Abstract

This study conducts a comprehensive bibliometric analysis of the Islamic finance field, utilizing VOSviewer to map out the scholarly landscape and investigate author collaborations, thematic clusterization, and evolving research trends. Our analysis identifies key thematic clusters centered on Islamic banking, Sharia law, and various financial instruments like Sukuk, along with the examination of market dynamics such as volatility and the impact of global disruptions like the COVID-19 pandemic. The study highlights the multidimensional nature of Islamic finance research and pinpoints areas with potential for deeper investigation, particularly in the integration of technology and ethical finance principles into Islamic financial practices. Furthermore, the exploration of author collaboration networks reveals a robust academic community with influential scholars at the core, facilitating a dynamic exchange of ideas and fostering significant research developments. The findings suggest promising directions for future research, emphasizing the need for further integration of interdisciplinary approaches and emerging technologies in the field of Islamic finance. This study serves as a valuable resource for academics, practitioners, and policymakers engaged in Islamic finance, offering insights that can drive future innovations and collaborations in the sector.

Abstract

This study examines the impact of risk management and compliance practices on the financial performance and corporate reputation of financial institutions in Indonesia. Utilizing a quantitative approach, data were collected from 160 financial institutions through a structured questionnaire and analyzed using Structural Equation Modeling-Partial Least Squares (SEM-PLS 3). The results indicate that both risk management and compliance practices significantly enhance financial performance and corporate reputation. Specifically, risk management practices have a stronger positive impact on both outcomes compared to compliance practices. These findings underscore the necessity for financial institutions to integrate comprehensive risk management and compliance strategies into their operations to achieve financial stability and bolster their reputation. The study provides valuable insights for practitioners and policymakers, highlighting the critical role of these practices in fostering long-term sustainability and success in the financial industry.

Abstract

Penelitian ini menyelidiki dampak kebijakan gratifikasi terhadap pencegahan korupsi di lingkungan pemerintah desa di Provinsi Jawa Barat. Melalui analisis kualitatif, kami memeriksa kebijakan yang ada, menilai kesadaran dan pemahaman di antara para pejabat, mengeksplorasi dampak yang dirasakan terhadap pencegahan korupsi, dan mengidentifikasi tantangan dalam implementasi. Program pelatihan dan strategi komunikasi secara signifikan mempengaruhi kesadaran, dengan menekankan pentingnya inisiatif yang komprehensif. Efek jera yang dirasakan dan dampak positif terhadap perilaku etis menggarisbawahi pentingnya kebijakan gratifikasi. Tantangan yang dihadapi, termasuk penegakan hukum yang tidak konsisten dan keterbatasan sumber daya, menunjukkan adanya bidang-bidang yang perlu ditingkatkan. Rekomendasi yang diberikan mencakup standarisasi penegakan hukum, alokasi sumber daya, pengembangan kapasitas yang berkelanjutan, dan peningkatan keterlibatan masyarakat. Studi ini memberikan wawasan yang berharga dalam wacana pencegahan korupsi, dengan menekankan pentingnya kebijakan yang sesuai dengan konteks dan pendekatan kolaboratif dalam tata kelola pemerintahan daerah.

Abstract

This study examines the utilization of e-government to enhance transparency and accountability in public services in Indonesia. The main issue addressed is the lack of transparency and accountability in the delivery of public services, which can hinder the realization of good governance and erode public trust. The aim of this research is to analyze how e-government can be implemented to improve transparency and accountability in public services, as well as to identify the challenges and strategies in its implementation. The research method used is a literature review, analyzing various relevant sources such as academic journals, research reports, and policy documents. The findings of the study indicate that e-government has the potential to enhance transparency and accountability in public services through the provision of publicly accessible and transparent information, empowering the public in overseeing the use of public funds, and improving the efficiency and effectiveness of bureaucracy. However, the implementation of e-government also faces challenges, such as the digital divide, data security issues, and a lack of digital literacy. This study recommends that the government improve digital infrastructure, strengthen data security systems, enhance public digital literacy, and develop integrated and user-friendly e-government applications and platforms. The concept of "Tarakan Smart City" presented in this study offers a comprehensive and integrated smart city development model by incorporating e-government into various aspects of urban life.

