Abstract

This research aims to identify whether the environmental destruction could be considered as terrorism and to identify why the person who damaged the environmental should be considered as a terrorist. The conclusion of this research indicates a concept which views that the person who did enviromental destruction as terrorism. This concept is textual elaboration which is contained in section 10 Law No. 15, 2003 about the eradication of the terrorism. The crime for environmental destructions which are catagorized as terrorism are as follows: The impacts of the environmental destruction and pollution exceed Baku Mutu Lingkungan Hidup (BMLH), the poisonous chemicals release in the public areas (as happened during internal armed conflict in suriah on March 2011), there are bulk of victims, and it harms and damages the strategical vital objects. Based on those criterion, the environmental destruction is considered as equal as terrorism, because they are catagorized as a crime againts humanity. The environmental destruction happens because of low obedience and awareness of people to protect and to save the environment and it could be indicator that the law enforcement for environmental protection and management has not gone well yet. Based on this concept, it is expected that the responsibility and commitment of Indonesia could be achieved in order to ensure the protection and fulfillment of the environment and human rights and to reach the aims of environmental justice.

Abstract

The function and role of Indonesian immigration is to prevent, as a traffic controller people enter or leave the territory of the Republic of Indonesia in accordance with what is stated in the Law Law of the Republic of Indonesia Number 6 of 2011 concerning Immigration. This legal research focused on knowing the implications of prevention abroad for Indonesian citizens abroad based on a human rights perspective. The research method used is normative juridical. This research concludes that the regulations in Indonesia which regulate the prevention of Indonesian citizens abroad is in accordance with the values and norms contained in the in the state ideology, namely Pancasila and the state Constitution, namely the 1945 Constitution prevention carried out by immigration officers to people suspected of being involved in cases The law that will go outside the territory of the Indonesian state is in accordance with the applicable rules. Then related to prevention, it is also not a form of limiting human rights, because human rights are Indonesia is a human rights balance with its human obligations as a member of society. The use of human rights in Indonesia cannot be carried out without paying attention to human rights obligations, in other words, human rights cannot be used absolutely.

Abstract

Indonesia as an archipelagic country consisting of large and small islands separated by the ocean with geographical conditions has a total area of ​​7,827,087 Km2 and is located in Equatorial emeralds have a wealth of abundant natural resources, especially in the sea ​​and coastal areas which cover of the territory of Indonesia (5.8 million Km2). Article 18 B paragraph (2) and Article 28 I paragraph (3) of the 1945 Constitution of the Republic of Indonesia as the constitutional basis for recognition and protection the rights of indigenous peoples in coastal areas and small islands. Resource wealth nature in the form of coastal areas and small islands controlled and managed by the state tothe greatest prosperity of the people. Abstract

The problem of land acquisition is a problem that always arises in development activities. The emergence of land speculators who take advantage of the project infrastructure development. In the end, this causes development projects to be difficult to implement, and even fail or be abandoned altogether. Therefore, in Law Number 11 of 2020 concerning Job Creation, the government establishes a land bank agency that functions as land manager. The result of this research is that the existence of a land bank agency has existed both constitutionally in the Indonesian agrarian law system, namely in Article 33 Paragraph (3) of the 1945 Constitution, which is then implicitly enshrined in Article 2 paragraph (2) of the UUPA. The land bank agency is a form of authority of the State Controlling Rights over Land (HMN) which carries out the function as land manager. The regulation of land bank entities in Law Number 11 of 2020 concerning Job Creation places investment as a top priority, in addition to several other objectives, such as public interests, social interests, national development interests, economic equity, land consolidation and agrarian reform. This is different from the concept of land banks in several other countries, such as the Netherlands, Sweden and the United States, which are broadly focused on welfare. The implementation of land banks in these countries is very dependent on the needs of the community in a particular area, because that will determine the objectives and focus of the land bank specifically.

Abstract

Misperceptions or misconceptions on the importance of land in people's lives by turning land into an economic commodity have triggered social conflicts, one of the most prominent problems in the land sector lately is social conflict over plantation land. The problems studied in this research are how is the mechanism for the permit of Cultivation Rights (Hak Guna Usaha, HGU) on plantation land and how to hold accountability for the use of plantation land outside the Cultivation Right. The method used is normative juridical by using normative analysis methods. The results of this study conclude that land misuse often occurs because of overlapping land ownership and the acquisition of the land has not been completed in the granting of the Cultivation Rights. Holders of Cultivation Rights often ignore their obligations, causing disputes that are detrimental to other parties. So that the holder of the Cultivation Right is responsible for everything he does that causes harm to other parties. Key Words: Accountability; abuse; cultivation rights; plantation land Abstrak Pemahaman atau persepsi yang keliru terhadap arti pentingnya tanah dalam kehidupan masyarakat dengan memanfaatkan tanah sebagai komoditi ekonomi semata, telah memicu konflik sosial, salah satu permasalahan di bidang pertanahan yang menonjol akhir-akhir ini adalah konflik sosial di atas tanah perkebunan. Permasalahan yang akan dikaji ialah mengenai bagaimana mekanisme izin Hak Guna Usaha (HGU) atas lahan perkebunan serta bagaimana tanggung gugat atas penggunaan lahan perkebunan diluar Hak Guna Usaha. Metode penelitian yang digunakan yuridis normatif dengan menggunakan metode analisis normatif. Hasil dari penelitian ini menyimpulkan penyalahgunaan tanah sering terjadi karena adanya tumpang tindih kepemilikan tanah juga pembebasan/perolehan tanah belum tuntas dalam pemberian Hak Guna Usaha. Pemegang Hak Guna Usaha seringkali menghiraukan kewajiban-kewajibannya sehingga menimbulkan sengketa yang merugikan pihak lain. Sehingga pemegang Hak Guna Usaha tersebut bertanggung gugat atas segala hal yang dilakukannya yang menimbulkan kerugian bagi pihak lain. Abstract

