Abstract

Tujuan kegiatan ini adalah (1) memperkuat pemahaman konsep penyusunan rancangan peraturan desa kepada Kepala Desa beserta perangkat desa dan anggota BPD di Kecamatan Kopang Kabupaten Lombok Tengah, (2) memberikan keterampilan untuk Menyusun rancangan peraturan desa bagi Kepala Desa beserta perangkat desa dan anggota BPD di Kecamatan Kopang Kabupaten Lombok Tengah. Adapun manfaat Kegiatan adalah (1) memberikan sumbangsih pemikiran bagi public mengenai penyusunan rancangan peraturan desa dan (2) menjadikan Kepala Desa beserta perangkat desa dan anggota BPD di Kecamatan Kopang Kabupaten Lombok Tengah paham dan terampil dalam menyusun rancangan peraturan desa. Metode yang digunakan dalam kegiatan pengabdian ini adalah metode ceramah dan diskusi. Kegiatan dihadiri oleh staf kecamatan, kepala desa, staf desa, anggota BPD, serta anggota lembaga kemasyarakatan desa di wilayah Kecamatan Kopang, Kabupaten Lombok Tengah pada tanggal 12 Juni 2023, bertempat di Aula Kantor Kecamatan Kopang, Kabupaten Lombok Tengah. Materi penyuluhan adalah mengenai kewenangan desa dalam membuat peraturan desa, tahapan rancangan penyusunan peraturan desa, partisipasi public dalam penyusunan peraturan desa, dan klarifikasi dan evaluasi rancangan peraturan desa.

Abstract

The Welfare State ideology teaches about the role of the State which is broader than the "night watchman", The ideals of the welfare state which have been stated in the 1945 Constitution are continued with the existence of Law number 20 of 2023 concerning the State Civil Apparatus (ASN). ASN of the Ministry of ATR/BPN has issued Scholarships for employees as a form of employee and institutional welfare. The study uses the statue approach which shows that the efforts of the Ministry of ATR/BPN in realizing the welfare state have been seen, only the educational qualifications are still for certain education, in fact every ASN has the same opportunity to get a scholarship according to the Utrecht Welfare State theory.

Abstract

The aim of this research is to determine the disparity in constitutional court decisions regarding the age threshold for presidential and vice-presidential candidates. This research is a type of normative legal research that uses statutory, conceptual and case approach methods. The results of the research explain that if examined from the aspect of considerations of constitutional court judges in case number 29/PUU-XXI/2023, it is stated that determining the minimum age of the President and Vice President is the domain of law makers (open legal policy), while in case number 90/PUU- XXI/2023 the constitutional court interpreted that the existence of an open legal policy (open legal policy) although it can be accepted in constitutional practice, but in its development the constitutional court could ignore or set aside while giving a re-interpretation of the norm which is an open legal policy, while from the adoption procedure decision in the judge's deliberative meeting held in case Number 29/PUU-XXI/2023, the chairman of the constitutional court, Anwar Usman, did not participate in discussing and deciding to avoid conflicts of interest, while in case Number 90/PUU-XXI/2023 with the same constitutionality issue the chairman The constitutional court participated in discussing and deciding the case with the decision being granted in part, namely being at least 40 years old or having/currently held a position elected through general elections, including regional head elections.

Abstract

The discourse on the status of liaisons and institutional employees is not recognized in the Law on State Civil Servants or the Law on Employment, thus giving rise to problems, namely the recognition of the employment status of liaisons in each region. The formulation of the problem raised is legal protection of the employment status of liaisons. The method used in this research is the normative legal research method. The approach used is a statutory approach (statute approach) and conceptual approaches (conceptual approach). In conclusion, the absence of norms explaining the employment status of liaisons has implications for the absence of liaison personnel management arrangements, indicating that legal protection for the employment status of liaisons is not yet effective. The suggestion that can be given is that countries can convert liaisons into part of ASN through a series of tests, regulations and policy regulations as guidelines.

