Abstract

Based on the results of training on Techniques for Preparing Good Village Regulations, it was found that there are still many village officials (Village Heads and Village Consultative Body) who do not have the knowledge and expertise in drafting good village regulations in accordance with the provisions of statutory regulations. The low level of knowledge of village government officials in drafting village regulations has created a legal vacuum in society, thereby affecting the effectiveness of village government administration. If this is not addressed from the start, it can affect all village development policies in accordance with the mandate of Law Number 6 of 2014 concerning Villages. The objectives of training in preparing good village regulations are (1) to provide knowledge and understanding of the procedures for preparing good and correct village regulations (2) to provide knowledge about the correct preparation of village regulations in accordance with the theory, principles and concepts of legislative science. The expected benefit from training in techniques for preparing good village regulations is that it can provide scientific contributions to village government officials and the community regarding the benefits of correct procedures for drafting village regulations and how to implement the village regulations themselves. Community service was carried out in Skouw Mabo Village, Muara Tami District, Jayapura City using the method: lectures and discussions with the theme "Training on Techniques for Preparing Good Village Regulations for Village Government Apparatus", then continued with a question and answer session to explore the problems and obstacles faced and find solutions as a form of resolving the obstacles faced by village government officials. Based on the results achieved in this training activity, it can be concluded as follows: (1) training participants are able to understand and know the procedures for preparing village regulations that are good and correct; and (2) and Training Participants can apply the results of the training by compiling and implementing village regulations independently

Abstract

Marriage registration is a legal obligation aimed at ensuring marital status certainty and protecting children’s rights. In the indigenous community of Kampung Sereh, however, marriage validity is often determined by customary and religious legitimacy rather than state registration. This situation creates potential legal issues, including the status of children, inheritance rights, and population administration. The study seeks to analyze factors influencing legal compliance, identify obstacles, evaluate legal effectiveness, and develop a compliance model that respects local culture while guaranteeing legal certainty. Using a qualitative case study approach, the research applies Lawrence M. Friedman’s legal system theory, which emphasizes structure, substance, and culture. Data were obtained through observation and interviews with customary leaders, religious figures, village officials, and community members, and analyzed thematically. Findings reveal compliance is influenced by collaboration among officials, customary leaders, and the church; the alignment of rules with customary practice; and community perceptions of marital validity. Barriers include limited access, rigid procedures, timing differences between custom and state, and dominance of customary legitimacy. The study offers a Cultural-Legal Compliance Model integrating rituals with state registration through collaboration, local education, flexibility, and proportional incentives.   Abstrak Pencatatan perkawinan merupakan kewajiban hukum yang dirancang untuk memastikan kepastian status pasangan dan perlindungan hak anak. Namun, di masyarakat adat Kampung Sereh, sahnya perkawinan lebih sering ditentukan oleh legitimasi adat dan agama daripada pencatatan negara. Kondisi ini berpotensi menimbulkan masalah hukum, seperti penetapan status anak, hak waris, dan administrasi kependudukan. Penelitian ini bertujuan menelaah faktor yang memengaruhi kepatuhan hukum, hambatan yang dihadapi, efektivitas hukum yang berlaku, sekaligus merumuskan model kepatuhan hukum yang menghargai budaya lokal namun tetap menjamin kepastian hukum. Penelitian dilakukan dengan pendekatan kualitatif dan desain studi kasus, berlandaskan teori sistem hukum Lawrence M. Friedman yang menekankan dimensi struktur, substansi, serta budaya hukum. Data diperoleh melalui observasi lapangan dan wawancara mendalam bersama tokoh adat, pemuka agama, aparat kampung, serta warga, kemudian dianalisis menggunakan teknik tematik. Hasil penelitian menunjukkan kepatuhan hukum dipengaruhi kolaborasi aparat kampung, tokoh adat, dan gereja; kesesuaian aturan formal dengan praktik adat; serta persepsi masyarakat mengenai sahnya perkawinan. Hambatan meliputi keterbatasan layanan, prosedur yang kaku, perbedaan waktu antara adat dan negara, serta dominasi legitimasi adat. Penelitian menawarkan Cultural-Legal Compliance Model yang memadukan prosesi adat dengan pencatatan negara melalui kolaborasi, edukasi lokal, fleksibilitas prosedural, serta penerapan insentif dan sanksi proporsional.

Abstract

The capacity building of employees at the Regional Revenue Agency (Bapenda) of Jayapura Regency in understanding and implementing Law Number 1 of 2022 on Financial Relations between the Central Government and Regional Governments is crucial for optimizing regional financial management. This new regulation brings significant changes in the mechanisms of fund transfers, as well as tax and regional retribution management, requiring deep understanding and technical skills from the employees. The purpose of this community service is to enhance the understanding and skills of Bapenda Jayapura Regency employees in drafting academic papers and regional regulations (Raperda) related to taxes and retributions. Thus, it is expected to improve the effectiveness and efficiency of regional revenue management in accordance with the provisions of the new law. This community service is conducted using lecture and mentoring methods. The lecture method is used to provide theoretical understanding of Law Number 1 of 2022 and its implications for regional governments. Meanwhile, the mentoring method is used to assist employees in directly drafting academic papers and Raperda, ensuring that these documents comply with legal principles and local needs. The results of the community service show a significant increase in employees' understanding of the new financial regulations. Bapenda Jayapura Regency employees successfully drafted academic papers and Raperda on taxes and retributions in accordance with the provisions of Law Number 1 of 2022. Additionally, this activity also encouraged collaboration and interactive discussions that enriched the practical and theoretical understanding of the employees.

