Abstract

This research aims to investigate public perceptions of trust in the Indonesian legal system based on an analysis of three legal cases that went viral in various media. The cases selected were the Case of Brigadier J or Ferdy Sambo, the Case of Mario Dandy and the Son of a Tax Official, and the Corruption Case of the Ministry of Agriculture, Syahrul Yasin Limpo. This research uses a qualitative approach with literature study data collection methods. Data was obtained from news sources, articles, media reports, and related research that discussed these three cases. Analysis was carried out to identify general patterns, public perceptions, and implications for trust in the legal system. The research results show that the Brigadier J case raises doubts about the justice of the legal system, while the case of Mario Dandy and the Tax Official's Son strengthens perceptions about abuse of power and privilege, the Ministry of Agriculture corruption case shows the negative impact of corruption on public trust in the government and the legal system. The public feels injustice and a lack of trust in the integrity of the legal system, which can threaten the legitimacy of legal institutions.

Abstract

This research examines how cultural values influence the development and structure of commercial law across different societies, addressing the critical question of whether business regulations simply reflect technical economic requirements or embody deeper cultural values about appropriate commercial conduct. The study employs a qualitative methodology based on systematic literature review, analyzing over 200 academic sources from multiple disciplines including law, sociology, anthropology, and economics to identify patterns in how cultural values shape commercial law development. The research utilizes thematic analysis to examine cultural transmission mechanisms and contemporary challenges in cultural-legal interactions within commercial regulatory frameworks. The findings reveal that cultural values serve as fundamental determinants of commercial law structure, influencing property rights concepts, corporate governance frameworks, and regulatory enforcement mechanisms across different societies. The research identifies specific cultural transmission mechanisms including legal education institutions, judicial decision-making processes, professional organizations, and international legal transplantation that embed cultural values within commercial law systems. Contemporary challenges including globalization, digital transformation, and environmental governance create new tensions between universal commercial law principles and culturally specific regulatory approaches. The study concludes that cultural values continue to play a persistent and fundamental role in shaping commercial law development, requiring greater sensitivity to cultural diversity in international commercial regulation and legal harmonization efforts.

Abstract

This study aims to analyze the legal complexity of Bitcoin and altcoin use in commercial transactions and identify the need for legal evolution to accommodate the digitalization of society. The research method uses a qualitative approach with a literature study focusing on normative legal analysis of cryptocurrency regulation, consumer protection, and the applicable legal framework. Data collection techniques were conducted through document studies of primary, secondary, and tertiary legal materials, with qualitative descriptive analysis using content analysis and a comparative approach to cryptocurrency regulation in various jurisdictions. The results show that the legal uncertainty of cryptocurrencies creates significant legal complexity in commercial transactions, where the ambiguous legal status, diverse characteristics of altcoin technology, and cross-border jurisdictional challenges require an adaptive and responsive regulatory approach. The existing consumer protection framework is inadequate to accommodate the risks of volatility, transaction irreversibility, and the complexity of blockchain technology. An adaptive regulatory model that integrates a regulatory sandbox, a principle-based approach, and a risk-based framework provides a solution to accommodate the dynamic characteristics of cryptocurrencies. This study proposes a responsive legal adaptation framework that can facilitate the co-evolution between law and blockchain technology while providing adequate protection for all stakeholders in the cryptocurrency ecosystem.

Abstract

The development of digital technology has brought about major changes in the way political campaigns are conducted. Campaign activities that were previously carried out conventionally have now shifted to the online realm. This change has had a significant impact on the democratic process, particularly in the context of public opinion manipulation. This study focuses on analyzing law enforcement and the role of constitutional law regulations in regulating and preventing manipulative practices in digital-based political campaigns. The research method used is a normative legal approach by examining various laws and regulations, such as the Election Law, the Electronic Information and Transaction Law (ITE), and regulations issued by the General Election Commission (KPU) and the Election Supervisory Agency (Bawaslu). The findings show that manipulation of public opinion is often carried out in various ways, including the spread of disinformation, the use of fake identities or anonymous accounts, the use of bots, and the application of deepfake technology. In practice, law enforcement efforts against these acts still face various obstacles, such as weak regulations specifically governing digital manipulation, limited law enforcement resources, and difficulties in tracking perpetrators operating in cyberspace. Therefore, it is necessary to update regulations that are responsive to technological developments, improve the competence of election supervisory agencies, and strengthen digital literacy in society. These steps are expected to serve as preventive strategies to realize healthier, more transparent, and democratic political campaigns.

Abstract

Cases of electronic-based sexual violence (KSBE) are increasing in the digital age, resulting in serious psychological and social impacts, especially for children as victims. This study aims to understand the legal protection for child victims of KSBE based on Indonesian positive law and to understand how the law responds to such crimes. The research method used is normative research with a legislative and conceptual approach. The results show that Indonesian positive law has a significant legal protection framework for child victims of ESV, including the Child Protection Law, the Sexual Violence Criminal Law, and other related regulations. The legal protection provided covers various aspects, including health services and psychosocial assistance, the right to protection in the judicial process, the right to restitution, and the right to the removal of sexual content. The penalties include imprisonment and fines with various ranges, adjusted to the level of violation, in accordance with relevant legal regulations. However, even though this legal framework is in place, its implementation still faces challenges, such as a lack of understanding among law enforcement officials and incomplete implementing regulations. Therefore, this study also provides policy recommendations to strengthen legal protection for child victims of KSBE.

Abstract

Penelitian ini mengkaji perlindungan hukum hak cipta karya digital di era teknologi modern, khususnya Technological Protection Measures (TPMs) dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta serta menganalisis pembuktian pelanggaran hak cipta digital pasca Putusan Pengadilan Niaga Jakarta Pusat Nomor 51/Pdt.Sus-HKI/Cipta/2025/PN Niaga Jkt.Pst. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitian menunjukkan bahwa pengaturan TPMs dalam UU Hak Cipta masih belum jelas, terutama terkait DRM, alat bukti digital, dan tanggung jawab platform digital. Selain itu, pembuktian pelanggaran hak cipta digital masih menghadapi kendala dalam pembuktian kepemilikan karya dan penentuan pihak yang bertanggung jawab. Penelitian ini menyimpulkan bahwa diperlukan pembaruan regulasi yang lebih adaptif terhadap perkembangan teknologi digital guna memberikan perlindungan hukum yang semestinya terhadap hak cipta karya digital di Indonesia.
