Abstract

Genocide against civilians constitutes a severe infringement upon fundamental human rights, demanding a firm response from the international community. This crime not only causes immense suffering for its victims but also poses a serious threat to global stability. Legal accountabillity for perpetrators of genocide is a crucial aspect pertaining to the global framework of international law. In this articles evaluates the mechanisms of legal accountability, highlighting the effectiveness, challenges, and opportunities faced by Judicial bodies like the International Criminal Court (ICC) and temporary tribunals such as the ICTR and ICTY. By examining genocide incidents from the 20th and 21st centuries, the research highlights various shortcomings in the accountability framework, such as political interference, inconsistent legal enforcement, and insufficient international collaboration from member states in extraditing suspects. Legal and administrative obstacles, such as evidence collection and witness protection, also hinder judicial processes. Nevertheless, there are opportunities to enhance the system’s effectiveness, including strengthening the authority of international judicial bodies, improving inter-state coordination, and utilizing technology in genocide investigations. By addressing these shortcomings, the international legal system is expected to become more effective in upholding justice and preventing future acts of genocide.

Abstract

Human trafficking is a transnational crime that requires an effective legal approach. Indonesia and the United States of America have different legal systems in addressing human trafficking, particularly in regulation, law enforcement, and victim protection. Indonesia enforces Law No. 21 of 2007 on the Eradication of Human Trafficking, yet faces challenges in implementation due to weak inter-agency coordination and the involvement of corrupt officials. Meanwhile, the United States relies on the Trafficking Victims Protection Act (TVPA) of 2000, which provides a more comprehensive legal framework supported by strong law enforcement mechanisms. Although the United States of America legal system is more effective in investigating and prosecuting traffickers, strict immigration policies often deter victims from seeking help. In contrast, Indonesia struggles with weak law enforcement and inadequate victim protection measures. This study highlights the need for Indonesia to enhance coordination, transparency, and technological utilization in trafficking investigations, while the United States of America should consider revising its immigration policies to be more victim-friendly. Collaboration between both countries in information sharing and investigative strategies is essential to improving anti-trafficking efforts and strengthening victim protection.

Abstract

Human trafficking is a serious and growing crime, including in Cambodia, which has become one of the countries vulnerable to this practice. This study aims to analyze the handling of human trafficking crimes in Cambodia from an international law perspective. Cambodia plays a significant role in the context of human trafficking due to its geographic location and socio-economic conditions, which influence the rate of human trafficking, whether for sexual exploitation, forced labor, or organ trafficking. This research uses a qualitative method with a literature review approach from various sources, including international conventions, reports from international organizations, and Cambodia's national regulations. The findings show that although Cambodia has adopted several laws to combat human trafficking, the implementation of these policies is often hindered by limited resources, corruption, and lack of cooperation between countries. Additionally, despite efforts from the international community, such as the Palermo Protocol, challenges in consistently applying the law remain a significant barrier. The study also finds that stricter law enforcement and better rehabilitation systems for victims are necessary to improve the situation. Therefore, further collaboration between the Cambodian government, international organizations, and non-governmental organizations is needed to comprehensively address this issue.

Abstract

The Senkaku Islands dispute involves Japan, China, and Taiwan on the basis of historical claims, international law, and strategic and economic interests. The strategic value of this region increases along with the potential of natural resources and the importance of maritime routes in the East China Sea. The main problems in this research are, first, how is the chronology of the Senkaku Islands dispute, and second, how is the analysis of international law on the sovereignty claims of each party. This research uses a qualitative approach with a descriptive-analytical method, which is based on a literature study of international legal documents, scientific journals, and various related official sources. The results show that Japan controls the Senkaku Islands de facto and strengthens its claim based on the principle of effectiveness. In contrast, China and Taiwan make claims based on the history of the Ming and Qing Dynasties but have no actual control over the territory. The dispute is further complicated by the United States' security support for Japan, as well as increased maritime and military patrol activities around the disputed area. Efforts to resolve the dispute through the International Court of Justice have been stymied by Japan's refusal to recognize the dispute and China's caution in taking the case to international law. Overall, the dispute has not only a legal dimension, but also reflects the sharp geopolitical competition in the East Asian region. Resolving this dispute requires a flexible diplomatic approach, given that formal legal channels are difficult to pursue. Multilateral dialog is the key to preventing conflict escalation that could threaten regional stability.

