Abstract

Perjanjian Kerja Waktu Tertentu (PKWT) merupakan salah satu bentuk hubungan kerja yang memberikan fleksibilitas bagi pengusaha, namun di sisi lain berpotensi menimbulkan ketidakpastian terhadap pemenuhan hak-hak pekerja apabila tidak dilaksanakan sesuai dengan ketentuan peraturan perundang-undangan. Berlakunya Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja menjadi Undang-Undang membawa perubahan dalam pengaturan hubungan kerja, khususnya mengenai perlindungan hukum bagi pekerja PKWT. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum yang diberikan kepada pekerja PKWT serta mengkaji mekanisme penyelesaian sengketa hubungan industrial berdasarkan ketentuan hukum yang berlaku. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Data yang digunakan berupa bahan hukum primer, sekunder, dan tersier yang dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa pekerja PKWT memiliki hak atas kompensasi setelah berakhirnya masa kerja, upah yang layak, jaminan sosial, waktu kerja dan waktu istirahat, keselamatan dan kesehatan kerja, serta perlindungan dari pemutusan hubungan kerja yang bertentangan dengan ketentuan hukum. Apabila terjadi perselisihan hubungan industrial, penyelesaiannya ditempuh secara bertahap melalui perundingan bipartit, mediasi, dan apabila tidak tercapai kesepakatan dapat dilanjutkan ke Pengadilan Hubungan Industrial. Oleh karena itu, diperlukan konsistensi dalam pelaksanaan ketentuan perundang-undangan serta pengawasan yang efektif guna menjamin terpenuhinya hak-hak pekerja PKWT dan mewujudkan hubungan industrial yang adil, harmonis, dan berkeadilan.

Abstract

Penelitian ini menganalisis implementasi sistem pengamanan di Lembaga Pemasyarakatan Pemuda Kelas III Langkat berdasarkan Undang-Undang Nomor 22 Tahun 2022 tentang Pemasyarakatan. Menggunakan pendekatan yuridis-empiris, penelitian mengombinasikan analisis norma hukum dengan observasi lapangan, wawancara petugas keamanan, dan studi dokumen terkait insiden selama 2023–2025. Hasil menunjukkan bahwa implementasi pengamanan telah berjalan melalui mekanisme preventif, represif, dan administratif sesuai kerangka normatif UU No.22/2022, namun efektivitasnya terbatas oleh keterbatasan SDM, overkapasitas, keterbatasan sarana-prasarana, serta tantangan situasional termasuk bencana alam. Upaya optimalisasi telah dilakukan (intensifikasi razia, peningkatan koordinasi, pelatihan petugas), tetapi memerlukan penguatan struktural: penambahan personel, modernisasi infrastruktur pengawasan, dan integrasi manajemen risiko serta protokol darurat. Rekomendasi menyarankan kebijakan penguatan kapasitas institusional yang komprehensif dan berorientasi hak asasi manusia agar fungsi pengamanan mendukung tujuan pembinaan dan reintegrasi.

Abstract

Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum bagi Pekerja Harian Lepas (PHL) di Dinas Pemadam Kebakaran dan Penyelamatan Kota Medan yang menghadapi risiko tinggi setiap hari dalam menjalankan tugasnya. Meskipun memiliki tanggung jawab besar terhadap keselamatan publik, status hukum PHL seringkali kurang jelas, terutama dalam hal jaminan sosial dan perlindungan kecelakaan kerja. Dalam praktiknya, banyak karyawan dengan status PHL mengalami kecelakaan kerja tetapi belum menerima kompensasi penuh sebagaimana diatur dalam peraturan perundang-undangan. Penelitian ini menggunakan metode yuridis-empiris dengan meneliti peraturan perundang-undangan yang berlaku, termasuk Perjanjian Kerja Waktu Spesifik (PKWT) dan Undang-Undang Penciptaan Lapangan Kerja sebagai dasar hukum baru yang memengaruhi perlindungan pekerja kontrak di Indonesia. Hasil penelitian menunjukkan bahwa masih terdapat kesenjangan antara ketentuan normatif dan implementasi perlindungan hukum bagi PHL. Oleh karena itu, diperlukan kebijakan daerah yang lebih jelas dalam mengatur hubungan kerja, kompensasi, dan jaminan keselamatan bagi PHL di lingkungan pemerintahan daerah.

Abstract

This study examines the effectiveness of fulfilling the rights to healthcare services and adequate food provision at the Class IIA Pancur Batu Correctional Institution amid the regulatory transition during the 2024–2025 period. Employing a juridical-empirical research method with statutory, case, and comparative approaches, the study analyzes the harmonization between the mandates of Law Number 22 of 2022 and Minister of Immigration and Corrections Regulation Number 1 of 2025 and the State’s fiscal capacity. The findings reveal a disparity between normative expectations (das Sollen) and operational realities (das Sein). Although prison management demonstrates procedural compliance through the implementation of Standard Operating Procedures (SOPs), food security innovations, and financial digitalization, the substantive effectiveness of service delivery remains constrained by structural barriers. These obstacles include budget limitations under the Standard Input Costs (SBM), food price volatility, and demographic pressures resulting from overcrowding, which heighten health risks. A comparison with the Nelson Mandela Rules confirms gaps in meeting the standards of wholesome food quality and the principle of equivalence of care in healthcare provision. Accordingly, institutional strengthening strategies are required, including budget rationalization, optimization of telemedicine services, and integration of prison healthcare into the national social security system to ensure the protection of inmates’ fundamental rights.

