Abstract

In the context of the quality of elections, transactional politics and money politics have always been a bug in the quality of elections in Indonesia. In the context of election law enforcement, including related to transactional politics, Bawaslu is an institution established to enforce election law, including money politics. Unfortunately, various data show that money politics is still the dominant political strategy in elections. This research seeks to prove that there is an implementation gap between Bawaslu's authority in enforcing electoral law and the existing reality and find out what factors cause the implementation gap. In addition, this research seeks to provide recommendations regarding the existing implementation gap. This research uses descriptive qualitative research with data collection methods of literature study and document study which are correlated with the existing theoretical basis. The result of this research is that there are several things that cause the implementation gap such as the difficulty of defining money politics which is a systemic problem in policy capacity theory. The recommendations presented in this study are First, the need to strengthen the role of Bawaslu as an election supervisory institution by providing more comprehensive authority in the investigation and examination process. Second, there is a need for a firmer and clearer legal change related to money politics, as well as an increase in sanctions for violators.

Abstract

Pemilihan Umum di Indonesia kerap diwarnai oleh praktik politik uang yang mengancam integritas demokrasi. Penelitian ini bertujuan untuk mengeksplorasi kewenangan Badan Pengawas Pemilu DKI Jakarta dalam menangani dugaan praktik politik uang selama Kampanye Pemilu 2024, serta menilai efektivitas peran lembaga tersebut dalam menjaga integritas demokrasi. Penelitian ini menggunakan pendekatan kualitatif melalui studi pustaka, dengan menganalisis regulasi, kebijakan, serta dinamika sosial yang berkaitan dengan pengawasan Pemilu. Hasil penelitian menunjukkan bahwa Bawaslu memiliki kewenangan yang cukup luas, termasuk menerima laporan pelanggaran, melakukan investigasi awal, dan berkoordinasi dengan aparat penegak hukum. Namun demikian, efektivitas pengawasan masih menghadapi berbagai kendala, seperti keterbatasan sumber daya, budaya politik uang yang telah mengakar, serta tekanan politik dari berbagai pihak. Meskipun Bawaslu memainkan peran penting dalam penegakan hukum terhadap praktik politik uang, dibutuhkan langkah-langkah strategis untuk memperkuat kapasitas kelembagaan dan menjamin independensinya. Penelitian ini diharapkan dapat memberikan kontribusi dalam bentuk rekomendasi bagi penguatan sistem pengawasan Pemilu serta peningkatan partisipasi masyarakat dalam menjaga kualitas demokrasi di Indonesia.

Abstract

In Indonesia’s multi-party democratic system, the implementation of a 4% parliamentary threshold is intended to simplify the party system and strengthen the stability of the presidential government. However, this policy also raises issues of political representation because not all voters’ votes can be converted into parliamentary seats. This study aims to analyze the impact of the parliamentary threshold on the electoral exclusion of non-parliamentary parties and its implications for the quality of representative democracy in the 2024 General Election. The research employs a qualitative method with a library research approach through the analysis of academic literature, legal regulations, and official data from the 2024 Election. The findings indicate that the parliamentary threshold creates disproportionality between vote acquisition and the distribution of seats in the House of Representatives, causing millions of votes to become wasted votes without political representation. This policy strengthens the dominance of major parties, limits the competitive space for small and new parties, and reduces the level of democratic inclusiveness in Indonesia. Therefore, an evaluation of the parliamentary threshold policy is necessary to create a balance between governmental effectiveness and fair political representation.