Abstract

Sekolah dasar sebagai lembaga pendidikan formal pertama yang ditempuh anak setelah pendidikan usia dini memegang peran strategis dalam pembentukan karakter. SD Negeri Inpres Perumnas 1 Waena, Kota Jayapura, sebagai lokasi pengabdian, menghadapi sejumlah permasalahan yang dapat menghambat pembentukan budaya antikorupsi. Berdasarkan hasil observasi dan diskusi awal dengan pihak sekolah, ditemukan bahwa pemahaman siswa terhadap konsep korupsi masih sangat rendah. Tujuan kegiatan ini adalah memastikan setiap siswa pulang dengan hati yang lebih jujur, pikiran yang lebih terbuka, dan semangat untuk terus menebarkan kebaikan. Inilah langkah kecil namun berarti untuk menyiapkan masa depan Indonesia yang bebas dari korupsi, dimulai dari senyum polos dan tekad murni anak-anak di SD Negeri Inpres Perumnas 1 Waena. Capaian terakhir, namun sangat berarti, adalah terbangunnya kesadaran kolektif. Guru, siswa, orang tua, dan tim pengabdian kini berbagi harapan yang sama: menyiapkan generasi muda Papua yang berani jujur, disiplin, dan bertanggung jawab. Semua pihak menyadari bahwa integritas bukan sekadar pelajaran, melainkan kebiasaan yang harus dipupuk sejak dini. Pada akhirnya, kegiatan ini menegaskan bahwa masa depan Papua dan Indonesia dibangun dari hati-hati kecil yang berani jujur. Dari ruang kelas sederhana di Waena, sebuah cahaya kecil telah dinyalakan, cahaya kejujuran yang diharapkan terus tumbuh, menguat, dan menerangi perjalanan generasi penerus bangsa.

Abstract

The research carried out in Jayapura City with the title "Legal Certainty in Determining the Amount of Tax on Acquisition of Land and Building Rights" (BPHTB) aims to provide legal certainty regarding the imposition of Tax on Acquisition of Land and Building Rights. (BPHTB) in determining the amount of BPHTB tax. The method used is normative law and empirical law in relation to land and building tax collection.In accordance with applicable laws and regulations, BPHTB levies in Jayapura City do not yet have complete legal certainty. Tax Object Acquisition Value (NPOP) transaction value is no longer used as a basis for determining BPHTB tax, in Jayapura City the basis for determining BPHTB is the interpretation made by the tax authorities based on market prices, location of land and buildings and building conditions. This happens because of society's tendency to try to get around it BPHTB financing. Taxpayers declare the transaction price in accordance with the NJOP if the market price or transaction value is greater than the Sales Value of the Tax Object (NJOP). Taxpayers will also try to avoid it if the Tax Object Acquisition Value (NPOP) is lower than the Tax Object Sales Value (NJOP). Abstract

This study aims to determine the function and role of the customary head in resolving land disputes in the territory of the Customary Law Community. The role of customary heads in various regions is still very strong, even though there has been a village administration, where there is institutional uniformity. The purpose of this writing is to find out how the authority of the customary head in resolving land disputes between customary law communities, is it replaced by the village head. The results of the study show that the role of the customary head as a leader in the Customary Law Community functions as a dispute resolution judge and as a reconciliation judge in maintaining the balance of customary law. The enforcement of customary law by customary heads in dispute resolution is marked by customary rituals, deliberations, and customary fines that are adjusted to the status of the parties to the dispute, in the form of returning rights to landowners, animal slaughter, a sum of money, or in the form of gold.

Abstract

Customary constitutions in Indonesia are scattered in various regions at the village, sub-district, district, city, province, and even archipelago levels.  The codification and unification of laws are increasingly undermining the existence of customary constitutions in Indonesia.  The existence and position of the customary constitution are increasingly unclear in the regulatory framework in Indonesia. Maintaining the customary constitution is crucial as it can serve as a spirit and guide in the formation of national law.  To remind the nation again about the spirit of being cultured and to give the nation confidence in the nation's civilization, it is necessary that the customary law be placed in an equal position with the existing and recognized statutory order in Indonesia. For this reason, it is necessary to provide a separate place for the growth and development of customary law as part of the nation's wealth and as a reference in the formation of national law so that in every formation of statutory regulations, it always reflects values. is contained in the nation's customs, especially those related to basic law, namely the customary constitution in Indonesia. This paper uses a sociological normative writing method, which will provide an overview of the position and status of the customary constitution in the Indonesian legal system. Abstract

Customary land management in Jayapura Regency has a strategic role in encouraging regional economic growth through improving the investment climate. However, management practices have often caused problems such as land conflicts, legal uncertainty, and low participation of indigenous peoples in decision-making. This condition hinders investors from investing their capital optimally. This research aims to formulate a model for reconstruction of customary land management that is fair, provides legal certainty, and facilitates synergy between indigenous peoples, local governments, and investors. The research method used is a qualitative approach with a descriptive-analytical design. Data was obtained through in-depth interviews with traditional leaders, local government officials, investors, and academics, as well as through the study of relevant laws and regulations. The analysis was carried out using the Miles & Huberman interactive model technique, including data reduction, data presentation, and conclusion drawn. The results of the study show that equitable management of customary land requires formal recognition of customary rights, the existence of a clear written agreement mechanism between customary rights owners and investors, and the existence of permanent mediation institutions to resolve disputes quickly. The implementation of this reconstruction model has been proven to increase legal certainty, reduce potential conflicts, and encourage increased investment interest in Jayapura Regency.
