Abstract

This study aims to analyze the concept of diversion as an instrument to realize restorative justice, applied in the Decree of the Minister of Law and Human Rights of the Republic of Indonesia Number M. HH-19. PK.01.04.04 of 2020 Regarding Release and Acquittal of Prisoners and Children Through Assimilation and Integration to Prevent and Control the Spread of Covid-19. The research method used in this research is normative juridical using secondary legal data. Based on the results of the research, it is known that the handling of juvenile criminal cases through the concept of diversion based on restorative justice is carried out to guarantee and respect the dignity of the child, carried out in the best interests of the child and by considering justice for the victim. The government, which is represented by The Minister of Law and Human Rights, has made a very responsive policy through the Decree of the Minister of Law and Human Rights of the Republic of Indonesia Number M. HH-19. PK.01.04.04 of 2020 Regarding Release and Acquittal of Prisoners and Children Through Assimilation and Integration to Prevent and Control the Spread of Covid-19.

Abstract

Isu potensi korupsi kebutuhan medis pada masa pandemi Covid-19 yang diberitakan media online menunjukkan ada ketidakpercayaan pemerintah pada para pihak terkait efektivitas penyaluran dan penggunaan kebutuhan medis bagi para tenaga medis. Penelitian ini bertujuan untuk menganalisis adanya celah korupsi pada saat diadakannya pengadaan alat medis di Indonesia pada saat pandemi Covid-19. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan pendekatan yuridis normatif. Hasil analisa menunjukkan: potensi besar korupsi pada aparatur pemerintahan akan adanya momentum covid-19 yang menjadi cenderung berpotensi diuntungkan karena seluruh aspek pemerintahan sedang terfokus pada pandemi covid-19, ditambah lagi adanya peraturan yang pada intinya menyatakan bahwa biaya yang dikeluarkan dalam rangka pelaksanaan kebijakan penanggulangan covid-19, merupakan bagian dari biaya ekonomi untuk penyelamatan perekonomian dari krisis dan bukan merupakan kerugian keuangan negara. Kesimpulan dari penelitian ini adalah celah korupsi dalam hal kebutuhan medis di Indonesia pada masa covid-19 terbuka karena adanya Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2020 tentang Kebijakan Keuangan Negara dan Stabilitas Sistem Keuangan untuk Penanganan Pandemi Corona Virus Disease 2019 (COVID-19) dan/atau Dalam Rangka Menghadapi Ancaman yang Membahayakan Perekonomian Nasional dan/atau Stabilitas Sistem Keuangan, yang mengatur bahwa penggunaan biaya untuk penanggulangan covid-19 bukan merupakan kerugian keuangan negara.

Abstract

Compensation for crime victims based on  Law Number 12 of 2022 concerning Anti Sexual Violence has the potential for distortion due to the regulatory framework and the enforcement process. The article aims to examine the regulatory framework that ensures compensation as an instrument of victim restorations, whether it becomes a supplement or a substitution for restitution. Research methods using the upstream and downstream process models that emphesize regulatory design and process feasibility for payments, in which compensation has a role in victim recovery. The study result explain that compensation is formally a substitution for restitution. Compensation is not the primary goal, even though it is a state’s obligation. Law Number 12 of 2022 concerning Anti Sexual Violence thus emphasizes the use of direct restitution aimed at the recovery of victims and the rehabilitation of offenders. Compensation loses its meaning as a responsibility of the state that stands alone. Data from various decisions clarify that in cases where the offenders does not pay restitution, their property is confiscated and auctioned by the prosecutor to pay restitution. If it is insufficient, courts decide that imprisonment is a substitute and do not determine that the state has to pay compensation.

Abstract

Law enforcement is one of the many facets of society that have seen substantial changes as a result of the quick growth of digital technology, especially artificial intelligence (AI). The purpose of this study is to assess how electronic evidence is used in Indonesia's criminal justice system, pinpoint the difficulties encountered, and offer suggestions for enhancing the efficiency and equity of electronic evidence in the age of artificial intelligence. In line with the technological elements included in digital and criminal investigation research methodologies, this qualitative study aids in the creation of a theoretical framework for the use of electronic evidence in the setting of artificial intelligence. The results show that Indonesian law is now able to meet the needs of the digital age with its adaptation to technological advancements. Finding material truth in court proceedings is made possible by electronic evidence, which is legally acknowledged as a legitimate tool in criminal justice. To successfully address these issues and optimize the use of AI in the legal system, it is imperative to develop a strong ethical framework, improve law enforcement capacities, and update rules on a regular basis.
