Abstract

Daerah perbatasan memiliki potensi terjadinya kerentanan masyarakat penerima manfaat dari pembangunan dan pemberdayaan kawasan. Jarak dan isolasi daerah berimplikasi pada akses pembangunan dan pelayanan dasar masyarakat. Realisasi mandat atas peran Kecamatan dalam UU Pemda dan PP Kecamatan sedapat mungkin dapat didorong untuk memastikan pembangunan berbasis HAM terwujud. Pengabdian Kepada Masyarakat (PKM) berfokus pada peningkatan kapasitas aktor pembangunan berbasis HAM di wilayah Kecamatan Besitang. PKM ini dilaksanakan dengan menggandeng mitra Pemerintahan Kecamatan Besitang untuk mewujudkan pembangunan berbasis HAM. PKM ini dilaksanakan dengan melalui tahap perencanaan, pelatihan, dan pendampingan. Peserta PKM terdiri segmentasi penting terkait tata kelola Pemerintahan Kecamatan Besitang. PKM dirancang melalui pendekatan partisipatif dengan paradigma pembangunan masyarakat (people centered development). Hasil pelaksanaan PKM peningkatan pemahaman dan keterampilan guna mendorong partisipasi masyarakat dan pemerintah untuk meningkatkan tata kelola pembangunan berbasis HAM di Kecamatan Besitang. Pemerintah dapat memahami dan mengintegrasikan standar dan prinsip HAM dalam pembangunan, pemberdayaan dan partisipasi di wilayah pemerintahannya. Warga dapat memahami partisipasi secara konseptual, bentuk dan mekanisme untuk berpartisipasi dalam pembangunan.

Abstract

This study is a normative juridical research, which is a research method by examining library materials in the form of secondary data which will be analyzed qualitatively to achieve clarity regarding the decision issued by the Constitutional Court regarding the age limit of Presidential and vice presidential Candidates from the law of the Republic of Indonesia decision no. 92/PUU-XXI/2023. This research aims to analyze in depth the legal aspects related to the decision, including its relation to Law Number 7 of 2017 concerning the Election of Age Limits for Candidates for President and Vice President. The results of this in-depth analysis are expected to provide a comprehensive understanding of the legal implications of the Constitutional Court's decision in the context of the Indonesian constitutional system. Thus, this research is expected to contribute to the understanding and analysis of legal issues relevant to the Indonesian constitutional system.

Abstract

This study aims to determine and analyze the form of legal protection for consumers of refill drinking water in Medan City, especially in Gedung Johor Village as the research location. Consumer protection must be reviewed from the Law that has been given by the authorities as a form of protection for Indonesian citizens as a whole, both for business actors and consumers. This research is a Normative-empirical Legal research, namely research that examines the implementation of legal provisions (legislation) and written documents factually. This research was conducted using the Observation, interview, and document study methods that directly go into the field (society) with informants, namely the Medan Consumer Protection Agency, Refill Drinking Water Business Actors and Refill Drinking Water Consumers who are interrelated. The results of the study show that consumer protection for Refill Drinking Water in Gedung Johor Village as a form of government protection in accordance with the Consumer Protection Law is seen from the fulfillment of the rules set by the government as terms and conditions for selling refill drinking water in Gedung Johor Village and the obstacles in terms of this protection are the lack of public understanding of the quality of refill drinking water and the importance of consumer protection and rules that are not known by the public or consumers. This is why the government should continue to try to provide understanding through socialization, counseling, assistance and education to increase the knowledge and awareness of the Gedung Johor Village community

Abstract

This study aims to find out the application of the principle of diversion in the cases of children of criminal offenders in the Medan District Court, as well as to find out the obstacles and obstacles faced in its application. This study uses a normative-empirical legal approach with qualitative methods and case studies. The results of the study show that the principle of diversion is applied to provide optimal legal protection for children involved in criminal acts. Diversion is implemented from the investigation stage to the court, with a focus on shifting case resolution from the formal path to a more humane and rehabilitation-based restorative approach. Factors that contribute to the application of diversion include the type of crime, the involvement of the victim's family in mediation, and the willingness of all parties to reach a peace agreement. Diversion is easier to apply to misdemeanors, while more serious cases often face obstacles in reaching an agreement.

Abstract

Land inheritance disputes in Paniaran Village are generally caused by unclear land boundaries that have been passed down through generations via oral tradition without written documentation. The community resolves these disputes through Batak Toba customary deliberation (adat deliberation), as it is considered consistent with kinship values ​​and local culture. However, community participation in the deliberation has not been fully inclusive, which has the potential to create uncertainty and recurring conflict. This study aims to analyze the forms and levels of community participation in the resolution of land disputes. The method used is qualitative research with a descriptive method and a case study approach, employing observation, interviews, and documentation. The results show that the forms of community participation in the land dispute resolution process are manifested through attendance at customary deliberations, the provision of information and testimony regarding the history and boundaries of the land, the expression of opinions and arguments, and involvement in deliberation prior to the customary decision being made. Although the community is given the opportunity to be involved, the level of participation that occurs remains consultative, as the final decision is still dominated by customer leaders and parties considered to have greater knowledge of the land's history. Factors that encourage community participation include the high level of trust in customary institutions and the strong sense of kinship within the Batak Toba community. Meanwhile, factors that hinder community participation include the culture of deference toward customer leaders, a patriarchal system that limits women's involvement, low acceptance of the opinions of the younger generation, a lack of confidence among community members in voicing their opinions, and minimal documentation of the outcomes of customary deliberations. This study shows that customary deliberation remains an effective mechanism for maintaining social harmony; However, efforts are needed to increase more inclusive participation so that the land dispute resolution process can proceed in a fairer, more transparent, and more sustainable manner.
