Abstract

The focus of this research is a review of muamalah jurisprudence on employee wage practices in tempe businesses in Penggalangan Village, Sei Bamban District, Serdang Bedagai Regency, by raising two main issues, namely 1) how to implement wage payments between owners and employees in tempe businesses in Penggalangan Village, Sei Bamban District, Regency. Serdang Bedagai? 2) What is Fiqih Muamalah's review of employee wage practices in the tempe business in Penggalangan Village, Sei Bamban District, Serdang Bedagai Regency? The approach used in this research is a qualitative-descriptive approach, namely collecting data by means of interviews, observation and documentation. This research is qualitative, namely research carried out by collecting primary data and secondary data on phenomena that are occurring directly. The primary data from this research is the business owner and three workers in the tempe business in Penggalangan Village, Sei Bamban District, Serdang Bedagai Regency. And the secondary data in this research are books, journals, government publications, and other supporting sites or sources. The results of the research show that the mechanism used in the tempe business in Penggalangan Village, Sei Bamban District, Serdang Bedagai Regency is carried out by means of a verbal agreement, with the contents of the agreement stating that the salary is given in the form of a monthly salary with working hours starting from 07.00-17.00 WIB with a salary of Rp. 750,000 per month. If there is additional work outside the specified time, the business owner will provide an additional salary of Rp. 10,000 per hour. The workers have fulfilled their agreement, but the business owner has not fulfilled what was stated in the verbal agreement, namely not paying wages outside the agreed working hours. Based on the reality of the implementation of the agreement in the tempe business in Penggalangan Village, Sei Bamban District, Serdang Bedagai Regency, in terms of muamalah fiqh, it is contrary to what was agreed (default). It is mentioned in the hadith narrated by Ibnu Maja Rasulullah Saw, who said, which means "give a worker his wages before his sweat dries", based on the hadith narrated by Ibnu Maja Rasulullah Saw, the tempe business owner did not fulfill his agreement, namely not providing additional wages outside the specified working hours. A Muslim must carry out all transactions in a clear, transparent and fair manner.

Abstract

AbstractMarriages sometimes do not run smoothly and experience breakdowns, giving rise to divorce which causes a period of iddah. The aim of this research is to find out how the husband's marriage during the wife's iddah period is from the maslahah almurlah perspective in Circular Letter Number: P-005/Dj.Iii/Hk.00.7/10/2021. This research uses a normative juridical approach. So from several points stated in the circular letter Circular Number: P-005/Dj.III/Hk.00.7/10/2021 Concerning Husband's Marriage During the Wife's Iddah Period, it explains that if a husband wants to remarry another woman while the wife is divorced from him and still undergoing the iddah period according to his circumstances, then the husband must wait for his wife's iddah period to finish first. Because there are still obligations that the husband must carry out towards his wife who is still undergoing her iddah period. Advising men not to marry during the wife's iddah period is in line with the principles of maslahah murlah, where the principles of maslahah murlah are actions that contain good or useful values, as well as maintaining the objectives of the Shari'a which are limited by several limits and is not applied to things caused by human passions or desires alone. Apart from the iddah period being an opportunity to return again to rebuild the household, then maslahah murlah in enacting the law must maintain the objectives of the syara', namely maintaining religion, soul, mind, offspring and property.Keywords: Marriage, Iddah, Maslahah Almurlah.

Abstract

This research seeks to see the legal awareness of the community in carrying out traffic in the Southern part of Tapanuli by not being followed by coercion without pressure, or orders from outside to obey the applicable law. As legal awareness progresses in the community, the law does not need to impose sanctions. The purpose of this research is to find out the level of legal awareness of the community in traffic on the road. knowing the obstacles of the community in understanding the legal awareness of the community in traffic on the road and knowing the efforts made by law enforcement to overcome the low level of legal awareness of the community in traffic on the road in the southern part of Tapanuli. The method in this research is by using a qualitative research method by interviewing several sources and conducting mini research related to the title raised in the study. Results: This study increases knowledge and understanding for the author, especially regarding the issues researched related to traffic law awareness on the road. Conclusion: The public's legal awareness in traffic is very minimal, even though law enforcement against motor vehicle violations on the road has been regulated in Law Number 22 of 2009 concerning Road Traffic and Transportation.