Abstract

Sharia economics is an economic discipline that focuses on Islamic sharia. Providing capital to business actors in the Sharia economy can be covered by a syirkah contract. The Syirkah contract is closely related to providing capital to MSMEs (Micro et al.). Through a syirkah contract, providing capital to MSMEs can be an effective tool. This research aims to determine the implementation of aqad syirkah as capital for the progress of MSME businesses. This research is descriptive qualitative research. The subjects of this research are business capital providers and MSMEs in Purwantoro District, Wonogiri Regency, as capital recipients. This research was conducted through interviews, observation and documentation, followed by qualitative data analysis. The research results showed that the approach to providing capital by implementing the Syirkah contract reflects the principles of sustainability and justice. In a syirkah contract, capital providers and MSME players share profits and risks by a predetermined agreement. The choice of type of syirkah contract, whether mudarabah or musyarakah, depends on the characteristics and goals of the business. Providing capital involves negotiation stages, establishing mutual requirements, dividing capital, and detailing profit sharing. In the context of a syirkah contract, the benefits for MSMEs include easy access to capital, higher motivation, and a significant contribution to business growth.

Abstract

AbstractFeminist are trying to fight for women in Indonesia to stand in line with men. However, these struggles are often based on liberal ideology. Gender equality based on liberal values can certainly be contrary to the values of Pancasila.  Based on this, it needs to be discussed related to Pancasila Feminism as a form of gender justice based on the values of Pancasila precepts. Feminism based on human rights must still respect the differences in culture, nation and religion embraced by each country. In Pancasila feminism, all gender equality struggles must be in accordance with the nature of Pancasila which includes awareness as a creature of God, awareness as a civilized and just human being, awareness as a social being, unity and nationhood, and the ability to consult consensus. The views of feminism should not be contrary to the values of Pancasila, especially, with the value of Godhead. Religion considers that the position of men and women is equal in God's eyes. However, equality does not mean in all things for example in domestic and inheritance affairs.Keywords:  Feminism, Gender Equality, Pancasila  AbstrakPara pemerhati feminisme berusaha memperjuangkan kaum perempuan di Indonesia untuk berdiri sejajar dengan laki-laki. Namun, perjuangan tersebut seringkali berpedoman pada ideologi liberal. Kesetaraan gender yang berlandaskan nilai-nilai liberal tentu dapat bertentangan dengan nilai-nilai Pancasila.  Berdasarkan hal tersebut, perlu dibahas terkait Feminisme Pancasila sebagai bentuk keadilan gender yang berbasis pada nilai-nilai sila Pancasila. Feminisme yang berdasar pada hak asasi manusia harus tetap menghormati perbedaan budaya, bangsa dan agama yang dianut masing-masing negara. Dalam feminisme Pancasila, semua perjuangan keseteraan gender harus sesuai dengan sifat Pancasila yang meliputi kesadaran sebagai makhluk Tuhan, kesadaran sebagai manusia yang beradab dan berkeadilan, kesadaran sebagai makhluk sosial, bersatu dan berbangsa, dan kemampuan bermusyawarah mufakat. Pandangan feminisme tidak boleh bertentangan dengan nilai-nilai Pancasila, terutama, dengan nilai Ketuhanan. Agama menganggap bahwa kedudukan laki-laki dan perempuan adalah sama di mata Tuhan. Namun, kesetaraan itu bukan berarti dalam segala hal misal dalam urusan rumah tangga dan waris. Kata Kunci: Feminisme, Kesetaraan Gender, Pancasila