Abstract

The government wants to foster and empower mass organizations by managing the activities of mass organizations not to take actions that are contrary to the sovereignty of the Unitary State of the Republic of Indonesia based on Pancasila and the 1945 Constitution of the Republic of Indonesia. The reality that occurs in the field is often inconsistent with the objectives of the law. law, for example regarding the problem of mass organizations in Central Lombok Regency which resulted in the formulation of the problem: 1) How is the legality of Community Organizations in Central Lombok Regency? 2) How is the implementation of empowerment, guidance and supervision of CBOs in Central Lombok Regency, 3) What are the obstacles faced by the Regional Government in implementing the empowerment, guidance and supervision of Community Organizations in Central Lombok Regency. The research method used is an empirical research method. The conclusions obtained are 1) CSOs in Central Lombok district have a legal basis because they have regulations as a legal basis and several CSOs have been registered with Bakesbangpol, 2) Empowerment, guidance and supervision of CSOs in Central Lombok Regency has been carried out by the local government by way of : Empowerment: through policy facilitation, strengthening institutional capacity, and improving the quality of human resources, Guidance: counseling, public consultation, and training, Supervision: supervision carried out by opening a complaint service for organizations that are indicated to be carrying out activities that are not in accordance with regulatory provisions legislation and granting and revoking permits for mass organizations. 3) The obstacles faced are as follows: a. There are still many CSOs that carry out activities outside the field of activity listed in the AD/ART, b) Many CSOs are reluctant to report their existence at Bakesbangpol Central Lombok Regency so they are not registered in the Ormas data, c) Addresses of secretariats and CSOs and Ormas management often changes.

Abstract

Keberadaan layanan jasa ekspedisi lokal menjadi alternatif bagi masyarakat. Meskipun ada perbedaan skala usaha antara Go-Jek dan Grab serta jasa kurir lokal tak lantas menghilangkan hak dan kewajiban antara pelaku usaha dan konsumen. Hak dan kewajban selalu menjadi isu awal terjadinya sengketa, sehingga segala hubungan yang menimbulkan hak dan kewajiban dapat menjadi objek sengketa. Usaha yang dirintis Boncuss Fast Courier merupakan usaha lokal yang terbilang baru di Lombok, sehingga prosedur perlindungan konsumen yang dilakukan oleh pelaku usaha ekspedisi lokal tentu memiliki perbedaan dengan perusahaan unicorn milik Go-Jek dan Grab. Metode penelitian yang digunakan normatif empiris menggunakan data sekunder, dengan menggunakan pendekatan peraturan perundang-undangan (statute approach), pendekatan konseptual (conseptual approach), serta pendekatan sosiologis (sociological approach). Hasil penelitian menunjukkan bahwa Boncuss Fast Courier memberikan perlindungan terhadap konsumen melalui itikad baik ganti rugi bagi komplain konsumen meski belum secara komprehensif serta metode penyelesaian sengketa dengan konsumen berupa negosiasi, yakni penyatuan konsensus terhadap para pihak untuk mendapatkan win-win solution.

Abstract

The regulation of the execution of State Administrative Court (TUN) decisions in Law Number 51 of 2009 concerning the Second Amendment to Law Number 5 of 1986 on State Administrative Court does not include a mechanism for executing TUN decisions, which in practice has caused many problems that undermine legal certainty and justice for the public. The focus of the writing is to provide an understanding to the public about the urgency of implementing execution in administrative court decisions. The main issues include two aspects: the obstacles faced by administrative officials in executing administrative court decisions, and solutions to address the compliance problems of administrative officials in executing administrative court decisions. The research method used is a normative research method. The research findings indicate that the obstacles in the implementation of TUN Decisions are due to the non-compliance of TUN officials and the lack of enforcement power for TUN decisions. The solution to address the compliance issues of TUN officials in executing TUN Decisions is to file a maladministration complaint with the Indonesian Ombudsman to exert pressure and revise the PTUN law to provide enforcement measures against the relevant TUN officials.