Munculnya Perpres 14 Tahun 2021 membuat kontroversi di masyarakat, pelaksanaan pelayanan publik kini telah memberikan kebimbangan kepada masyarakat. Masyarakat yang tidak memiliki atau tidak bisa menunjukkan bahwa telah tervaksinasi, secara terang-terangan ditolak oleh tempat pelayanan publik dan tidak dapat mengurus kepentingan masyarakat tersebut. Rumusan masalah dalam penelitian ini yaitu: Implikasi Sertifikat Vaksin Coronavirus Disease (Covid-19) Terhadap Pelayanan Publik dan upaya hukum bagi masyarakat yang tidak memiliki sertifikat vaksin COVID-19. Penelitian ini menggunakan metode yuridis-normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil dari penelitian ini adalah Sertifikat vaksin COVID-19 layak menjadi syarat administrasi dan merupakan bentuk iktikad baik pemerintah, namun akuntabilitas pelayanan publik yang dilakukan pemerintah belum sepenuhnya dapat dikatakan maksimal. Upaya hukum bagi masyarakat yang tidak memiliki sertifikat vaksin COVID-19 yang akan melakukan kegiatan pelayanan publik dapat dilakukan melalui jalur non-litigasi maupun jalur litigasi. Upaya non-litigasi disarankan terlebih dahulu untuk dilakukan yaitu dengan menelaah dan memahami secara cermat maksud pemerintah dalam putusan tersebut, namun jika memang belum mendapatkan titik terang maka dapat mengajukan tindakan litigasi di Pengadilan Tata Usaha Negara (PTUN), atau dapat mengajukan judicial review kepada MA atau MK.

Abstract

The Ombudsman is an institution established to deal with abuse of power by government officials and to assist officials in carrying out government efficiently and fairly, as well as to encourage power holders to carry out their responsibilities and provide good service. The Ombudsman Representative for West Nusa Tenggara Province has a role in supervising public services in their working area. In following up on each report complained by the complainant, the Ombudsman will ensure whether the report falls under the authority of the Ombudsman or not. This study aims to see the effectiveness of the Ombudsman in supervising public services in the village. The research method is socio-legal. Socio-legal research represents an interface with a context whitin which law exists. In supervising public services, apart from receiving reports from the public, the Ombudsman can also carry out on his own initiative through a systemic review, the results of which can be in the form of recommendations/suggestions. To ensure compliance with efforts to resolve the Ombudsman by the Reported Party or the Reported Party's superiors, the Ombudsman conducts direct monitoring or through the media/publications and submits periodic and annual reports to the President of the Republic of Indonesia and the People's Representative Council.

Abstract

Desa merupakan lingkup terkecil dalam pemerintahan, salah satu fungsi utama desa adalah memberikan pelayanan kepada masyarakat (public services). Pemerintah desa harus mampu menerapkan inovasi untuk menjawab tantangan yang datang beriringan dengan arus moderenisasi dan semakin tingginya espektasi masyarakat.  Selain itu berbagai bentuk kritik yang sering muncul dalam pelayanan publik seperti pelayanan yang lama, berbelit marak terjadinya pungli menjadi tantangan yang lain.  Salah satu cara yang bisa dilakukan untuk meningkatkan kualitas pelayanan adalah dengan menerapkan pelayanan berbasis digital. Tujuan penelitian ini adalah untuk menganalisa implementasi pelayanan berbasis digital dan pengaruhnya terhadap peningkatan kualitas pelayanan kepada masyarakat di Desa Pringgasela Selatan.  Motode penelitian yang digunakan adalah metode penelitian hukum empiris dengan pendekatan kajian konseptual dan perundang-undangan. Penelitian ini menyimpulkan bahwa penerapan sistem pelayanan berbasis digital di desa mempu memberikan pengaruh yang cukup besar terhadap peningkatan pelayanan yang sebelumnya banyak dikeluhkan oleh masyarakat.  Dengan ditetapkannya pelayanan berbasis digital setidaknya tercapai beberapa hal seperti efisiensi dan mengurangi terjadinya pungutan liar yang sering terjadi dalam pelayanan publik.

Abstract

Tujuan penelitian ini untuk melihat Peran Ormas Dalam Mendukung Kebijakan Program Pemberdayaan Daerah Gotong Royong Di Kecamatan Taliwang Kab. Sumbawa Barat. Motode penelitian yang digunakan adalah metode penelitian normative dan empiris dengan pendekatan kajian perundang-undangan dan pendektan konsep dan sosiologis, analisa data yang digunakan adalah menggunakan hasil penelitian lapangan serta yang digunakan adalah metode penafsiran perundang-undangan dan penafsiran autentik serta data hasil penelitian lapangam. Hasil penelitian ini diharapkan pemerintah daerah lebih intensif dalam mengikutsertakan ormas dalam mendukung kebijakan pembanguna daerah.