Abstract

The use of a brand when in a trading activity is often classified as unfair competition, in an attempt to gain an advantage by taking advantage of someone else's brand, either by falsifying it in its entirety or only in certain parts, in other words, equality at its core. Many consumers are deceived when buying branded products because of plagiarism in the logo design or product packaging that has been known by the public and is very similar to the original form. There are still many business actors who are dishonest and violate the law. There are business actors who still plagiarize famous brands so that the products they make attract many fans. Therefore, there is a need for healthy competition in trade, so that no party feels disadvantaged in the process of trade, this study adopts the normative juridical method with a legislative approach and conceptual approach. The results showed that disputes related to the sale of counterfeit trademarks can be resolved both through court and out-of-court channels. The actions of sellers of counterfeit goods who trade products without the permission of the brand owner are certainly detrimental to the owner of the brand. In the face of brand infringement disputes, a wise step that brand owners can take is to resolve the issue out of court through mediation. This approach is expected to prevent further losses, especially for brand owners, while maintaining their reputation in the public eye regarding plagiarism issues. However, if mediation does not reach an agreement, the brand owner has the option of filing a lawsuit in the Commercial Court

Abstract

Restorative Justice has emerged as a progressive response to the limitations of the retributive approach within criminal justice systems. Both Indonesia and India demonstrate a growing inclination toward adopting Restorative Justice as a more humanistic mechanism for social restoration. This study aims to analyze and compare the policies and implementation of Restorative Justice in Indonesia and India, while highlighting the challenges and opportunities for its development. The research employs a normative legal method with a comparative and qualitative approach, using secondary data in the form of legal documents and scholarly articles, analyzed through online content analysis techniques. The findings indicate that both countries share fundamental principles of Restorative Justice, such as victim participation, mediation, and the restoration of social relationships. However, there are significant differences in legal frameworks, procedural flexibility, and institutional support: Indonesia demonstrates greater adaptability to local and community values, whereas India remains largely confined to the juvenile justice system and reliant on judicial discretion. This study offers a novelty in the form of a comprehensive mapping of the normative and structural dynamics of Restorative Justice within the South and Southeast Asian contexts, which have been underexplored in comparative legal research. The implications underscore the need for strengthening national regulations and institutional synergy as critical prerequisites for the sustainable implementation of Restorative Justice. The study also recommends the development of a flexible, community-based institutional model to advance criminal justice systems toward more inclusive, transformative, and participatory justice.

Abstract

Tata kelola yang baik berfungsi sebagai kerangka kerja kelembagaan yang penting untuk memastikan transparansi, akuntabilitas, dan efisiensi dalam administrasi proyek publik. Studi kualitatif ini meneliti implementasi prinsip-prinsip tata kelola yang baik dalam sistem administrasi proyek publik Indonesia, khususnya melalui mekanisme kelembagaan Komite Percepatan Pembangunan Infrastruktur Prioritas (KPPIP), PT Sarana Multi Infrastruktur (PT SMI), dan Dana Jaminan Infrastruktur Indonesia (PT PII/IIGF). Melalui wawancara semi-terstruktur dengan tiga puluh pemangku kepentingan proyek, termasuk pejabat pemerintah, manajer proyek, perwakilan sektor swasta, dan organisasi masyarakat sipil, penelitian ini mengidentifikasi mekanisme utama yang mengoperasionalkan tata kelola yang baik dan hambatan sistemik yang menghambat efektivitasnya. Studi ini mengungkapkan bahwa meskipun kerangka kerja kelembagaan untuk pengawasan tata kelola telah ada, kesenjangan yang signifikan tetap ada antara kebijakan yang dirumuskan dan praktik implementasi. Temuan utama menunjukkan bahwa mekanisme transparansi masih belum dikembangkan secara memadai, partisipasi pemangku kepentingan terbatas cakupannya, dan tantangan koordinasi antar berbagai lembaga melemahkan akuntabilitas. Penelitian ini menunjukkan bahwa mengatasi kesenjangan implementasi ini tidak hanya membutuhkan penguatan mekanisme transparansi dan jalur partisipasi, tetapi juga peningkatan komitmen kepemimpinan, peningkatan koordinasi antar lembaga, dan pengembangan kapasitas di antara personel tata kelola. Penelitian ini berkontribusi pada pemahaman bagaimana prinsip-prinsip tata kelola pemerintahan yang baik dapat diterjemahkan secara efektif ke dalam praktik administrasi dalam konteks sektor publik Indonesia yang kompleks, serta menawarkan wawasan untuk reformasi kebijakan dan pembangunan kapasitas kelembagaan.
