Abstract

Penelitian ini bertujuan untuk menganalisis pelaksanaan eksekusi objek jaminan fidusia melalui pengambilan paksa di Kota Pare–Pare serta mengidentifikasi hambatan yang dihadapi dalam praktiknya. Jaminan fidusia merupakan bentuk jaminan kebendaan yang memberikan hak kepada kreditur untuk mengeksekusi objek jaminan apabila debitur wanprestasi. Namun, setelah adanya Putusan Mahkamah Konstitusi Nomor 18/PUU-XVII/2019, mekanisme eksekusi fidusia mengalami perubahan, terutama terkait pembatasan parate eksekusi dan perlunya keterlibatan pengadilan apabila tidak terdapat penyerahan sukarela dari debitur. Metode penelitian yang digunakan adalah penelitian hukum empiris dengan pendekatan kualitatif. Data diperoleh melalui studi kepustakaan dan penelitian lapangan di Kota Pare–Pare dengan melibatkan lembaga pembiayaan, aparat penegak hukum, dan pihak debitur. Hasil penelitian menunjukkan bahwa pelaksanaan eksekusi jaminan fidusia di Kota Pare–Pare masih menghadapi berbagai kendala, baik dari aspek yuridis, teknis, maupun sosial. Hambatan utama meliputi penolakan debitur, rendahnya pemahaman hukum masyarakat, serta koordinasi yang belum optimal antara lembaga pembiayaan dan aparat penegak hukum. Selain itu, keterlibatan pihak ketiga dalam proses eksekusi berpotensi menimbulkan konflik hukum. Pelaksanaan eksekusi jaminan fidusia memerlukan kepastian hukum, prosedur yang jelas, dan pengawasan yang efektif guna menjamin perlindungan hukum bagi para pihak. This study aims to analyze the implementation of fiduciary collateral execution through forced repossession in Pare–Pare City and to identify the challenges encountered in practice. Fiduciary security is a form of proprietary guarantee that grants creditors the right to execute collateral when the debtor defaults. However, following Constitutional Court Decision Number 18/PUU-XVII/2019, the mechanism of fiduciary execution has undergone significant changes, particularly regarding the limitation of parate execution and the requirement of court involvement when there is no voluntary surrender from the debtor. The research employs an empirical legal method with a qualitative approach. Data were obtained through literature review and field research conducted in Pare–Pare City involving financing institutions, law enforcement authorities, and debtors. The findings indicate that the implementation of fiduciary collateral execution in Pare–Pare still faces various obstacles from legal, technical, and social aspects. The main challenges include debtor resistance, low public legal awareness, and suboptimal coordination between financing institutions and law enforcement agencies. In addition, the involvement of third parties in the execution process has the potential to create legal conflicts. Therefore, the execution of fiduciary collateral requires legal certainty, clear procedures, and effective supervision to ensure legal protection for all parties involved.

Abstract

Penelitian ini bertujuan untuk menganalisis pelaksanaan parate eksekusi terhadap objek jaminan fidusia pasca lahirnya Putusan Mahkamah Konstitusi Nomor 18/PUU-XVII/2019 serta mengkaji implikasinya terhadap perlindungan hukum dan kepastian hukum bagi para pihak. Penelitian menggunakan tipe penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum primer berupa peraturan perundang-undangan dan putusan Mahkamah Konstitusi, sedangkan bahan hukum sekunder diperoleh dari literatur, jurnal ilmiah, dan doktrin hukum yang relevan. Analisis data dilakukan secara kualitatif dengan metode deduktif, yaitu menelaah norma hukum yang berlaku kemudian mengkonstruksikannya terhadap permasalahan pelaksanaan parate eksekusi dalam praktik. Hasil penelitian menunjukkan bahwa pengaturan baru yang dibuat memberikan rekonstruksi pelaksanaan patrate eksekusi melalui tafsir konstitusionalnya. Parate eksekusi tidak dihapus, tetapi mengalami transformasi dari model eksekusi absolut menjadi model eksekusi bersyarat. Kreditur tetap memperoleh perlindungan hukum melalui pengakuan title eksekutorial sertifikat fidusia serta hak preferen dalam pelunasan utang.  This study aims to analyze the implementation of parate execution on fiduciary guarantee objects after the issuance of Constitutional Court Decision Number 18/PUU-XVII/2019 and examine its implications for legal protection and legal certainty for the parties. The study uses a normative legal research type with a statutory and conceptual approach. Primary legal materials are in the form of laws and Constitutional Court decisions, while secondary legal materials are obtained from literature, scientific journals, and relevant legal doctrines. Data analysis is carried out qualitatively with a deductive method, namely examining applicable legal norms and then constructing them to the problems of implementing parate execution in practice. The results of the study show that the new regulations made provide a reconstruction of the implementation of parate execution through its constitutional interpretation. Parate execution is not abolished, but undergoes a transformation from an absolute execution model to a conditional execution model. Creditors still obtain legal protection through the recognition of the executorial title of the fiduciary certificate and preferential rights in debt repayment.