Abstract

Corruption is an extraordinary crime deeply rooted in Indonesia's social and political structures. Combating corruption is a critical agenda requiring adaptive and synergistic strategies. One strategic step is the establishment of the Corruption Eradication Task Force (Kortas Tipikor) within the Indonesian National Police (Polri), aimed at optimizing anti-corruption efforts through synergy and coordination among law enforcement agencies. This research employs a qualitative approach using a normative-juridical method to examine the formation of Kortas Tipikor Polri, analyze its duties and functions, and assess its synergy with other institutions such as the Corruption Eradication Commission (KPK) and the Audit Board of Indonesia (BPK). The findings indicate that the formation of Kortas Tipikor Polri is a strategic step that can strengthen anti-corruption efforts. Additionally, the study identifies several challenges in establishing Kortas Tipikor, such as the potential overlap in case handling and the need for clear regulations regarding the division of duties and authority between Kortas Tipikor and other law enforcement agencies. The synergy between Kortas Tipikor Polri, KPK, BPK, and community involvement is key to achieving success in eradicating corruption.

Abstract

Sistem jaminan fidusia di Indonesia telah lama memberikan wewenang eksekusi yang kuat kepada kreditur, memungkinkan eksekusi langsung atas jaminan jika debitur gagal bayar tanpa intervensi peradilan sebelumnya. Meskipun mekanisme ini dimaksudkan untuk meningkatkan efisiensi dan kepastian hukum dalam transaksi kredit, penerapan praktisnya seringkali menghasilkan praktik penegakan hukum yang sepihak dan paksa, yang melemahkan perlindungan hak debitur. Kondisi ini secara fundamental diatasi melalui Putusan Mahkamah Konstitusi Nomor 18/PUU-XVII/2019, yang menafsirkan ulang sifat eksekutorial jaminan fidusia berdasarkan prinsip-prinsip konstitusional. Penelitian ini bertujuan untuk menganalisis landasan hukum dan implikasi normatif putusan tersebut terkait pelaksanaan jaminan fidusia dan perlindungan hak debitur di Indonesia. Dengan menggunakan metode penelitian hukum normatif yang menggabungkan pendekatan yuridis, yudisial, dan konseptual, penelitian ini mengkaji peraturan perundang-undangan, ketentuan konstitusional, dan pertimbangan yudisial yang relevan. Temuan menunjukkan bahwa Mahkamah Konstitusi memperkenalkan interpretasi konstitusional bersyarat, yang mensyaratkan pengakuan sukarela atas wanprestasi oleh debitur atau putusan pengadilan sebagai prasyarat untuk eksekusi. Reinterpretasi ini memperkuat proses hukum yang adil, kepastian hukum, dan perlindungan konstitusional atas hak milik, sambil mempertahankan peran fungsional jaminan fidusia. Studi ini menyimpulkan bahwa Putusan Mahkamah Konstitusi Nomor 18/PUU-XVII/2019 mewakili perkembangan konstitusional yang signifikan dalam hukum privat Indonesia, yang memerlukan harmonisasi regulasi dan adaptasi institusional untuk memastikan perlindungan yang seimbang bagi kepentingan debitur dan kreditur.

Abstract

The enactment of Law Number 1 of 2023 on the Indonesian Criminal Code (the National Criminal Code) marks a fundamental shift from a colonial criminal law framework toward a national legal system grounded in substantive justice and the protection of human rights. Nevertheless, at the practical level, the implementation of these progressive norms is frequently constrained by a gap between law in books and law in action. This study examines the termination of prosecution in the Hogi Minaya case by the Sleman District Prosecutor’s Office as a critical intersection of prosecutorial discretion, socio-political pressure, and institutional risk management. Employing an interdisciplinary approach that integrates responsive criminal law theory and public risk management, the study reveals a significant implementation gap at the operational level of law enforcement agencies. The findings indicate that law enforcement authorities tend to adopt a defensive law enforcement approach to mitigate procedural accountability risks, which in turn leads to the marginalization of justificatory grounds under Article 34 of the National Criminal Code until legislative intervention occurs. This research proposes a new framework for understanding prosecutorial discretion not merely as a technical legal instrument, but as a form of strategic risk response aimed at preserving the legitimacy of the criminal justice system.
