Abstract

This research aims to analyze Indonesia's ability as a country to utilize various international legal instruments in initiating political, economic and social goals, the study identifies the substantive instruments used, the challenges faced and the implications of Indonesia's foreign policy. Normative research method by analyzing international law rules and case studies through international agreements that have been ratified by Indonesia. The research results show that International Law has a significant influence on the formation of national legislation, there are a number of challenges and opportunities because the application of International Law requires effective and rational implementation.

Abstract

This narrative review examines how the principle of the “best interests of the child” is applied across legal systems. Using a thematic synthesis of peer-reviewed literature (2020–2025) from Scopus, Google Scholar, and PubMed, the study explores its implementation in custody, adoption, immigration, child marriage, and non-traditional families. Findings highlight uneven enforcement shaped by patriarchal norms, legal pluralism, and institutional gaps. While European jurisdictions showcase holistic child-centered approaches, many developing countries face persistent challenges. Key recommendations include harmonized legislation aligned with the CRC, guaranteed child participation rights, and systemic reforms that strengthen judicial training, inter-sectoral collaboration, and public awareness. This review contributes by integrating comparative insights across regions and emphasizing the urgency of context-sensitive, rights-based reforms.

Abstract

The purpose of writing this article is to focus on how the Indonesian state in accordance with the Contitution, makes the protection of citizen’ rights as one of the main characteristics of the implementation of human rights. In the process important issues that deserve to be studied in depth were discovered (1) the role of the state institutionally protecting citizens from acts of persecution and intolerance that also occurred during the Covid-19 pandemic; (2) prevention of acts of persecution and intoleranceaffecting the life of the nation and state in the past five years occurated in the Covid-19 pandemic. The results of the study provide a perspective that legal efforts which are a form of the existence of the practice of Pancasila and UUD 1945 including the implementation of protection of human rights in Law number 39/1999 concerning Human Rights as legal umbrella that must be upright and firm in its implementation, because law emforcement in human rights will fatale consequences with the destruction of diversity in the Republic of Indonesia, during the Covid-19 pandemic it turned out that persecution and intolerance continued and needed consistency in the protection of human rights law in accordance with the mandate of Pancasila as a value and UUD 1945 as a legal norm.

Abstract

Pending klaim BPJS Kesehatan merupakan persoalan krusial dalam penyelenggaraan pelayanan kesehatan nasional karena berdampak pada stabilitas finansial rumah sakit dan mutu layanan yang diterima pasien. Kajian ini bertujuan menganalisis hubungan kontraktual BPJS-rumah sakit,kewajiban para pihak dalam perjanjian kerja sama, serta akibat hukum pending klaim dalam perspektif hukum perdata, khususnya terkait wanprestasi dan perbuatan melawan hukum.Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan,pendekatan konseptual,dan pendekatan kasus. Hasil penelitian menunjukkan bahwa pending klaim dapat menimbulkan tanggung jawab hukum bagi BPJS apabila pembayaran klaim tidak dilaksanakan setelah berkas dinyatakan lengkap,sementara bagi rumah sakit dapat menimbulkan tanggung jawab akibat menurunnya mutu layanan yang berdampak pada hak pasien.Kajian ini menegaskan perlunya penguatan regulasi dan klausul kontraktual untuk menjamin kepastian hukum serta perlindungan pasien dalam sistem JKN.

Abstract

This study aims to provide a clear picture of the steps (efforts) of the government of the Republic of Indonesia to provide vaccines to its people evenly and free of charge according to the standards or procedures in the Health Law which is a derivative of the constitutional mandate of the Republic of Indonesia, the research method uses normative juridical research that combines the rule of law. With law enforcement which is a regulation of the Indonesian government, the results of the study provide a perspective that various ways have been attempted by the Indonesian government to overcome the Covid-19 virus pandemic, vaccines are a continuous hope to increase immunity and immunity of community groups which will certainly have a positive impact with the release of the Indonesian state from health threats and a spike in the increase in cases during the global pandemic. The conclusion of this study is that the Indonesian government has made intensive and accurate efforts to protect citizens and build group immunity which of course has an impact on the positive possibility that the Indonesian state and nation can get out of worries due to the Covid-19  pandemic.

Abstract

This study aims to analyze: 1) the structural challenges facing the UN and the international legal consequences of israel's violations of jus cogens obligations, alongside the implications for the global legal order and the fostering of international trust; and 2) the potential role of International Criminal Law specifically through the International Criminal Court (ICC) in addressing entities implicated in crimes evidenced empirically but which have evaded direct accountability, while also proposing strategies for international law enforcement. The research employs a normative-juridical method, utilizing approaches based on International Law, International Court of Justice rulings, and doctrines within International Criminal Law. The findings necessitate a comprehensive analysis, revealing that theoretically: 1) the failure of the legal regime to address jus cogens violations erodes the foundation of opinio juris and fosters the fragmentation of international law; and 2) israel’s proven violations and blatant display of arrogant impunity undermine state confidence in the legitimacy of International Law which ought to protect humanity thereby risking a normative collapse of the International Criminal Law regime. Consequently, there is a need for counter-hegemonic legal strategies driven by coalitions of states and non-state actors. As the UN comprises 193 member states, any action taken on its behalf must reflect the collective will of those members. Throughout the conflict involving Palestine as a nation state particularly following israel's 1948 declaration of independence the UN's inability to take appropriate humanitarian action in this protracted conflict has perpetuated the suffering of the Palestinian people to this day; this is clearly evidenced by the UN Security Council (the UN's highest body responsible for maintaining international peace and security) being repeatedly stymied by vetoes, preventing agreement on swift and effective resolutions to ensure the safety of the Palestinian people, especially in Gaza.