Abstract

The registration and classification of inmates constitute a fundamental initial stage in the administration of the correctional system, as they form the basis for placement decisions, security management, and individualized rehabilitation programs. Registration standards, as regulated through technical guidelines and administrative instruments within correctional units, are intended to ensure accurate data recording, risk identification, and the formulation of effective treatment and development programs. However, their implementation continues to face various challenges that affect the overall effectiveness of inmate classification. Empirical studies conducted across several correctional institutions indicate that limitations in human resources, infrastructure constraints, and insufficient training of assessment officers hinder the consistent application of registration standards in accordance with established guidelines. As a result, the objective of achieving appropriate inmate grouping and the optimal design of individualized correctional programs has not been uniformly realized. At the normative level, the enactment of Law Number 22 of 2022 concerning Corrections has renewed the legal framework previously governed by Law Number 12 of 1995. The new statute reinforces the principles of individualization, continuity, and the protection of inmates’ rights as integral components of a modern correctional system oriented toward rehabilitation and social reintegration. Although this updated legal framework strengthens the rights-based and evidence-based orientation of correctional administration, the technical regulation of registration and classification procedures remains largely dependent on guidelines issued by the Directorate General of Corrections. Consequently, further harmonization between statutory provisions and technical instruments is necessary to enhance legal certainty and operational effectiveness. These findings demonstrate that the effectiveness of registration standards in inmate classification is determined not solely by the quality of written regulations, but also by institutional capacity, administrative coherence, and the availability of adequate resources to ensure accurate and sustainable implementation.

Abstract

The strong correlation between crime and social interaction is implicitly reflected in the Criminal Code (KUH Pidana), which states that crime is essentially rooted in social interaction. And when that interaction causes harm to another party, a crime occurs. This is the premise that describes how the correlation between crime and social interaction is established. When a harmful act is regulated by criminal law, it is no longer categorized as merely a crime but becomes a criminal offense. This definition defines the act as behavior that, at a given time and within a given cultural context, is considered intolerable and must be corrected through the use of legal means. The author's background in formulating the problem in this research is:How is the capability of Correctional Institutions in Preventing Recidivism in Class IIA Langkat Narcotics Prison in an effort to prevent the phenomenon of repeated criminal acts? This research is a normative-empirical research with a live-case study category based on empirical observations of the implementation of provisions of correctional laws and regulations in Class II A Langkat Narcotics Prison to evaluate the effectiveness of the guidance of inmates in it related to efforts to prevent repeated criminal acts (recidive). He acknowledged that repeat offenders in the Class IIA Langkat Narcotics Prison experience annual recidivism. Therefore, he believes recidivism in his area is a common occurrence, as crime, which is a part of society, also accompanies crime. Where there is society, there is law; where there is law, there is crime; and where there is crime, there is recidivism. Therefore, the goal of rehabilitation is not to eliminate recidivism but to minimize it. To prevent character-based recidivism, the Class II A Langkat Narcotics Prison collaborates with Islamic, Christian, Hindu, and Buddhist religious leaders to provide regular spiritual guidance. This ensures that mental and spiritual development activities can benefit inmates.

Abstract

Child neglect within the household constitutes one of the forms of violation of children’s rights that still frequently occurs in Indonesia. Although legal instruments are already in place, the enforcement of the law in cases of child neglect has not yet been implemented optimally. The issues examined in this study include: the general provisions concerning child neglect within the household under the Child Protection Law; the obstacles in enforcing cases of child neglect; and the efforts to optimize law enforcement in child neglect cases based on Decision Number 30/Pdt.G/2020/PN.Amb. The research method employed is normative legal research with a descriptive-analytical nature. The data consist of primary, secondary, and tertiary legal materials obtained through library research. The analysis was conducted qualitatively by examining statutory regulations, legal doctrines, legal theories, as well as relevant court decision case studies. The results of the study indicate that, normatively, child neglect has been categorized as a violation under Article 76B in conjunction with Article 77B of the Child Protection Law. However, in judicial practice, child neglect is more frequently positioned as grounds for divorce in civil cases without imposing criminal liability on negligent parents. The analysis of the Ambon District Court Decision Number 30/Pdt.G/2020/PN.Amb demonstrates a tendency for judges to focus solely on the aspect of divorce, while the issue of child neglect is not addressed at allThe conclusion of this study emphasizes that the implementation of law enforcement against child neglect within the household remains weak and lacks integration between civil and criminal aspects. Therefore, it is necessary to optimize law enforcement through preventive measures, strengthening the role of state institutions, increasing public legal awareness, and applying the principle of the best interest of the child. It is recommended that courts become more responsive to issues of child neglect, that the government strengthen regulations and inter-agency coordination, and that society take a more active role in preventing and reporting cases of child neglect.

Abstract

Women's agency in divorce cases demonstrates a shift in women's position from passive parties to active legal subjects in fighting for their rights through the courts. Divorce is not only understood as the end of a marriage, but also as a form of women's legal awareness in facing injustices that exist amidst a social structure that still influences patriarchy. This study focuses on the reform of women's institutions in the divorce process as well as the obstacles and supporting factors that influence it. The method used is normative-empirical law, with a normative approach to legislation and an empirical approach through interviews with judges, clerks, and plaintiffs at the Medan Religious Court. The results of the discussion indicate that, in terms of legal regulations, Law Number 1 of 1974 has provided a strong legal basis for women to face challenges such as limited legal information, social stigma, family pressure, and administrative restrictions. On the other hand, assistance, support from the Understanding Institute, the availability of legal facilities, and the gender-sensitive attitudes of judges play an important role in strengthening women's institutions to achieve real justice.