Abstract

Abstrak Artikel ini menyoroti inkompatibilitas kewenangan legislasi presiden dengan prinsip presidensial, penelitian menggunakan metode hukum normatif, dengan pertimbangan analisis teoritis dan norma konstitusi yang mengatur tentang kewenangan legislasi kekuasaan eksekutif dalam hal ini Presiden Republik Indonesia sesudah perubahan UUD 1945 dan kesesuaiannya dengan prinsip sistem pemerintahan presidensial. Pendekatan yang digunakan adalah pendekatan konseptual dan perundang-undangan yang merujuk pada peraturan-peraturan perundang-undangan, literatur, buku, artikel jurnal atau karya ilmiah yang membahas diskursus yang relevan. Metode analisis dilakukan secara kualitatif dan hasil dipaparkan secara deskriptif yang menunjukkan bahwa secara normatif dalam pengaturan konstitusi pasca amandemen kekuasaan legislasi presiden masih masif dan secara teoritis hal itu menimbulkan inkompatibilitas konsep dan mengamputasi kehendak purifikasi sistem pemerintahan presidensial yang balance sebagai cita reformasi.

Abstract

Keberadaan peraturan desa memiliki peran yang signifikan dalam penyelenggaraan pemerintahan desa, sebab peraturan desa merupakan legalitas terhadap tindakan hukum yang dilaksanakan oleh pemerintah desa karena jabatannya. Sehingga pemerintah desa harus memiliki pemahaman yang komprehensif mengenai hal yang diatur dalam peraturan desa. Tujuan kegiatan ini adalah meningkatkan pemahaman kepada Kepala Desa, perangkat desa, dan Badan Permusyawaratan Desa mengenai fungsi Struktur Organisasi Tata Kelola di Desa Sesait Kabupaten Lombok Utara, serta mengoptimalkan pemahaman tentang Struktur Organisasi Tata Kelola kepada Kepala Desa, perangkat desa dan anggota BPD di Desa Sesait Kabupaten Lombok Utara. Hasil menunjukkan bahwa kegiatan ini telah membantu mengoptimalkan pemahaman pemerintah desa terhadap Struktur Organisasi Tata Kelola. Optimalisasi pemahaman diukur melalui sesi diskusi dan focus group discussion dalam memberikan saran terhadap rancangan peraturan desa tentang Struktur Organisasi Tata Kelola.

Abstract

Terbitnya perjanjian akan menimbulkan prestasi bagi para pihak. Namun jika salah satu pihak ingkar janji, maka timbul sebuah kebingungan, apakah kasus ini menjadi ranah pidana atau perdata.Adapun rumusan masalah yang diangkat adalah 1) apakah perkara wanprestasi dapat dialihkan menjadi perkara pidana 2) apakah upaya hukum perkara wanprestasi dengan perkara penipuan dapat berjalan dalam waktu yang bersamaan? Tujuan penelitian ini adalah 1) untuk mengetahui apakah hubungan keperdataan dalam wanprestasi dapat beralih menjadi perkara pidana? 2) apakah upaya hukum seseorang yang digugat wanpretasi dan dituntut pidana dapat dilakukan secara bersamaan? Untuk mengkaji permasalahan dalam penelitian ini penulis menggunakan pendekatan perundang-undangan(statue approach dan pendekatan konseptual (conceptual approach). Adapun kesimpulan yang dapat ditarik adalah sebagai berikut 1) wanprestasi dan penipuan memiliki unsur yang berbeda sehingga perkara wanprestasi tidak dapat dialihkan menjadi perkara penipuan 2) jika wanprestasi dan penipuan terjadi dalam suatu perkara yang memiliki hubungan hukum maka proses pidana dapat ditangguhkan sampai ada putusan perkara perdata.
