bill, the issuance of Supreme Court Regulations to equalize non-written evidence, and the integration of customary courts into the national judicial system to achieve substantive justice.
